CALL TO ORDER Mayor Napoleone called the meeting to order at 7:00 p.m. Council Members present: Michael J. Napoleone, Mayor; John T. McGovern, Vice Mayor, Tanya Siskind, Councilwoman; Maria Antuña, Councilwoman; and Amanda Silvestri, Councilwoman. Advisors to the Council: Jim Barnes, Manager; Laurie Cohen, Attorney; Tanya Quickel, Deputy Village Manager; Ed De La Vega, Assistant Village Manager; and Chevelle D. Hall, Village Clerk. 2. PLEDGE OF ALLEGIANCE Mayor Napoleone led the Pledge of Allegiance. 3. INVOCATION Deacon Al Payne, St. Therese de Lisieux Catholic Church, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as amended. The Applicant submitted a Request To Postpone Public Hearing Item 7A, Ordinance No. 2024-04 (Orange Point Pod O (Islepointe) Comprehensive Plan Amendment). A motion was made by Councilwoman Siskind, seconded by Vice Mayor McGovern, and unanimously passed (5-0), to approve the Agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS There were no Presentations and Proclamations. 6. CONSENT AGENDA There were no Consent Agenda items. 7. PUBLIC HEARINGS Village of Wellington Page 1 Village Council Action Summary - Final June 25, 2024 A. 24-6577 ORDINANCE NO. 2024-04 (ORANGE POINT POD O (ISLEPOINTE) COMPREHENSIVE PLAN AMENDMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP (FLUM) OF WELLINGTON’S COMPREHENSIVE PLAN, (PETITION NUMBER 2023-0002-CPA), TO MODIFY THE FUTURE LAND USE MAP DESIGNATION FROM COMMERCIAL TO RESIDENTIAL C (1.01 DU/AC – 3.0 DU/AC) FOR CERTAIN PROPERTY KNOWN AS EQUESTRIAN CENTER OF THE ORANGE POINT PLANNED UNIT DEVELOPMENT (PUD) MASTER PLAN, TOTALING 10 ACRES, MORE OR LESS; LOCATED APPROXIMATELY TWO (2) MILES WEST OF STATE ROAD 7, AT THE NORTHEAST CORNER OF 50TH STREET SOUTH AND 120TH AVENUE SOUTH, AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. This Item was postponed due to a request from the Applicant. B. 24-6575 ORDINANCE NO. 2024-05 (ORANGE POINT POD I (CANTER) COMPREHENSIVE PLAN AMENDMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP (FLUM) OF WELLINGTON’S COMPREHENSIVE PLAN, (PETITION NUMBER 2023-0003-CPA), TO MODIFY THE FUTURE LAND USE MAP DESIGNATION FROM COMMUNITY FACILITY TO RESIDENTIAL C (1.01 DU/AC – 3.0 DU/AC) FOR THE SOUTHERN 22.54 ACRES OF CERTAIN PROPERTY KNOWN AS POD D OF THE ORANGE POINT PLANNED UNIT DEVELOPMENT (PUD) MASTER PLAN, TOTALING 40 ACRES, MORE OR LESS; LOCATED APPROXIMATELY TWO (2) MILES WEST OF STATE ROAD 7, AT THE SOUTHEAST CORNER OF LAKE WORTH ROAD AND 120TH AVENUE SOUTH, AS MORE SPECIFICALLY DESCRIBED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Mr. Barnes recommended that there be one concurrent staff presentation since the items (Ordinance No. 2024-05 and Resolution No. R2024-19) are related; with a separate motion for each item. Ms. Cohen stated the Item is Quasi-Judicial and swore in the individuals who wished to speak on the item. Ms.title. by Hall read Ordinance No. 2024-05 and Resolution No. R2024-19 Mr. Newell entered the files into the record and presented this item. Brian Terry, Insite Studio, Inc, on behalf of the applicant, discussed the proposed land use request. The Interested Parties spoke and/or conducted presentations. Public Comment: 1. Seth Finkel spoke regarding setbacks and traffic studies. 2. Victoria McCullough spoke regarding 120th Avenue and traffic. She stated the traffic there is significant. She urged Council to look carefully at the roadway. There being no further public comments, a motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to close the public hearing. There was discussion between Village Council, staff and the applicant's agent regarding the EPC, 120th Avenue, 50th Street and Lake Worth road, access points, proportionate share, budget, types of homes, setbacks, cross access easement, budget, landscape buffers, impacts, traffic flow in the area, the five leg roundabout and the four leg roundabout, traffic light, Vision Zero Action Plan, intersections/intersections failing, roads in the EPA and EOZD, and conditions. The Applicants and Interested Parties made their closing statements. Ms. Cohen stated Council is voting on the Comprehensive Plan and it requires four affirmative votes. There was discussion regarding the Comprehensive Plan Amendment and the Master Plan Amendment. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to approve Ordinance No. 2024-05 (Orange Point Pod I (Canter) Comprehensive Plan Amendment) on second reading. R2024-19 (ORANGE POINT PUD MASTER PLAN AMENDMENT – CANTER PROJECT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL, APPROVING A MASTER PLAN AMENDMENT (PETITION NUMBER 2023-0003-MPA) AMENDING THE ORANGE POINT PLANNED UNIT DEVELOPMENT (PUD) MASTER PLAN FOR CERTAIN PROPERTY KNOWN AS POD D (ALSO KNOWN AS THE 40-ACRE PRIVATE CIVIC SITE), TOTALING 40 ACRES, MORE OR LESS; LOCATED APPROXIMATELY TWO (2) MILES WEST OF STATE ROAD 7, AT THE SOUTHEAST CORNER OF LAKE WORTH ROAD AND 120TH AVENUE SOUTH; TO DESIGNATE THE SOUTHERN 22.54 ACRES OF THE ORANGE POINT PUD POD D AS SINGLE-FAMILY RESIDENTIAL AND CREATE A NEW POD KNOW AS POD I, TO ALLOW DEVELOPMENT OF THE CANTER PROJECT (POD I), A RESIDENTIAL DEVELOPMENT WITH 42 SINGLE-FAMILY RESIDENTIAL LOTS, AND TO AMEND THE CONDITIONS OF APPROVAL AND ADOPT THE CANTER PROJECT STANDARDS MANUAL; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. This item was discussed in conjunction with Item 7B. Vice Mayor McGovern stated the question regarding the Master Plan is if this is the best option for entry and exit. A motion was made by Councilwoman Siskind to approve Resolution No. R2024-19 (Orange Point PUD Master Plan Amendment - Canter Project) with all of the concessions and amendments that were discussed. The Motion failed due to lack of a second. Vice Mayor McGovern mentioned the issue of paying for the traffic signal and roundabout. Mr. Barnes discussed projects, budget and funding. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to extend the meeting past 11:30 pm. There was discussion regarding the property, 120th Avenue, roundabout, the EPC weighing in, and delay of the project. A motion was made by Councilwoman Silvestri, seconded by Village of Wellington Page 4 Village Council Action Summary - Final June 25, 2024 Councilwoman Antuña, and passed (4-1; Councilwoman Siskind dissenting) to postpone Resolution No. R2024-19 (Orange Point PUD Master Plan Amendment - Canter Project) to a date certain of August 13, 2024. 8. REGULAR AGENDA A. 24-6586 RESOLUTION NO. 2024-25 (INTERLOCAL AGREEMENT BETWEEN THE VILLAGE OF WELLINGTON AND THE PINE TREE WATER CONTROL DISTRICT) A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL APPROVING AND AUTHORIZING THE MAYOR TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE PINE TREE WATER CONTROL DISTRICT FOR THE PROVISION OF ROAD MAINTENANCE SERVICES WITHIN THE PINE TREE WATER CONTROL DISTRICT; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes presented this item and discussed what is provided in the agreement. Ms. Cohen highlighted items in the agreement. Mayor Napoleone and Vice Mayor McGovern suggested changes to the agreement. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Silvestri, and unanimously passed (5-0) to Approve Resolution No. R2024-25 (Interlocal Agreement between the Village Of Wellington and the Pine Tree Water Control District) as amended, conditioned upon Pine Tree holding a properly noticed meeting approving the Interlocal Agreement with PTWCD Board President Kerry Hitt signing it and the money being paid prior to noon on Monday, July 1, 2024. 9. PUBLIC FORUM Mr. Barnes indicated there was one card submitted for Public Forum. Public Comment: Mr. Tumin was not present to speak. 10. ATTORNEY'S REPORT MS. BARNES: Mr. Barnes presented the following report: The next council meeting will be held on July 16, 2024. Village offices will be closed on July 4, 2024 in observance of the Independence Day holiday. Mr. Barnes spoke regarding the July 4th activities. 12.
