PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. INVOCATION Deacon Pete Del Valle, St. Therese de Lisieux Catholic Church, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as presented. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Agenda as presented. 5. PRESENTATIONS AND PROCLAMATIONS A. 22-5678 PROCLAMATION RECOGNIZING THE WELLINGTON HIGH SCHOOL MIGHTY WOLVERINE SOUND MARCHING BAND FOR THEIR REPRESENTATION OF WELLINGTON AT LONDON’S NEW YEAR’S DAY PARADE 2023 Mr. Barnes introduced the item. Ms. Addie read the proclamation. Council was shown a video of the band’s performance at London’s New Year’s Day Parade 2023. Council commended WCHS Mighty Wolverine Sound Marching Band, chaperones and band directors. B. 23-5747 PALM BEACH COUNTY FIRE RESCUE ANNUAL REPORT PRESENTATION Mr. Barnes introduced the item. Battalion Chief Pribyl of Palm Beach County Fire-Rescue thanked Council for the opportunity and presented the Village of Wellington FY 22 Annual Report. Council gave comments and asked various questions in regards to the Village of Wellington Page 1 Village Council Action Summary - Final March 14, 2023 report. Battalion Chief Pribyl responded to Council's questions. Council extended their thanks to Battalion Chief Pribyl, Fire Rescue and commended him for the comprehensive report. C. 23-5790 PRESENTATION BY WELLINGTON ATHLETICS Mr. Barnes introduced the item. Mr. De La Vega presented the item. He stated S. Kaitlin Guerin, ESQ., Associate for Gunster Yoakley & Stewart P.A., representing Wellington Athletics, LLC, was present to provide an update. Ms. Guerin provided a brief overview regarding the project. She showed Council a site plan of the Wellington Sports Academy as renderings of the space. She stated they are targeting an August 2024 opening. Ms. Guerin discussed the cost estimate from Verdex Construction. Mayor Gerwig inquired about a tot lot. Ms. Guerin responded to Mayor Gerwig’s question regarding open green space and amenities on the site. Mayor Gerwig asked about the concept of Palm Beach Central High School using the baseball field. She asked if the public benefit compared to the private use had been worked out. Mr. De La Vega discussed the courts and stated Mr. Bostic has agreed to allow the Village to utilize the courts when they are not in use. In addition, he explained that the Village will also have use of the full sized synthetic multiple purpose field. Councilman Napoleone stated Council has heard comments/questions from the public regarding traffic and parking. Ms. Guerin stated they are working with traffic engineers regarding the traffic. Councilman McGovern inquired about the financing. Ms. Quickel stated the financing team is present tonight and Mr. Raymond, Bond Counsel, is available via Zoom. She stated they are working with the Village, Mr. Bostic and team and will have meetings based on the timeline going forward. Mr. Jon Bostic, Founder and President of Wellington Athletics, LLC, spoke Village of Wellington Page 2 Village Council Action Summary - Final March 14, 2023 regarding the basketball and volleyball courts. Councilwoman Siskind inquired about the court that is available now for anyone to use for open play. Mr. De La Vega responded regarding the court use. Vice Mayor Drahos asked when they plan to break ground. Ms. Guerin responded August 2023. Rex B. Kirby, President of Verdex Construction, spoke regarding the construction schedule. George Linley, Palm Beach County Sports Commission, spoke regarding the project. He discussed the possibilities for creating sport tourism. Mr. Barnes briefly referenced a tri-party agreement. D. 23-5774 PRESENTATION OF AUDIT RESULTS FOR THE FISCAL YEAR ENDED SEPTEMBER 30, 2022 Mr. Barnes introduced the item. Ms. Tanya Quickel introduced Ms. Racquel McIntosh, Partner with Grau & Associates, who presented the Audit for the Village of Wellington for the fiscal year ended September 30, 2022. Ms. Quickel stated it was a Village wide effort and commended everyone involved in providing information for the audit. Council extended their thanks to Ms. McIntosh and her firm and Ms. Quickel and team for their hard work. 6. CONSENT AGENDA Mr. Barnes stated there was one comment card received for the Consent Agenda. Public Comment: 1. John Fourney submitted a letter into record regarding Consent Agenda Item 6E. REGULAR AGENDA A. 22-5500 RESOLUTION NO. R2023-08 (MEMORANDUM OF UNDERSTANDING BETWEEN THE VILLAGE OF WELLINGTON AND THE WELLINGTON COMMUNITY FOUNDATION, INC.) A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL Village of Wellington Page 9 Village Council Action Summary - Final March 14, 2023 APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE VILLAGE OF WELLINGTON AND THE WELLINGTON COMMUNITY FOUNDATION, INC. FOR PARTNERSHIP ON A PROJECT-BY-PROJECT BASIS ON CERTAIN COMMUNITY PROJECTS AND ACTIVITIES THAT MEET THE FOUNDATION’S MISSION STATEMENT; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced this item. Mr. De La Vega stated it is time for the agreement to be renewed and staff proposed a new five-year term. Mr. Barry Manning, Wellington Community Foundation (WCF), spoke regarding the agreement. Ms. Cohen stated the change that was made to the agreement is that all communication will be with the Chair of (WCF). Council gave comments to members of WCF. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0) to Approve Resolution No. R2023-08 (Memorandum of Understanding between the Village of Wellington and the Wellington Community Foundation, Inc.). B. 23-5714 AUTHORIZATION TO AMEND AN EXISTING AGREEMENT FOR ARCHITECTURAL AND ENGINEERING SERVICES FOR THE CONSTRUCTION OF AN AQUATICS FACILITY Mr. Barnes introduced this item. Mayor Gerwig declared a Conflict of Interest, passed the gavel to Vice Mayor Drahos and left the dais. Mr. De La Vega discussed the proposed locations for the Aquatics facility. He stated based on Council’s discussion at agenda review yesterday, the site for the Aquatics facility will be Village Park 120th Avenue. He stated staff recommends amending the contract with Ohlson Lavoie Corporation, LLC. Public Comment: 1. Delores Bocian, resident of Mayfair, spoke regarding the pool and stated they are in favor of the 120th site. 2. Eric Bell stated he uses the pool regularly. He is gratified that the Village of Wellington Page 10 Village Council Action Summary - Final March 14, 2023 120th location will be the site. 3. Jason Metts spoke regarding the site for the Aquatics facility. He supports the 120th site. 4. Diane Souder submitted an email for the record. Vice Mayor Drahos read the email into record. A motion was made by Councilman Napoleone, seconded by Councilwoman Siskind, and unanimously passed (4-0; with Mayor Gerwig recused) for Authorization to Amend the Contract for Architectural and Engineering Services for the Construction of An Aquatics Facility at the Village Park 120th Site. Council gave brief comments. C. 23-5768 DISCUSSION OF REAPPOINTMENT OF CODE COMPLIANCE SPECIAL MAGISTRATE ALAN ZANGEN, ESQ Mr. Barnes introduced this item. Mr. Stillings presented the item. He informed Council that there are currently three other special magistrates in place. He stated Mr. Zangen’s current term expires June 30, 2023. Mr. Zangen will serve until June 30, 2025 if he is reappointed. There was discussion regarding the number of magistrates. Mr. Drahos stated he is opposed to the reappointment of Mr. Zangen. A motion was made by Councilman Napoleone, seconded by Councilman McGovern, and passed (4-1; Vice Mayor Drahos dissenting) to reappoint Mr. Zangen with the condition that next year staff present a report regarding the format for the number of magistrates. 9. PUBLIC FORUM There was one comment card submitted for public forum. 1. Varisa Lall Dass, Port Commissioner for District 2, provided brief updates to Council regarding tourism packages for the Margaritaville Cruise and tax request. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Village of Wellington Page 11 Village Council Action Summary - Final March 14, 2023 Ms. Cohen stated they had the hearing regarding the Palm Beach Polo case. She provided a brief update on the Palm Beach Polo foreclosure action, Brefrank and PR Raintree matter. 11. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The next Council Meeting will be held on Tuesday, April 11, 2023 at 7:00 p.m. Farrell East and West are postponed and are not on the March 15, 2023 PZAB agenda. Email notices went out to those the Village received public comments from via the website. A-Frame notifications were placed at the entrance to Palm Beach Polo at Forrest Hill Boulevard and St. Andrews at South Shore Boulevard. Project Lighthouse representatives were scheduled to meet with staff this Thursday but have rescheduled to March 27, 2023. The Village received a request from the Indian Trail Improvement District for support of their incorporation effort. The request is for support of the local bill residents submitted to the State Legislature to allow a vote for incorporation of Palm Beach County’s 40th municipality. The bill title is the Village of Loxahatchee. The Board is requesting that the Village Council also support the request for voters to hold a Special Referendum Election in November 2023. Consensus of Council to provide letter of support. Mr. Barnes stated he and Ms. Cohen will work together to draft the letter. Mr. Barnes spoke regarding Lake Worth Professional Center (LWPC) notice letter. There was Council discussion regarding the notice letter. 12. COUNCIL REPORTS COUNCILMAN NAPOLEONE: Councilman Napoleone presented the following report: Councilman Napoleone commented regarding the Pinewood Derby that was held on March 4, 2023. In addition, he stated the Women’s History Month Tea Talk would be held on March 31, 2023 at 3:00 p.m. in the Wellington Community Center. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind congratulated Bruce Wagner and the Public Works Department on achieving re-accreditation. Councilwoman Siskind congratulated Ms. Quickel and team on a successful audit process. Councilwoman Siskind thanked Councilman Napoleone for the Pinewood Derby car. VICE MAYOR DRAHOS: Vice Mayor Drahos presented the following report: Vice Mayor Drahos stated that last weekend the Village hosted the Wellington Spring Classic in coordination with Perfect Game. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig said she attended Relay for Life on Saturday and it was well attended. She would like to recognize Terry Monahan for coordinating the Wellington Team. Mayor Gerwig spoke regarding the accident that happened the other day in front of Wellington Community High School. She asked Mr. Barnes to review that intersection. Mr. Barnes stated he will follow up with the traffic engineers and PBSO. Councilman McGovern inquired about the naming location for Former Mayor Wenham. Mr. Barnes stated staff is working on this.
