Call to Order and Roll Call Pursuant to due call and notice thereof, the regular meeting of the Watertown City Council was called to order at 6:30 p.m. Tuesday, June 12, 2018 in the Council Chambers of City Hall by Mayor Steve Washburn. Council Members present: Washburn, Mike Walters, Deb Everson, Lindsay Guetzkow and Adam Pawelk. City Staff present: City Administrator Shane Fineran, City Planner Mark Kaltsas, Public Works Superintendent Mike Dressel Those who signed in were: Randy Masica, Mario Cortolezzis, and Darren Kahmeyer. 2. Adopt Agenda GUETZKOW MOVED, EVERSON SECONDED A MOTION TO ADOPT THE AGENDA AS PRESENTED. MOTION CARRIED 5-0. 3. Consent Agenda Discussion and Approval All items listed under the consent agenda are considered to be routine by the City Council and will be enacted by one motion on an affirmative vote by roll call of a majority of the members present. There will be no separate discussion of these items unless a Council member or citizen so requests, in which event, the item(s) will be removed and discussed prior to the adoption of the consent agenda. New/Old Business Page 1 of 4 A. 116 Angel Ave SW Variance Request City Planner Kaltsas explained that the owner of 116 Angel Avenue Southwest is requesting a reduced side yard setback. The side yard setback would be reduced in order to construct a four unit townhome. The lot is about a quarter of an acre. The current building on 116 Angel Avenue Southwest is encroaching into the side yard setback. Being that the property is on the corner of Angel and White, there are two front yard setbacks. Kaltsas said that townhomes are a permitted use in the R-2 zoning district. He pointed out multiple properties that currently do not meet required setbacks. Kaltsas reviewed the requirements by the City in order to grant a variance. The owner will adhere to aesthetic requirements for the residential area when constructing the townhomes. The variance request went in front of the Planning Commission on May 24th where they were not in favoring of granting the setback. The Planning Commission is concerned about the character of this building and that it would not fit in with the older homes around it. Walters shared the concerns that were addressed during the Planning Commission meeting. These included sidewalk, grading, parking, and design. Pawelk clarified that Council is only addressing the setback variance and not use of building or number of units. Property owner, Darren Kahmeyer approached the podium to address Council. He said the house is not in great shape and would like to see something new built. Washburn asked the owner to describe the current property on 116 Angel Avenue SW. Kahmeyer stated that the exterior needs updating, the basement has drainage issues and the carport is falling down. Everson stated that by allowing this variance, it is enhancing the area near downtown. EVERSON MOVED, WALTERS SECONDED A MOTION TO ADOPT RESOLUTION 2018-82, GRANTING APPROVAL OF A VARIANCE TO ALLOW A SIDE YARD SETBACK THAT IS LESS THAN THE DISTANCE PERMITTED AT THE PROPERTY LOCATED AT 116 ANGEL AVENUE SOUTHWEST. MOTION CARRIED 5-0. B. Riverpointe Drainage Agreement The City was approached by the Riverpointe Home Owner’s Association to allow for drainage collected from two homes and direct water to the pond. The request is to directionally bore the drainage tube underground and across City property. Pawelk asked about the long term liability for the City and the importance for the legal records to be recorded. Guetzkow asked about the depth of the drain tile and possible failure of the trail. Fineran said that staff has reviewed the plans. Everson asked if anything similar to this has been done in the past. Fineran replied yes in the same area. Washburn asked if the HOA will be responsible for maintenance. Fineran said yes. GUETZKOW MOVED, WALTERS SECONDED A MOTION TO ADOPT RESOLUTION 2018- 83, APPROVING THE AGREEMENT FOR DRAINAGE ONTO CITY PROPERTY BY THE RIVERPOINTE HOME OWNERS ASSOCIATION AND THE PROPERTIES OF 1468 RIVERPOINTE ROAD AND 1474 RIVERPOINTE ROAD. MOTION CARRIED 5-0. C. Marios Italian Kitchen Strong Beer & Wine License Page 2 of 4  Fineran explained that an application has been received from Mario’s Italian Kitchen for the sale of wine and strong beer. Staff is recommending approval contingent on receiving a clear background check and certificate of liquor liability insurance. WALTERS MOVED, PAWELK SECONDED A MOTION TO APPROVE RESOLUTION 2018- 88, APPROVING WINE AND STRONG BEER LICENSES FOR MARIO’S ITALIAN KITCHEN. MOTION CARRIED 4-0 WITH EVERSON ABSTAINING. D. Evergreen Park Improvement Project City Administrator Fineran said that with the Council authorization of the Evergreen Park Project, staff has received quotes for both concrete and fencing. Both low quotes combined came back at about $900 over estimate. Everson asked for the differences in fencing quotes to be pointed out. Fineran noted the major differences. Washburn asked about the warranty on the work. Fineran stated it is one year. EVERSON MOVED, GUETZKOW SECONDED A MOTION TO ADOPT RESOLUTION 2018- 84 AND 2018-85, APPROVING THE LOW QUOTE FOR EVERGREEN PARK FENCING AND EVERGREEN PARK CONCRETE INSTALLATION. MOTION CARRIED 5-0. E. 2017 Population Estimate Comments Annually the Metropolitan Council releases population estimates for communities within the region. These estimates are as of April 1, 2017. Watertown is estimated at 4,310 people and 1,618 households. The household size is averaged at 2.623 people which is down from 2.633. Fineran explained that the City believes the per person household calculation for duplex/triplex/quadplex style housing units should be increased. He is recommending that a letter be sent requesting this change. Council discussed the estimates provided. GUETZKOW MOVED, EVERSON SECONDED A MOTION TO APPROVE COMMENT LETTER AND SUBMITTAL FOR THE 2017 METROPOLITAN COUNCIL POPULATION ESTIMATE. MOTION CARRIED 5-0. 6. Other Reports Mark Kaltsas updated that he was asked to speak at an annual planning conference which stemmed from the EDA Developer’s Day. The focus is on developer friendly communities. Fineran shared thank you notes from the Watertown Mayer Elementary students thanking Council for the tennis courts. He updated on the Highway 25 MNDOT meetings held with property owners along the west side of Highway 25. Feedback on the project was positive. He said the distance of required retaining wall has decreased since the initial plan. Fineran also updated that a neighborhood meeting was held for the Elim Home site. Pawelk updated the next Park Board meeting June 20th at 6:30. Page 3 of 4  Mayor Washburn would like to get a joint school board meeting arranged. He also shared commentary from residents on the stream bank restoration project which was negative. A. Mike Dressel, Public Services Superintendent 7. Adjournment Members of the City Council and City staff may convene directly following the adjournment of the meeting at the Luce Line Lodge in a purely social event.
