CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. Council Members present: Anne Gerwig, Mayor; Michael Drahos, Vice Mayor; John McGovern, Councilman; Michael Napoleone, Councilman; and Tanya Siskind, Councilwoman. Nubin, Village Clerk. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. INVOCATION Dr. Dave Smith, Associate Pastor of New Sound Church, Wellington, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Schofield indicated staff recommended approval of the Agenda as presented. A motion was made by Councilman McGovern, seconded by Councilman Napoleone, and unanimously passed (5-0), to approve the Agenda as presented. 5. PRESENTATIONS AND PROCLAMATIONS There were no Presentations or Proclamations. 6. CONSENT AGENDA Mr. Schofield indicated staff recommended approval of the Consent Agenda as presented. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Consent Agenda as presented. PUBLIC HEARINGS A. 18-2352 SECOND PUBLIC HEARING TO ADOPT THE FY 2018/2019 MILLAGE RATE AND ANNUAL BUDGET FOR WELLINGTON I. RESOLUTION NO. R2018-52 (MILLAGE RATE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING THE TAX LEVY AND MILLAGE RATE FOR WELLINGTON FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2018, AND ENDING SEPTEMBER 30, 2019; AND PROVIDING AN EFFECTIVE DATE. II. RESOLUTION NO. R2018-53 (WELLINGTON BUDGET) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING A BUDGET FOR THE VILLAGE OF WELLINGTON FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2018, AND ENDING SEPTEMBER 30, 2019; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced this item. Ms. Quickel presented this item. Mr. Schofield provided comments regarding the budget. Public Hearing A motion was made by Councilman Napoleone, seconded by Vice Mayor Drahos, and unanimously passed (5-0), to open the Public Hearing. There were comments received from the public. Marion Frank, Cameron Buetel, Bill Wheelen, Lynda Reich, Melissa Weinberg, Bruce Tumin and Peter Tauber all spoke regarding the Lake Wellington Professional Center and Lake Wellington Waterfront Development. There being no further public comments, a motion was made by Councilman Napoleone, seconded by Councilman McGovern, and unanimously passed (5-0), to close the Public Hearing. There was Council discussion regarding the budget. A motion was made by Councilman Napoleone, seconded by Village of Wellington Page 3 Village Council Action Summary - Final September 25, 2018 Vice Mayor Drahos, and passed (4-1) with Mayor Gerwig dissenting, to approve Resolution R2018-52 (Millage Rate) with 2.48 as the millage rate. Regarding Resolution No. R2018-53, Ms. Quickel summarized the modifications to the budget and Mr. Schofield stated the changes will be detailed to Council as staff prepares the budget document. Public Hearing A motion was made by Councilman McGovern, seconded by Councilman Napoleone, and unanimously passed (5-0), to open the Public Hearing. There being no public comments, a motion was made by Councilman Napoleone, seconded by Vice Mayor Drahos, and unanimously passed (5-0), to close the Public Hearing. A motion was made by Councilman Napoleone, seconded by Vice Mayor Drahos, and unanimously passed (5-0), to approve Resolution R2018-53 (Wellington Budget) as amended. Mr. Jose Reyes read the mandatory language regarding the millage rate into record. B. 18-2285 ORDINANCE NO. 2018-09 (FY 2018/2019 ANNUAL CAPITAL IMPROVEMENT ELEMENT UPDATE OF WELLINGTON’S COMPREHENSIVE PLAN) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, UPDATING THE WELLINGTON COMPREHENSIVE PLAN BY INCORPORATING THE ANNUAL REVIEW AND REVISIONS TO THE CAPITAL IMPROVEMENTS ELEMENT TO REFLECT THE 2018/2019 THROUGH 2023/2024 FIVE YEAR CAPITAL IMPROVEMENT PLAN FOR LEVEL OF SERVICE PROJECTS; AND UPDATING THE SCHOOL DISTRICT OF PALM BEACH COUNTY CAPITAL IMPROVEMENT SCHEDULE; PROVIDING FOR CONFLICT AND SEVERABILITY; AUTHORIZING THE MANAGER TO UPDATE THE COMPREHENSIVE PLAN; AND PROVIDING FOR AN EFFECTIVE DATE. There being no public comments, a motion was made by Vice Mayor Drahos, seconded by Councilman Napoleone, and unanimously passed (5-0), to close the Public Hearing. A motion was made by Councilman McGovern, seconded by Vice Mayor Drahos, and unanimously passed (5-0), to approve Ordinance No. 2018-09 (FY 2018/2019 Annual Capital Improvement Element Update of Wellington's Comprehensive Plan). 8. REGULAR AGENDA 9. PUBLIC FORUM There were no comment cards received for Public Forum. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen stated, other than what she discussed yesterday (complaint by Pine Tree Water Control District) during agenda review, she has no report. 11. MANAGER'S REPORT MR. SCHOFIELD: Mr. Schofield presented the following report: The next Regular Council Meeting will be held on Tuesday, October 9, 2018, at 7:00 p.m. in the Council Chambers. The Agenda Review meeting will be held on Thursday, October 4, 2018 at 4:00 p.m. Mr. Schofield stated Village Offices will be closed on Monday, October 8, 2018, in observation of the Columbus Day Holiday. 12. COUNCIL REPORTS Mayor Gerwig stated she would like to accept a nomination for Village of Wellington Page 5 Village Council Action Summary - Final September 25, 2018 Councilman Napoleone to serve as the Village's appointment to the Transportation Planning Agency (TPA) Board. A motion was made by Vice Mayor Drahos, seconded by Councilman McGovern, and unanimously passed (5-0), to appoint Councilman Napoleone to serve on the Transportation Planning Agency Board. It was Council consensus for Councilman McGovern to serve as the alternate on the TPA. COUNCILMAN NAPOLEONE: Councilman Napoleone presented the following report: Councilman Napoleone stated he attended the Garden Club's Tree/Shrub planting at Peaceful Waters Sanctuary on Saturday morning. He stated it was a tremendous turnout and they planted approximately 500 different shrubs, bushes and trees along the perimeter of Peaceful Waters. VICE MAYOR DRAHOS: Vice Mayor Drahos presented the following report: Vice Mayor Drahos stated there has been alot of interest in what is going on with the golf courses on Polo North and Polo West particularly since the grass is getting higher and is not being cut. He asked Ms. Cohen to provide a report on this regarding the recent code enforcement hearing. Ms. Cohen provided a report regarding the code enforcement hearing/violation on the Polo West property. In addition, Ms. Cohen stated there is a violation that has been noticed for the North course and is scheduled for special magistrate in October. Discussion ensued regarding the fines, violations and the cutting of the grass. Vice Mayor Drahos stated he would like to meet with Mr. Basehart regarding target golf. Councilman McGovern asked what is going on with the berm along Stribling as it is unsightly. Ms. Cohen provided an update regarding the upcoming hearing in Village of Wellington Page 6 Village Council Action Summary - Final September 25, 2018 October and appeals that have been filed. Mr. Basehart stated the owner has not submitted a plan to show re-vegetation. Ms. Cohen stated she and Rachel Bausch will be out of town at a conference for the October magistrate hearing. Ms. Cohen stated she will have coverage for the hearing. Vice Mayor Drahos stated it is unfortunate that the Village has to devote time and resources to litigate these kinds of issues and stated it is important the residents are aware that the Village is doing everything within their power to protect the residents' interests. COUNCILMAN MCGOVERN: Councilman McGovern presented the following report: Councilman McGovern thanked the residents who attended and the Parks and Recreation staff for putting on the Lakeside event. He stated it was very well attended. Councilman McGovern stated there are upcoming events in October and November. Councilman McGovern stated many people came out for the Coastal Cleanup and he is glad that this is moving around the Village so that everyone gets to take advantage of this. Lastly, Councilman McGovern recognized the Village's Customer Service Representives who provide first class customer service throughout all of the Village's departments daily. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind thanked the Rotary Club for the beautiful Peace ceremony on Sunday. Councilman McGovern commended Ms. Elizabeth Cardozo, Principal of New Horizons, for winning the peace award. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig stated people are on social media about the minor repairs Village of Wellington Page 7 Village Council Action Summary - Final September 25, 2018 to the pavement on Big Blue Trace. Mr. Schofield stated it is not new work; they failed the "rolling straight edge test". Consequently, the Village is making them do it correctly. Mr. Barnes stated it is remedial work that the Village does at the end of the project. Mr. Barnes stated this is the due diligence that staff and the consultants do before final certification. This will delay the project by one day (weather permitting). Mayor Gerwig stated the residents in Westhampton are asking for more road patrol and some additional lighting in the neighborhood. Mr. Schofield stated he will speak with PBSO Captain Silva. Mayor Gerwig spoke, as a follow up to public comment, regarding Community Development Block Grant (CDBG) funds and Section 8 (a federal program). Ms. Cohen and Mr. Schofield provided clarification regarding CDBG funds and Section 8. Mayor Gerwig reminded everyone that the Green Market starts next weekend. Mayor Gerwig stated some people did not like the language posted by the vendor. She asked that the concerns be passed along to the vendor. Mr. Barnes stated everyone is welcome to come to the Green Market. Mayor Gerwig addressed parking in the neighborhoods around the schools and stated this is dangerous for the kids on the bikes and not fair to the neighborhoods. She encouraged everyone to use the program the schools have laid out for drop off and pick up and utilize the car loop so that the neighborhoods are not affected. Mayor Gerwig stated she attended the first act of Rock the Ballet by Ballet Arts Conservatory at Wellington High School. 13.
