PLEDGE OF ALLEGIANCE Mayor Napoleone led the Pledge of Allegiance. 3. INVOCATION Deacon Al Payne, St. Therese de Lisieux Catholic Church, delivered the invocation. 4. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as amended. 1. Add Agreement with Coastal Waste & Recycling For Storm (Hurricane Milton) Debris Disposal to the Consent Agenda as Item 6G. 2. Ms. Cohen requested that Regular Agenda Item 8A, Discussion And Direction On The Terms Of The Purchase And Sale Agreement(S) For K Park, be moved up on the agenda and begins when the Related Ross Group arrives, due to outside counsel being present on Zoom. A motion was made by Councilwoman Siskind, seconded by Councilwoman Silvestri, and unanimously passed (5-0), to approve the Agenda as amended. 5. Ms. Hall read Ordinance No. 2024-09, Ordinance No. 2024-11, Ordinance No. 2024-10 and Ordinance No. 2024-12 by title. Ms. Cohen stated two of the Items are Quasi-Judicial and swore in the individuals who wished to speak on the item. The Village Council disclosed their Ex-Parte Communications and stated they could be fair and impartial. Robert Basehart, Director of Sustainability and Regulatory Affairs, presented the item. The Village Council asked questions regarding the zoning designation of the property, approvals and density. Mr. Basehart stated Council would have control over how the applications function and how they look. Mr. Stillings discussed single family zoning, number of units and project type. Mayor Napoleone stated the item is largely ministerial to bring us into compliance with the Building Code and FEMA. A motion was made by Councilwoman Siskind, seconded by Councilwoman Silvestri, and unanimously passed (5-0) to approve Ordinance No. 2024-23 (Flood Damage Prevention) as presented on first reading. At this point, Mr. Barnes stated the representatives from the Related Ross Group were not present yet. Therefore, the Village Council moved to Regular Agenda Item 8B. 8. REGULAR AGENDA A. 24-6825 DISCUSSION AND DIRECTION ON THE TERMS OF THE PURCHASE AND SALE AGREEMENT(S) FOR K PARK The Village Council reconvened the meeting at 7:54 pm. Ms. Cohen mentioned Attorney Adam Bregman. Mr. Barnes introduced the item and stated representatives from Elkus Manfredi Architects would also be on Zoom. Jordan Bargas, Partner/Related Ross, introduced the representatives from Related who provided an update regarding the master planning of the project and retail, community outreach, economic benefits assessment and preliminary traffic strategies. Kenneth Himmel, President of Related Ross, provided an update regarding Related Ross and programming. Kevin Ryan, Partner/Related Ross, show some of their previous projects. He discussed the updated plan for Wellington Village and Education In Motion (EiM). Kevin Crowder, Founder of Business Flare Economics Firm, provided an Economic Benefits Assessment Summary. Mr. Ryan reviewed the public input meeting they held on October 17, 2024 at the Wellington Community Center and expressed the majority of Village of Wellington Page 9 Village Council Action Summary - Final October 22, 2024 concerns from the public was traffic. Leonardo Rodriguez, Principal /Langan Engineering and Environmental Services, and Maximo Polanco, Traffic Engineer, discussed that they are looking at project access strategy and operations for the school, traffic, bus routes, main access to the school from 441, student drop-off and pick-up and roadway improvements. Karen Yung, EiM Co-Founder & Chief Collaboration Officer, briefly reviewed resident concerns with the school and stated she was able to answer a lot of questions for them. She referenced access for Village of Wellington Neighbors. Public Comment: 1. State Representative Katherine Waldron stated approximately 10 years ago the residents stated they wanted K-Park to remain a park. She expressed her concerns regarding the development. 2. Roxana Henry spoke regarding times for landscaping. 3. Bill Flack referenced 2015 and stated they wanted a botanical gardens which is a mixed use project. He highlighted the concerns of residents regarding the traffic and the school. 4. Phoebe Weseley read a statement into record regarding the project and referenced town hall meetings held in 2015. She mentioned the Vice Mayor. 5. Leslie Hingorani spoke regarding the project and the 55 acres. She stated there is a push for housing in Wellington. 6. Jim Mantrozos spoke regarding K-Park and said people do not want it developed and want it to remain green space. He mentioned the Vice Mayor recusing himself. 7. James Jordan spoke regarding the Wellington Village project and asked if the Council would consider a variance on the fence and wall rules. He said his development has an issue with the sound. 8. Brian Atkins said he is the pastor of Life Church. He stated they are extremely excited at this opportunity and referenced the project. He said the church is not receiving any money nor is he regarding this project. 9. Michael Whitlow stated he has been here since 1989 and stated Village of Wellington Page 10 Village Council Action Summary - Final October 22, 2024 Wellington should be kept from being overrun by development. He mentioned five surveys and said people did not want development in K-Park and stated they wanted gardens, etc. He stated he is very concerned. 10. Carol Coleman stated Wellington has always been a rural community and spoke regarding housing. She said there needs to be a moratorium on development and feels the equestrians are being driven away. 11. Lisa Kerkorian spoke regarding the project, traffic and stated she would be thrilled with Related and EiM coming to Wellington. 12. Maureen Brennan discussed the process and stated there was no RFP. She stated she does not know if the process of only engaging with one group is right. She mentioned the school. She stated that she feels more investigation needs to be completed regarding this project. 13. Barbara Williams provided some background regarding where she lives and asked how will traffic be reduced/managed and said she supports the project but expressed her concerns regarding density and the parking lot. 14. Vice Mayor McGovern read cards of those who did not wish to speak (Carol Silliman, Pinar Kama-O’Brien, Sarah Palmer, Angelika Schuette and Monica Nunes) into record. Mr. Barnes provided background information regarding K-Park. He responded to Council’s questions and spoke regarding the Town Hall meetings. Vice Mayor McGovern stated Ms. Yung should speak to the nonprofit component and the school. Ms. Yung provided background and spoke regarding the school and education. She stated this is a unique opportunity. Ms. Yung responded to Vice Mayor McGovern’s questions regarding the not for profit corporation. Vice Mayor McGovern referenced the Purchase and Sale Agreement (PSA) and asked when would a contract with EiM come about. Ms. Cohen stated that would have to be discussed with Council and the school. She stated she and Mr. Pincus (the Village’s outside counsel) have discussed the agreement. Ms. Cohen informed Council that Mr. Pincus and Mr. Bregman were both on Zoom tonight and briefly Village of Wellington Page 11 Village Council Action Summary - Final October 22, 2024 referenced the open terms of the contract. Councilwoman Antuña asked if Council could have a very clear understanding of what is happening now. Mr. Barnes explained the purpose of tonight’s agenda item. There was further discussion regarding what the Council would like to see in the agreement. Ms. Cohen summarized the direction given by Council. The Village Council gave comments regarding the project. Mr. Himmel gave brief comments regarding the project and financing. B. 24-6820 RESOLUTION NO. R2024-41 (ADOPTING NEW COUNCIL PROCEDURES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL REVISING THE RULES OF PROCEDURE FOR COUNCIL MEETINGS; AND PROVIDING AN EFFECTIVE DATE. The Village Council discussed this item after Public Hearing Item 7F. Mr. Barnes introduced the item. Ms. Cohen presented the proposed Council Procedures. Ms. Cohen responded to Council’s questions and comments regarding time limit for comments from the public, interested parties, and combination of items. Councilwoman Antuña asked when the rules would take effect. Ms. Cohen stated the new procedures will take effect immediately. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Antuña, and unanimously passed (5-0) to approve Resolution No. R2024-41 (Adopting New Council Procedures) as amended. At 7:39 pm, the Village Council took a 15 minute recess prior to the discussion of Item 8A. 9. PUBLIC FORUM Village of Wellington Page 12 Village Council Action Summary - Final October 22, 2024 Mr. Barnes indicated there was one comment card submitted for Public Forum. Public Comment: 1. Maureen Brennan spoke regarding interested party time in the Council Procedures. She asked who is driving the change regarding this and feels their ability to participate is being stymied. Councilwoman Silvestri discussed what Council voted on tonight with the procedures. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen stated she had no report. 11. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The Next Council Meeting will be held on November 12, 2024. Agenda Review will be held on Thursday, November 7, 2024. Vice Mayor McGovern inquired about Veterans’ Day programming. Ms. Cohen asked Council if they still would like to have a workshop with Mr. Pincus. Mr. Barnes discussed actions that were taken regarding post disaster permitting, list of impacted properties and temporary repairs and persons going into the field to be issued on site as inspectors go out, waiving of fees for renovation and reconstruction projects and any pending code cases in that area are closed. Water utility accounts will not be impacted by late fees, etc. Mayor Napoleone commended employees, community partners and residents who came together to help those impacted. He stated he has received very positive reports regarding staff and stated everyone was outstanding. The emergency site located at Village Park will change tomorrow. COUNCIL REPORTS COUNCILWOMAN SILVESTRI: Councilwoman Silvestri presented the following report: Councilwoman Silvestri commended Mr. Barnes, Nicole Coates, Palm Beach County Fire Rescue, Palm Beach Sheriff’s Office and Public Works. She stated everyone was amazing and it nice to see how the community came together. Councilwoman Silvestri stated early voting has begun and referenced the library as one of the early voting sites. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind waived comments and thanked everyone for coming together after the tornadoes. COUNCILWOMAN ANTUÑA: Councilwoman Antuña presented the following report: Councilwoman Antuña commended Mr. Barnes on his leadership during the storm and thanked everyone that had been involved. VICE MAYOR MCGOVERN: Vice Mayor McGovern presented the following report: Vice Mayor McGovern congratulated Maria on her Hispanic Heritage Leadership award that she will she receive from Hispanic Vote on Thursday night. Vice Mayor McGovern thanked and commended Eric Juckett, Michelle Garvey and the Parks and Recreation Team regarding all of their efforts for Fall Festival and thanked the residents who turned out for it. Vice Mayor McGovern stated neighbor helping neighbor is the hallmark of the Village. He commented that they heard from the White House in 24 hours, the county, Congresswoman Lois Frankel and Senator Rick Scott . He said recovery is a team effort at national, state and county levels -- -these partners are essential in getting everything done. He thanked Mr . Barnes, Ms. Quickel, Mr. De La Vega and the entire team. Vice Mayor McGovern stated he would like the residents to know that Wellington will be there for them. He stated alerts coming to cell phones are essential going forward. He commended Palm Beach County Fire-Rescue and Village of Wellington Page 14 Village Council Action Summary - Final October 22, 2024 PBSO for assisting Wellington. Mr. Barnes recognized the Village’s two local contractors who started working on Sunday: H&J Contracting and Reback Construction. He encouraged everyone to get their debris to the curb. Mr. Barnes commended Mr. Wagner and his team. MAYOR NAPOLEONE: Mayor Napoleone presented the following report: Mayor Napoleone thanked staff for the Fall Festival and stated he was very impressed with the haunted hallways. Mayor Napoleone congratulated Wellington Community High School (WCHS) on their homecoming parade and the game win. Mayor Napoleone said Palm Beach Central High School has their first homecoming parade on Friday and a game against Wellington Community High School. Mayor Napoleone stated information is on the website for the Village ’s Holiday Food Drive. 13.
