CALL TO ORDER Mayor Margolis called the meeting to order at 7:00 p.m. Council Members present: Bob Margolis, Mayor; John Greene, Vice Mayor; Matt Willhite, Councilman; Anne Gerwig, Councilwoman; and John T. McGovern, Councilman. 2. PLEDGE OF ALLEGIANCE Luke and Mark Willhite led the Pledge of Allegiance. 3. INVOCATION Councilman McGovern delivered the invocation. 4. APPROVAL OF AGENDA Mr. Schofield presented the agenda. A motion was made by Councilman Willhite, seconded by Vice Mayor Greene, and unanimously passed (5-0), to approve the Agenda. 5. PRESENTATIONS AND PROCLAMATIONS A. 15-1137 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING MATTHEW A. WILLHITE FOR HIS DEDICATED SERVICE AND SIGNIFICANT CONTRIBUTIONS TO THE VIILLAGE OF WELLINGTON AND ITS RESIDENTS Mr. Schofield introduced the item. Ms. Callovi read the Proclamation. Councilman Willhite stated he was deeply honored to have served the Village residents, visitors and everyone that calls Wellington home and thanked his family; mother, aunt, wife Alexis and sons Mark and Luke in supporting him. He said he appreciated staff for their support, hard work and the recognition they bring to the Village in making the community better. He thanked PBSO, Palm Beach Fire Rescue and all the Councilmembers that he served with during the past years. Councilman Willhite wished Councilman Napoleone the best and said since they had similar circumstances; young, have a family with children, entrenched in the community, he felt that he will work to make the Village a better place. He asked Council to think before making decisions and remember the people in the community and how their decisions would affect them; and to look at the young children that were similar in age to his sons, and to to think about the huge impact they are making to the community's future. He said that the children are the future of Wellington and the country. Council and staff expressed their thanks to Councilman Willhite for his service to the Village's residents. B. 15-1127 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING CHLOE ODOM AND LEEANN HEWITT Village of Wellington Page 1 Village Council Action Summary - Final March 8, 2016 ON THEIR STATE CHAMPIONSHIP TITLES IN GIRLS WEIGHTLIFTING AND FOR BECOMING THE FIRST GIRLS IN PALM BEACH COUNTY HISTORY TO WIN A STATE WEIGHTLIFTING CHAMPIONSHIP Mr. Schofield introduced the item. Ms. Callovi read the Proclamation. Ms. Hewitt thanked Coach Callovi for his inspiration and for being a hard working coach. She thanked her team members, her family, and her first coach which was her mother that always supported and believed in her even when she does not believe in herself and for their support. She indicated that the win was a team effort and the entire team should have been on the podium and thanked everyone who helped her with her journey and the Village Council for their commendations. Ms. Odom thanked her parents for allowing her to do weight lifting because initially her mother was skeptical, Coach Callovi for being an awesome coach, her team mates who are always there to help and everyone for showing their appreciation and being supportive. Council congratulated and expressed their thanks to Leeann Hewitt and Chloe Odom for their statewide winning position, for being incredible examples of the Wellington public school system, their sports achievements, for being outstanding core students, being able to achieve the balance of their academics and their sports involvements and make it work. Furthermore, Council commended all of their teammates for being present to celebrate with them which says alot about the entire team. 6. CONSENT AGENDA Mr. Schofield presented the agenda recommending approval as presented. Mayor Margolis indicated no comment cards were received from the public for the Consent Agenda. Ms. Cohen stated the revised agreement that would be approved for Resolution No. AC2016-01 was included in the blue packet for Council. A motion was made by Councilman Willhite, seconded by Councilman McGovern, and unanimously passed (5-0), approving the Consent Agenda as presented. A. 15-1128 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF FEBRUARY 23, 2016 This item was approved on Consent. B. 15-874 ACME IMPROVEMENT DISTRICT: RESOLUTION NO. AC2016-01 (PALM BEACH COUNTY INFORMATION SYSTEMS SERVICES AGREEMENT) A RESOLUTION OF THE ACME IMPROVEMENT DISTRICT’S BOARD APPROVING AN INTERLOCAL AGREEMENT BETWEEN Village of Wellington Page 2 Village Council Action Summary - Final March 8, 2016 THE PALM BEACH COUNTY BOARD OF COUNTY COMMISSIONERS AND THE ACME IMPROVEMENT DISTRICT FOR THE ASSIGNMENT OF PROPERTY DATA AND DEVELOPMENT OF ANNUAL ASSESSMENTS FOR PALM BEACH COUNTY NON- AD VALOREM DISTRICTS. This item was approved on Consent. 7. PUBLIC HEARINGS A. 15-991 CORRECTION OF SCRIVENER’S ERROR IN SECTION 2-323 “MEETINGS, QUORUM AND REQUIRED VOTE” OF PLANNING, ZONING AND ADJUSTMENT BOARD Mr. Schofield introduced the item. Ms. Callovi read the Ordinance by title. Ms. Cohen presented the staff report. Public Hearing A motion was made by Councilman Willhite, seconded by Councilman McGovern, and unanimously passed (5-0) to open the Public Hearing. There being no public comments, a motion was made by Councilman Willhite, seconded by Vice Mayor Greene, and unanimously passed (5-0) to close the Public Hearing. A motion was made by Councilman Willhite, seconded by Councilman McGovern, and unanimously passed (5-0) to approve Ordinance No. 2015-04 on First Reading as presented. 8. REGULAR AGENDA A. 15-1056 RESOLUTION NO. R2016-15 (INTERLOCAL AGREEMENT BETWEEN THE VILLAGE OF WELLINGTON AND THE SCHOOL BOARD OF PALM BEACH COUNTY FOR THE MUTUAL USE OF RECREATIONAL FACILITIES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE SCHOOL BOARD OF PALM BEACH COUNTY FOR MUTUAL USE OF RECREATIONAL FACILITIES; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the item. Ms. Callovi read the Resolution by title. Mr. Barnes presented the staff report. A motion was made by Councilman Willhite, seconded by Vice Mayor Greene, and unanimously passed (5-0) to approve Resolution No. 2016-15 as presented. Village of Wellington Page 3 Village Council Action Summary - Final March 8, 2016 9. PUBLIC FORUM Mayor Margolis indicated no public comment cards were received. 10. ATTORNEY'S REPORT Ms. Cohen presented the following report: • Ms. Cohen mentioned the Village Manager was asked to attend an event on Thursday at Binks Forest Country Club to answer questions regarding the Charter Amendments. The Village Manager will be out of town so she agreed to attend in his place. She stated she would communicate that the Village was not taking a position regarding the Charter Amendments and her sole role was to answer questions, clarify any confusion and she indicated that she would not advocate in favor or against the amendments. She stated that a candidate forum was to follow the event, but she was not staying for the forum. 11. MANAGER'S REPORTS Mr. Schofield presented the following report: •He explained that after the agenda review meeting he was asked to prepare a recommendation for an advertisement regarding the Charter Amendments. He indicated Ms. Callovi was handing it to Council now for their review. • He stated the next regular Council Meeting would be held on Tuesday, March 22, 2016, in the Council Chambers at 7:00 PM. •Early voting was currently underway and concludes on Sunday, March 13, for the Presidential Primary and Municipal Election to held on March 15th. •During early voting, registered voters can vote at any voting site around the County but on Election Day, voters will have to vote at their normal polling location. •The 20th Anniversary event is scheduled for Saturday, March 19 at Village Park. The Aquatic Center will be open from 10:00 AM to 4:00 PM with free admission followed by the main event at Village Park from 5:00 PM to 10:00 PM. •He said that he will be out of the office for the balance of the week and Mr. Barnes will be acting in his stead. •Mr. Schofield explained the Village was prohibited by law from taking a position on amendments like the ones just distributed to Council but could be used as educational pieces. He said subsequent to the request, he prepared the document in front of them to review and if there was no objection, he woud provide to the Town Crier to publish it over the weekend. 12. COUNCIL REPORTS Councilwoman Gerwig presented the following report: •Councilwoman Gerwig thanked everyone from the Village that helped with the forum last night including the Council of Community Associations. It went very well and every seat was filled. • She said she was advised by a resident that there was a typographical error in each resolution. After her conversation with Ms. Cohen they came to the agreement that the error does not change the actual purpose. Ms. Cohen indicated it was clearly a typo, and she did not think anything would invalidate the ordinance. Councilwoman Gerwig stated she asked that question based on the request of a resident. Village of Wellington Page 4 Village Council Action Summary - Final March 8, 2016 • Councilwoman Gerwig indicated that Wicked was opening at the Kings Academy this Thursday and running for two weeks; Luke Gerwig was the Wizard. •She hoped that everyone can come together for the 20th Anniversary. Vice Mayor Greene presented the following report: • Vice Mayor Greene said that he wanted to not only focus on Councilman Willhite's service to Wellington but his service to the country. He thanked him for his service and wished him the best. He said that Councilman Willhite was going serve the Village well in Tallahassee. Councilman Willhite presented the following report: •Councilman Willhite said that the Village reached the twenty year milestone and said he met with a resident the other day who mentioned that he was shocked by the size of City Hall and all the happenings. He said he shared a few facts with the resident that he was not aware of about Wellington; fifth largest city in Palm Beach County; large amount of visitors during the equestrian season. He said that Wellington was a large municipality and it was great to see so many things happening including discussions about property values, growth, sustainability, Binks Elementary being the number one school and many other good things that happened during the past twenty years. He encouraged everyone to attend the anniversary celebration on March 19 that will include fireworks. •He said that everyone needed to vote at the early voting site located at the library in order to let your voice be heard on March 15th. •Councilman Willhite thanked everyone, including his family and staff for the hard work that they do. He said he knows that the critics don't believe that the Village has been moving forward during the past twenty years but in 2008, Wellington did not undergo the decline in property values as other cities and the Village has continued to grow. •He indicated that by working with Mr. Schofield, they have made the Village a better place and at the end of the day, Mr. Schofield does a great job with the Village, represents us well and it was an honor to negotiate his last contract in the Village that has set the tone for the next five years. He explained that Mr. Schofield along with his staff will continue to make Wellington a better place. •He thanked Council for their kind words, support over the years. He said that the only shadow that he sees on himself is when he stands behind the Patriot's Memorial pieces of steel. He was aware of people holding different events at the memorial on a daily basis and others that visit the memorial on a yearly basis because of what the memorial means to them. He stated that he commends staff for the effort and respect in transporting the steel and indicated that the memorial was one of the things that he truly appreciates in the Village especially since it was located at the entrance of Village Hall and was very beautiful and represents this country. Our country, his and his children's lives all changed on 9/11 and he was very proud to have the memorial in the Village and he was proud to leave it to the Village. He also said that he was every proud for everything that he has done during the eight years he served the Village and said that currently things were better than when he started. Councilman McGovern presented the following report: •Councilman McGovern said during the summer camp there were some issues and an anti-bullying campaign was developed that would be incorporated in Village of Wellington Page 5 Village Council Action Summary - Final March 8, 2016 the recreation programs and camps. He asked Mr. Schofield if the campaign would be included in the 2016 spring break program. Mr. Schofield said that the campaign was adopted and was included in the programs and was currently being used. • He said an important election was coming up on Tuesday. Last night's debate was good and he was excited to have seen so many members of the community present. Each councilmember is very accessible and if people want to know what they think on a particular issue, all the candidates have made themselves available to answer all those questions, particularly when we are seeing highly negative campaigning which was unfortunate. He encouraged the residents to reach out to each councilmember to know how they think on the issues by email or telephone calls to obtain their answers and said that was a good thing about the Village and the residents should take advantage of it. •Councilman McGovern encouraged all the residents to vote. Early voting is everyday until 6:00 pm at the public library in Wellington until Sunday. Voting will happening throughout the Village on Tuesday. •He said the Village has come a long way in twenty years and hoped that all of the residents will be present for a great celebration at Village Park on March 19th. •He wished everyone a happy and safe Spring Break and thanked Councilman Willhite for his service to the Village of Wellington. Mayor Margolis presented the following report: •Mayor Margolis mentioned the results for last weekend's Pine Wood Derby were great noting the Village of Wellington finished eighth and they beat the Fire Fighters and PBSO Deputies by a fairly large margin. •He explained he had the opportunity to attend the Wellington Wave Basketball Tournament and there were about one hundred teams. He commended staff for putting on such a great event. •He said he and Deputy Scott Walker had the opportunity to give a presentation on leadership to the Safety Patrol kids. One of the kids asked Deputy Walker if he liked doughnuts. •Mayor Margolis said it was a pleasure and an honor to have served with Councilman Willhite and to be his friend. He was going to miss their discussions. He indicated that he was going to be very proud of Councilman Willhite when he is up in Tallahassee, and asked him to bring alot of money back to Wellington. •He wished his wife, Linda, a happy birthday. At this point, Councilwoman Gerwig said she was reading the last line of Question #3 and it looked different than what they had discussed before. She said it says, "Should this amendment pass, one additional step will be added, a vote of the citizens of Wellington would be required before hotels, motels, condo-hotels and apartments could be built. This would occur in a general election ballot.” She thought it sounded like this was adding a referendum. Ms. Cohen explained in order to amend the Charter, it would have to go out for referendum. Councilwoman Gerwig said the wording was awkward because it sounds like they are adding a referendum only for the one question.. Ms. Cohen said that was not the case. Councilwoman Gerwig understood the Charter would have to be amended again for that to happen. Ms. Cohen replied affirmatively. Village of Wellington Page 6 Village Council Action Summary - Final March 8, 2016 Councilwoman Gerwig thought the wording was confusing and asked the other Council members to review. Vice Mayor Greene agreed that it should state that the changes would be put into a Charter Amendment. Ms. Cohen agreed. She said they were not submitting a development order or a comp plan amendment out to the vote of the electorate. She stated it would just be an amendment to the Charter. Councilman McGovern stated he did not understand that part. Councilwoman Gerwig stated it said “Should this amendment pass, one additional step will be added, a vote of the citizens of Wellington will be required before motels, hotels, condo-hotels or apartments could be built.” Councilman McGovern suggested that “One additional step . . .” be taken out, so that it reads “Should this amendment pass, before motels and hotels could be built, another vote of the citizens and an amendment of the Charter would be required.” Councilwoman Gerwig stated she was saying that it seems unnecessary, because if they are going to revise the Charter it has to go out to the electorate. She thought they should strike the last two sentences from the word “Should . . . ,” as it would have no bearing on the conversation. Ms. Cohen suggested it say, "Should the amendment pass, condos, hotel, condo-hotels and apartments could not be built absent another amendment to the Charter". Councilwoman Gerwig stated she just wanted to make sure it was not misleading or implying some kind of referendum to the public. Ms. Cohen stated it was not and it was not intended to. Mr. Schofield stated he would fix it. On another note, Councilman McGovern said Wellington Idol happened this past weekend and it was another great event that was well attended. He congratulated Charlotte Ostrov for being the 2016 Wellington Idol. 13. ADJOURNMENT There being no further business to come before the Village Council, the meeting was adjourned.
