CALL TO ORDER Mayor Margolis called the meeting to order at 7:00 p.m. Council Members present: Bob Margolis, Mayor; John Greene, Vice Mayor; Anne Gerwig, Councilwoman; and John T. McGovern, Councilman. Council Member Not in Attendance: Matt Willhite, Councilman. 2. PLEDGE OF ALLEGIANCE Mayor Margolis led the Pledge of Allegiance. 3. INVOCATION Deacon Al Payne, St. Therese de Lisieux Catholic Church, Wellington, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Schofield presented the agenda recommending approval as amended: 1)Add to Presentations and Proclamations the introduction of the newest PBSO Deputy Bates and Leo as item 5B. 2) He recommended removing consent agenda item 6B Authorization to Award a Contract for the Stratford Area Water Main Replacement Project and move to regular agenda as item 8B. 3)Remove Consent agenda item 6D Resolution no. R2016-014 Special Use Permit for GPL Polo Event which has been withdrawn by the applicant. 4)Add Resolution No. 2016-020 as item 8C. A motion was made by Vice Mayor Greene, seconded by Councilman McGovern, and unanimously passed (4-0), to approve the Agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS A. 15-1057 PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA CONGRATULATING WELLINGTON HIGH SCHOOL STUDENT AHMMON RICHARDS FOR BEING SELECTED TO PLAY IN THE UNITED STATES ARMY ALL-AMERICAN BOWL FOOTBALL GAME AND RECOGNIZING HIM ON HIS MANY OUTSTANDING FOOTBALL ACCOMPLISHMENTS Mr. Schofield introduced the item. Ms. Callovi read the proclamation. Council congratulated Mr. Richards on his many athletic achievements, awards, academic accomplishments, leadership and community involvement. Mr. Richards spoke briefly about how he balances his football and academic commitments. Council watched a short video of Mr. Richards as Wellington’s Hometown Hero. B. INTRODUCTION OF WELLINGTON'S NEW K-9 DEPUTY "LEO" AND HIS PARTNER DEPUTY SCOTT BATES Village of Wellington Page 1 Village Council Action Summary - Final February 23, 2016 Mr. Schofield introduced the agenda item. Deputy Scott Bates introduced his new K-9 partner, Leo, an 18-month old German Shepard Belgian Malinois mix. He stated Leo has been a great dog as he goes through the K-9 Academy he will be trained in narcotics detection and criminal apprehension. Deputy Bates thanked Council for the opportunity to introduce Leo. 6. CONSENT AGENDA Mr. Schofield presented the agenda recommending approval as amended. Mayor Margolis indicated no public comment cards were received for the Consent Agenda. A motion was made by Councilwoman Gerwig, seconded by Councilman McGovern, and unanimously passed (4-0), approving the Agenda as presented. Mayor Margolis indicated no comment cards were received for the Public Forum. Mr. Schofield mentioned, as part of the Consent Agenda, the Village received a $200,000 grant from the State of Florida to fund waterfront improvements to the new Community Center and staff would move forward with a press release and invited Council to take a picture with the check. Vice Mayor Greene asked for a recap of the budget numbers. Mr. Schofield stated they were within the budget, as approved by Council, and on schedule with a “Topping-Off” Ceremony scheduled to take place at the Community Center on February 29th. Ms. Quickel indicated they were on budget and they periodically publish the expenditures to date. She said the Tennis Center was basically complete and the punch list was being finalized. She explained they budget for the grant funds when they were received and staff was working and applying for other grants related to the Community Center, so they were hoping to receive some additional funding. Mr. Barnes stated the Tennis Center came in on budget. He said what Mayor Margolis referenced at a previous meeting was actually sales tax and incentive savings. He explained the overall number referenced was what the Village had to do in direct purchase orders, so that did not reflect the savings. He said the savings is 6% of that number, which is approximately $40,000 for the Tennis Center. At this point, Council had their photograph taken with the $200,000 check for the press release. This item was approved on Consent. C. 15-1069 RESOLUTION NO. R2016-16 (LAND AND WATER CONSERVATION FUND PROGRAM GRANT) AND RESOLUTION NO. PUBLIC HEARINGS A. 15-973 ORDINANCE NO. 2016-01 (VILLAGE PROFESSIONAL PARK ANNEXATION) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, PROPOSING THE VOLUNTARY ANNEXATION (PETITION NUMBER 15-80 / 2015 - 42 ANX 1) OF REAL PROPERTY COMPRISING OF 10.5 ACRES, MORE OR LESS, LOCATED APPROXIMATELY 600 FEET WEST OF STATE ROAD 7 AND APPROXIMATELY .5 MILES NORTH OF FOREST HILL BOULEVARD IN PALM BEACH COUNTY, FLORIDA, KNOWN AS THE “VILLAGE PROFESSIONAL PARK,” MORE PARTICULARLY DESCRIBED HEREIN; DECLARING THAT THE VOLUNTARY ANNEXATION PETITION BEARS THE SIGNATURE OF THE PROPERTY OWNER; AMENDING SECTION 11 OF THE VILLAGE CHARTER BY REDEFINING THE CORPORATE LIMITS OF THE VILLAGE OF WELLINGTON; DIRECTING THE VILLAGE MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS ANNEXATION; DIRECTING THE VILLAGE CLERK TO FILE A COPY OF THIS ORDINANCE WITH THE CLERK OF THE CIRCUIT COURT IN PALM BEACH COUNTY, THE CHIEF ADMINISTRATIVE OFFICER OF PALM BEACH COUNTY, AND THE FLORIDA DEPARTMENT OF STATE WITHIN SEVEN DAYS AFTER ADOPTION, IN ACCORDANCE WITH CHAPTER 171 OF THE FLORIDA STATUTES; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the item. He stated this was the second reading and no changes were made from the first reading. Ms. Callovi read the Ordinance by title. Ms. Cohen swore in those individuals who would be giving testimony on this item. Ex-Parte Communications Each member of Council disclosed their ex-parte communicaitons. Mr. Basehart presented the staff report. Public Hearing A motion was made by Vice Mayor Greene, seconded by Councilman McGovern, and unanimously passed (4-0) to open the Public Hearing. A motion was made by Vice Mayor Greene, seconded by Councilman McGovern and unanimously passed (4-0) to approve Ordinance No. 2016-01 on Second Reading as presented. D. 15-1076 RESOLUTION NO. R2016-014 (SPECIAL USE PERMIT FOR GPL POLO EVENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A SPECIAL USE PERMIT FOR THE 7th ANNUAL GPL POLO EVENT UTILIZING OUTDOOR AMPLIFIED MUSIC TO BE HELD AT 3665 120th AVENUE SOUTH; AND PROVIDING AN EFFECTIVE DATE. THIS ITEM HAD BEEN WITHDRAWN 8. REGULAR AGENDA A. 15-1072 OUTSIDE LEGAL FEES AND COSTS Mr. Schofield introduced the item. Ms. Cohen presented the staff report. B. 15-1058 AUTHORIZATION TO AWARD A CONTRACT FOR THE STRATFORD AREA WATER MAIN REPLACEMENT PROJECT Mr. Schofield introduced the item. Mr. Riebe presented the staff report. Mayor Margolis indicated no public comment cards were received. R2016-20 (SUPPORTING IMPROVEMENTS TO THE CHAIN OF LAKES, THE OCEAN TO TRAILS INITIATIVE AND DEVELOPMENT OF A BOAT LIFT AT THE C51 CANAL S155 CONTROL STRUCTURE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL, SUPPORTING AND ENCOURAGING EFFORTS BY THE TOWN OF LAKE CLARKE SHORES AND NEIGHBORING MUNICIPALITIES TO PROCEED WITH IMPROVEMENTS TO THE CHAIN OF LAKES, THE OCEAN TO TRAILS INITIATIVE AND DEVELOPMENT OF A BOAT LIFT AT THE C51 CANAL S155 CONTROL STRUCTURE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the item and read the resolution by title. Mr. Schofield presented the staff report. Mayor Margolis indicated no public comment cards were received. PUBLIC FORUM Mayor Margolis indicated no public comment cards were received. 10. ATTORNEY'S REPORT Ms. Cohen presented the following report: • Ms. Cohen stated she sent Council a memo regarding the outcome of the hearing last Friday. She said it was dismissed, so the Village prevailed in that action. • She indicated there is a hearing on Thursday, February 25th at 9:30 a.m. in the permit case; a Motion for Summary Judgment. She said the other party has moved for a continuance, but she did not know if the court will grant it. She stated the Village would be in opposition to that. 11. MANAGER'S REPORTS Mr. Schofield presented the following report: • The next regular Council Meeting will be held on Tuesday, March 8, 2016, in the Council Chambers at 7:00 PM. • There is a “Topping Off” Ceremony for the Wellington Community Center on Monday, February 29th at 10:00 AM. • The Twelfth Annual Wellington Wolves March Madness Basketball Tournament takes place on March 4th through 6th at Village Park and other gymnasiums around the Village. There are over 100 teams expected to participate. • Early voting for the Presidential Primary and Municipal Elections will be held Saturday, March 5th through Sunday, March 13th from 10:00 a.m. to 6:00 p.m. daily at the Wellington Branch Library. There are other voting locations in Palm Village of Wellington Page 5 Village Council Action Summary - Final February 23, 2016 Beach County as well. • Plans are in the works for celebrating Wellington’s 20th Anniversary, scheduled for Saturday, March 19th and kicks off at 10:00 a.m. here with free admission at the Aquatics Center until 4:00 p.m. with a variety of other events. 12. COUNCIL REPORTS Councilwoman Gerwig presented the following report: • Councilwoman Gerwig stated Saturday, March 5th is the kick-off at Ultima for the Let’s Move campaign. She hoped they could participate and get healthy together as a community. • She stated she was wearing purple for the Relay for Life for the American Cancer Society and invited everyone to Lindburgers after the meeting, as Relay for Life will get a percentage of the proceeds if they mention it. Vice Mayor Greene presented the following report: • Vice Mayor Greene congratulated Mr. Richards once again, as he is a great example of so many of the residents in their community. He said at every meeting they have another group of athletes or academic stars that demonstrate what this community is really about. He stated the kids are great and the local educators work hard to ensure these kids have a balanced life between the academics and athletics and wished Mr. Richards the best in Miami, as he was sure he was going to represent Wellington very well. • He stated there was so much going on at the Amphitheater; Thursday, Friday and Saturday nights are basically at capacity and has become such a great attraction. He thought it would be great when the Community Center is complete and they open up the entire complex and have more grass. He said Joe Piconcelli was doing a great job, as the crowds seem to love the talent that comes out. He stated it was exceptional to see the people gather and enjoy what the Village has spent a lot of money to provide. He thanked everyone for coming out and supporting it. He said it was for them, as it was their money and their Village and said he was proud to be a part of it. Councilman Willhite was not present at the meeting. Councilman McGovern presented the following report: • Councilman McGovern also thought what was happening at the Amphitheater and the whole complex was moving in the right direction. For the youngsters, he said this Friday, February 26th at 7:30 p.m., Minions the movie, will be playing at the amphitheater and the Green Market continues this weekend and next weekend. • He mentioned Wellington Little League’s opening day is Saturday, February 27th at 8:30 a.m. at Olympia Park. He stated it was very exciting last year, so he hoped everyone would come out. He said that was one of their greatest sport programs and a great day. • He stated the Chamber of Commerce will be hosting the ColorFest run this weekend. He wished everyone participating in that event the best of luck. • Regarding the 20th Anniversary Celebration of the Village of Wellington, he said the event on March 19th at Village Park from 5:00 p.m. to 10:00 p.m. is going to be a smaller version of the forth of July; with bounce houses, trapeze, musical acts and fireworks. He thought it was going to be a great time to celebrate, so he hoped everyone would be there. • He stated there has been a lot of discussion about the election. He announced three upcoming debates will be held: tomorrow, February 24th, the Wellington Chamber is hosting a debate at the Wanderer’s Club; February 29th Village of Wellington Page 6 Village Council Action Summary - Final February 23, 2016 at 6:00 PM the Florida Alliance for Retired Americans is hosting a debate at the old Wellington Mall; and in this Chamber on March 7th the Council of Community Associations is having a debate. He encouraged everyone to come hear what the candidates have to say. • He stated early voting was at the Wellington Library, but voters could early vote the Wellington Ballot at any early voting site in Palm Beach County and encouraged everyone to be active in the process and vote. Mayor Margolis presented the following report: • Mayor Margolis stated he read an article in the Palm Beach Post today that reported that Binks Forest has been sold to a golf management company and an unknown other person, and they were going to bring the course back to what it was a long time ago. He thought that was good news for the Binks Forest residents and thanked the reporter for provided the report. 13.
