CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. 2. PLEDGE OF ALLEGIANCE Rosemary Reder, American Flag Society, led the Pledge of Allegiance. She provided a presentation about the Majestic Flag of America and demonstrated the appropriate way the American flag was to be folded. At this time, Ms. Reder presented Mayor Gerwig with the American flag. 3. INVOCATION Deacon Pete Del Valle, St. Therese de Lisieux Catholic Church, delivered the Invocation. Mayor Gerwig requested a moment of silence for the families affected by the tragedy that occured in Orlando, Florida. 4. APPROVAL OF AGENDA Paul Schofield, Village Manager, presented the agenda. He requested that Resolution No. R2016-44, joining the Florida League of Cities in offering support to the City of Orlando, Florida, be added to the agenda as item No. 5A. A motion was made by Vice Mayor McGovern, seconded by Councilman Napoleone and unanimously passed (5-0), to approve the agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS A. RESOLUTION NO. R2016-44 (SUPPORT OF CITY OF ORLANDO) A motion was made by Councilman Drahos, seconded by Councilman Napoleone and unanimously passed (5-0), to approve Resolution No. 2016-44. Rachel Callovi, Acting Village Clerk, read the Resolution's title into the record. B. 16-0215 PRESENTATION ON NILE MONITORS BY FRANK MAZZOTTI, PH.D., THE UNIVERSITY OF FLORIDA Dr. Frank Mazzotti, University of Florida, provided a presentation on the efforts of state and federal agencies to combat the proliferation of Nile Monitors along Wellington's northern boundary. 6. CONSENT AGENDA Mr. Schofield presented the Consent Agenda recommending approval as presented. PUBLIC HEARINGS A. 16-0189 ORDINANCE NO. 2016-07 (FLYING COW RANCH ANNEXATION) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, PROPOSING THE VOLUNTARY ANNEXATION (PETITION NUMBER 16-017/2016-007ANX) OF REAL PROPERTY COMPRISING OF 2.8 ACRES, MORE OR LESS, LOCATED WITHIN SECTION 24, TOWNSHIP 44 AND RANGE 40, APPROXIMATELY 4.5 MILES SOUTH OF SOUTHERN BOULEVARD IN PALM BEACH COUNTY, FLORIDA, KNOWN AS THE “FLYING COW RANCH,” MORE PARTICULARLY DESCRIBED HEREIN; DECLARING THAT THE VOLUNTARY ANNEXATION PETITION BEARS THE SIGNATURE OF THE PROPERTY OWNER; AMENDING SECTION 11 OF THE VILLAGE CHARTER BY REDEFINING THE CORPORATE LIMITS OF THE VILLAGE OF WELLINGTON; Village of Wellington Page 2 Village Council Action Summary - Final June 14, 2016 DIRECTING THE VILLAGE MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS ANNEXATION; DIRECTING THE VILLAGE CLERK TO FILE A COPY OF THIS ORDINANCE WITH THE CLERK OF THE CIRCUIT COURT IN PALM BEACH COUNTY, THE CHIEF ADMINISTRATIVE OFFICER OF PALM BEACH COUNTY, AND THE FLORIDA DEPARTMENT OF STATE WITHIN SEVEN DAYS AFTER ADOPTION, IN ACCORDANCE WITH CHAPTER 171 OF THE FLORIDA STATUTES; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the agenda item. Robert Basehart, Planning & Zoning, advised that there were no changes since the first reading. Laurie Cohen, Village Attorney, swore in those who wished to give testimony. The Council advised that there were no exparte communications. The title of the ordinance was read into the record by Acting Village Clerk, Rachel Callovi. Mr. Basehart provided a presentation concerning the proposed voluntary annexation. Public Hearing A motion was made by Councilman Napoleone, seconded by Vice Mayor McGovern and unanimously passed (5-0), to open the Public Hearing. There were no public comments. A motion was made by Councilman Drahos, seconded by Councilman Napoleone and unanimously passed (5-0), to approve Ordinance No. 2016-07 as presented on second reading. B. 16-0187 ORDINANCE NO. 2016-15 (REFERENDUM QUESTION AMENDING THE VILLAGE CHARTER RELATING TO THE FILLING OF COUNCIL VACANCIES) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL PROPOSING AMENDMENTS TO SECTION 5 OF WELLINGTON’S CHARTER RELATING TO FILLING OF VACANCIES FOR COUNCILMEMBERS BY AMENDING SECTION 5, SUBSECTION G, “VACANCIES; FORFEITURE OF OFFICE; SUSPENSION; FILLING OF VACANCIES”; PARAGRAPH 4 “FILLING OF VACANCIES” TO ELIMINATE THE POWER TO APPOINT TO FILL COUNCIL VACANCIES AND TO PROVIDE FOR SPECIAL ELECTION WHEN Village of Wellington Page 3 Village Council Action Summary - Final June 14, 2016 THE UNEXPIRED TERM IS 180 DAYS OR MORE; SPECIFYING THE TIMING REQUIREMENTS FOR SPECIAL ELECTIONS TO FILL MAYORAL AND COUNCILMEMBER VACANCIES; PROVIDING FOR SUBMISSION OF THE PROPOSED CHARTER AMENDMENT TO THE ELECTORS OF WELLINGTON AT THE ELECTION TO BE HELD ON AUGUST 30, 2016; PROVIDING FOR FILING WITH THE FLORIDA DEPARTMENT OF STATE; PROVIDING FOR PUBLICATION; PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the agenda item. The title of the ordinance was read into the record by Acting Village Clerk, Rachel Callovi. Ms. Cohen explained that this was the second reading of the ordinance that will place the ballot summary and question on the August 30th ballot for approval by the voters. She then provided a summary of the ordinance. Public Hearing A motion was made by Vice Mayor McGovern, seconded by Councilman Napoleone and unanimously passed (5-0), to open the Public Hearing. There were no public comments. A motion was made by Councilman Napoleone, seconded by Vice Mayor McGovern and unanimously passed (5-0), to close the Public Hearing. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind and unanimously passed (5-0), to approve Ordinance No. 2016-15 as presented on second reading. 8. REGULAR AGENDA There were no items on the Regular Agenda. 9. PUBLIC FORUM There were no public comments. 10. ATTORNEY'S REPORT Ms. Cohen presented the following report: • She said that she expects to call a shade session concerning resolving code violations related to pending litigation. • She mentioned that Councilman Napoleone offered to attend an upcoming mediation. The mediation is scheduled on July 14, 2016, however, he is unable to attend on that date. They will try to reschedule the mediation for July 12th or the 13th. She asked that another Councilmember be designated to attend in the event Councilman Napoleone is unable to be present. Village of Wellington Page 4 Village Council Action Summary - Final June 14, 2016 Councilman Drahos said that he is available to attend on July 14, 2016 if Councilman Napoleone is unable to be present. Vice Mayor McGovern stated that he can be designated to be the back-up in the event either Councilmen cannot attend. • Ms. Cohen advised that she will be out of the office from June 26th through July 9th. 11. MANAGER'S REPORTS Mr. Schofield presented the following report: • He provided a list of upcoming meetings and events. 12. COUNCIL REPORTS Councilman Napoleone presented the following: • He is pleased with the decision to place the charter amendment on the ballot. • He asked that opinions concerning the upcoming fluoride item be emailed to the Councilmembers. Councilman Drahos presented the following: • He asked that opinions concerning the upcoming fluoride item be forwarded to the Councilmembers if residents are not able to attend the Council meeting. • He commented on the passing of Father Dockerill of Saint Rita Catholic Church. Councilwoman Siskind had no report. Vice Mayor McGovern presented the following: • He said that he was pleased the residents will have the opportunity to vote on the charter amendment. • He commented on the upcoming fluoride item and being available to hear the perspectives of the residents. • He commented on the Veterans Open House program that he attended. • He said that he is looking forward to seeing everyone at the July 4th events. Mayor Gerwig presented the following: • .She thanked Rosemary Reder and asked that the flag she presented be displayed on July 4th. Mr. Schofield stated that it will be flown at Village Park. • She commented on the Veterans Open House program that she attended. 13.
