CODE ENFORCEMENT HEARING MINUTES Thursday, January 22, 2026 at 10:00 AM Historic City Hall, Commission Chambers – 225 East Main Street, Suite 105 www.cityofwauchula.gov CALL TO ORDER Magistrate Elliott Mitchell called hearing to order @10am ADMINISTER OATH Oath was administered to anyone testifying MINUTES FOR APPROVAL 1. Minutes for August 28, 2025 Code Enforcement Hearing and Minutes for 11/20/2025 Code Enforcement Hearing Minutes for August 28, 2025 Code Enforcement Hearing will be reviewed and approved at a later date, due to a copy was not presented at time of hearing Minutes for 11/20/2025 Code Enforcement Hearing have been approved by Magistrate Mitchell NEW CASES 2. Fernando & Iris Gonzalez 811 Hawaiian Drive 25-208-L Fernando and Iris Gonzalez were not present for this hearing. Ms. Ortiz, along with her husband, son of the listed property owners, Jonathan Gonzalez were present to make their statement regarding the findings that were presented by Code Enforcement Bergens. Initial complaint was reported by Tom Fort of Wauchula Police Department, regarding dead dog in their backyard, this is when Fort discovered the grass/weed height conditions of the back yard, that were higher than the existing fence. Bergens inspected the property to find the conditions of the back yard were not acceptable and captured her evidence via camera. Ortiz stated the property has been worked on as they are having to do all by hand and showed pictures from her phone to the magistrate. Per Magistrate Mitchell, there will not be any fines or fees imposed at this time and give the property owners until February 23, 2026 to clean up the property and be in compliance or a fines will be $100.00 per day and every day thereafter until property is in compliance ORDER TO FORECLOSE  3. Kelly Kindrick 1098 Downing Circle 24-083-L Kelly Kindrick was not present, nor anyone in their absence Bergens provided evidence to Magistrate Mitchell. Case was opened May 14, 2024. Property has not been cleaned up. There are still unpaid liens. Bergens request to foreclose. Magistrate Mitchell approved Bergens request and will sign an order for the City of Wauchula to move foward with Foreclosure.
