NEXT REGULAR MEETING DATE: TUESDAY– JULY 18, 2023 [NOTE: THE AUGUST 15, 2023 COUNCIL MEETING IS CANCELED.]  BILL # 9231 ORDINANCE # 9231 AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT TO DIFFERENT DYNAMICS TO ALLOW AN EDUCATIONAL FACILITY, SCHOOL FOR THE ARTS USE ON AN APPROXIMATELY 1.67-ACRE TRACT OF LAND IN AN EXISTING STRUCTURE AT 45 W LOCKWOOD AVENUE IN THE “D” COMMERCIAL DISTRICT AND MATTERS RELATED THERETO WHEREAS, the Zoning Code of Webster Groves provides the City Council may, by conditional use permit issued under the provisions of Section 53.140 and 53.159, authorize the use of property in the “D” Commercial District for an “Educational Facility, School for the Arts”; and WHEREAS, the property located at 45 W. Lockwood Avenue (the “Property”) is used for a place of worship most recently; and WHEREAS, Different Dynamics (the “Applicant”), is requesting a Conditional Use Permit to utilize the classroom spaces in the existing structure for classes which would fall under an educational facility, school for the arts use within a “D” Commercial District (the “Application”); and WHEREAS, the Application was referred to the City Plan Commission, which, after studying the Application and the recommendation of the Director of Planning and Development, and holding a public hearing on June 5, 2023, has recommended approval of the Application subject to certain conditions; and WHEREAS, the City Council gave due notice and held a public hearing on the Application at City Hall on July 5, 2023 at 7:30 p.m., where the Council heard and considered comments and suggestions by those present; and WHEREAS, the City Council has determined, in accordance with Section 53.176.b of the Zoning Code, that the existing building setbacks are not being changed and shall continue to govern structures on the Property; and WHEREAS, the City Council has determined, in accordance with the provisions of Chapter 53.170 et seq. of the Zoning Code, that granting the Applicant’s Conditional Use Permit will not: 1. Substantially increase traffic hazards or congestion; 2. Substantially increase fire hazards; 3. Adversely affect the character of the neighborhood; 4. Adversely affect the general welfare of the community; or 5. Overtax public utilities. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES:  Section 1. The City Council hereby approves a Conditional Use Permit to Different Dynamics to operate an educational facility, school for the arts use within an existing structure on an approximately 1.67 acre tract of land at 45 W. Lockwood Avenue within the “D” Commercial District, subject to the following conditions: 1. All provisions of the City Code shall apply except as expressly modified in this Ordinance #9231. 2. All activities of the Educational Facility, School for the Arts use shall be located within the existing structure of the subject property. 3. Hours of operation shall be limited to Mondays-Fridays 8 am-9 pm and Saturdays 10 am-2 pm. 4. This conditional use permit is personal to the owner and shall not run with the land. Section 2. This Ordinance shall not be printed in the Code of Webster Groves. Section 3. This Ordinance shall become effective immediately upon passage and approval. Passed and Approved this _____ day of _______________ 2023. _____________________________ Mayor ATTEST: ____________________________ City Clerk  BILL #9229 ORDINANCE #9229 AN ORDINANCE PERMITTING THE SUBDIVISION OF CERTAIN PROPERTY AT 818 HOLLAND AVENUE, AND 826 HOLLAND AVENUE WHEREAS, Jaqueline and Joseph Palazzolo and Karen Alexander (the “Owners”) -- who own certain property that is approximately 0.79 acres of land commonly referred to as 818 Holland Avenue and 826 Holland Avenue and that is more particularly described in the final subdivision plat which is attached hereto as Exhibit A and that is incorporated herein by this reference (hereinafter referred to as “the Property”) -- have requested a subdivision of the Property that is within the “A4” Seventy-Five Square Foot Residence District; and WHEREAS, one of the structures are currently non-conforming to the Zoning Code; and WHEREAS, the re-subdivision of the Property does meet all the requirements of the current version of the zoning code; and WHEREAS, consideration of the request was referred to the City Plan Commission, which, after studying the application and the standards and requirements of the Webster Groves Subdivision Ordinance, recommended approval of the requested subdivision to allow the existing structure to remain in place at 826 Holland Avenue until such time as it is reconstructed or required to be reconstructed pursuant to the regulations governing non-conforming uses; and WHEREAS, the owners are now requesting that the City Council give final approval to the subdivision of the Property; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Section 2. All future development at the subject properties shall meet the existing Municipal Code requirements. The establishment of this plat precludes current and future owners from obtaining setback variances from the Municipal Code at the subject properties. Section 3. This ordinance shall take effect and be in force from and after its passage and approval.  Passed and Approved this _____ day of ______________ 2023. ____________________________________ Mayor ATTEST: _____________________________ City Clerk  BILL #9230 ORDINANCE #9230 AN ORDINANCE AMENDING CHAPTER 60, THE TRAFFIC CODE, BY REPEALING ARTICLE IV, SECTION 60.160, SPEED REGULATION GENERALLY, AND AMENDING ARTICLE XVI, SECTION 60.940, SCHEDULE A “MAXIMUM SPEED FOR DESIGNATED STREETS” WHEREAS, the Police Department recommends amending Chapter 60, the Traffic Code, to clarify Official Maximum Speed Limits, and the City Council deems it to be in the best interest of public safety to enact this recommendation into law. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Chapter 60, Article IV, Section 60.160, Speed Regulation Generally, the following language is hereby Repealed: Section 60.160. Speed Regulation Generally. No person may operate a motor vehicle (except emergency vehicles on emergency runs) on any street, or public or private way, place or lot at any time at a rate of speed in excess of twenty- five (25) miles per hour, unless a higher/lower maximum rate of speed applicable to certain designated streets or portions thereof be fixed by ordinance and marked by signs erected at the beginning and end of such designated portions of such streets. The maximum speed limit upon such designated areas shall be as stated in Schedule A hereof. Section 2. Chapter 60, Article XVI, Section 60.940, Schedule A, “Maximum Speed for Designated Streets,” is hereby amended to reflect a new title as follows: Section 60.940. Schedule A – Maximum Speed for Designated Streets. Official Maximum Speed Limits, and shall read as follows, reassigning subsections a, b and c accordingly: a. No person may operate a motor vehicle (except emergency vehicles on emergency runs) on any street, or public or private way, place or lot at any time at a rate of speed in excess of twenty-five (25) miles per hour, unless a higher/lower maximum rate of speed applicable to certain designated streets or portions thereof be fixed by ordinance and marked by signs erected at the beginning and end of such designated portions of such streets. The maximum speed limit upon such designated areas shall be as stated in Schedule A hereof. b. In accordance with Article IV of this Chapter, all vehicles operating on and within the limits of the following designated streets or portions thereof shall operate at speeds as hereinafter provided in this and the following subsection: [NOTE: MAINTAINS THE EXISTING LIST OF STREETS AND SPEED LIMITS] c. The City Manager shall cause to be posted at all entrances to the City signs with black letters four (4) inches high and one (1) inch wide, on a white background, indicating the maximum speed of twenty-five (25) miles per hour unless otherwise posted, and shall Page 1  cause to be posted upon all of the streets listed in Paragraph 1 above similar signs with the designated speed for said streets thereon. . Section 3. This ordinance shall be printed in the Code of Webster Groves. Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5. This ordinance shall take effect and be in force from and after its passage and approval as provided by law. PASSED AND APPROVED this ___ day of ______________ 2023. __________________________________ MAYOR ATTEST: _____________________________ CITY CLERK Page 2  RESOLUTION #2023-30 RESOLUTION SETTING A GOAL OF ZERO ROADWAY FATALITIES AND SERIOUS INJURIES BY 2030 FOR THE SS4A (SAFE STREETS AND ROADS FOR ALL) PLANNING AND DEMONSTRATION GRANT WHEREAS, as part of the new Federal Transportation Bill, Infrastructure Investment and Jobs Act (IIJA), there is over $1B of roadway safety funding available in the form of Safe Streets and Roads for All (SS4A) grants. To be an eligible applicant for this new safety funding, a city MUST have an eligible Action Plan in place; and WHEREAS, the City of Webster Groves plans to apply for a SS4A grant to develop and supply an eligible Action Plan as part of the Planning and Demonstration Grant; and WHEREAS, the City of Webster Groves will commit to achieve significant declines in roadway fatalities and serious injuries; and WHEREAS, the Council of the City of Webster Groves recognizes the Action Plan and will assist in achieving the goal of a dramatic decrease in roadway fatalities and serious injuries and zero roadway fatalities and serious injuries by the year 2030; and WHEREAS, the Council of the City of Webster Groves desires to participate in a SS4A grant to develop and receive an eligible Action Plan for the City through the Planning and Demonstration Grant. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, that the City of Webster Groves does hereby request to be included in the Department of Transportation SS4A grant to develop Action Plans through the Planning and Demonstration Grant. Elm Ave. (See Exhibit B) Janet Noble, 333 N. Gore Ave., addressed concerns regarding the allowance of people to work out of their homes because a neighbor had been painting nearby and the fumes were interfering with her ability to work outside. She wanted to know the parameters of the ordinance or law that allows for this work. My remarks were made off‐the‐cuff as I did not read a prepared wri en statement, so please forgive me if my email below does not match perfectly with what I said last night. Plus, given overnight incuba on, I have also added a few new embellishments to help make my points). In summary, my main points were regarding the City’s DEI efforts, beginning with two personal stories: 1. I grew up in Kansas, a historically red state. My parents were both die‐hard Republicans and life‐long Episcopalians, or Chris ans. In 1975, I was a senior in college and my sister, Ka e, who is 5 years younger than me, was a junior in high school in Wichita, KS, when she came out as a gay lesbian woman. Ka e was called abnormal, unnatural, sick, a degenerate, and a sin against God. But Ka e stood her ground and was a Profile in Courage. Needless to say, she changed my world view and changed me for the be er forever. 2. My wife, Barb, who Marie knows and who Laura knows as a dear friend really well for the last 20 years, is for me the best example of some one who lives a DEI life without wearing it on her sleeve. I do not know anyone who embraces honesty, kindness, acceptance, respect, empathy and inclusion 1  more than Barb. Barb does not have goals perse. She has these core VALUES and she lives these values every single day in her work, family and daily life. I could share many stories that will blow you away about how she has been true to and lived these values. In short, every day, Barb uses her considerable powers for the forces of good and, in doing so, she has made a huge, las ng difference in people’s lives and created enduring friendships in the process. 3. To me, this is all I need to see in an overall DEI statement from the City, ie., a list of those core values that the City promises to live by and lead from every day, in every situa on. Versus the tradi onal concept of “Management by Objec ves”, it’s called “Leadership by Values.” 4. Back when my sister came out in 1975, homosexuality was the moral issue of the day. Today, transgender is the moral issue of today, as evidenced by the rash of an ‐transgender bills in Jefferson City and in many states across the country. I am privileged and fortunate to have as my friend a transgender male who grew up in Webster Groves and, just like my sister, Ka e, came out as a transgender male in high school. Sonja is now Banjo, and he is a nicest, sweetest and kindest kid you would ever want to meet. He just completed his sophomore year at Loyola University in New Orleans and he is a gi ed music prodigy. Just like my sister, Ka e, Banjo is a Profile in Courage. His gender iden ty just doesn’t ma er. What ma ers is that he is a fellow human being and should be treated with the same respect, honesty, kindness, acceptance, empathy and inclusion, and nothing less. 5. Laura, earlier you asked the Council what more could or should you be doing in the DEI area. Well, here is my response: that the City Council take and make a united stand and come out with a new and focused declara on in support of our transgender community and, likewise, take and make a united stand against all an ‐transgender bills in Jeff City and beyond. In short, for Council to be a Profile in Courage themselves and take a stand of courageous leadership in the name of humanity for all. Thank YOU! 2 PEACE. 3
