CALL TO ORDER
The September 15, 2014 Village Board meeting was called to order by Village Clerk Julee Helt
at 6:02 p.m.
ROLL CALL
Present: Phil Willems (arrived at 6:05 p.m.), Gary Walden, Chris Zellner, Sue Springman,
Gary Herzberg, Steve Kraus
Absent: John Laubmeier

Motion by Steve Kraus, second by Chris Zellner, to appoint Gary Herzberg as temporary chair.
Motion Passed. For: 5, Against: 0, Absent: 2.
CONSENT AGENDA
Items under the consent agenda may be acted upon by one motion. If, in the judgment of any
Board Member, a consent agenda item needs discussion, the item may be moved to later on the
agenda for discussion and/or action.
Motion by Steve Kraus, second by Gary Walden, to approve the Consent Agenda including all
of the items listed below.
Motion Passed. For: 5, Against: 0, Absent: 2.
1. Approve September 2, 2014 Village Board Minutes
Motion to approve September 2, 2014 Village Board minutes.
2. Approve Routine Bills
Motion to approve check numbers ranging from 70133 through 70151 totaling $50,391.35 and
check numbers ranging from 70163 through 70176 totaling $1,767.11.
3. Approve Non-Routine Bills
Motion to approve check numbers ranging from 70152 through 70162 totaling $287,006.96.
4. Approve Updated Inclement Weather and Emergency Closing Policy - Library
Motion to approve the updated Inclement Weather and Emergency Closing policy as proposed
by staff.
5. Approve Halloween Trick or Treat Hours
Motion to approve Trick or Treat hours for Friday, October 31, 2014, between 5:00 p.m. and
7:00 p.m.
PUBLIC COMMENT
There was no comment from the public.
Phil Willems arrived at 6:05 p.m.
PUBLIC HEARING
1. Discuss and Take Action on Amendment to Section 42 of Village Ordinance
Relating to Floodplain Zoning
The public hearing to consider an Amendment to Section 42 of Village Ordinance Relating to
Floodplain Zoning was opened at 6:06 p.m. and closed at 6:07 p.m.
Motion by Chris Zellner, second by Sue Springman, to adopt the Amendment to Section 42 of
Village Ordinance Relating to Floodplain Zoning.
Motion Passed. For: 6, Against: 0, Absent: 1.
2. Discuss and Take Action on Lot Line Adjustment for Dixie Olson, 5545 Clove
Road, Town of Westport
The public hearing to consider a lot line adjustment for Dixie Olson, 5545 Clove Road, Town of
Westport, was opened at 6:06 p.m. and closed at 6:07 p.m.
Motion by Steve Kraus, second by Gary Walden, to approve the Certified Survey Map for a lot
line adjustment at 5545 Clove Road, Town of Westport.
Motion Passed. For: 6, Against: 0, Absent: 1.
3. Discuss and Take Action on Request by Guy Kitchell of Halloween FX to Rezone
5305 CTH M, Town of Westport, from County C-2 to Village C-1
The public hearing to consider a request by Guy Kitchell of Halloween FX to Rezone 5305
CTH M, Town of Westport, from County C-2 to Village C-1, was opened at 6:08 p.m. Tim
Lang, Rhonda Arries, Elaine Mischler, Nicholas Mischler, and Austin Munson spoke against
the project. Linda Olson was undecided about the project. Guy Kitchell, owner of the project,
spoke in favor. Mary Robertson, Doug Shillinglaw, and Mark Trotter provided written
opposition to the project. Amanda Raabe provided written support for the project. The public
hearing to consider a request by Guy Kitchell of Halloween FX to Rezone 5305 CTH M, Town
of Westport, from County C-2 to Village C-1, was closed at 6:32 p.m.
Motion by Gary Herzberg, second by Steve Kraus, to approve temporary removal of restrictions
as recommended by the Westport Town Board in Resolution 14-16 with the additional limit that
the dates of operation be from October 3, 2014 to October 31, 2014.
Motion Passed. For: 4, Against: 2, Absent: 1.
4. Discuss and Take Action on Request by David Everitt to Rezone 5578 River
Road from County R-1 to Village SR-4 for Purpose of Rebuilding Deck
The public hearing to consider a request by David Everitt to rezone 5578 River Road from
County R-1 to Village SR-4 for the purpose of rebuilding a deck was opened at 6:43 p.m. and
closed at 6:44 p.m.
Motion by Gary Walden, second by Steve Kraus, to approve the rezone ordinance for 5578
River Road.
Motion Passed. For: 6, Against: 0, Absent: 1.
OLD BUSINESS
1. Discuss and Take Action on Development Agreement, Related Documents, and
Potential Land Acquisition Relating to Alloy Site Redevelopment "The Village
Board may convene in closed session as authorized by Wisconsin Statute
19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of
public properties, the investing of public funds, or conducting other specified
public business, whenever competitive or bargaining reasons require a closed
session. The Village Board may reconvene in open session and discuss and take
action on the subject matter discussed in closed session.
No action was taken.
2. Discuss and Take Action Regarding Investment of Public Funds Related to
Waunakee Business Park Development Proposal *The Village Board may
convene in closed session as authorized by Wisconsin Statute 19.85(1)(e) for the
purpose of deliberating or negotiating the purchasing of public properties, the
investing of public funds, or conducting other specified public business,
whenever competitive or bargaining reasons require a closed session. The Village
Board may reconvene in open session and discuss and take action on the subject
matter discussed in closed session.
No action was taken.
NEW BUSINESS
1. Discuss and Take Action on Request by Erdman to Reduce Mitigation Fee
Related to Development in Environmental Corridor
Motion by Sue Springman, second by Chris Zellner, to refer the mitigation fee related to
development in the environmental corridor to the Waunakee Economic Development
Commission for consideration.
Motion Passed. For: 6, Against: 0, Absent: 1.
