PLAN COMMISSION
MINUTES
A regular meeting of the Waunakee Plan Commission was held Monday November 9, 2015, at the
Waunakee Village Hall, 500 W. Main Street, Waunakee, WI.
CALL TO ORDER
Mr. McGowan called the meeting to order a 6:06 p.m.
ROLL CALL
Members Present: Gary Herzberg, Pat McGowan, Mark McGuire, Brad Zeman.
Members Absent: Chris Zellner, Steve Kraus, Bill Pellino.
Also Present: Kevin Even, Tracy Meinholz, Bryan Kleinmaier, Ed Freer, Patrick Hagerman, Dennis
Heimann, Robert Rancourt, Roberta Baumann Susan Gardner, Jim Douglas.
APPROVAL OF MINUTES
Motion Zeman, second McGuire, to approve the minutes from the September 14, 2015 meeting. Motion
carried.
PUBLIC COMMENT
None
NEW BUSINESS
Public Hearing & Discussion / Action on Conditional Use Permit Request by The Gathering Place,
115 W Main Street
Public hearing opened at 6:09 p.m. Dennis Heiman from Village Market questioned the number of rooms
and if they would be charged a hotel tax. The Village Attorney stated that the use does not appear to
warrant the hotel tax due to the nature of the business, but the Village reserves the right to change this if
circumstances warrant. The public hearing was closed at 6:11 p.m. Mr. Even went over the proposed
conditions of approval stating that the applicant was amenable, but wished to change the maximum number
of consecutive days from 3 to 5. The Commission members agreed.
Motion McGuire, second Zeman, to approve the conditional use permit with the following conditions:
A) Compliance with all building code issues
B) Village Plan Commission determines that the proposed use, which is identified as Option 1 and
Option 2 in August 26, 2015 email from Susan Gardner to Todd Schmidt, is similar to a hotel

and/or bed and breakfast establishment, both of which constitute conditional uses in the C-1D
zoning district. Pursuant to Section 106-10(4)(b), Village Plan Commission approves the proposed
use as a conditional use, subject to the following conditions:
1 Compliance with all state or local regulations applicable to businesses that allow food to be
served and/or prepared on premises.
2 Compliance with all state or local regulations applicable to businesses that allow customers
to sleep overnight on premises.
3. Compliance with all state or local regulations applicable to capacity control.
4. Any exterior alteration of the building requires site plan approval by Village Plan
Commission.
5. Sleeping quarters not to exceed 12 individuals.
6. Sleeping quarters may be rented by customers for a maximum of five consecutive calendar
days.
7. Village reserves the authority to reevaluate whether business is subject to hotel / motel room
tax under Wis. Stat. § 66.0615 and Chapter 90, Article III of Village Code.
8. Use of the second-floor outdoor deck and the outdoor eating / drinking area is limited to
11:00 a.m. to 9:00 p.m. Sunday through Thursday and 11:00 a.m. to 10:00 p.m. on Fridays
and Saturdays.
9. Use of the second-floor outdoor deck and the outdoor eating / drinking area will be reviewed
on an annual basis and may be prohibited by Village Plan Commission in the future if there
are significant complaints from neighboring residences or businesses, if there are violations
of Village noise standards, or if there are an unreasonable number of police calls to the
business.
10. Residential noise restrictions shall apply to all amplified music and/or use of television
screens or monitors.
11. Lighting shall be approved by the Village Engineer.
12. Alcohol beverage related conditions:
a. Customers of the business may bring and consume alcohol beverages on the premises,
which premises are defined as the first and second floors of the building at 115 W. Main
Street, including the second-floor outdoor deck and the fenced-in outdoor eating / drinking
area east of the building.
b. No alcohol beverages may be sold on the premises.
c. No alcohol may be consumed on the premises except by individuals who have rented the
business and their invited guests.
d. When alcohol is consumed on the premises, the premises shall not be open to the general
public.
e. Open containers of alcohol beverages shall not be taken off the premises.
f. Consumption of alcohol beverages shall be limited to private property (i.e., the premises)
and shall not extend to the sidewalk or road right of way.
g. No persons under the age of 21 may consume alcohol beverages on the premises.
Motion carried.
Discussion of Compliance Issues Related to Existing Conditional Use Permit for Scotlea Hot Rods as
Potential User at StorageShop USA, 315 Moravian Valley Road
After a brief discussion of the nature of the proposed business, motion Herzberg, second McGuire, to find
that the use is compatible, and that all conditions of the CUP shall apply to this use including no outside
storage. Motion carried.

The October JPC meeting was cancelled.
