NEXT REGULAR MEETING DATE: TUESDAY – NOVEMBER 19, 2024  BILL #9255 ORDINANCE #9255 AN ORDINANCE OF THE CITY OF WEBSTER GROVES, MISSOURI, AMENDING CHAPTER 70, BY ADDING A NEW SECTION 70.227, PROHIBITING THE POSSESSION, MANUFACTURE, TRANSPORT, REPAIR, AND SALE OF CERTAIN WEAPONS WHEREAS, Section 21.750 of the Missouri Revised Statutes permits political subdivisions to pass any ordinance that "conforms exactly with any of the provisions of sections 571.010 to 571.070;" and WHEREAS, Section 571.020 of the Missouri Revised Statutes prohibits the possession, manufacture, transport, repair, and sale of any firearm silencer or short-barreled rifle or shotgun in violation of federal law; and WHEREAS, Section 571.020 of the Missouri Revised Statutes prohibits the possession, manufacture, transport, repair, and sale of any machine gun in violation of federal law; and WHEREAS, federal law prohibits possessing, selling, and transferring machine guns, which include "switches/Glock switches," "auto-sears," "bump stocks," and any other parts or combination of parts designed to convert a weapon into one capable of firing more than one shot by a single function of the trigger. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Chapter 70, of the Code of Ordinances of the City of Webster Groves, Missouri, is hereby amended by adding a new Section 70.227, Prohibiting the Possession-manufacture- transport-repair-sale of prohibited weapons, and said section to read as follows: Sec. 70.227: Possession-manufacture-transport-repair-sale of prohibited weapons. (a) Definitions: (1) Machine gun. A "machine gun" is any firearm that is capable of firing more than one shot automatically, without manual reloading, by a single function of the trigger, regardless of whether the firearm was originally manufactured as a machine gun or was modified by a switch, Glock switch, auto sear, bump stock, trigger crank, or any other manufactured or homemade component. The word "machine gun" includes any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machinegun, and any combination of part from which a machinegun can be assembled if such parts are in the possession or under the control of a person. (2) Firearm silencer. A "firearm silencer" is any instrument, attachment, or appliance that is designed or adapted to muffle the noise made by the firing of any firearm. Page 1 of 2  (3) Short barrel. A "short barrel" is a barrel length of less than sixteen inches for a rifle and eighteen inches for a shotgun, both measured from the face of the bolt or standing breech, or an overall rifle or shotgun length of less than twenty-six inches. (4) Shotgun. A "shotgun" is any firearm designed or adapted to be fired from the shoulder and to use the energy of the explosive in a fixed shotgun shell to fire a number of shots or a single projectile through a smooth bore barrel by a single function of the trigger. (b) Unlawful possession, manufacture, transport, repair, or sale of a prohibited weapon. A person commits the unlawful possession, manufacture, transport, repair, or sale of a prohibited weapon if the person knowingly possesses, manufactures, transports, repairs, or sells a machine gun, firearm silencer, or short-barreled rifle or shotgun in violation of federal law. (c) Violation. Any person violating any provision of this section shall be deemed guilty of an ordinance violation. (d) Penalty. The punishment for violating any provision of this section shall be the same as the punishment for the ordinance violation of unlawful use of weapons, which is defined by Section and . (e) Severability. If any section, subsection, word, or phrase in this law is held unenforceable, invalid, or illegal, every other section, subsection, word, and phrase shall continue to have the full force and effect of law. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. This Ordinance shall be printed in the Code of Webster Groves. Section 4. This Ordinance shall become effective immediately upon passage and approval. Passed and Approved this day of 2024. Mayor ATTEST: City Clerk Page 2 of 2  BILL #9256 ORDINANCE #9256 AN ORDINANCE OF THE CITY OF WEBSTER GROVES, MISSOURI, AMENDING CHAPTER 70, BY ADDING A NEW SECTION 70.226 RELATED TO THE UNLAWFUL TRANSFER OF WEAPONS TO A MINOR AND FAILURE TO REPORT A STOLEN OR LOST DEADLY WEAPON OR EXPLOSIVE WHEREAS, Section 21.750 of the Missouri Revised Statutes permits political subdivisions to pass any ordinance that “conforms exactly with any of the provisions of sections 57.010 to 571.070” and Section 21.750.3 allows a political subdivision to pass an ordinance eliminating the open carrying of firearms to those who possess a valid concealed carry endorsement or permit. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: WHEREAS, for the purposes of Missouri's prohibition on delivering firearms to minors, Section 571.010 defines "firearm" as "any weapon that is designed or adapted to expel a projectile by the action of an explosive;" and WHEREAS, Section 21.750 of the Missouri Revised Statutes permits political subdivisions to pass any ordinance that conforms exactly with any of the provisions of sections 571.010 to 571.070." NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Chapter 70, of the Code of Ordinances of the City of Webster Groves, Missouri, is hereby amended by enacting a new Section 70.226, Unlawful transfer of weapons; parental or guardian consent for delivery of a firearm to minors; failure to report stolen or lost firearm, and said section shall read as follows: Sec. 70.226. Unlawful transfer of weapons; parental or guardian consent for delivery of a firearm to minors; failure to report stolen or lost firearm. (a.) Definitions (1) Recklessly. The word "recklessly" as used in this section means a person who consciously disregards a substantial and unjustifiable risk that circumstances exist or that a result will follow, and such disregard constitutes a gross deviation from the standard of care which a reasonable person would exercise in the situation. (2) Minor. The word "minor" as used in this section means a person less than 18 years old. (3) Bullet-Cartridge. An object consisting of a cartridge case, primer, powder, and projectile arranged in such a way that the projectile can be expelled by the action of an explosion. Page 1 of 3  (4) Deadly weapon. as used in this section, shall have the same definition as found in RSMo § 556.061. (5) Explosive. as used in this section, shall have the same definition as found in RSMo § 319.303. (6) Concealed. The word "concealed" means kept hidden or removed from sight and either on one's person or within a person's reach. (7) Handgun. The word "handgun" as used in this section means a firearm which has a short stock and is designed to be held and fired by the use of a single hand. (b) Unlawful transfer of a weapon. A person commits the unlawful transfer of a weapon if the person recklessly sells, leases, loans, gives away or delivers any firearm, which includes a bullet-cartridge, to a minor without the consent of the minor's custodial parent or guardian; provided, that this does not prohibit the delivery of such weapons to any peace officer or member of the Armed Forces or National Guard while performing the officer's or member's official duty. (c) Failure to report a stolen or lost deadly weapon or explosive. A person commits the unlawful failure to report a stolen or lost deadly weapon or explosive if the person owns a deadly weapon or explosive and knowingly fails to report the theft or loss of such weapon or explosive to the police department within 72 hours of the time such person knew or should have known the weapon or explosive has been stolen or lost. (d) Exception. The provisions of this section shall not apply to the following places: (e) Violation. A person violating this section shall be guilty of an ordinance violation. (f) Penalty. Any person violating any of the provisions of this Chapter shall upon conviction be punished by a fine of not less than Twenty-Five Dollars ($25.00), nor more than Five Hundred Dollars ($500.00). (g) Severability. If any section, subsection, word, or phrase in this law is held unenforceable, invalid, or illegal, every other section, subsection, word, and phrase shall continue to have the full force and effect of law. Section 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3. This Ordinance shall be printed in the Code of Webster Groves. Section 4. Mayor ATTEST: City Clerk Page 3 of 3  BILL #9271 ORDINANCE #9271 AN ORDINANCE OF THE CITY OF WEBSTER GROVES, MISSOURI, AMENDING CHAPTER 70, BY ADDING A NEW SECTION 70.228 RELATED TO CARRYING A WEAPON IN PUBLIC BUILDINGS AND FAILURE TO LEAVE WHEN REQUESTED WHEREAS, Section 21.750 of the Missouri Revised Statutes permits political subdivisions to pass any ordinance that “conforms exactly with any of the provisions of sections 57.010 to 571.070” and Section 21.750.3 allows a political subdivision to pass an ordinance eliminating the open carrying of firearms to those who possess a valid concealed carry endorsement or permit. WHEREAS, Section 21.750.3 allows a political subdivision to pass an ordinance eliminating the open carrying of firearms to those who possess a valid concealed carry endorsement or permit. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. An ordinance of the City of Webster Groves, Missouri, amending Chapter 70, by adding a new Section 70.228 related to carrying a weapon in a public building and failure to leave when requested to do so and said section shall read as follows: Sec. 70.228 Carrying a weapon in a public building and failure to leave when requested (A). Concealed weapons in city buildings. (1) No person who has a concealed carry endorsement issued by the Missouri director of revenue under Section 571.094 RSMo. who has been issued a valid permit or endorsement to carry concealed firearms issued by another state or political subdivision of another state, shall, by authority of that endorsement or permit, be allowed to carry a concealed firearm or to openly carry a firearm in any building or portion of a building owned, leased or controlled by the city. (2) Signs shall be posted at each entrance of a building entirely owned, leased or controlled by the city stating that carrying of firearms is prohibited. Where the city owns, leases or controls only a portion of a building, signs shall be posted at each entrance to that portion of the building stating that carrying of firearms is prohibited. (3) This section shall not apply to buildings used for public housing by private persons, highways or rest areas, firing ranges, or private dwellings owned, leased or controlled by the city. (4) Any person violating this section may be denied entrance to the building or ordered to leave the building. No other penalty shall be imposed for a violation of this section. Page 1 of 2  (5) Prior to July 1, 2004, when the director of revenue begins issuing concealed carry endorsements, no person who has been issued a certificate of qualification which allows the person to carry a concealed firearm shall, by authority of that certificate, be allowed to carry a concealed firearm or to openly carry a firearm in any building or portion of a building owned, leased or controlled by the city. (B.) Failure to leave locations where carrying concealed weapons is not permitted. (1) Prohibition carrying concealed weapons in unauthorized locations. A person who has been issued a concealed carry endorsement, a certificate of qualification, or permit or endorsement issued by another state or political subdivision in another state, and is carrying a concealed weapon, shall not enter, and if already within the location must leave when requested, the premises for locations named in Section 571.107.1(1) through (17), RSMo. (2) Penalty. If such person refuses to leave the premises and a peace officer is summoned, such person may be issued a citation. A fine may be imposed according to the following schedule: First offense: Not to exceed $100.00. Second offense within six months of the date of the first offense: Not to exceed $250.00. Third offense within 12 months of the date of the first offense: Not to exceed $500.00. (3) Duty of court administrator. The court administer will provide a notice to the sheriff of the county which issued the certificate of qualification for a concealed carry endorsement and the department of revenue of the imposition of such fines. Section 3. This Ordinance shall be printed in the Code of Webster Groves. Section 4. This Ordinance shall become effective immediately upon passage and approval. Passed and Approved this day of 2024. Mayor ATTEST: City Clerk Page 2 of 2  BILL #9272 ORDINANCE #9272 AN ORDINANCE GRANTING A LOT SPLIT SUBDIVISION AT 2801 BRECKENRIDGE INDUSTRIAL COURT, ZONED “E” INDUSTRIAL DISTRICT WHEREAS, Omni Investments, Inc. (the “Owner”) the owner of certain real property located at 2801 Breckenridge Industrial Court, more particularly described in the Lot Split Plat 2801 Breckenridge Industrial Court which is attached hereto as Exhibit “A” and incorporated herein by reference (hereinafter referred to as “the Property”), have requested a subdivision of the property into two (2) lots; and WHEREAS, the Property was created as Lot 6 of Breckenridge Industrial Park a subdivision approved by the City Council of the City of Webster Groves on August 21, 1984 through Ordinance #7312; and WHEREAS, the Property is currently improved with structures and pavement, no additional development is proposed at this time, and the proposed use of Lot 6B is outdoor storage on previously paved surfaces; and WHEREAS, the Property is located within the Floodway and Floodway Fringe of Deer Creek as indicated on effective Flood Insurance Rate Maps as adopted by the City of Webster Groves, and the proposed Lot Split Plat conforms with the City of Webster Groves Flood Damage Prevention Code; and WHEREAS, Lot 6 of Breckenridge Industrial Park is subject to private Permanent Easements which allow for a previous property owner, the City of Brentwood, to stabilize, modify, and maintain the creek bank and retaining wall currently extending along the northern boundary of the Property; and WHEREAS, St. Louis County has assigned Lot 6A the address of 2801 Breckenridge Industrial Court and Lot 6B the address of 8201 Exchange Way; and WHEREAS, the proposed Lot 6B fronts on and takes access from Exchange Way, a privately maintained street; and WHEREAS, the Director of Planning and Development has reviewed the proposed lot split in accordance with the provisions of Section 50.015 of the City Code, and of Chapter 53 (the Zoning Code) of the City Code, for area and setback requirements for both resulting lots; and WHEREAS, the Director has referred this matter to the City Council as per Section 50.015 of the City Code; and WHEREAS, the City Council finds that the proposed lot-split subdivision is not in violation of any provision of Chapters 50, 53, or 80 of the City Code.  NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. It is agreed by the Council that the City of will participate in Missouri's Highway Safety Program. It is further agreed by the Council that the Chief of Police will investigate the financial assistance available under the Missouri Highway Safety Program for Traffic Enforcement and report back to the Council his/her recommendations. When funding through the Highway Safety Division is no longer available, the local government entity agrees to make a dedicated attempt to continue support for this traffic safety effort. The vendor was George Butler Associates, 16305 Swingley Ridge Road, Ste. 300, Chesterfield, MO 63017, in the amount not to exceed $199,657.00. Funds for this project were charged to the Stormwater Improvement Fund. BE IT FURTHER RESOLVED, that additional funding is needed to complete this project in the amount of $42,419.40.
