VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street December 2, 2019 6:00 PM Meeting Minutes CALL TO ORDER The December 2, 2019 Village Board meeting was called to order by Village Clerk Caitlin Stene at 6:00 p.m. Motion by Phil Willems, second by Bill Ranum to appoint Gary Herzberg as meeting chair. Motion Passed. For: 6, Against: 0. ROLL CALL Present: Bill Ranum, Joe Zitzelsberger, Erin Moran, Phil Willems, Kristin Runge, Gary Herzberg Absent: Chris Zellner Also Present: Todd Schmidt, Caitlin Stene, Renee Meinholz, Kevin Even, Bryan Kleinmaier, Tim Herlitzka, Steve Monk, Roberta Baumann, Sam Kaufmann, Maria Patt, Mary Heimbecker CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Phil Willems, second by Erin Moran, to approve the Consent Agenda including all of the items listed below. Motion Passed. For: 6, Against: 0. 1 Approve November 16, 2019 and November 18, 2019 Village Board Minutes Motion to approve November 16, 2019 and November 18, 2019 Village Board Minutes. 2 Approve Schedule of Bills Motion to approve US Bank in the amount of $109,819, check numbers 78744-78760 totaling $75,181.24, and 78771-78783 totaling $25,558.07. 3 Approve Election Inspector Appointments Motion to approve Election Inspectors as presented for the 2020-2021 election cycle. 4 Approve Resolution Designating Snowmobile Routes and Trails in the Village of Waunakee Motion to approve the Resolution designating snowmobile routes and trails and the associated trail map. PUBLIC COMMENT Steve Monk (206 Winston Way) addressed the Village Board regarding his building permit. LICENSES/PERMITS 1 Discuss and Take Action on Operator License Applications for Andrew Fountaine, Patricia Doyle, and Herbert Van Driel Motion by Phil Willems, second by Bill Ranum, to approve operator license applications for Andrew Fountaine, Patricia Doyle, and Harbert Van Driel, subject to successful completion of an approved responsible beverage server training course and review by the Waunakee Police Department. Motion Passed. For: 6, Against: 0. NEW BUSINESS 1 Discuss and Take Action on Sale of Overhead Electric Line to American Transmission Company Motion by Joe Zitzelsberger, second by Kristin Runge, to approve the Resolution of the Waunakee Village Board Authorizing Sale of Transmission Assets to the American Transmission Company, LLC. Motion Passed. For: 6, Against: 0. 2 Discuss and Take Action on Sewer Rate Adjustment Motion by Phil Willems, second by Kristin Runge, to approve the sewer rate increase effective January 1, 2020. Motion Passed. For: 6, Against: 0. 3 Discuss and Take Action on Animal License Fee Increases Motion by Erin Moran, second by Phil Willems, to approve the revised dog license fees, as presented. Motion Passed. For: 6, Against: 0. 4 Discuss and Take Action on Ordinance repealing Section 2-331 of the Village Code concerning the Waunakee Economic Development Commission Motion by Phil Willems, second by Bill Ranum, to approve the ordinance repealing Section 2- 0331 of the Code of Ordinances, Village of Waunakee, concerning the Waunakee Economic Development Commission. Motion Passed. For: 6, Against: 0. 5 Discuss and Take Action on Utilization of Community Development Authority Motion by Phil Willems, second by Kristin Runge, to confirm appropriateness of the 2011 CDA creation resolution and direct staff to solicit interest for CDA appointments for consideration by the Village President and Village Board. Motion Passed. For: 6, Against: 0. 6 Discuss and Take Action on Settlement of ongoing litigation related to property at 844 Walter Run in the Village of Waunakee* The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(g) for the purpose of conferring with Motion by Phil Willems, second by Bill Ranum, to approve the settlement agreement pertaining to the property at 844 Walter Run in the Village, subject to final review and approval by the Village Attorney. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. ADJOURN *As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on Board meeting agendas to afford an opportunity for valued public comments. This is specifically listed on the agenda as PUBLIC COMMENT, during which citizens may share comments with the Board on items that do not appear on the agenda. The Village Board may not engage in back-and-forth discussion or take formal action during this period, as the subject items are not specifically listed. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments. Any person who has a qualifying disability as defined by the Americans with Disabilities Act that requires the meeting or materials at the meeting to be in an accessible location or format should contact the municipal clerk at (608) 850-8500, 500 West Main Street, Waunakee, Wisconsin, at least twenty-four hours prior to the commencement of the meeting so that any necessary arrangements can be made to accommodate each request.
