NEXT REGULAR MEETING DATE: TUESDAY – DECEMBER 3, 2024  BILL #9272 ORDINANCE #9272 AN ORDINANCE GRANTING A LOT SPLIT SUBDIVISION AT 2801 BRECKENRIDGE INDUSTRIAL COURT, ZONED “E” INDUSTRIAL DISTRICT WHEREAS, Omni Investments, Inc. (the “Owner”) the owner of certain real property located at 2801 Breckenridge Industrial Court, more particularly described in the Lot Split Plat 2801 Breckenridge Industrial Court which is attached hereto as Exhibit “A” and incorporated herein by reference (hereinafter referred to as “the Property”), have requested a subdivision of the property into two (2) lots; and WHEREAS, the Property was created as Lot 6 of Breckenridge Industrial Park a subdivision approved by the City Council of the City of Webster Groves on August 21, 1984 through Ordinance #7312; and WHEREAS, the Property is currently improved with structures and pavement, no additional development is proposed at this time, and the proposed use of Lot 6B is outdoor storage on previously paved surfaces; and WHEREAS, the Property is located within the Floodway and Floodway Fringe of Deer Creek as indicated on effective Flood Insurance Rate Maps as adopted by the City of Webster Groves, and the proposed Lot Split Plat conforms with the City of Webster Groves Flood Damage Prevention Code; and WHEREAS, Lot 6 of Breckenridge Industrial Park is subject to private Permanent Easements which allow for a previous property owner, the City of Brentwood, to stabilize, modify, and maintain the creek bank and retaining wall currently extending along the northern boundary of the Property; and WHEREAS, St. Louis County has assigned Lot 6A the address of 2801 Breckenridge Industrial Court and Lot 6B the address of 8201 Exchange Way; and WHEREAS, the proposed Lot 6B fronts on and takes access from Exchange Way, a privately maintained street; and WHEREAS, the Director of Planning and Development has reviewed the proposed lot split in accordance with the provisions of Section 50.015 of the City Code, and of Chapter 53 (the Zoning Code) of the City Code, for area and setback requirements for both resulting lots; and WHEREAS, the Director has referred this matter to the City Council as per Section 50.015 of the City Code; and WHEREAS, the City Council finds that the proposed lot-split subdivision is not in violation of any provision of Chapters 50, 53, or 80 of the City Code.  NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WEBSTER GROVES, MISSOURI, AS FOLLOWS: Section 1. Alexander (Joined at 7:09 P.M.) A quorum was present. Also present: Neil Bruntrager, City Attorney Katie Nakazono, City Clerk Renee Tyler, Deputy City Manager - Community Vitality PROCLAMATION Mayor Arnold and the City Council proclaimed November as Native American Heritage Month. REMARKS FROM THE COMMUNITY AND VISITORS Dave Buck, 6 Colonial Village, spoke on several topics. He expressed that he misses Eric Peterson. He thanked Robert Myers for the impact he has made in his short tenure and wished him well. He thanked Plan Commission Chair, Jeff Smith, and the entire commission for their work on KVC, and running a long but orderly meeting. He noted Councilmember Hixson Shepherd and Attorney Bruntrager showed great leadership as liaisons for the Commission. He is pleased with the unanimous rezoning approval that will now go before Council, and he appreciates Council’s upcoming vote on the three gun control bills later this evening. He also acknowledged Native Heritage Month, and used it to segue into his promise to keep advocating for peace making to be a priority for City Council and City Hall. He noted upcoming community events: the 3rd Annual Webster Sings Amateur Singing Talent Show Contest is this Saturday, 7:00pm – 9:00pm at the Community Music School in the Concert Hall. The following week is the 2nd Annual Webster Grooves Community Dance Party, held November 16, 7:30pm – 10:30pm at the Masonic Temple, featuring Arvell & Company. NEW BUSINESS – MAYOR, COUNCILMEMBERS, CITY ATTORNEY, CITY MANAGER Mayor Arnold and Deputy City Manager, Renee Tyler, gave updates on the flooding that occurred overnight and this morning. A handful of residents have already reported flooding events to the City. Most of the majorly flooded streets are open as of 5:00 p.m. N Forest, E Pacific, E Jackson, and Deer Creek Park are open. Marshall and Kirkham were still closed at 5:00 p.m. They may be open now. November 05, 2024 Ms. Tyler thanked Fire, Police, Public Works, Parks & Recreation, and Planning for jumping into crisis mode at 5 am this morning. She gave a special shout out to Chief Ellis. She noted that emergency responses were also a multi-city/mutual-aid event. Response actions included stranded vehicles, streets blocked by limbs or down trees, monitoring and taking precautions at Schnucks’ parking lot, and a water rescue at N Laclede Station & Marshall that involved Brentwood and Maplewood. The City is working with the County to make sure Webster Groves is considered for disaster relief funds, including FEMA monies. Planning Director Robert Myers has put together a summation of known buildings (houses, condos, apartments, and industrial buildings) impacted by severe flooding. A longer report will be forthcoming with more solid data. This week there will be continued monitoring and reevaluations. Mayor Arnold noted that she has been in contact with County Councilmember Lisa Clancy, on behalf of County Executive Sam Page, State Representative Jo Doll, and Congressman Wesley Bell are also aware of the flooding event. A self-reporting impact study is being designed and will be available as soon as possible to residents. Its goal will be to identify who was impacted, where damages occurred (and how). As well, the data will help identify where the Stormwater Management Plan might need adjustments that could affect the capital improvement fund. It will be available on the City website and widely distributed through social media platforms. Chief Acevez has come up with a set of questions. The next step is to review it with the Public Information Officer so that the survey is framed in the best possible manner to elicit data needed by the County as to the monetary need, and or a declaration at the federal level. Known City properties impacted include Deer Creek Park, and the new water park construction. The new water park construction is affected because the heavy rains caused the embankment walls to slump off. Deer Creek had special circumstances in its flooding from chemicals dumped into the park as a result of flooding. The City is working with MSD on this issue. The pedestrian bridge, (Deer Creek) between Maplewood and Webster Groves, needs to be evaluated by the GRG engineering team before it can be reopened. A baseball field has been ruined, and its backstop fence has been destroyed. There will be an inventory of park amenities that may have been washed downstream or otherwise damaged. The City will provide dumpsters in several places that should be easily accessible to residents. Mayor Arnold said there might be updates at the November 19 meeting, and on behalf of herself and Council, she thanked all staff and departments for their actions in this all hands-on-deck situation.
