VILLAGE OF WATERFORD Public Works & Utilities Committee Meeting Minutes 801 Ela Ave. – DPW Building June 19, 2023 Meeting was called to order by Chair Koeller at 4:00 pm. Second by Koeller. All aye. Motion carried. Reports: Streets and Utilities Supervisor Huening spoke on updates in the Department of Public Works. Parks and Facilities Supervisor Sponholtz gave updates on the Department of Parks and Facilities. New Business: 1- Review of Lion’s Club Park Agreement. Motion to approve disclaimer additions and provide copy to Lion’s Club by Houston. Second by Koeller. All aye. Motion carried. 2- Review of bids received for RFP 05082023 Whitford Park Pavilion improvements. Motion to recommend bid from Tri County in the amount of $32,570.68 and bid alternate in the amount of $2726.12 to the Village Board for approval by Koeller. Second by Goldammer. All aye. Motion carried. 3- Discussion on ROW acquisition options for Main Street reconstruction project. Motion to table by Houston. Second by Goldammer. All aye. Motion carried. 4- Review and discussion on proposed playground equipment plan for Ten Club Park. Motion to approve plan section A & B and recommend purchase for consideration to the Village Board by Koeller. Second by Goldammer. All aye. Motion carried. 5- Discussion on the creation of a Historic Preservation Committee. Motion to recommendation to the Village Board to create a Historic Preservation Committee who would work under a framework of items as directed by the Village Board. Managing various contractors, performing PM on the HVAC, fire protection and alarm systems. -Restoration work from the December flood at Village Hall update-Elevator work still pending. One small issue remains. -Continued work on the library HVAC upgrades and community room repairs. On going work going on the roof and resetting the compressors. Almost daily. Contacted engineering services to design a new HVAC system to replace the aging system and again looked into a government purchasing organization to help with designing a system. 6 exterior windows are failing, temporarily sealed, and need permanent repair. -Preparing for remodeling projects at the Whitford park Bathrooms, pavilion, Seidel building and ball field buildings. Drafted and sent out an RFP for the pavilion roof, soffits, ceiling and siding repairs. -Working on plans and logistics for the 10 club bathroom/concession stand. Parks -10 club park construction project is moving along at a good pace -Whitford park driveway is complete. Working on several additional landscaping and improvement projects at Whitford park. -Working on summer events, Celebrate Waterford, Food and Fun on First, River Rhythms, Movies in the parks, Theatre group events, baseball tournaments and building rentals. -Built 21 plaques for the adopt a planter contest. The DPW is now watering all the street planters as well as the park planters. -Watering many areas due to recent dry conditions. Facilities and Parks supervisor. Mike Sponholtz 5 VILLAGE OF WATERFORD Engineer’s Report June 14, 2023 Danielson St. & Augusta Paving / Whitford Park Paving – Project No. 221301  The bid by Stark Pavement Corp ($674,320.15) was approved by the Village on 9/12/22.  Augusta and Whitford Park are complete.  Our payment recommendation will be forwarded in the next couple of weeks. Tetzlaf “The Armory Self Storage” Review – Project No. 222115  We received plans for a self-storage facility north of Gravity Ct in the Mercury Development.  The public water main extension plans and WDNR forms have not been submitted for review.  Review comments were forwarded to the Village and design engineer on 12/21/22. Neumann Homes Development – Project No. 221632  Neumann Homes is interested in developing the area north of Trailside Elementary on the east and west sides of N. Milwaukee.  The developer has requested a typical road width that is less than the Village standard.  We are working with the developer’s engineer to provide water and sewer service to the property. Space Squared Self Storage Review – Project No. 220614  We received plans for a self-storage facility at the corner of STH 83 and Park Dr.  Conditional approval recommendation was sent to the design engineer and the Village on 3/22/23. Ideal Process Review – Project No. 222586  We received plans for a building expansion project at Ideal Process on Ela Ave.  Draft review comments were completed on 12/14/22 and sent to the Village. 7th Street (Foat) Multi-Family Review – Project No. 222587  We received plans for a two building multi-family project on 7 th Street.  The project was conditionally approved on 4/17/23.  Site changes were made after the conditional approval. Comments on the changes were sent to the engineer and Village on 6/7/23. Spanky’s Tavern Review – Project No. 230062  A new Spanky’s Tavern is proposed in the Mercury Business Park.  We are coordinating utility connection scenarios with the Village and architect. We have not received an engineering plan submittal. Update Roadway Improvements – Project No. 230314  We have sent the Village an updated 20-year pavement maintenance plan based on updated costs and roadway PASER ratings. Fairview Pavement Maintenance – Project No. 230098  We anticipate opening bids in July. Page 1 of 2 P:\WATRF\General\Admin\Monthly Reports\2023\06-2023\06-14-23.docx 6 VILLAGE OF WATERFORD Engineer’s Report June 14, 2023 Saturn 5 Self Storage – Project No. 230648  We have reviewed the Saturn 5 Self Storage project at the east end of 6 th Street in the Mercury Subdivision.  The project was conditionally approved on 4/10/23. Pro-Health Clinic – Project No. 2325157  We received engineering plans for this project located at Gemini Lots 7 & 10 on 4/11/23.  Our conditional approval recommendation was forwarded to the Village and design engineer on 05/18/23. East Main Street Reconstruction / Right-of-way acquisition:  We have been working on the project scope and design fees to discuss with the Village. Well 6 Planning – Project No. 180435  This project will replace the capacity of existing Well 1 and Well 3 and allow the Village to obtain more water from the existing central treatment facility on Cornerstone Crossing.  This project was classified “Undetermined” by the WDNR for funding; we provided additional information justifying the need for funding. The Village would need to have plans and specifications submitted to the WDNR by June 30, 2023 to be eligible for the 2024 funding. We recommend the Village simply submit a new Intent to Apply with the Wisconsin Department of Natural Resources by September 30, 2023, request Authority to Construct from the Public Service Commission of Wisconsin, pass a reimbursement resolution for the project after September 30, 2023, and have the plans and specifications ready for submittal by June 30, 2024. We will prepare a work order for consideration. (hereina�er the, Lions Club) in helping to bring about the construc�on of and upgrades to the Ray Seidel Building located on the grounds of Whi�ord Park in the Village of Waterford, and upgrades to the walk in cooler located in the Pavilion in Whi�ord Park, the Village of Waterford (hereina�er, Village) and the Lions Club do hereby declare and agree, for and in considera�on of the keeping of their respec�ve obliga�ons set forth herein, as follows: A. Rental Priority. The Lions Club shall have priority over other groups, businesses and individuals who may wish to reserve the use of the Ray Seidel Building, the walk in cooler and the Whi�ord Park grounds, as follows: 1. The Seidel Building for two evenings a month, the second and fourth Thursdays of every month, for Lions Club mee�ngs. 2. The Seidel Building, walk in cooler and adjoining park grounds the first weekend in October for the Lions Club Annual Chicken BBQ/Tractorcade or other dates set by the Lions Club by April 1st of each year. 3. An addi�onal five days of exclusive use by the Lions Club provided said dates are scheduled no later than April 1st or nothing else is scheduled. 4. The walk in cooler and pavilion will be made available for the fourth weekend of April, the first weekend of June and the 4th of July. Furthermore, periodic storage in the Walk In Cooler will also be permited during other Lions Club community events. 5. The en�re Whi�ord Park grounds for the Annual 4th of July Parade, depending on the parade route. To be determined by April 1st each year. B. Term; Rental Fee. The Term of this Agreement, to allow the Lions Club to use of the Ray Seidel Building, walk in cooler and Whi�ord Park grounds as set forth in paragraph A, is 25 years, beginning on the last date of signature of this Agreement. Rental fee for said term shall be $1.00 payable to the Village Clerk at signing of said Agreement. C. Clean Up: Security Deposit. The Lions Club agrees to deposit the sum of $200 with the Village to be used as a security deposit. The Lions Club agrees to clean up and put everything back to the way it was a�er each scheduled use by the Lions Club. Clean up shall meet the sa�sfac�on of the Village Department of Public Works. The Lions Club shall not be responsible for clean up of those events or rentals for which the Lions Club did not schedule for their use or take part of. The Village may charge a cleanup fee if it is deemed necessary. D. Nothing herein shall obligate the Village to provide access or use of the building during �mes of renova�on, repair, disrepair, exegete need (with replacement mee�ng accomoda�ons), or condi�on of un-usability. 8 E. Should the Village determine that the building is obsolete, or otherwise not worthy of repair, nothing herein shall create an obliga�on to maintain or otherwise repair the building by either party. This includes but is not limited to interior drywall damage, stucco dislodging or falling off, decking or rafter cracks or breaks, soffit overhang damage or any other damage that does not relate to roofing and could not be easily identified during normal working activity. 20 CONSTRUCTION MATERIALS: Excess materials delivered to job site and/or materials not physically attached to the structure after Substantial Completion of the work contemplated by this Contract shall remain the property of the Contractor. SAFETY: Contractor is not responsible for the safety of persons on the roof other than its subcontractors and employees. Owner agrees to indemnify and hold Contractor harmless for claims for personal injury by persons or entities that Owner has allowed or authorized to be on the roof or inside the construction zone. PAYMENT: Owner shall timely make all payments (within 10 days) required by this Contract. If payment is not timely made, owner will be subject to interest charges as explained in the ‘Unpaid Balances’ section listed below. UNPAID BALANCES: Interest shall be paid on all amounts due after completion of job at the rate of 1.0% per month. Partial prepayments with interest to date of payment may be made. If any payment is not made when due and if this default continues for a period of ten (10) days after its due date, the unpaid balance shall mature in full and become immediately payable. The receipt of any payment after the occurrence of an event of default shall not constitute a waiver of the default or the holder’s rights and remedies on the default. Without affecting the liability of customer or guarantor, Tri-County may, without notice, renew or extend the time for payment. Customer and guarantors agree to pay all costs of collection, including reasonable attorney fees, and waive presentment, protest, demand, and notice of dishonor. ENFORCEMENT COSTS: In the event Tri-County prevails in any action or proceeding to collect any amount due Tri-County under this Contract, or otherwise enforce this Contract, it shall be entitled to recover from Buyer, in addition to any other damages, its costs and expenses including reasonable attorneys’ fees. OWNERS DUTIES: The Owner Certifies: 1) That s/he (they) are the Owner of the premises to be improved free of any current liens and this contract is given in reliance upon this representation of ownership; 2) s/he has read this agreement; 3) s/he fully understands the terms and conditions of this contract; 4) this agreement is the entire contract between the Owner and Tri-County; 5) there are no oral or written agreements between the parties other than that contained in this agreement; 6) Tri-County is not responsible or bound by any representations not contained in this agreement; 7) Changes made by one Owner are binding upon all Owners as the Owners hereby state that they are agents of each other; 8) No oral changes may be made to this contract, including any substitutions, unless the changes and substitutions are made in writing and signed by both the Owner and Tri- County; 9) No statements, promises, commitments or representations have been made by Tri-County, to induce the Owner to execute this Contract other than what are contained in this Contract or in the current advertising materials of the contractor; 10) A copy of this agreement is received by the Owner; 11) If Owners are married, they represent that this obligation is a family obligation incurred in the interest of the family. TRI COUNTY’S DUTIES: Tri-County Certifies: 1) to do all work in a workmanlike manner; 2) to do all work in compliance with State and local law; 3) that it will inform the Owner before entering into this home improvement contract of all required building or construction permits, and that it will obtain all such permits; 4) that it will furnish to the Owner the standard guarantees and warranties of the products supplied by the manufacturers of materials; however, Tri-County does not, and cannot, furnish to the Owner any of its own guarantees and warranties of the supplied products; 5) if inspections are required under state or local codes, Tri-County will give inspection certificates to the Owner when the home improvement is completed; 6) it will work with the Owner as to any change orders, and explain the reason for the change and the cost modifications when it provides written change orders for any substantial change from this contract; 7) provide a lien waiver after final payment is received. RIGHT TO CURE NOTICE: Wisconsin law contains important requirements you must follow before you may file a lawsuit or commence mediation or arbitration proceedings for defective construction against the contractor who constructed your dwelling or completed your remodeling project or against a window or door supplier or manufacturer. Section 895.07 (2) and (3) of the Wisconsin statutes requires you to deliver to the contractor a written notice of any construction conditions you allege are defective before you file your lawsuit or commence mediation or arbitration proceedings, and you must provide your construction contractor or window or door upper the opportunity to make an offer to repair or remedy the alleged construction defects. You are not obligated to accept any offer made by the contractor. All parties are bound by applicable warranty provisions. Buyer hereby acknowledges receipt of the brochure required under sec. 101.148 of the Wisconsin statutes. WARRANTY: The warranty in this contract extends only to labor and materials and does not cover other damages including but not limited to damage to the building or its furnishings. This warranty is in lieu of any and all other claims by customer including tort claims. Except as otherwise provided in this contract, Tri-County makes no other warranties, either express or implied, as to any matter whatsoever, including without limitation the condition of the improvements, merchantability or fitness for any particular purpose. Buyer agrees that in no event shall Tri-County be liable to buyer for any loss of use, loss of business, loss of profit, emotional distress, personal injury, bodily injury, death, direct or indirect, incidental or consequential damages, caused directly or indirectly by the acts or omissions of Tri-County under the contract. LIEN NOTICE: As required by the Wisconsin construction lien law, Tri-County hereby notifies buyer that persons or companies performing, furnishing, or procuring labor, services, materials, plans or specifications for the construction on buyer’s land may have lien rights on buyer’s land and buildings directly with the buyer or those who give the buyer notice within 60 days after they first perform, furnish, or procure labor, services, material, plans or specifications. Accordingly, buyer probably will receive notices from those who perform, furnish, or procure labor, services, material, plans or specifications, for the construction, and should give a copy of each notice received to the mortgage lender, if any. Tri-County agrees to cooperate with the buyer and the buyer’s lender, if any, to see that all potential lien claimants are duly paid.. ENTIRE AGREEMENT: This contract, including all documents attached to or referenced in this contract, shall constitute the entire agreement between buyer and Tri-County with respect to its subject matter, and shall not be modified or amended except by a writing signed by buyer and Tri-County. The provisions of this contract supersede all prior oral and written quotations, communications, agreements and understandings of the parties with respect to the subject matter of this contract. TERMINATION OF CONTRACT: In the event of cancellation of the Contract by the Owner, Contractor shall receive compensation from the Owner for all costs of labor and materials and all other expenses incurred through that date plus Contractor’s anticipated profit under the Contract. Contractor may unilaterally terminate this Contract at any time for any reason, including, without limitation, Owner’s failure to timely pay and Owner’s failure to timely make decisions relative to the Work. Owner shall remain obligated to pay Contractor for the value of all Work coupled and materials ordered as of the date of termination, plus Contractor’s anticipated profit under the Contract. RIGHT TO CANCEL: You may CANCEL this transaction, without any penalty or obligation, within THREE BUSINESS DAYS from the date the Owner signed this Contract (date noted on signature line next to Owners signature). If you cancel, any property traded-in, any payments made by you under the contract or sale, and any negotiable instrument executed by you will be returned in a timely manner following receipt by the seller of your cancellation 21 notice, and any security interest arising out of the transaction will be canceled. If you cancel, you must make available to the seller, at your residence, in substantially as good condition as when received by you, any goods delivered to you under this contract or sale; or you may, if you wish, comply with the instructions of the seller regarding the return shipment of the goods at the seller’s expense and risk. If you do make the goods available to the seller and the seller does not pick them up within 20 days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation. To cancel this transaction, mail or deliver a signed and dated copy of this cancellation notice, or any other written notice or telegram to Contractors place of business. DISCLOSURES: SKYLIGHT INSTALLATIONS: It is the recommendation of Tri-County to replace/repair drywall/trim boards, etc when existing skylights are being replaced. Unless noted above our replacement of skylights includes ONLY the installation and exterior finishing. Drywall repairs, trim carpentry, etc are LIKELY to be needed and homeowner accepts all interior damage and costs associated with these repairs. Tri-County’s sole responsibility in replacement of the skylight is to install the skylight unit per manufacturer’s specs and to complete all exterior flashing to make unit watertight. SIDING ON DORMER WALLS: When removing multiple layers of roofing at roof/wall intersections, damage can/may occur to the siding depending on the original installation. A large gap may also exist between the roofing and siding material once the roofing is completed depending on the original installation of the siding. Replacing/repairing the siding is not part of this quote unless specifically stated above. HELPFUL INFORMATION ABOUR YOUR PROJECT: SCHEDULING: Your job is on our schedule, however, our project manager will not call you until we are close to starting your project. Weather and length of job durations on our schedule prior to yours can affect the starting date of your project. Please feel free to call our office if you have any questions, we will be happy to update you as to your tentative start date. MATERIALS: Delivery and placement of all materials will be discussed with you by our project manager. If you have special placement requests, please inform our project manager as soon as possible. DUMPSTER: Our project manager will discuss the placement of the dumpster with you. Please do not put any items or debris in the dumpster — it is strictly to be used for debris we are removing from your project. WORK TRAILER: Many of our installation crews use utility trailers, which contain all the equipment needed for your project. The approximate size of the work trailer can be approx. 7 ft x 14 ft. We may leave a work trailer in your driveway for the duration of your project. Our project manager will discuss the details with you. PROTECTING YOUR HOME: Please cover or remove any items in the attic or garage spaces of your home that you do not want to get dirty. If we are doing a tear-off on your roof, there will be dust, dirt, shingle granules, shingle pieces, etc that will settle on the inside of the attic space and garage. All items around your home (i.e. solar lights, patio furniture, flower pots, bird baths, benches, decorations, art sculptures, etc) should also be removed in preparation for our work area. We will not be held responsible for damaged or broken items around the homeowner’s premises that were left in our work area. However, we will do our best to work around items that cannot be moved, protecting them with plywood sheets, tarps, etc. We will do our best to protect all flowers, shrubs, plantings, trees, etc with plywood, tarps, etc that happen to be in the immediate work area, however, we will not be responsible for replacing such items if they are damaged during the project. Homeowner should understand that during the project, the property is our work area and debris removal and methods to perform this are needing to be performed. The use of ladders, scaffolding, etc will also be required that may damage plants, flowers, shrubs, etc. It is not our intention to damage ANY of the Owners property and we will do our best to not damage anything during the project. We recommend removing any delicate items from shelves, walls, etc on the interior of the home also. There is a possibility of these items falling during a roofing, siding, windows, etc project. This includes chandeliers, lamps, pictures, art, shelves, plates, clocks, etc. Please discuss any concerns with our project manager to help you prepare for the project on your home. If you have an antenna or satellite dish on the home, we most likely will need to remove it during the project. We install all satellites back in the same holes from which we removed it, but you may need to have your provider re-align your dish if your service is interrupted. We will not be held responsible for payment of re-alignment of such accessories (On a positive note, re-alignment is rarely necessary because the dish is installed into the same position in the same). Remove the entire roof on pavilion only. Pull all nails. Replace up to 100 square feet of any rotten or damaged sheeting. The sheeting replaced over the first 100 sq ft will be charged at rate of $325.00 per 3 sheets used. 2. Install 6 ft of Ice & Water shield along the gutters edge, and around all roof protrusions. In the valley areas 3 ft of Ice & Water shield will be installed. 3. Install all new metal edge, and gutter apron over the new Ice & water shield. Install new leaded soil stack covers, and a new ridge vent system along the main peak of pavilion. Color of metal edge: 4. Install a synthetic underlayment and a Owens Corning Tru-definition Duration shingle. The shingles will have a warranty through the manufacturer. Color of shingle to be: Estate Grey 5. All Trim and Facia boards on Pavilion will consist of LP cedar textured boards. 6. All soffits around concession will consist of LP smooth non vented soffit panels fastened over the old pine soffit. Color of fascia & soffit: 7. The soffit and ceiling in the out-door pavilion will be done in ribbed steel panels fastened to trusses and existing ceiling joist. If there are enough supports framed on outdoor pavilion, all extra carpentry will be charged on a time and material basis and added to the contracted time below. Color of Steel Ceiling and Soffit: a. If selecting aluminum soffit & fascia, cost to be additional to contracted amount below by $25/linear foot. b. If selecting gutter installation, cost to be additional to contracted amount below by $10/linear foot. 8. Upon receipt of the Deposit, James R. Taylor & Sons Inc. agrees to perform work for homeowner. • Payments. The Deposit shall be made in US Dollars and paid to James R. Taylor & Sons via payments through check, cash, or credit card. There is a (3.4%) service fee on credit cards being paid over the phone and (2.4%) service charge being paid in person. • The balance of contracted work to be paid no later than (7) days after the work has been completed. Any Alteration or deviation from the above specifications involving extra cost of material or labor will only be executed upon written orders for same and will become an extra charge over the sum mentioned in this contract. All agreements must be made in writing. All permits to be contractor’s responsibility. Acts of God. Weather & circumstances that we cannot control • Ice Damming. If ice damming occurs after your new roof has been installed, James R. Taylor & Sons is not liable for any damage caused by ice damming. The installation of a new roof does not prevent ice damming. It is an act of nature. Ways to prevent ice damming would be to put heat cables on roof or put calcium chloride to help melt the ice. • Scheduling. James R. Taylor and Sons cannot guarantee an exact start date for proposed work. Work may need to be adjusted based on material lead times and schedule changes. Homeowner to be responsible for & aware of during construction process. During roofing, siding & exterior renovation jobs minor disturbances may occur. Contractor will not be held responsible or liable for any of the following disturbances that may occur during the above stated work. • Covering any items in attic for protection from falling debris and dust. Contractor will do no cleanup/debris removal in the attic. • Interior drywall cracking, nail pops, or any damage to any items on the interior. Homeowner is responsible for removing any fragile/delicate items that hang on the walls or from the ceiling. • Contractor will do their best to protect prevent damage to shrubbery, outside plants, landscaping, yard furniture, decking, sprinkler systems, and/or driveways during the process of the work. Upon request from the homeowner, the contractor will assist in covering or removing these items. • Contractor uses a self-propelled trailer for all roof work to drive debris from work area to the dumpster. In most cases yard disturbance is minimal, depending on weather conditions. Contractor will do their best to evaluate conditions before using the trailer to prevent disturbances, however occasionally disturbances will be unavoidable. • Upon completion of the work the property will be raked and swept with a metal magnet. All debris associated with the contracted work will be removed. • Mowing the yard around the perimeter of the building(s) where work is being done will assist the crews in cleaning up and getting all the nails with the magnet. • Contractor will re-install any roof mounted antennas or satellite dishes unless otherwise directed by client. Contractor will not be responsible for proper alignment or reception of same. Please contact you service provider to schedule the realignment of the satellite dish. Signatures. Acceptance of Proposal & Contract – The above prices, specifications, and conditions are satisfactory and hereby accepted and are not able to be changed without the consent of agreement between homeowner and James R.
