CALL TO ORDER Mayor Napoleone called the meeting to order at 7:00 pm. Council Members present: Michael J. Napoleone, Mayor; John T. McGovern, Vice Mayor, Tanya Siskind, Councilwoman; Maria Antuña, Councilwoman; and Amanda Silvestri, Councilwoman. Advisors to the Council: Jim Barnes, Manager; Laurie Cohen, Attorney; Tanya Quickel, Deputy Village Manager; Ed De La Vega, Assistant Village Manager; and Chevelle D. Hall, Village Clerk. 2. PLEDGE OF ALLEGIANCE Mayor Napoleone led the Pledge of Allegiance. 3. INVOCATION Rabbi Rosenkrantz, Temple Beth Torah, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as presented. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Agenda as presented. 5. PRESENTATIONS AND PROCLAMATIONS There were no Presentations and Proclamations. 6. CONSENT AGENDA There were no Consent Agenda items. 7. PUBLIC HEARINGS A. 24-6543 ORDINANCE NO. 2024-01 (AMENDMENTS TO CHAPTER 10 OF WELLINGTON’S CODE OF ORDINANCES) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON CODE OF ORDINANCES, MORE SPECIFICALLY, TO ADOPT, BY REFERENCE, THE PUBLIC Village of Wellington Page 1 Village Council Action Summary - Final May 28, 2024 FACILITIES IMPACT FEE STUDY; TO MODIFY CERTAIN PROVISIONS IN CHAPTER 10 (IMPACT FEES), AS CONTAINED HEREIN, TO PROVIDE FOR A PUBLIC FACILITIES IMPACT FEES; TO ESTABLISH THE FINDINGS AND IMPLEMENTATION OF A PUBLIC FACILITIES IMPACT FEE; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced this item. Ms. Hall read the Ordinance by title. Mr. Stillings presented this item. Mayor Napoleone inquired if there were any public comments since the first reading or any changes to the ordinance. Mr. Stillings stated there have no comments or changes since the first reading. Public Hearing A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to open the public hearing. There being no public comments, a motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to close the public hearing. Councilwoman Siskind inquired about the effective date. A motion was made by Councilwoman Siskind, seconded by Councilwoman Antuña, and unanimously passed (5-0) to approve Ordinance No. 2024-01 (Amendments to Chapter 10 of Wellington’s Code of Ordinances) as presented on second reading. B. 24-6540 ORDINANCE NO. 2024-04 (ORANGE POINT POD O (ISLEPOINTE) COMPREHENSIVE PLAN AMENDMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP (FLUM) OF WELLINGTON’S COMPREHENSIVE PLAN, (PETITION NUMBER 2023-0002-CPA), TO MODIFY THE FUTURE LAND USE MAP DESIGNATION FROM COMMERCIAL TO RESIDENTIAL C (1.01 DU/AC – 3.0 DU/AC) FOR CERTAIN PROPERTY KNOWN AS EQUESTRIAN CENTER OF THE ORANGE POINT PLANNED UNIT Village of Wellington Page 2 Village Council Action Summary - Final May 28, 2024 DEVELOPMENT (PUD) MASTER PLAN, TOTALING 10 ACRES, MORE OR LESS; LOCATED APPROXIMATELY TWO (2) MILES WEST OF STATE ROAD 7, AT THE NORTHEAST CORNER OF 50TH STREET SOUTH AND 120TH AVENUE SOUTH, AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Mr. Barnes introduced the item. Ms. Hall read Ordinance No. 2024-04 by title. Mr. Stillings entered the files into the record and presented this item. Mayor Napoleone asked if it takes two readings to amend the comprehensive plan. Mr. Stillings replied yes it takes two readings. Jerrod Purser, WGI, Inc., on behalf of the applicant, discussed the project. Public Hearing A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to open the public hearing. There were public comments relaying concerns about landscaping, change in zoning, access, traffic and density, opposition to the project, ongoing development in Wellington, delaying the project until a proper traffic evaluation can be done, financial impact of the development and sidewalks. There being no further public comments, a motion was made by Councilwoman Siskind, seconded by Vice Mayor McGovern, and unanimously passed (5-0) to close the public hearing. There was discussion between the Village Council, staff and the applicant regarding sidewalks for the development, alternatives that can be built on the property if the land use change is not approved, who the applicant had met with and if this project had to be approved, proportionate share, impact fees, the Village’s mobility element, traffic study, sound studies, mitigation of the noise and volume control, the Comprehensive Plan Amendment, voting on the land use change from Commercial to Residential C, units and density, multi modal system and path around the Village, traffic on 120th, 2026 start times for all schools, connectivity via sidewalk, Pods and PUD. Village of Wellington Page 3 Village Council Action Summary - Final May 28, 2024 The applicant asked if the item can be postponed to allow them more time to work through the details and concerns that have been discussed. Ms. Cohen stated the item could be postponed to a date certain and discussed the public hearing and public comment. There were a few questions regarding the second reading. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to postpone Ordinance No. 2024-04 (Orange Point Pod O (Islepointe) Comprehensive Plan Amendment) to a date certain of June 25, 2024. C. 24-6539 ORDINANCE NO. 2024-05 (ORANGE POINT POD I (CANTER) COMPREHENSIVE PLAN AMENDMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP (FLUM) OF WELLINGTON’S COMPREHENSIVE PLAN, (PETITION NUMBER 2023-0003-CPA), TO MODIFY THE FUTURE LAND USE MAP DESIGNATION FROM COMMUNITY FACILITY TO RESIDENTIAL C (1.01 DU/AC – 3.0 DU/AC) FOR THE SOUTHERN 22.54 ACRES OF CERTAIN PROPERTY KNOWN AS POD D OF THE ORANGE POINT PLANNED UNIT DEVELOPMENT (PUD) MASTER PLAN, TOTALING 40 ACRES, MORE OR LESS; LOCATED APPROXIMATELY TWO (2) MILES WEST OF STATE ROAD 7, AT THE SOUTHEAST CORNER OF LAKE WORTH ROAD AND 120TH AVENUE SOUTH, AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Mr. Barnes introduced the item. Ms. Hall read Ordinance No. 2024-05 by title. Mr. Newell entered the files into the record and presented this item. Brian Terry, Insite Studio, Inc, on behalf of the applicant, discussed the proposed land use request. Public Hearing A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to open Village of Wellington Page 4 Village Council Action Summary - Final May 28, 2024 the public hearing. There were public comments about traffic, safety, buffers, the land use, 120th, turning lanes, access and opposition to the project. There being no further public comments, a motion was made by Councilwoman Siskind, seconded by Vice Mayor McGovern, and unanimously passed (5-0) to close the public hearing. There was discussion between Village Council, staff and the applicant's agent regarding 120th and Lake Worth road, projections, future projects, congestion in the area, roundabout, costs, construction timeline for the project, connection points between the property and the church’s property, culvert, development, gate, pathway and the 120th Avenue entrance, traffic, the list of current and permitted uses for the property, driveway and turn lane coming into the property on Lake Worth Road, access easement regarding 120th and zoning. A motion was made by Councilwoman Siskind, seconded by Councilwoman Silvestri, and unanimously passed (5-0) to approve Ordinance No. 2024-05 (Orange Point Pod I (Canter) Comprehensive Plan Amendment) with the caveat of working things out in the conditions of approval, 120th Avenue South and Lake Worth Road, pathway to the school, a funding plan and traffic calming coming out of the development by second reading. 8. REGULAR AGENDA There were no Regular Agenda Items. 9. PUBLIC FORUM Mr. Barnes indicated there were no comment cards submitted for Public Forum. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen reported on the 130 Violations case. Ms. Cohen reported on the Pine Tree Case. Ms. Cohen reported that the Village Manager had sent out a letter to the county and the Village has to designate the roadways to be Village of Wellington Page 5 Village Council Action Summary - Final May 28, 2024 included with the gas tax. She suggested a workshop be held to discuss how to move forward with Pine Tree. Ms. Cohen provided brief background information. Mr. Barnes stated the deadline was May 24, 2024 for the county. He has a call into the Palm Beach County Assistant Engineer and Deputy County Administrator regarding the timeline. Vice Mayor McGovern inquired about the communication between the Village and Pine Tree. Mr. Barnes provided an update regarding communication between the Village and Pine Tree. Ms. Cohen stated her concerns regarding the gas tax map and deadline. Ms. Cohen said she, Ms. Bausch and Mr. Stillings have been working on updating council procedures and would like to bring them forward at a workshop. Ms. Cohen said she will be away June 4, 2024 through June 19, 2024 with limited access to email and phone. Ms. Bausch and Ms. Pisz will be available during this time. 11. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The next council meeting will be held at 7:00 pm on June 11, 2024. A ribbon cutting for the Centurion Black Luxury Office Suites will be held on Thursday, May 30, 2024 at 11:00 am. Mr. Barnes discussed Flying Cow Ranch Road. 12. COUNCIL REPORTS Councilwoman Silvestri waived comment. Councilwoman Siskind stated the Memorial Day Ceremony was beautiful. Councilwoman Antuña waived comment. Vice Mayor McGovern echoed Councilwoman Siskind’s comments regarding the Memorial Day Ceremony. Village of Wellington Page 6 Village Council Action Summary - Final May 28, 2024 Vice Mayor McGovern said the graduation ceremonies for Palm Beach Central High School and Wellington Community High School were spectacular. Mayor Napoleone congratulated Vice Mayor McGovern and Councilwoman Siskind on their graduates. Mayor Napoleone attended Palm Beach County Transportation Planning Agency trip to the Netherlands regarding walkability and cycling and provided a brief report. 13.
