VILLAGE OF WAUNAKEE PLAN COMMISSION MINUTES A regular meeting of the Waunakee Plan Commission was held Tuesday May 28, 2013, at the Waunakee Village Hall, 500 W. Main Street, Waunakee, WI. CALL TO ORDER Mr. Laubmeier called the meeting to order at 7:31 p.m. ROLL CALL Members Present: John Laubmeier, Steve Kraus, Pat McGowan, Mark McGuire, Bill Pellino, Tom Liebe. Members Absent: Gary Herzberg Also Present: Kevin Even, Tracy Meinholz, Bryan Kleinmaier, Mike King, Ed Freer, Ryan Dostalek, Don Bernards, Dave Porterfield, Pat & Joan O’Connor, Rod Zubella, Rod Rippley, Tim Knepprath, Barbara Newell, Brian Stottard, Mike Calkins. APPROVAL OF MINUTES Motion McGuire, second Kraus, to approve the minutes from the April 22, 2013 meeting. Motion carried. PUBLIC COMMENT None NEW BUSINESS DISCUSSSION/ACTION PUBLIC HEARING & DISCUSSION / ACTION ON A CONDITIONAL USE PERMIT FOR LUCKY’S WAUNAKEE LLC, 1000 QUINN DR. Rod Ripley presented the requested changes to the existing conditional use permit to allow for outdoor bar service. Page 1 of 3 Public hearing opened at 7:38 p.m. Public hearing closed at 7:40 p.m. with no comments from the public. Motion McGuire, second Liebe, to approve amended conditional use permit replacing the conditional use permit granted on June 25, 2012, with the following conditions: 1) Applicant shall acquire and maintain a parking agreement with the owner of an adjacent parking lot to handle overflow parking. Parking agreement shall be approved by Village Zoning Administrator. 2) Volleyball activity and volleyball lighting shall be limited to the hours of 9 AM to 10 PM daily. 3) Patio, including outdoor alcohol service, may remain open until 2 AM Sunday through Thursday and until 2:30 AM on Friday and Saturday. Outdoor televisions and music (not including live music or DJs) may stay on until the hours identified in the preceding sentence at reasonable noise levels. 4) Live music and/or DJs on patio (or anywhere outdoors) shall stop by 10:30 PM. Indoor events can continue until bar time. 5) Approval of following by technical staff: parking lot lighting, volleyball court lighting, volleyball fencing, and outdoor seating area fencing and signage. 6) Applicant is made aware that conditional use permits can be reviewed and re-evaluated by the Plan Commission and that conditional use permits are revocable and conditions of approval may be modified based on experience. 7) All utility issues and easements are satisfied. 8) Applicant shall install signage clearly identifying for customers where alcohol may be possessed and consumed on property (i.e., customers may possess and consume alcohol on “premises” as defined in alcohol license application). 9) Applicant is made aware that Village administrative staff maintains discretion to modify activities and hours of operation for outdoor areas, including patio, based on noise levels. PUBLIC HEARING & DISCUSSION / ACTION ON SITE PLAN & CONDITIONAL USE PERMIT FOR MADISON & MAIN LLC PROJECT The applicants presented the site plan and answered questions from the commission members. Public hearing opened at 8:15 p.m. Barb Newell asked questions about buffering between this parking lot and her own. Staff directed the applicant to work with Ms. Newell on a cooperative solution that meets the satisfaction of both parties and the Village Engineer. Public hearing closed at 8:25 p.m. Motion Liebe, second McGowan, to approve the site plan and conditional use permit with the following conditions: 1. Applicant granted a waiver to the parking requirements (6 stalls short), with the ability to add them later if deemed necessary. 2. All utility issues and staff technical comments resolved to the satisfaction of the Utilities Manager & Village Engineer. 3. Applicant to redesign the corner treatment between the building and sidewalk with a more urban design with administrative approval by the Village Engineer. 4. Applicant to work with Newel Gallery regarding the parking lot buffer. Motion carried. Page 2 of 3 PUBLIC HEARING & DISCUSSION / ACTION ON A RE-PLAT OF LOT 133, MEADOWBROOK SUBDIVISION Pat O’Connor presented the conversion of Lot 133 from condominiums to 9 single family residential lots. Public hearing opened at 8:37 p.m. Public hearing closed at 8:38 p.m. with no comments from the public. Motion McGowan, second Pellino, to approve conditioned upon all the outlined issues resolved to the satisfaction of the Village Engineer and Utility Manager. Motion carried. DISCUSS & TAKE ACTION ON A CERTIFIED SURVEY MAP TO COMBINE TWO PARCELS AT 211 BACON STREET Motion Pellino, second McGuire, to recommend approval of the Zimm CSM to the Village Board as long as there are no utilities present that need to be vacated. Motion carried. DISCUSS & TAKE ACTION ON A SITE PLAN FOR AN ADDITION TO ADVANCED DISPOSAL AT 300 RAEMISCH ROAD Motion Kraus, second Pellino, to approve the site plan as submitted and direct staff to work with the property owners to discuss noise mitigation.
