VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street August 20, 2012 - 6:00 PM Meeting Minutes CALL TO ORDER The August 20, 2012 Village Board meeting was called to order by President John Laubmeier at 6:01 p.m. ROLL CALL Present: Phil Willems, Gary Walden, Chris Zellner (arrived at 6:05 p.m.), Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier Absent: None Also Present: Roberta Baumann, Julee Helt, Todd Schmidt, Dave Ferris, Kevin Even, Dennis Steinkraus, Rick Stoughton, John Ganser, Dianne Hesselbein, Dan Birrenkott, Gary Epping, Bryan Kleinmaier, Mike Lawton, Don Tierney, Chuck Bongard, Phil Cosson, Leonard Allen, Tim Kiefer CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Steve Kraus, second by Phil Willems, to approve the Consent Agenda including all items listed below. Motion Passed. For: 6, Against: 0, Absent: 1. 1. Approve August 6, 2012 Village Board Minutes Motion to approve August 20, 2012 Village Board minutes. 2. Approve Routine Bills Motion to approve check numbers ranging from 61757 through 61774 totaling $33,488.26 and check numbers ranging from 61775 through 61785 totaling $2,993.73. 3. Approve Non-Routine Bills Motion to approve check numbers ranging from 61786 through 61801 totaling $502,323.73 and ACH check #1200914 totaling $111,850.34. 4. Approve Low Bid for CTH Q and Peaceful Valley Parkway Intersection Improvements Motion to approve the low bid from Parisi Construction out of Middleton Wisconsin for $654,992.70 conditioned on the following: 1. The Village obtaining the necessary easements for construction. 2. The Village having an approved developers agreement for the CSM lots that assures the completion of the parkway from the intersection to CTH Q. 3. The Village completing a review of the contractor and determining they are capable and financially viable to complete the work. Chris Zellner arrived at 6:05 p.m. PUBLIC COMMENT County Supervisor Tim Kiefer and Assemblyperson-elect Dianne Hesselbein introduced themselves to the Village Board. PUBLIC HEARING 1. Discuss and Take Action on Kilkenny Farms Commercial Lot Certified Survey Map The public hearing to consider the Kilkenny Farms commercial lot certified survey map was opened at 6:08 p.m. and closed at 6:09 p.m. Motion by Sue Springman, second by Gary Walden, to approve the Kilkenny Farms commercial lot certified survey map with the following conditions: 1. Restrictions to allow Dean to begin construction after commencement of construction on the parkway, but not take occupancy before completion of the parkway. 2. Restrictions that no development can occur on the three additional lots prior to completion of the parkway without additional release by the JPC and Village Board. 3. Approval of a developers agreement by the Village Engineer, Village Attorney, and Town Attorney. 4. Approval of zoning. Motion Passed. For: 7, Against: 0. 2. Discuss and Take Action on General Development Plan and Specific Implementation Plan for Lot 1 of Kilkenny Farms Certified Survey Map (Dean Clinic Lot) The public hearing to consider the General Development Plan and Specific Implementation Plan for lot 1 of the certified survey map for Kilkenny Farms (Dean Clinic lot) was opened at 6:10 p.m. and closed at 6:11 p.m. Motion by Gary Herzberg, seconded by Steve Kraus, to approve the General Development Plan and Specific Implementation Plan for lot 1 of the certified survey map for Kilkenny Farms (Dean Clinic) with the following conditions: 1. The loading dock entrance be restricted to deliveries only (Our transportation engineering consultants have recommended we avoid this driveway and indicate they reconfigure their internal parking lot to accommodate delivery trucks to the area). 2. Approval of the signage plan at a later date by the JPC and architectural committee. 3. Changes to the north elevation to reduce to street view impact as approved by JPC. 4. Approval of retaining walls by the Village Engineer after consultation with the architectural committee. 5. Approval of the final grading plan by the Village Engineer. 6. Approval of the lighting plan by the Village Engineer and Town Attorney after consultation with the architectural committee. 7. Approval of the stormwater plans by the Village Engineer after consultation with the Town Attorney and Town Board Chair. 8. Approval of the PUD zoning by the JPC and Village Board. 9. A development restriction that would restrict the start of the Clinic to after commencement of construction of the parkway and no occupancy prior to completion of the parkway as drafted and approved by the Village Attorney, Village Engineer, and Town Attorney. 10. Approval of any temporary access for construction purposes by the Village Engineer and Town Attorney. 11. Approval of the site plan by the architectural committee. 12. Approval of utility connections by the Village Engineer and Waunakee Utility Manager. 13. Reduction of the setback to CTH Q to minimum of 25 feet. 14. Any additional conditions as recommended by staff and included by the Plan Commission and JPC. 15. Any additional conditions as recommended by the Plan Commission and JPC. 16. Approval of a landscape plan by the Village Engineer, Town Attorney and Architectural Review Committee. 17. Revision of the north elevation/view as facing Peaceful Valley Parkway due to the change in location to the south side of the roadway to the satisfaction of the Architectural Review Committee. 18. Approval of the GDP and SIP zoning documents for this lot by the Village Engineer, and Town and Village Attorneys, limiting the GDP/SIP approval to medical and health care clinics and related uses only. Motion Passed. For: 7, Against: 0. 3. Discuss and Take Action on Kilkenny Farms Preliminary Plat The public hearing to consider the Kilkenny Farms preliminary plat was opened at 6:20 p.m. Don Tierney talked about the dead-end street and what he would do to work cooperatively with John Ganser with regard to his adjacent property. John Ganser spoke about the dead-end street, the misalignment of Simon Crestway, and the $1.1 million developer incentive for Peaceful Valley Parkway. Bryan Kleinmaier explained that the incentive was for the entire development not just the parkway construction. The public hearing to consider the Kilkenny Farms preliminary plat was closed at 6:30 p.m. Motion by Steve Kraus, second by Phil Willems, to approve the proposed Kilkenny Farms preliminary plat, subject to the recommended conditions and restrictions of the Joint Plan Commission that were made based on the findings of the Village Plan Commission. Motion Passed. For: 7, Against: 0. NEW BUSINESS 1. Discuss and Take Action on Developers Agreement for Lot 1 of Kilkenny Farms Certified Survey Map (Dean Clinic Site) Motion by Gary Herzberg, second by Gary Walden, to authorize the Village Engineer and Village Attorney to draft, finalize, and execute a developers agreement for Lot 1 of Kilkenny Farms Certified Survey Map (Dean Clinic Site) consistent with the outline presented. Motion Passed. For: 7, Against: 0. 2. Discuss and Take Action on Directing Village Administrator to Draft Organizational Growth and Transitioning Plan Motion by Chris Zellner, second by Sue Springman, to direct the Village Administrator to draft an organizational growth and transitioning plan. Motion Passed. For: 7, Against: 0. OLD BUSINESS 1. Discuss and Take Action on Conceptual Terms of Development Agreement with CBI LLC for Main and Madison Street *The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The Village Board may reconvene in open session. Motion by Chris Zellner, second by Steve Kraus, to convene in closed session at 6:45 p.m. as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session. The Village Board may reconvene in open session. Motion Passed. For: 7 - Phil Willems, Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 0.
