CALL TO ORDER
Mr. Zellner called the meeting to order at 5:30 p.m.
ROLL CALL:
Present: Chris Zellner, Gary Herzberg, Joe Zitzelsberger, Brian Wallace, Chris Thomas, Brian

Motion Thomas, second Zitzelsberger, to approve the August 8, 2022, Plan
Commission Minutes. Motion carried.

PUBLIC HEARINGS
1 Public Hearing and Discussion/Action on a Request for Conditional Use Permit
by GSS on behalf of US Cellular to Construct a New Mobile Structure (Cell
Tower) and Facilities at 1100 Frank H. Street (Item for Final Action by the Plan
Commission)
GSS, Inc is seeking approval of a site plan and CUP to construct a 100‘ tall monopole
communication tower and associated ground equipment for US Cellular. The pole and ground
equipment will be situated within a 20’ x 48’ fenced enclosure along the southern portion of
the property behind the existing multi-tenant building – with the area being leased from the
current property owner. The monopole itself will be setback approximately 40’ from the rear
lot line, which is consistent with zoning setbacks for this part of the Business Park. The
facilities would be accessed from Frank H. Street via a 30’ wide utility and access easement
across the existing parking and circulation area.
Brian Malich arrived at 5:32 p.m.
The public hearing was opened at 5:32 p.m. There we no comments from the public. The
hearing was closed at 5:34 p.m.
Gary Herzberg arrived at 5:34 p.m.
Staff recommends approval and the Village Attorney has drafted the CUP document.
Motion Zellner, second Wallace, to approve the site plan and conditional use permit for 1100
Frank H. Street as recommended by staff. Motion carried.
2 Public Hearing and Discussion/Action on a General Development Plan
Amendment, Specific Implementation Plan and Conditional Use Permit, Kyron
Tierney Properties LLC, The Tasting Room, 1330 Water Wheel Drive (Item for
Recommendation to JPC & Village Board)
Chris Zellner recused himself due to his employer having an affiliation with the owners of The
Tasting Room. Motion by Herzberg, second Malich, to appoint Zitzelsberger interim Chair.
Motion carried.
The original application included a request for a GDP amendment to remove the
future potential roadway to the south. The applicant has since withdrawn that portion
of the request. Upon further review staff also determined that the use was a permitted
use and therefor did not require a conditional use permit. Both the GDP and CUP
were noticed as public hearings. While no longer needed, Zitzelsberger held the
public hearings as a courtesy. The public hearing was opened at 5:42 p.m. With no
comments from the public, the hearing was then closed at 5:43 p.m.
Motion Malich, second Herzberg, to recommend that the Joint Plan Commission
approve the SIP for Lot 2 of CSM #15373 and Outlot 16 of Kilkenny Farms to
develop a building and grounds for a licensed cigar bar per the submitted plan subject
to outstanding concerns being addressed to the satisfaction of the Community
Development Director and Village Engineer, along with the following conditions:
1. Limitation of amplified music to 9:00 p.m. Sunday to Thursday and 10:00
p.m. Friday and Saturday, with the condition that if there are noise or other
nuisance complaints from neighboring residents or property owners, the Plan
Commission may review the outdoor hours of operation. The Waunakee
Chief of Police may grant a waiver to this restriction for special events.
2. Fire pit(s) must be approved by the Waunakee Fire Department.
3. Any capacity controls shall be established by the Waunakee Fire Department
and/or Wisconsin state statute / administrative code requirements.
4. A public improvements agreement is needed prior to the issuance of a building
permit.
5. Prior to the commencement of operations, liquor and tobacco licenses for the
premises will need to be obtained.
Motion carried 5-0-1, with Zellner abstaining.
Zellner resumed the Chair.
BUSINESS ITEMS
1 Discuss and Take Action on a Change of Use Request, DHS75 Licensed Medical
Facility, Luxcom Hotels LLC, 904 E. Main Street (Item for Final Action by the
Plan Commission)
Luxcom Hotels, Inc is requesting approval of a site plan to accommodate a change in
use to the building located at 975 Frank H Street. The use will be changing from a
hotel to a medical clinic providing inpatient and outpatient services to a target
population of mothers with very young children facing mental health barriers.
The change in use will likely facilitate the need for additional plan review to ensure
compliance with applicable building codes. The applicant is encouraged to contact the
Village Building Inspector to facilitate whatever changes are needed for the new use
of the building.
Motion Zitzelsberger, second Thomas, to approve the Luxcom Hotels, Inc site plan
subject to all outstanding issues being addressed to the satisfaction of the Community
Development Director and Village Engineer. Motion carried 6-0.
2 Discuss and Take Action on Site Plan for Parking Lot Expansion, First Choice
Drywall, 302 Moravian Valley Road (Item for Final Action by Plan Commission)
First Choice Drywall, Inc is requesting site plan approval for additional parking
toward the rear of their site at 302 Moravian Valley Road. Fourteen stalls along with
an approximately 1,400 square foot outdoor storage area will be added to the west end
of the existing parking field. The surface area for outdoor vehicle/trailer storage is
shown as gravel. Parking and circulation areas are normally to be covered with a with
dustless surface; however, the Commission may grant approval of the use of gravel.
Commissioners should provide direction regarding the use of surface materials.
Motion Zellner, second Wallace, to approve the First Choice Drywall, Inc. site plan ,
including the gravel areas, subject to all outstanding issues being addressed to the
satisfaction of the Village Engineer. Motion carried 6-0.
3 Discuss and Take Action on Site Plan for a 283 Square Foot Addition to Kwik
Trip, 208 E. Main Street (Item for Final Action by the Plan Commission)
Kwik Trip, Inc is requesting approval of a small (~306 square feet) addition to the SW
corner of the building. The additional area will accommodate the relocation of the
walk-in cooler and freezer space so the interior food prep area may be expanded. The
remodeled spaces will not be accessible to the general public. The proposed
improvements will maintain the existing paving, parking, traffic circulation, and
pump areas.
The applicant should provide the Village Engineer with calculations to ensure they
meet their stormwater management requirements from their originally approved plans
and have enough capacity in their SW facility to accommodate the additional
impervious surface. The plans include a white metal roof coping along the top course
of the addition. Staff recommends this element along the north and south elevations of
the addition be changed to match the current brick soldier course along the street front
façade (shown above). This would help better integrate the addition into the existing
architectural design. Staff also recommends the plantings along the west side of the
building that are displaced due to the improvements be replaced to the extent
practicable while maintaining the integrity of the stormwater basin.
Motion Herzberg, second Malich, to approve the Kwik Trip, Inc site plan subject to
all outstanding issues being addressed to the satisfaction of the Community
Development Director and Village Engineer. Motion carried 5-1, Wallace opposed.
WAUNAKEE/WESTPORT JOINT PLAN COMMISSION UPDATE
Staff gave a brief report on the items being discussed at the September 13, 2022 JPC
meeting.
