CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. Council Members present: Anne Gerwig, Mayor; Michael Napoleone, Vice Mayor; John T. McGovern, Councilman; Michael Drahos, Councilman; and Tanya Siskind, Councilwoman. Advisors to the Council: Jim Barnes, Manager; Laurie Cohen, Attorney; Tanya Quickel, Deputy Village Manager; Ed De La Vega, Assistant Village Manager; and Chevelle D. Addie, Village Clerk. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. INVOCATION Father Steven Thomas (retired), St. David’s In The Pines Episcopal Church, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as amended. 1) The applicant has requested a continuance of the public hearings to a date certain and staff supports the request. Mr. Barnes stated the dates of November 14th, 15th, 16th as well as November 6th, 7th, and 8th are available dates and he suggested the meetings begin at 6:00 p.m. Mayor Gerwig asked Mr. Barnes to explain why the ordinances do not need to be remanded to the Committees to be re-heard. Mr. Barnes and Ms. Cohen explained why the ordinances do not need to be remanded to the Committees. Councilman McGovern inquired about compatibility. There was Council discussion regarding meeting dates. Council asked that the Regular Council meeting be held on November 7, 2023 and that Village of Wellington Page 1 Village Council Action Summary - Final October 10, 2023 the dates of November 14th, 15th, and 16th be scheduled for the continuance of the public hearings. A motion was made by Councilman Drahos, seconded by Councilman McGovern, and unanimously passed (5-0), to continue the public hearings to November 14th, 15th and 16th and to move the Regular Village Council Meeting to November 7, 2023. A motion was made by Councilman Drahos, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS There were no Presentations and Proclamations. 6. CONSENT AGENDA Mr. Barnes stated there were no comment cards on the Consent Agenda. Mr. Barnes indicated staff recommended approval of the Consent Agenda as presented. A motion was made by Vice Mayor Napoleone, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Consent Agenda as presented. B. 23-5848 AUTHORIZATION TO 1) AWARD PUBLIC WORKS AND UTILITY CONTRACTS FOR SURFACE WATER DRAINAGE INFRASTRUCTURE INSPECTION, CLEANING, REPAIR SERVICES AND UTILITY SANITARY SEWER SERVICES, AND 2) APPROVE VARIOUS FY 2024 SURFACE WATER PROJECTS This item approved on Consent. This item continued to a date certain of November 14-16, 2023. 8. REGULAR AGENDA There were no Regular Agenda Items. At this point, Ms. Cohen discussed public comment regarding quasi-judicial proceedings. She informed the Village Council that they could take public comment on Non-Agendaed items tonight. Mayor Gerwig reiterated Ms. Cohen’s comments. Vice Mayor Napoleone asked Ms. Cohen if the comment cards submitted for the public hearings tonight can be carried over to the public hearings scheduled for the November meetings. Ms. Cohen responded affirmatively. 9. PUBLIC FORUM Public Comment: 1. Elizabeth Walkinshaw stated it was her understanding that if the ordinances pass, they can then go to a vote of Wellington residents. She asked if that was correct. Ms. Cohen referenced a provision in the Charter about the Equestrian Preserve and language from the Florida Statutes regarding a land use decision. 2. Richard Sirota provided a statement regarding the process. 3. Elizabeth Fath spoke regarding process. 4. Karen Holland referenced a notice she received in the mail. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen stated she sent an email regarding the complaint that was drafted in the PFAS litigation and filed today. Village of Wellington Page 5 Village Council Action Summary - Final October 10, 2023 Councilman McGovern inquired about the memo sent by the Village Attorney regarding a tax lien on the Big Blue Preserve. Ms. Cohen stated there were tax certificates that were sold on the Big Blue Preserve property and provided corresponding information regarding the Village’s liens that were transferred to a cash bond. She stated the Village is protected. Councilman McGovern inquired about the back taxes. Mayor Gerwig asked if the preserve property was transferred to the POA. Councilwoman Siskind asked if one purchaser is trying to obtain a tax deed. Ms. Cohen responded to Council’s questions. Mr. Barnes explained that the Village was notified by Palm Beach County’s Environmental Resources Management because of their interest due to the environmental nature of the property. 11. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The Next Council Meeting will be held on November 7, 2023; with the additional Council Meeting dates of November 14th, 15th, and 16th as necessary in schedule. With confirmation from the Florida Department of Health, Palm Beach County Animal Care and Control and the property owner, the county has its first reported horse West Nile virus issue. 12. COUNCIL REPORTS VICE MAYOR NAPOLEONE: Vice Mayor Napoleone presented the following report: Vice Mayor Napoleone expressed that he understands the frustration of the audience and referenced the public comment link on the website. He stated the Village Council does read the comments. Vice Mayor Napoleone thanked everyone for coming out tonight. COUNCILMAN DRAHOS: Councilman Drahos presented the following report: Village of Wellington Page 6 Village Council Action Summary - Final October 10, 2023 Councilman Drahos expressed his sentiments regarding the applications before Council and stated this is a very important vote for Wellington and he does not want to rush this through. He thanked everyone who attended. Councilman Drahos said he is available to meet with anyone from the public. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig referenced the process and stated Council is available to meet with anyone who wishes to speak regarding the items. She asked Mr. Barnes to explain to the public how to obtain the information from the website. Mr. Barnes explained how to access the information. COUNCILMAN MCGOVERN: Councilman McGovern presented the following report: Councilman McGovern thanked the residents for coming out tonight and thanked the Boards and Committees. He expressed his sentiments regarding the application and stated Council and staff want to get this right. Councilman McGovern informed everyone the information is available on the website. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind thanked everyone for coming out tonight and for their patience. She stated the Council is accessible and encouraged everyone to reach out to them. 13.
