OLD BUSINESS 1 Discuss and Take Action on Village Trustee Vacancy Motion by Phil Willems, second by Erin Moran, to appoint Kristin Runge to fill the Village Trustee vacancy. Motion Passed. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. For: 6, Against: 0. 1 Approve July 15, 2019 Village Board Minutes and July 29, 2019 Subcommittee on Trustee Vacancy Minutes Motion to approve the July 15, 2019 Village Board Minutes and the July 29, 2019 Subcommittee on Trustee Vacancy Minutes. 2 Approve Schedule of Bills Motion to approve check numbers 78288-78293 totaling $405,208.61, 78294-78316 totaling $79,229.07, WEX in the amount of $4,604.93, US Bank in the amount of $104,818.91, check number 78317 in the amount of $125.00, 78319-78336 totaling $151,898.45, 78337-78338 totaling $14,567.02, and 78339-78351 totaling $19,465.11. 3 Approve Application for Temporary Class "B" License for Waunakee Area Chamber of Commerce Motion to approve an application for a Temporary Class “B” license for Waunakee Area Chamber of Commerce for a block party at the Waunakee Manor on August 15, 2019. Licensed Premise is identified as a 20’ x 40’ beer tent area located on the east lawn at 801 S. Klein Drive. PUBLIC COMMENT Maria Patt (1000 Wexford Drive) commented on the new library and encouraged the use of the old library building as a place for a historical society. Todd Schmidt, Village Administrator, provided a comment regarding the opening of the new library. President Zellner provided a comment regarding the opening of the new library. PRESENTATIONS 1 Dane County Update from County Supervisor Tim Kiefer Tim Keifer, Dane County Supervisor, provided the Village Board with an updated regarding Dane County. No action taken. 2 Dane County Cities and Villages Association (DCCVA) Update Forbes McIntosh, Executive Director of the Dane County Cities and Villages Association, provided an organizational update to the Village Board. No action taken. PUBLIC HEARING 1 Public Hearing and Discussion/Action on Potential Regulation of Short-Term Rentals The public hearing to consider potential regulation on short-term rentals, was opened at 6:36 p.m. Bonnie Koenig with Dane County Public Health provided comments regarding regulation of short-term rentals. Brad Duffin (Dane County Sherriff Deputy representing the Town of Westport), Alexis Buchanan (5556 Polo Ridge), Terrence Mullen (1006 Franconia Court), Rhonda Arries (5106 Reynolds Ave), AJ Bussan (5654 Cobblestone Lane), Valerie Lincoln (5597 Polo Ridge), Mariam Block (5589 Surrey Lane), Wendy Vincent (5642 Cobblestone Lane), Beth Hornung (1005 Franconia Court), Colette Bussen (5654 Cobblestone Lane), Don Tierney (3564 Egre Road, DeForest), and David Caulkins (5114 Reynolds Avenue) all provided comments against short-term rentals and supportive of regulation of short-term rentals. Teresa & Jeff Wilder (5667 Cobblestone Lane) and Nick & Barb Meriggioli (5545 Surrey Lane) provided written comments against short-term rentals and supportive of regulation of short-term rentals. Crystal Schliefer (1003 Franconia Court), Akil Cooper (1003 Franconia Court), and Chris Foss (506 Seventh Street) provided comments in support of short-term rentals. The public hearing to consider potential regulation on short-term rentals was closed at 7:18 p.m. The Village Board provided direction to Village Staff regarding the regulation of short-term rentals. President Zellner recessed the Village Board at 7:41 p.m. President Zellner called the Village Board meeting back into session at 7:44 p.m. 2 Public Hearing and Discussion/Action, Gerald Schutz, 5540 Gerend Road, Town of Westport, to Rezone from County R-1 to Village R-1, to Bring Existing Residence into Compliance with Setback Regulations and Allow Construction of a Garage Addition The public hearing to consider the rezone from County R-1 to Village R-1 of 5540 Gerend Road in the Town of Westport to bring existing residence into compliance with setback regulations and allow construction of a garage addition, was opened at 7:44 p.m. No comments received. The public hearing to consider the rezone from County R-1 to Village R-1 of 5540 Gerend Road in the Town of Westport to bring existing residence into compliance with setback regulations and allow construction of a garage addition, was closed at 7:45 p.m. Motion by Phil Willems, second by Gary Hertzberg, to approve the rezone from County R-1 to Village R-1 as presented will all standard Town conditions as recommended by the Joint Plan Commission. Motion Passed. For: 6, Against: 0. 3 Public Hearing and Discussion/Action on a Certified Survey Map for Quality Machining, Inc., 1001 Uniek Drive The public hearing to consider the certified survey map for Quality Machining, Inc located at 1001 Uniek Drive, was opened at 7:47 p.m. No comments received. The public hearing to consider the certified survey map for Quality Machining, Inc located at 1001 Uniek Drive, was closed at 7:48 p.m. Motion by Gary Hertzberg, second by Joe Zitzelsberger, to approve the certified survey map as presented subject to any outstanding issues with the Village Engineer or Utilities Manager. Motion Passed. For: 6, Against: 0. 4 Public Hearing and Discussion/Action on a Request by Arboretum Village LLC for Preliminary Plat at the Corner of Hogan Road and Quinn Drive The public hearing to consider the preliminary plat at the corner of Hogan Road and Quinn Drive requested by Arboretum Village LLC, was opened at 7:49 p.m. No comments received. The public hearing to consider preliminary plat at the corner of Hogan Road and Quinn Drive requested by Arboretum Village LLC,was closed at 7:50 p.m. Motion by Joe Zitzelsberger, second by Phil Willems, to conditionally approve the Arboretum Village preliminary plat with the following conditions: (1) satisfaction of comments in the Strand email dated June 30, 2019, (2) approval of proposed park dedication by the Parks Committee, and (3) approval of the easements necessary by Waunakee Utilities. LICENSES/PERMITS 1 Discuss and Take Action on Original Alcohol Beverage License Application for Kinzel Hospitality Group LLC dba Boston's The Gourmet Pizza Motion by Bill Ranum, second by Erin Moran, to approve an Original Alcohol Beverage Retail License Application for Kinzel Hospitality Group LLC dba Boston's The Gourmet Pizza, premise identified as building located at 1370 Water Wheel Drive. 2,000 square foot outdoor dining and entertainment space on the south side of the building. Fencing for the outdoor patio area is required and shall be subject to approval by the Village of Waunakee Chief of Police and Village Engineer. Limitation of outdoor service and amplified music to 9:00 p.m. Sunday to Thursday and 10:00 p.m. Friday and Saturday, with the condition that if there are noise or other nuisance complaints from neighboring residents or property owners, the Joint Plan Commission may review the conditional use. The Waunakee Chief of Police may grant a waiver to this restriction for special events. Any capacity controls shall be established by the Waunakee Fire Department and/or Wisconsin state statue / administrative code requirements. Motion Passed. Haban Motion by Bill Ranum, second by Joe Zitzelsberger, to deny the operator license application for Tommy J. Haban consistent with the Policy for Review of Operator License Applications. For: 6, Against: 0. 3 Discuss and Take Action on Operator License Applications for Ana Monje, Myranda Leonard, Skylar Lainberger, Derrek Kinzel, Otto Clifcorn, Jennifer Devlin, and Jacob Bethke Motion by Bill Ranum, second by Erin Moran, to approve an operator license application for Ana Monje, Myranda Leonard, Skylar Lainberger, Derrek Kinzel, Otto Clifcorn, Jennifer Devlin, and Jacob Bethke, subject to successful completion of an approved responsible beverage server training course and review by the Waunakee Police Department.
