VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street November 20, 2023 6:00 PM Meeting Minutes CALL TO ORDER The November 20, 2023 Village Board meeting was called to order by Village President Kristin Runge at 6:00 p.m. ROLL CALL Present: Nila Frye, Tricia Braun, Sam Kaufmann, Kristin Runge, Erin Moran, Joe Zitzelsberger and Robert McPherson. Also Present: Todd Schmidt, Renee Meinholz, Bryan Kleinmaier, Tim Semmann, Bill Frederick, Adam Kreitzman, Sue McDade, Erick Plumb and Jared Heyn CONFIRMATION OF OPEN MEETING COMPLIANCE (Public postings, official notices, and online availability) Public postings, official notices, and online availability were confirmed by Village Clerk Karla Endres for open meeting compliance. PUBLIC COMMENT* Isak Drangstveit, 1510 Centennial Pkwy- spoke on sustainability and the Village’s actions toward future sustainability efforts. CONSENT AGENDA Items under the consent agenda may be acted upon by one motion. If, in the judgment of any Board Member, a consent agenda item needs discussion, the item may be moved to later on the agenda for discussion and/or action. For: 7, Against: 0. 2 Public Hearing & Discussion/Action on a Request by Kennedy Family Limited Partnership for a Comp Plan Amendment/Rezone/CSM for Lands Generally Located North of Kennedy Rd. Along the West Side of the Railroad Tracks, ~ ½ mile west of STH 113 Opened Public Hearing at 6:16 pm David Kennedy, 702 West Street, clarified the name of the street is Kennedy Drive, not Kennedy Road Closed Public Hearing at 6:17 pm Motion by Kristin Runge, second by Tricia Braun to approve an ordinance that amends the Waunakee-Westport comprehensive plan, changing the use category for a five-acre parcel of land (PIN 0809-153-9330-5) located 500 feet north of Kennedy Drive along the west side of the railroad tracks from the ‘Community Residential’ to the ‘Parks and Open Space’ designation – contingent on approval of same by the Town of Westport Board. Motion passed. For: 7, Against: 0. Motion by Kristin Runge, second by Nila Frye to approve two (2) certified survey maps (CSM) for the purposes of clearly identifying lands that will be owned by Dane County and lands that will remain in the Kennedy Family, resulting in one 2-lot CSM located in the Village of Waunakee, along with one 3-lot CSM located in the Town of Westport and within the extraterritorial zoning area (ETZ). Motion passed. For: 7, Against: 0. Motion by Kristin Runge, second by Nila Frye to approve a rezoning request to rezone three parcels of land (PIN 0809-153-9330-5, 0809-222-8500-7, 0809-222- 8560-5) located in the extraterritorial zoning area (ETZ) from the A-3 zoning district to the A-1 zoning district. Motion passed. For: 7, Against: 0. 3 Public Hearing & Discuss & Take Action on 2024 Budget and 5-Year Equipment Replacement Plan. Opened Public Hearing at 6:28 pm No public comment. BUSINESS ITEMS 1 Discuss and Take Action on Options to Address Sustainability The suggestion was made that there be a special Board meeting to discuss the single topic of sustainability. Motion by Robert McPherson, second by Erin Moran to hold a special Board meeting on December 11, 2023 directly following the Plan Commission meeting. Motion passed For:7, Against: 0. 2 Discuss and Take Action on Ordinance recinding "No Mow May" Motion by Nila Frye, second by Sam Kaufmann to adopt “An Ordinance Amending Chapter 78, Article I of the Code of Ordinances, Village of Waunakee, to Remove the No Mow May Exemption”. Motion passed. For: 6, Against: 1 (Joe Zitzelsberger). 3 Discuss and Take Action on Policy for Remote Participation by Elected and Appointed Members of Village Boards, Committees, and Commissions Motion by Joe Zitzelsberger, second by Erin Moran to approve the Policy for Remote Participation by Elected and Appointed Members of Village Boards, Committees, and Commissions as it exists in the written policy. Motion by Robert McPherson, second by Joe Zitzelsberger to amend the motion to include the language Todd Schmidt to allow for circumstances where technical limitations or connectivity disruptions create a situation where virtual participation via video is impossible. In such cases the presiding official of said body shall be authorized to allow remote participation by phone or other similar means for all committee members and attendees. Motion passed For: 7, Against: 0. Action on the amended motion. Motion passed. For: 4, Against: 3(Robert McPherson/Sam Kaufmann /Nila Frye) Bryan Kleinmaier will review the conflicting language in the ordinance and the handbook regarding attendance percentage and bring it back before the Village Board. Motion by Joe Zitzelsberger, second by Robert McPherson to take item 5 before item 4 under business items. Motion passed. For: 7, Against: 0. 5 Discuss and Take Action on public improvements associated with intersection of State Highway 113 and Hogan Road and adjacent roadways, which may include an agreement with the Wisconsin Department of Transportation and other public improvement agreements Motion by Robert McPherson, second by Kristin Runge to approve the agreement subject to review and approval by Village Administrator and Village Attorney. Motion passed. For: 7, Against: 0 4 Discuss and Take Action on WPPA Union Contract* Motion by Tricia Braun, second by Erin Moran to enter into closed session at 8:25 pm. IN-PERSON: Public comment forms are available at the Board Room entrance. Please fill out and hand to staff prior to start of meeting. Comments are limited to three-minutes per person and must be delivered at the gallery podium for recording purposes. Accommodations can be provided for those unable to access the podium. VIRTUAL: When public comments are allowed, attendees on Zoom wishing to participate should click “raise hand” if on video or press *9 if on phone call. Attendees will be called on in the order in which hands are raised. Those wishing to provide oral comments remotely must have their full name displayed within the Zoom application and must state address of residence. Virtual comments are only allowed for those who reside, own or lease property in the Village of Waunakee. Anonymous comments will not be allowed. *As permitted by the Wisconsin open meetings law and while not required, the Village Board has chosen to allow public comments during their meetings. This is specifically listed on the agenda as PUBLIC COMMENT. The Village Board may not engage in discussion or take action during this period but may consider deferring the subject to a later meeting with notice. State statute and/or Village Code require the Village Board to hold PUBLIC HEARINGS on certain specified matters where the public can comment. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Board to allow public comment, however the meeting chairperson can at their own discretion allow limited public comments. Land Acknowledgment: The Village of Waunakee acknowledges that the land we occupy is Teejop, ancestral territory of the Hoocąkra (Ho-Chunk Nation), People of the Sacred Voice. Hoocąkra are stewards of these lands and waters since time immemorial. Settlers attempted to forcibly remove them from their homelands by exploiting a series of land cessions and treaties, including the Treaty of 1832. However, the Hoocąkra resisted these conquests and asserted their sovereignty as a nation. We address this trend of dispossession by upholding Hoocąk woošgąra (way of life), sovereignty, culture, language, and environmental practices. Acknowledging these atrocities is only the first step towards reconciliation. Through relationship building, education, and action, the Village will advocate for a shared future with the Hoocąkra Nation. Any person who needs an interpreter or has a qualifying disability as defined by the Americans with Disabilities Act that requires the meeting or materials at the meeting to be in an accessible location or format should contact the Village Clerk at (608) 850-8500 or kendres@waunakee.com at least forty-eight (48) hours prior to the commencement of the meeting.
