VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street December 20, 2021 6:00 PM Meeting Minutes CALL TO ORDER The December 20, 2021 Village Board meeting was called to order by President Chris Zellner at 6:00 p.m.. ROLL CALL Present: Nila Frye, Sam Kaufmann, Phil Willems, Chris Zellner, Erin Moran, Gary Herzberg, Bill Ranum Also Present: Todd Schmidt, Bryan Kleinmaier, Tim Semmann, Bill Frederick, Rick Moran, Ryan Endres, Gabe Altenbernd, Roberta Bauman CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and online availability) Public postings, official notices, and online availability were confirmed by Village Administrator Todd Schmidt for open meeting compliance. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. Motion by Nila Frye, second by Sam Kaufmann, to approve the Consent Agenda items #1-2 from the list below. Motion Passed: For: 6, Against: 0 1 Approve Schedule of Bills Approve check numbers 81509-81525 totaling $86,452.05, US Bank in the amount of $64,107.74, WEX in the amount of $5,924.03, and check numbers 81526-81548 totaling $320,849.02. 2 Approve Election Inspector Appointments Approve Election Inspectors as presented for the 2022-2023 election cycle. PUBLIC COMMENT* Mary Ellen Kearney (317 W. Main Street) spoke in favor of the aquatic facility PRESENTATIONS 1 Show and Tell: New Village Loader / Plow on Display Outside Village Hall Department of Public Works staff presented the new loader and answered questions. PUBLIC HEARING* 1 Public Hearing and Discussion/Action on an Ordinance Amendment to Create an Airport Overlay District Adjacent to the Waunakee Airport Following a presentation by Village staff, the public hearing regarding an ordinance amendment to create an airport overlay district adjacent to the Waunakee Airport was opened at 6:15 pm. No comments received. The public hearing was closed at 6:17 p.m. Motion by Gary Herzberg, second by Phil Willems, to approve the airport overlay zoning ordinance as presented as a separate division under article III districts, within chapter 133 zoning, of the municipal code. Motion passed: For: 7, Against: 0. 2 Public Hearing and Discussion/Action on a Request by Forward Development Group to Amend the General Development Plan for Woodland Crest to Allow Multi-Family on Outlot 1 at the Corner of Peaceful Valley Parkway and Simon Crestway Following a presentation by Village staff, the public hearing regarding a request by Forward Development Group to amend the general development plan for Woodland Crest to allow multi-family on outlot 1 at the corner of Peaceful Valley Parkway and Simon Crestway, was opened at 6:20 p.m. John Dooley (2611 Dublin Way) shared concerns on number of apartment complexes in the community. The public hearing was closed at 6:25p.m. There was as discussion on the apartment NEW BUSINESS 1 150th Village Sesquicentennial Proclamation and Sealing of Time Capsule Todd Schmidt presented the items to be included in the time capsule. Motion by Sam Kaufman, second by Nila Frye to approve the 150th village sesquicentennial proclamation and sealing of the time capsule. Motion passed: For: 7, Against:0. 2 Discuss and Take Action on Exceptional Performance Bonus for Police Officer Kara Christenson Chief Adam Kreitzman summarized the new role Officer Christenson took while office staff were out on leave. Motion by Chris Zellner, second by Erin Moran to approve exceptional performance bonus for Police Officer Kara Christenson. Motion passed: For: 7, Against: 0. 3 Discuss and Take Action on Proposed Amendments to Chapter 18, Article II of the Village of Waunakee Code of Ordinances Related to Transient Merchants. Motion by Sam Kaufman, seconded by Phil Willems to approve Amendments to Chapter 18, Article II of the Village of Waunakee Code of Ordinances Related to Transient Merchants with added language by the Village Attorney. Motion passed: For: 7, Against: 0. 4 Discuss and Take Action to Negotiate Employment Terms for Village Center Office Manager Candidate* Motion by Gary Herzberg, a second by Bill Ranum to convene in closed session at 7:35 PM as authorized by Wisconsin Statute 19.85(1)(c) for the purpose of considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. The Village Board may reconvene in open session and discuss and take action on the subject matter discussed in closed session. Roll Call Vote. Motion Passed: For: 7 – Nila Frye, Phil Willems, Bill Ranum, Chris Zellner, Erin Moran, Sam Kaufmann, Gary Herzberg. Against: 0. Motion by Bill Ranum, second by Sam Kaufman, to convene back into open session at 8:10 p.m. Motion passed. For: 7, Against: 0. Motion by Erin Moran, second by Bill Ranum, to authorize the new hire offer for the position of Village Center Office Manager with annual vacation allotment of two weeks upon hire, and immediate sick leave balance of 192 hours for specified purposes. Motion passed: For: 7, Against: 0. OLD BUSINESS 1 Discuss and Take Action on Community Aquatics Facilities Planning, Financial Impacts, and Review of Options Related to Referendum Process Todd Schmidt summarized the financial impacts projected. Bryan Kleinmaier explained the process of taking this item to referendum. There was a discussion amongst the Board with the direction to Staff for continued planning. No further action taken. ADJOURN Motion by Bill Ranum, second by Erin Moran, to adjourn at 8:12 p.m. Motion Passed: For: 7, Against: 0. Please check the posting board at the Village Hall, 500 W. Main Street, Waunakee, Wisconsin for the current agenda. ***Special Notice Regarding Pandemic Health Concerns*** The Board meetings have returned to pre-pandemic arrangements. The Board Chambers at Village Hall can accommodate about 50 public attendees without social distancing accommodations. Face coverings are required. The meeting room technology is not currently sufficient to allow for simultaneous virtual and in-person participation. Anyone wishing to participate during the “Public Comment” or “Public Hearing” items, but uncomfortable about attending in-person for any reason, is advised to contact Deputy Village Clerk Lynn Richardson at lrichardson@waunakee.com or (608) 850-2174 in advance of the meeting to supply a written statement to be read aloud. Note that time limits for public comments also apply to the reading of written statements. Also, systems are not yet in place to provide a quality live-streamed online meeting feed. The meeting will be video recorded and posted on a later date to the Village’s YouTube and Facebook pages. OLD BUSINESS 1 Discuss and Take Action on Community Aquatics Facilities Planning, Financial Impacts, and Review of Options Related to Referendum Process ADJOURN *As permitted by the Wisconsin open meetings law, the Village Board has chosen to list a public comment period on Board meeting agendas to afford an opportunity for valued public comments. This is specifically listed on the agenda as PUBLIC COMMENT. The Village Board may not engage in back-and-forth discussion or take formal action during this period. The Board may consider deferring the subject to a later meeting when specific notice can be given. Note: In general, Wisconsin law grants citizens the right to attend and observe open session meetings of the Village Board, but does not require allowing the public to speak or actively participate. The Village Board may determine if citizen participation will be allowed and to what extent. State statute and/or Village Code requires the Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment on the particular subject. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at his/her own discretion allow limited public comments. Any person who has a qualifying disability as defined by the Americans with Disabilities Act that requires the meeting or materials at the meeting to be in an accessible location or format should contact the municipal clerk at (608) 850-8500, 500 West Main Street, Waunakee, Wisconsin, at least twenty-four hours prior to the commencement of the meeting so that any necessary arrangements can be made to accommodate each request.
