NEXT REGULAR MEETING DATE: TUESDAY – APRIL 16, 2024 ***NOTE: The July 16, 2024 Council Meeting Is Canceled*** BILL #9248 ORDINANCE #9248 AN ORDINANCE PERMITTING THE SUBDIVISION OF CERTAIN PROPERTY AT 407 FAIRVIEW AVENUE AND 415 FAIRVIEW AVENUE IN THE “A4” SEVENTY-FIVE HUNDRED SQUARE FOOT RESIDENCE DISTRICT WHEREAS, the Fleischer Living Trust and Bethania Danish Evangelical Lutheran Church of Webster Groves (the “Owners”) -- who own certain property that is approximately 0.715 acres of land commonly referred to as 407 Fairview Avenue and 415 Fairview Avenue and that is more particularly described in the final subdivision plat which is attached hereto as Exhibit A and that is incorporated herein by this reference (hereinafter referred to as “the Property”) -- have requested a subdivision of the Property that is within the “A4” Seventy-Five Square Foot Residence District; and WHEREAS, one of the structures are currently non-conforming to the Zoning Code; and WHEREAS, the re-subdivision of the Property does not meet all the requirements of the current version of the zoning code; and WHEREAS, consideration of the request was referred to the City Plan Commission, which, after studying the application and the standards and requirements of the Webster Groves Subdivision Ordinance, recommended approval of the requested subdivision to allow the existing structures to remain in place at 407 Fairview Avenue and 415 Fairview Avenue until such time as they are reconstructed or required to be reconstructed pursuant to the regulations governing non- conforming uses; and WHEREAS, the City Plan Commission also recommended approval of the requested subdivision where the property at 415 Fairview Avenue will not meet the minimum lot width and average lot width for the “A4” Seventy-Five Square Foot Residence District; and WHEREAS, the owners are now requesting that the City Council give final approval to the subdivision of the Property; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Perry, AICP, Director of Planning & Development MEETING DATE: March 4, 2024 PETITION: 24-PC-01 Tuxedo Park Block 5 Lots 43-46 Boundary Adjustment Plat LOCATION: 407 and 415 Fairview Avenue APPLICANT: Fleischer Living Trust and Bethania Danish Evangelical Lutheran Church of Webster Groves Proposal Summary The Fleischer Living Trust, property owners of 415 Fairview Avenue, and Bethania Danish Evangelical Lutheran Church of Webster Groves, property owners of 407 Fairview Avenue have submitted an Application for a Boundary Adjustment Plat to be known as “Tuxedo Park Block 5 Lot 43-46 Boundary Adjustment Plat”. The subject properties encompass approximately 0.715 acres of land. The subject properties are located within the “A4” Seventy Five Hundred Square Foot Residence District. Requested Action The City Plan Commission is requested to review the Application for a Subdivision and make a recommendation to the City Council. The City Council is tentatively scheduled to review the plat on Tuesday March 19, 2024. Land Use and Zoning History of Subject Site The approximately 0.715-acre area subject properties are zoned “A4” Seventy Five Hundred Square Foot Residence District. There is currently a single family dwelling and detached garage at 415 Fairview Avenue owned by The Fleischer Living Trust. According to St. Louis County records, the house was built in 1914. The detached garage was built in 2019. There is currently a Church and a single family dwelling with detached garage at 407 Fairview Avenue, owned by Bethania Danish Evangelical Lutheran Church of Webster Groves. According to church records and documentation, the church was built in 1904 and the single family dwelling which was a rectory building was built in 1920. The current ownership of the Church is still listed in the name of Bethania Danish Evangelical Lutheran Church of Webster Groves. In June of 2022, the Central State Synod of the Evangelical Lutheran Church in America (ELCA) voted to close the church. Before the plat is signed, the City will request for a legal determination on what party has the right to sign the plat on behalf of the church. Land Use and Zoning of Surrounding Properties North/East/South: The properties to the north, east and south are zoned “A4” Seventy Five Hundred Square Foot Residence District and contain single family residential structures. West: The property to the west is the Union Pacific Railroad. 2023 zoning map – existing lot lines 2018 Aerial map – existing lot lines STAFF ANALYSIS The applicants have proposed a boundary adjustment to transfer ownership of an approximately 1,011 square foot tract of land from 407 Fairview Avenue to the property at 415 Fairview Avenue. The land is located to the west of the existing lot at 415 Fairview Avenue. The transfer is to address the use and maintenance of the land by the owners at 415 Fairview. This agreement is the result of initial legal action on the property. In addition, the land which is still noted as Lot 44, 45 and 46 was merged under the 1956 Zoning Code. The code allows for land that has been under common ownership prior to 1956 to be deemed merged. These lots came under common ownership in 1933. When addressing boundary adjustment plats with those merged by the ordinance, the plat should be cleaned up and recorded properly. This plat will consolidate the lots on the plat while also adjusting the lot line between the two properties. Staff has prepared the following graphic to summarize the boundaries of the existing lots and the proposed changes. 2 The Plan Commission and City Council review of this proposal is necessary because the existing structures at both 407 and 415 Fairview Avenue do not meet the setbacks per the plat or in the “A4” Seventy Five Hundred Square Foot Residence District, nor would the lots established after the proposed boundary adjustment meet these requirements. Per Chapter 50 of the Municipal Code, which regulates the subdivision of land, each lot resulting from a Boundary Adjustment must meet the minimum width and area requirements of the applicable zoning district in which the lot is located. If the existing or proposed lots would not meet these requirements, they cannot be boundary adjusted without approval of the City Council. Per Section 53.073(g.), every lot in the “A4” Seventy Five Hundred Square Foot Residence District must have a minimum area of seventy five hundred (7,500) square feet, a minimum width at the front yard setback of not less than sixty (60) feet, and an average width of not less than sixty (60) feet. The existing lot at 415 Fairview Avenue as well as the proposed amended lot will not meet the minimum width at the front yard setback or the minimum average lot width requirements. The additional land will only bring the lot to be 56.73 feet wide at the front yard setback and at an average of 56.155 feet wide. Both of these will be below the minimum required sixty (60) feet. 3 Additionally, Plan Commission and City Council review are needed because the existing single family dwelling and detached garage at 407 Fairview Avenue will not meet the required setbacks on the proposed plat. Req’d 5’ Side Accessory Existing 4.79’ Proposed -1.20’ with easement 4 Per Section 50.060 of the Subdivision Code under Variations and Exceptions, the Plan Commission and City Council may vary or modify the regulations applicable to each proposed lot if it deems the strict enforcement of the regulations would entail unusual, real and substantial difficulties or hardships to the subdivider if at the same time the public welfare and interests of the municipality are fully protected and the general intent and spirit of the regulations preserved. Should the City Council approve the variances to the plat, staff would recommend that the ordinance approving the subdivision require all future development on the property to meet the current city code requirements. Establishing this plat would preclude the property owner and future owners from obtaining variances from the zoning code regarding development of these lots. Staff Recommendation Should the Plan Commission recommend to the City Council approval of the subdivision plat, Staff recommends the following conditions: 1. All provisions of the City Code shall apply except as expressly modified in this Ordinance #XXXX. 2. All future development at the subject properties shall meet the existing Municipal Code requirements. The establishment of this plat precludes current and future owners from obtaining variances from the Municipal Code at the subject properties. Action Action on the plat will be in the form of a motion for approval, approval with conditions or denial. The recommendation of the Plan Commission will be forwarded onto the City Council. PASSED AND APPROVED this _______day of ____________________ 2024. __________________ Mayor ___________________ City Clerk 3 RESOLUTION #2024-17 AUTHORIZING THE INCREASED EXPENDITURE OF $4,000 FOR THE PURCHASE OF AN AMBULANCE FROM AMERICAN RESPONSE VEHICLES ORIGINALLY APPROVED IN 2021 WHEREAS the City Council did approve Resolution #2021-67 authorizing the purchase of an ambulance from American Response Vehicles, 521 Hilldale Rd., Columbia, MO 65201, in the amount of $288,202.00 in December 2021; and WHEREAS the City Council did approve Resolution $2023-49 authorizing the increased cost of $15,350 in November 2023. NOW THEREFORE, BE IT RESOLVED, the City Council authorizes the expenditure increase of $4,000.00 for a total not to exceed $307,350.00 for the purchase of the new ambulance payable from the Capital Improvement Fund. Mayor ATTEST: City Clerk RESOLUTION #2024-18 AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT FOR OWNERS REPRESENTATIVE SERVICES DURING THE CONSTRUCTION OF THE WATER PARK, CONTINGENT UPON PASSAGE OF PROPOSITION W WHEREAS, the City desires to enter into an Owners Representative Services agreement during the construction of the Water Park; and WHEREAS, the proposal of Avison Young, 1401 S. Brentwood Blvd, Suite 900, St. Louis, Mo 63144, in the amount not to exceed $132,500.00, was determined to be the most advantageous proposal received in accordance with the specifications. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, that the City Manager is hereby authorized to enter into an agreement with Avison Young, for the sum hereinabove set forth, and to assure that all services are provided in accordance with specifications. BE IT FURTHER RESOLVED, that this agreement is contingent upon the passage of Proposition W by the residents of Webster Groves. The funds for this service shall be paid from the proceeds of Proposition W.
