CALL TO ORDER Mayor Napoleone called the meeting to order at 4:02 pm. Council Members in Attendance: Mayor Michael J. Napoleone, Vice Mayor John T. McGovern, Councilwoman Tanya Siskind, Councilwoman Maria Antuña, and Councilwoman Amanda Silvestri. 2. PLEDGE OF ALLEGIANCE Mayor Napoleone led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the June 11, 2024 Regular Council Meeting for review. A. 24-6546 RECOGNITION OF JANELL LEATHERMAN FROM EMERALD COVE MIDDLE SCHOOL FOR WINNING THE 2024 DWYER AWARD FOR STUDENT ADVANCEMENT AND CAREER EDUCATION Mr. Barnes introduced the item. He stated that this was the Recognition of Janell Leatherman from Emerald Cove Middle School for Winning the 2024 Dwyer Award for Student Advancement and Career Education. B. 24-6547 RECOGNITION OF THE 2024 WELLINGTON HIGH SCHOOL PATHFINDER AWARD WINNERS, EMILIA MCGOVERN AND JOHNATHON BUCKNOR Mr. Barnes introduced the item. He stated that this was the Recognition of the 2024 Wellington High School Pathfinder Award Winners, Emilia McGovern and Johnathon Bucknor. C. 24-6550 RECOGNITION OF MARY OSER, WELLINGTON HIGH SCHOOL BAND TEACHER, ON HER RETIREMENT Mr. Barnes introduced the item. He said that this was the Recognition of Mary Oser, Wellington High School Band Teacher, on Her Retirement. Mayor Napoleone asked if coordination was done with the Band Boosters or band parents for them to attend the meeting. Mr. Barnes answered a question from Mayor Napoleone. D. 24-6497 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF APRIL 9, 2024 AND MAY 14, 2024 Village of Wellington Page 1 Village Council Workshop Action Summary - Final June 10, 2024 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meetings of April 9, 2024, and May 14, 2024. He asked Council to provide comments, if any, to the Clerk's Office. E. 24-6437 AUTHORIZATION TO AWARD A CONTRACT FOR DUMPSTER AND MATERIAL ENCLOSURES AT VARIOUS PARKS Mr. Barnes introduced the item. He stated that this was the Authorization to Award A Contract for Dumpster and Material Enclosures at Various Parks. Mr. Reinsvold explained the item. He noted the location maps on page 66 of the agenda where the dumpster enclosures would be located. He said that the base bid came in at $259,923 with $58,400 in alternatives. Mr. Barnes further explained the item. Mayor Napoleone commented on the enclosures. Mr. Barnes responded to Mayor Napoleone's comment. Vice Mayor McGovern asked if the residents would be required to have the enclosures. Mr. Barnes answered a question from Vice Mayor McGovern. Mayor Napoleone asked how many enclosures there are. Mr. Reinsvold answered a question from Mayor Napoleone. There was discussion regarding the alternate enclosures and the cost. Vice Mayor McGovern asked if there is another code compliant way to enclose the dumpsters for a lesser cost. Mr. Barnes answered a question from Vice Mayor McGovern. F. 24-6464 AUTHORIZATION TO AWARD A SOLE SOURCE CONTRACT TO FLOCK SAFETY TO UPGRADE LICENSE PLATE READER (LPR) CAMERAS AT VARIOUS LOCATIONS THROUGHOUT THE VILLAGE Mr. Barnes introduced the item. He stated that this was the Authorization to Award A Sole Source Contract to Flock Safety to Upgrade License Plate Reader (LPR) Cameras at Various Locations Throughout The Village. Councilwoman Siskind inquired if these are replacing the existing LPRs. Mr. Silliman responded to Councilwoman Siskind's inquiry. There was discussion regarding the contract, cost and total number of LPRs. Mayor Napoleone inquired why the Village chose Flock. Mr. Barnes responded to Mayor Napoleone's inquiry. Vice Mayor McGovern asked how long the Village had the LPRs. Mr. Barnes and Mr. Silliman answered a question from Vice Mayor Napoleone. Vice Mayor McGovern asked about the time frame for installation. Mr. Silliman answered a question from Vice Mayor Napoleone. G. 24-6515 AUTHORIZATION TO RENEW AN EXISTING CONTRACT FOR THE SUPPLY AND DELIVERY OF ROAD BASE Mr. Barnes introduced the item. He stated that this was the Authorization to Renew an Existing Contract for the Supply and Delivery of Road Base. Mr. Barnes explained the item. He said that this is the first renewal option with no price increase. H. 24-6548 AUTHORIZATION TO UTILIZE A PALM BEACH COUNTY CONTRACT FOR THE TENNIS CENTER CONCRETE AND ASPHALT REPAIRS PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Utilize A Palm Beach County Contract for the Tennis Center Concrete and Asphalt Repairs Project. Mr. Barnes explained the item. Mayor Napoleone asked if this was due to the roots. Mr. Wagner answered a question from Mayor Napoleone. Mr. Barnes discussed the repairs. I. 24-6549 AUTHORIZATION TO CONTINUE UTILIZING A CONTRACT FOR INSURANCE BROKERAGE SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing A Contract for Insurance Brokerage Services. Rommi Mitchell, Senior Consultant of the Gehring Group explained the item. Mayor Napoleone commented on the Gehring Group and the work they have done for the Village. Mr. Barnes commented on the Gehring Group's wide range of services provided to the Village. Vice Mayor McGovern asked about the commission variation percentage. Ms. Mitchell answered a question from Vice Mayor McGovern. Mayor Napoleone asked if these are the same commission rates or are they increasing. Ms. Mitchell answered a question from Mayor Napoleone. J. 24-6557 AUTHORIZATION TO RENEW AN EXISTING CONTRACT FOR PALM TREE PRUNING AND ROOT PRUNING Mr. Barnes introduced the item. He stated that this was the Authorization to Renew an Existing Contract for Palm Tree Pruning and Root Pruning. Mr. Barnes explained the item. Mr. Wagner said that the price is not being increased. Mayor Napoleone asked if this is all the stuff that the Village cannot do. R2024-18 (EQUESTRIAN TRAILS CIRCULATION MASTER PLAN) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND ADOPTING THE EQUESTRIAN TRAILS CIRCULATION MASTER PLAN, AND APPROVING THE IMPLEMENTATION OF THE EQUESTRIAN CAPITAL IMPROVEMENT PROJECTS TO WELLINGTON’S CAPITAL IMPROVEMENT PROGRAM FOR FISCAL YEAR 2024/2025- 2026/2027; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2024-18 (Equestrian Trails Circulation Master Plan). Mr. Santa-Gonzalez explained the item. He provided a brief background of the Equestrian Trails Circulation Plan. He noted that there are four 1-year Capital Improvement Projects which will be reviewed by the Equestrian Preserve Committee (EPC) on an annual basis. Mr. Barnes further explained the item. He noted that this is subject to the approval of the Capital Improvement portion of the annual budget on an annual basis. Mayor Napoleone commented on this coming before Council to vote on a whole plan in place as it is an expenditure. Mr. Barnes responded to Mayor Napoleone's comment. Mr. Santa-Gonzalez discussed the recommendation. Vice Mayor McGovern commented on the mandatory stops. Mr. Reinsvold responded to Vice Mayor McGovern's comment. There was discussion regarding the mandatory stops and locations. Councilwoman Silvestri asked how successful are the signs. Mr. Reinsvold answered a question from Councilwoman Silvestri. Mr. Reinsvold answered a question from Councilwoman Siskind. Mayor Napoleone asked if all the other trail improvements that are being proposed have been through the EPC. Mr. Reinsvold answered a question from Mayor Napoleone. There were comments and discussion regarding the trail expansion, maintenance investment and having the EPC take a look at the recommended CIP Projects. L. 24-6561 RESOLUTION NO. R2024-24 (INVESTMENT POLICY UPDATE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING A REVISED INVESTMENT POLICY FOR THE VILLAGE OF WELLINGTON AND ACME IMPROVEMENT DISTRICT; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced this item. He stated that this was the Resolution No. R2024-24 (Investment Policy Update). He noted that Ms. Quickel is available via zoom. Ms. Acevedo explained the item. She noted that the last changes were made in 2018. She said that John Grady, Managing Director and Partner of Investment Advisory Services for Public Trust Advisors, was present. Mr. Grady distributed the Investment Policy to the Village Council. Vice Mayor McGovern asked if the policy had been reviewed by the Auditors and the Finance Team. Ms. Acevedo answered a question from Vice Mayor McGovern. Mr. Grady discussed recommended updates to the policy. There were comments and discussion regarding the statutory changes, compliance and recommendations. Councilwoman Antuña inquired if any of the changes would put the Village at risk. Mr. Grady responded to Councilwoman Antuña's inquiry. He thanked the Finance Team for their support. Village of Wellington Page 6 Village Council Workshop Action Summary - Final June 10, 2024 M. 24-6534 ORDINANCE NO. 2024-02 (ZONING TEXT AMENDMENT TO SECTION 6.4.1.A.5. OF WELLINGTON’S LAND DEVELOPMENT REGULATIONS FENCES, WALLS, AND HEDGES) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON LAND DEVELOPMENT REGULATIONS, MORE SPECIFICALLY, A ZONING TEXT AMENDMENT TO MODIFY SECTION 6.4.1.A.5 OF ARTICLE 6, FOR PURPOSES OF CLARIFYING FENCE SETBACK REQUIREMENTS, MODIFYING HEDGE HEIGHT REQUIREMENTS, AND PROVIDING ADMINISTRATIVE APPROVALS WITH CRITERIA REQUIREMENTS FOR NON-COMFORMING HEDGES ALONG MAJOR THOROUGHFARES IN EFFORTS TO ACHIEVING CONSISTENT APPEARANCE FOR HEDGES AND FENCES ALONG THOROUGHFARES, AS CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Ordinance No. 2024-02 (Zoning Text Amendment to Section 6.4.1.A.5 of Wellington's Land Development Regulations Fences, Walls and Hedges). Mr. Santa-Gonzalez explained the item. He discussed the proposed amendments. Mayor Napoleone commented on the proposed changes and the setback requirement. Vice Mayor McGovern asked what the public comment had been for this item. Mr. Santa-Gonzalez and Mr. Stillings answered a question from Vice Mayor McGovern. There was discussion regarding the implementation timeframe and communication with property owners. Councilwoman Siskind asked how many properties would need to come into compliance. Mr. Stillings and Mr. Santa-Gonzalez answered a question from Councilwoman Siskind. There was continued discussion regarding property owners' compliance and enforcement. Councilwoman Silvestri asked how often enforcement is done. N. 24-6532 ORDINANCE NO. 2024-07 (AMENDING THE CODE OF ORDINANCES TO PROVIDE FOR ELECTRONIC PUBLICATION OF REQUIRED NOTICES AND ADVERTISEMENTS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON CODE OF ORDINANCES TO CREATE A NEW SECTION 1-13 OF CHAPTER 1, GENERAL PROVISIONS, TO BE TITLED “PUBLIC NOTICE REQUIREMENTS”, PROVIDING FOR ELECTRONIC PUBLICATION OF REQUIRED NOTICES AND ADVERTISEMENTS ON A PUBLICLY ACCESSIBLE COUNTY WEBSITE, PROVIDING FOR ANNUAL NOTIFICATION TO RESIDENTS AND PROPERTY OWNERS TO RECEIVE NOTICES BY MAIL OR E-MAIL, AND ESTABLISHING A REGISTRY FOR THIS PURPOSE IN ACCORDANCE WITH SECTION 50.0311, FLORIDA STATUTES; AMENDING CHAPTER 20, STREETS, SIDEWALKS, AND OTHER PUBLIC PLACES, SECTIONS 20-15, 20-16, AND 20-18 OF WELLINGTON’S CODE OF ORDINANCES TO REFERENCE THE NEW SECTION 1-13, AND THE LAND DEVELOPMENT REGULATIONS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Ordinance No. 2024-07 (Amending the Code of Ordinances to Provide for Electronic Publication of Required Notices and Advertisements). Ms. Bausch explained the item. She noted that this is the first reading of the ordinance. She mentioned the legislative change enacted that allows governmental agencies the option to publish public notices and advertisements on a publicly accessible website as opposed to a newspaper. Mayor Napoleone asked how the cost was set for this. Ms. Quickel said that the cost was approximately $7,000. Ms. Hall provided a brief overview of the advertisement process. Vice Mayor McGovern asked if there was a cost to residents for requesting the notices. Ms. Quickel and Ms. Hall answered a question from Vice Mayor McGovern. Councilwoman Antuña asked if the Village would be responsible for monitoring the subscriber list. Ms. Hall answered a question from Councilwoman Antuña. Mayor Napoleone asked what the Village spent last year for advertisments. Ms. Hall answered a question from Mayor Napoleone. Ms. Bausch noted that a similar ordinance will be coming before the Council regarding the Land Development Regulations (LDR). 4. WORKSHOP Mr. Barnes said that an item would be added to the Workshop. He said that Mr. Stillings and Ms. Ferraiolo are present to discuss the Color Board. A. 24-6568 GAS TAX DISCUSSION Mr. Barnes introduced the item. He stated that this was the Gas Tax Discussion. Mr. Barnes explained the item. He noted that this was a follow-up regarding the request to add lane miles of the roadways within Rustic Ranches to the County's request for an update regarding the Village's roadway responsibilities. Councilwoman Siskind commented on the interlocal agreement. Mr. Barnes responded to Councilwoman's Siskind comment. Ms. Bausch provided a brief overview of the interlocal agreement and the lawsuit filed by PineTree. She noted that the Village has spent $164,342.56 in this case and recovered a cost judgment of $14,000 and there were no entitlements to fees. She discussed the Special Assessment case regarding Section 24. She said that the Village is entitled to a $80,000 judgment plus fees in the amount $139,560.88; which is roughly $240,000. Ms. Bausch discussed the appeal process, Legal's concern and the past negotiations with Pine Tree. She said that it would be the Council's position to advise Legal whether to continue negotiations or begin negotiations for the interlocal agreement. Mayor Napoleone asked Ms. Quickel if she had anything to add to this discussion. Ms. Quickel answered a question from Mayor Napoleone. Mayor Napoleone commented on the litigation and the interlocal agreement. Councilwoman Siskind said that she agrees with Mayor Napoleone's comment. Vice Mayor McGovern commented about the letter to Pine Tree. There were comments and discussion regarding withdrawing the letter and the next steps. Councilwoman Silvestri commented on the negotiations. Councilwoman Antuña commented on the Pine Tree meeting set for tomorrow. Vice Mayor McGovern responded to Councilwoman Antuña's comment. Mr. Barnes responded to Vice Mayor McGovern's comments. Mr. Barnes introduced the Color Board item. Ms. Ferraiolo explained the item. She noted that she is the Village of Wellington Page 10 Village Council Workshop Action Summary - Final June 10, 2024 Architectural Review Board (ARB) Staff Liaison. She said that the ARB was tasked with updating the color board a year ago. She discussed the colors, recommended fence designs and materials. Mr. Stillings said that this would go back to the ARB at their next meeting for a formal adoption. Mayor Napoleone asked if the gray fence option is being added back in as a vinyl option. Ms. Ferraiolo answered a question from Mayor Napoleone. Councilwoman Silvestri asked about the enforcement and residents being made aware of this. Ms. Ferraiolo and Mr. Stillings answered questions from Councilwoman Silvestri. Vice Mayor McGovern asked if the numbers in parenthesis are color codes. Ms. Ferraiolo answered a question from Vice Mayor McGovern. Councilwoman Antuña asked if a licensed painter is required to have a permit. Ms. Ferraiolo answered a question from Councilwoman Antuña. There were comments and discussion regarding roof colors. Councilwoman Silvestri asked if the colors were available on the Village Website. Ms. Ferraiolo answered a question from Councilwoman Silvestri. 5. ATTORNEY'S COMMENTS Ms. Bausch asked the Council if there was consensus to see what happens with the Pine Tree meeting tomorrow or is the consensus that the Village would withdraw the letter. Vice Mayor McGovern said that he thinks there is a consensus that the Village is going to withdraw the letter and see what happens after the Pine Tree meeting tomorrow. MANAGER COMMENTS None. 7. COUNCIL COMMENTS Councilwoman Silvestri commented on the email sent to the Council regarding a rehearing. She inquired about having an open discussion regarding the stance on the issue as no one had responded to Ms. Brennan. Mr. Barnes noted that a copy was provided to each Council member individually as it relates to the issue aimed at the original petition among the residents. He discussed the additional comments submitted by Ms. Brennan that were provided to the Council. He said that he is happy to discuss these items or however the Council chooses to move forward. He discussed parliamentary procedure, Robert's Rules and provisions afforded to the Village by the Code and Land Development Regulations (LDR) Section 5.2. Councilwoman Siskind asked if the answers could be sent out. Mr. Barnes answered a question from Councilwoman Siskind. Vice Mayor McGovern asked about LDR Section 5.2.4.A.4.
