CALL TO ORDER Council Members present: Bob Margolis, Mayor, John Greene, Vice Mayor, Matt Willhite, Councilman, Anne Gerwig, Councilwoman, and John T. McGovern, Councilman. Mayor Margolis called the meeting to order at 3:00 p.m. 2. REVIEW OF COUNCIL AGENDA Mr. Schofield presented the Agenda for the March 8th Council Meeting for discussion and review. A. 15-1137 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING MATTHEW A. WILLHITE FOR HIS DEDICATED SERVICE AND SIGNIFICANT CONTRIBUTIONS TO THE VIILLAGE OF WELLINGTON AND ITS RESIDENTS Mr. Schofield introduced the item. This item is a Presentation of a Proclamation to Councilman Matt Willhite recognizing him for his dedicated service and significant contributions to the Village of Wellington and Its residents. There were no changes recommended. B. 15-1127 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING CHLOE ODOM AND LEEANN HEWITT ON THEIR STATE CHAMPIONSHIP TITLES IN GIRLS WEIGHTLIFTING AND FOR BECOMING THE FIRST GIRLS IN PALM BEACH COUNTY HISTORY TO WIN A STATE WEIGHTLIFTING CHAMPIONSHIP Mr. Schofield introduced the item. This item is for a Presentation of a Proclamation to Cloe Odom and LeeAnn Hewitt recognizing them for their wins as State Champions in Girls Weightlifting and for becoming the first girls in Palm Beach County to win a State Weightlifting Championship. There were no changes recommended. C. 15-1128 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF FEBRUARY 23, 2016 Mr. Schofield introduced the item. This item is for the Review and Approval of the Minutes of the Regular Wellington Council Meeting of February 23, 2016. There were no changes recommended. D. 15-874 ACME IMPROVEMENT DISTRICT: RESOLUTION NO. AC2016-01 (PALM BEACH COUNTY INFORMATION SYSTEMS SERVICES AGREEMENT) Village of Wellington Page 1 Village Council Workshop Action Summary - Final March 7, 2016 A RESOLUTION OF THE ACME IMPROVEMENT DISTRICT’S BOARD APPROVING AN INTERLOCAL AGREEMENT BETWEEN THE PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS AND THE ACME IMPROVEMENT DISTRICT FOR THE ASSIGNMENT OF PROPERTY DATA AND DEVELOPMENT OF ANNUAL ASSESSMENTS FOR PALM BEACH COUNTY NON- AD VALOREM DISTRICTS. Mr. Schofield introduced the item. This item is for the Approval of Resolution No. AC2016-01 approving the Interlocal Agreement between the Acme Improvement District and the Palm Beach County Board of County Commissioners for the Assignment of Property Data and Development of Annual Assessments for Palm Beach County Non-Ad Valorem Districts. Ms. Cohen indicated that the blank areas would be filled in when Council received their copies the following night. There were no changes recommended. E. 15-991 CORRECTION OF SCRIVENER’S ERROR IN SECTION 2-323 “MEETINGS, QUORUM AND REQUIRED VOTE” OF PLANNING, ZONING AND ADJUSTMENT BOARD Mr. Schofield introduced this item. This item is for the approval of Ordinance No. 2016-04 Amending Section 2-323 (b) to require the affirmative vote of four members in order to take official action on matters before the Planning, Zoning and Adjustment Board. Ms. Cohen presented the Item and explained the reason for the item was because of a typographical error. She indicated that on page 44, Section 2-323 (b) affirmative vote of four members; the intention was for both sentences to read four and not three members. The change would provide a majority from the entire Board and not the members present at a given time. Mayor Margolis asked if a quorum was four. Ms. Cohen replied affirmatively and said that in the past it was three when it was a five member Board. Currently as a seven member Board, four members would be needed for a quorum along with four votes which was the majority of the Board. Councilwoman Gerwig asked who noticed the error. Ms. Cohen said that a staff member from the Planning, Zoning and Adjustment department caught the error. There were no changes recommended. F. 15-1056 RESOLUTION NO. R2016-15 (INTERLOCAL AGREEMENT BETWEEN THE VILLAGE OF WELLINGTON AND THE SCHOOL BOARD OF PALM BEACH COUNTY FOR THE MUTUAL USE OF RECREATIONAL FACILITIES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE SCHOOL Village of Wellington Page 2 Village Council Workshop Action Summary - Final March 7, 2016 BOARD OF PALM BEACH COUNTY FOR MUTUAL USE OF RECREATIONAL FACILITIES; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced this item. This item is for the Approval of the Interlocal Agreement between the Village of Wellington and the School Board of Palm Beach County for the Mutual Use of Recreational Facilities. Mr. Barnes presented the item and explained the partnership between the Village and the School Board predates the interlocal agreements and were formalized in 2004. Mr. Willhite asked if the agreement was a contract with the School Board. Mr. Barnes explained it was an interlocal contract whereby the School Board was able to use the Village's facilities and the Village was able to use theirs. Mr. Barnes said that contract was subject to the availability on both ends. Ms. Cohen added that the contract was a legally binding agreement. Ms. Cohen stated that she approved the contract on a conditional basis provided that the addendum be executed by all of the sports providers due to the provision in the contract. Mr. Barnes confirmed that the Parks and Recreation Department was handling the addendum portion of the Agreement with the sports providers. Councilwoman Gerwig asked if the contract would make the Wellington High School tennis courts available as in past years. Mr. Barnes explained that due to issues in the past as well as short staffing, the courts are only available to the public in the evenings when staff is on the premises, not on the weekends or off hours when the gates are locked. He explained that the courts are located in the rear of the school, and if the gates are locked, access to the courts is not possible. Councilman McGovern said that the issue needed to be worked out. Mayor Margolis said that the lockdown was due to security reasons after 9/11. Mr. Barnes explained that the current agreement on the agenda was not for open play but was meant for the joint use of individual programs that were already in place. During the past weekend arrangements were made for the March Madness Tournament and the Wellington Travel Team where some of the gyms at the schools and the Village Park were used for practice and the travel basketball teams existing programs that were in place as per the existing agreement. Some of the gyms that were used were located at; Wellington Landings Middle School, Polo Park Middle School and Emerald Cove Elementary School. Mr . Barnes said that Olympia Park and Emerald Cove have hard courts that were open and accessible for open play and were jointly managed by the School District and the Village. Councilwoman Gerwig reiterated that those courts were open, because she has been told that they were not open. Mr. Barnes reaffirmed that the courts were open for unmanaged play at no charge but they were not lighted but Council approved a recent project which was currently underway that would provide lights at Olympia Park and Emerald Cove Parks. The courts were dual purpose tennis and basketball courts. Village of Wellington Page 3 Village Council Workshop Action Summary - Final March 7, 2016 Councilman McGovern said the contract was for one year with four one year renewals. Mr. Barnes replied affirmatively. Councilman McGovern asked for the reason why the contract was not renewed for a longer period of time. Mr. Barnes explained the School Board's Legal Department proposed the terms and he thought they wanted to have the ability to reconsider the contract if budget restraints occur in the future. Councilwoman Gerwig asked if Panther Run Elementary School and Palm Beach Central High School were not on the list because they are not located within the Village's boundaries. Mr. Barnes said that both Panther Run Elementary and Palm Beach Central are within the Village's boundaries and an addendum would be provided to Council adding them. He noted that both are part of the Village's Challenge Grant Program. There were no changes recommended. 3. WORKSHOP None. 4. ATTORNEY'S COMMENTS None. 5. MANAGER COMMENTS Mr. Schofield stated that he would be out of town on Wednesday, Thursday and Friday of this week. In his absence, Mr. Barnes would be available to take any calls. 6.
