CALL TO ORDER Councilmembers present: Anne Gerwig, Mayor; John McGovern, Vice Mayor; Michael Drahos, Councilman; Michael Napoleone, Councilman; Tanya Siskind, Councilwoman. Mayor Gerwig led the Pledge of Allegiance. 2. REVIEW OF COUNCIL AGENDA Paul Schofield, Village Manager presented the Agenda for the June 28th Council Meeting for discussion and review. A. 16-0248 PRESENTATION OF RETIREMENT RESOLUTION TO AWILDA RODRIGUEZ BY DEBRA R. BUFF, MMC, SOUTHEAST DISTRICT DIRECTOR OF THE FLORIDA ASSOCIATION OF CITY CLERKS (FACC) Mr. Schofield introduced the item. This item is a presentation of the Retirement Resolution to Awilda Rodriguez by the Florida Association of City Clerks (FACC). Mr. Schofield said that a resolution will be presented to VIllage Clerk, Awilda Rodriguez, by the SE District Director of the FACC. There were no changes recommended. EMPLOYEE OF THE MONTH Mr. Schofield announced that the Employee of the Month was present. Matt Estes, Operations Supervisor, introduced Alex Wamsley the Employee of the Month. He said that Mr. Wamsley was from the Public Works Department but was assigned to the Aquatics and Parks and Recreation area. He provided background information as to Mr. Wamsley's employment at the Village of Wellington and the excellent work he does. Council congratulated Mr. Wamsley and the entire department for their outstanding job being done with the parks and all the fields. B. 16-0253 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF JUNE 14, 2016 Mr. Schofield introduced the item. This item is for the approval of the Minutes of the Regular Wellington Council Meeting of June 14, 2016. There were no changes were recommended. C. 15-1012 AUTHORIZATION TO RENEW AN EXISTING CONTRACT WITH PORT CONSOLIDATED, INC. FOR THE SUPPLY AND DELIVERY OF GASOLINE AND DIESEL FUEL Mr. Schofield introduced the item. This item is for the authorization to renew an Village of Wellington Page 1 Village Council Workshop Action Summary - Final June 27, 2016 existing contract with Port Consolidated, Inc. for the supply and delivery of gasoline and diesel fuel in the amount of approximately $350,000.00. Mr. Schofield explained that the item would have to be sent out to bid the following year since this was the last renewal. Mr. De La Vega explained the process when changing a vendor. No changes were recommended. D. 15-1019 AUTHORIZATION TO ENTER INTO AN AGREEMENT FOR SUPPORT AND MAINTENANCE OF THE VILLAGE'S INTERACTIVE VOICE RESPONSE (IVR) SYSTEM Mr. Schofield presented the item. This item is for the authorization to enter into an agreement for support and maintenance of the Village's IVR system with Selectron Technologies, Inc. in the amount of $30,335.00 for fiscal year 2017. No changes were recommended. E. 15-1113 AUTHORIZATION TO AWARD A CONTRACT FOR THE PURCHASE AND DELIVERY OF A THREE (3) TON VIBRATORY COMPACTOR Mr. Schofield presented the item. This item is for the authorization to award a contract to Flagler Construction Equipment, LLC for the purchase and delivery of a three (3) ton vibratory compactor, in the amount of $31,395.00, and authorization to dispose of the existing 2006 vibratory compactor. Mr. Fleury stated the machine was needed for small paving and patchwork road repairs. He indicated the existing machine was worn out and the cost to repair and maintain it was not feasible. No changes were recommended. F. 16-0218 AUTHORIZATION TO CONTRACT WITH JONES AWNINGS & CANVAS, INC. FOR THE PURCHASE AND INSTALLATON OF A CANOPY AT THE WELLINGTON AMPHITHEATER Mr. Schofield presented the item. This item is for the authorization to award a contract to Jones Awnings & Canvas, Inc. for the purchase, delivery, and installation of a canopy at the Wellington Amphitheater, in the amount if $35,800.00. No changes were recommended. G. 15-1136 ORDINANCE NO. 2016-06 (CORRECTION OF SCRIVENER'S ERROR IN SECTION 2-292 "REMOVAL OF BOARD AND COMMITTEE MEMBERS") AN ORDINANCE OF THE VILLAGE OF WELLINGTON, FLORIDA, AMENDING CHAPTER 2, ARTICLE VI, 2-292 ENTITLED "REMOVAL OF BOARD AND COMMITTEE MEMBERS" TO CLARIFY THE NUMBER OF UNEXCUSED ABSENCES THAT COULD RESULT IN REMOVAL AND TO CORRECT THE LAST SENTENCE OF Village of Wellington Page 2 Village Council Workshop Action Summary - Final June 27, 2016 SUBSECTION (A); PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. This item is for the approval of Ordinance No. 2016-06 amending Section 2-292 (a) to clarify the number of the unexcused absences for removal as a member of a board or committee and correcting the last sentence of Section 2.292(a). Aaron Dunlap, Assistant Village Attorney, explained the change was to clarify the number of unexcused absences that could result in removal of a board or committee member. No changes were recommended. H. 16-0194 DISCUSSION AND PUBLIC MEETING ON FLUORIDATION OF WELLINGTON'S DRINKING WATER Mr. Schofield presented the item. This item is for Council to determine that fluoridation of Wellington's drinking water should be reinstituted, and Resolution No. R2016-42 would require approval. Mr. Schofield provided Council with the proposed operating procedures for the fluoride public hearing presentation. Mayor Gerwig asked staff to find out who would be speaking for fifteen (15) minutes against fluoridation. Mr. Schofield said that staff has been reaching out to find a spokes person that wants to commit. Mr. Riebe said he would contact several of the contacts and report back to Council. Bill Riebe, Utilities Director, provided information to support fluoridation, which included benefits, safety measures for handling chemicals procedure and techniques to filter fluoride from homes and Wellington's drinking water. He explained staff tests the water levels on a daily basis and adjust the levels throughout the day. Mr. Riebe noted the National Health Department's recommendations of levels of fluoride per dosage rate. Councilman Drahos said that a councilperson asked for a list of the municipalities that currently fluoridate. Mr. Riebe said the information was part of his presentation and he provided the information to the Village Manager but would provide to Council at the following night's meeting. Mayor Gerwig asked that the information have the county population percentage that fluoridates as well. Mr. Riebe explained that the CDC website has a database that lists every community in the country that does or does not fluoridate and noted that the EPA heavily regulates the chemicals being used in the water. No changes were recommended. I. 16-0246 VOTING DELEGATE FOR THE FLORIDA LEAGUE OF CITIES’ 90TH ANNUAL CONFERENCE Mr. Schofield presented the item. This item is for the nomination and section of a Voting Delegate for the Florida League of Cities' 90th Annual Conference in Village of Wellington Page 3 Village Council Workshop Action Summary - Final June 27, 2016 Hollywood, Florida, from August 18th to 20th, 2016. There was consensus that Mayor Gerwig be designated as the voting delegate for the Florida League of Cities. Mr. Schofield said he would have the necessary form filled out indicating Mayor Gerwig as the delegate for the Village. There were no changes recommended. 4. MANAGER COMMENTS • Mr. Schofield explained thathe sent Council site plans for a proposed charter school on 120th Avenue and 50th Street and was available to answer any questions regarding the request. • Mr. Schofield said that staff was reviewing traffic calming on Clydesdale Avenue and was available to discuss the project. Vice Mayor McGovern said the weekly report mentioned the rescheduling of the Blue Cypress meeting. Mr. Schofield said he spoke to the attorney representing the parties who stated there was a significant cost difference with the estimate provided by the engineer. He stated that he would like to speak to each councilmember individually to discuss the issue and would contact them when he obtained additional information that he was waiting for. 5. ATTORNEY'S COMMENTS There was none. 6. COUNCIL COMMENTS There was none. 7. WORKSHOP A. 16-0103 CODE COMPLIANCE FINE REDUCTION POLICY Mr. Schofield presented the item. Mr. Schofield introduced Mr. Koch who would be speaking regarding fine reductions and a recommendation from Bill Klein. Mayor Gerwig asked staff to obtain the article from the past week's Palm Beach Post regarding the County's fine that was reduced and provide to Council. Mr. Koch explained the settlement agreements process which was a legal binding agreement. Vice Mayor McGovern said the process that Mr. Koch explained was different from that of Mr. Schofield. Mr. Schofield said that staff would review the procedure and policy and report back to Council. Vice Mayor McGovern said that Ms. Cohen indicated in an email dated June 15th, that if there was ongoing litigation, Mr. Koch would be able to negotiate Village of Wellington Page 4 Village Council Workshop Action Summary - Final June 27, 2016 the fine amount. He said he does not agree with that procedure. Mr. Schofield said that he would have the policy revised and additional clarification added and provide to Council for approval. 8.
