CALL TO ORDER Mayor Napoleone called the meeting to order at 4:03 pm. Council Members in Attendance: Mayor Michael J. Napoleone, Vice Mayor John T. McGovern, Councilwoman Tanya Siskind, Councilwoman Maria Antuña, and Councilwoman Amanda Silvestri. Mayor Napoleone led the Pledge of Allegiance. 2. REVIEW OF COUNCIL AGENDA Mr. Barnes mentioned that the Workshop Item, "Binks Forest Drive and Bent Creek Road Traffic Signal Discussion", would be moved to be heard first before the review of the agenda. Mr. Barnes introduced the agenda for the October 22, 2024 Regular Council Meeting for review. A. 24-6818 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF OCTOBER 8, 2024 Mr. Barnes introduced the item. He stated that this was Council approval of the Minutes of the Regular Wellington Council Meeting of October 8, 2024. He asked Council to provide comments, if any, to the Clerk's Office. B. 24-6775 AUTHORIZATION TO 1) TO RENEW AN EXISTING CONTRACT FOR ANNUAL ASPHALT MILLING, RESURFACING AND SEALCOATING VILLAGE-WIDE, AND 2) APPROVE EXISTING CONTRACTS FOR VARIOUS FY 2025 PUBLIC WORKS ROAD PROJECTS Mr. Barnes introduced the item. He stated that this was the Authorization to 1) To Renew An Existing Contract For Annual Asphalt Milling, Resurfacing and Sealcoating Village-Wide, and 2) Approve Existing Contracts For Various FY 2025 Public Works Road Projects. Mr. De La Vega explained the item. He noted that the Council awarded a contract to Ranger on October 10, 2023; the Village would like to exercise the first renewal option through October 9, 2025 with no price increases and noted the nine (9) projects for a total cost of $2,210,725.00. Mayor Napoleone asked had the Village been happy with Ranger for the last year. Mr. De La Vega answered a question from Mayor Napoleone. Mayor Napoleone asked if these have been identified by Engineering and Public Works Department as necessary improvements. Mr. Wagner answered a question from Mayor Napoleone. C. 24-6785 AUTHORIZATION TO CONTINUE UTILIZING A CITY OF PLANTATION CONTRACT, AS A BASIS FOR PRICING, WITH ALLIED UNIVERSAL CORPORATION, FOR THE PURCHASE AND DELIVERY OF SODIUM HYPOCHLORITE Mr. Barnes introduced the item. He stated that this was the Authorization to Continue to Utilizing A City of Plantation Contract, As a Basis for Pricing, with Allied Universal Corporation, For the Purchase and Delivery of Sodium Hypochlorite. Ms. Panse explained the item. She noted that the Council approved a City of Plantation piggyback contract for the purchase of this chemical two-years ago. She spoke about the proposed 3% increase in unit price from $1.50 to $1.55 a gallon. Mayor Napoleone asked if this is the best price for a must have item. Ms. Panse answered a question from Mayor Napoleone. Vice Mayor McGovern commented on the cost. D. 24-6800 AUTHORIZATION TO CONTINUE UTILIZING A SOUTHEAST FLORIDA COOPERATIVE CONTRACT FOR THE PURCHASE AND DELIVERY OF QUICKLIME Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing A Southeast Florida Cooperative Contract For the Purchase and Delivery of Quicklime. Ms. Panse explained the item. She noted that this is another cooperative contract bid by the City of Tamarac as the lead contract. She said that this contract proposes a 10% increase over last year's line price which would bring it to $494.77 per ton of lime. She said that this is budgeted in the Water Plant Budget. Mayor Napoleone asked if lime is being phased out and what is the timeline. R2024-54 (FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION’S FLORIDA RECREATIONAL DEVELOPMENT ASSISTANCE PROGRAM (FRDAP) GRANT FOR THE TENNIS COURT PROJECT AND RESOLUTION NO. R2024-55 FOR A BUDGET AMENDMENT TO ALLOCATE THE GRANT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL TO ENTER INTO AN AGREEMENT WITH THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION FOR THE PURPOSE OF RECEIVING A GRANT UNDER PROVISIONS OF THE FLORIDA RECREATION DEVELOPMENT ASSISTANCE PROGRAM (FRDAP) FOR THE TENNIS COURT PROJECT; AND PROVIDING AN EFFECTIVE DATE. RESOLUTION NO. Mr. Barnes introduced the item. He stated that this was the Resolution No. R2024-54 (Florida Department of Environmental Protection's Florida Recreational Development Assistance Program (FRDAP) Grant for The Tennis Court Project and Resolution No. R2024-55 For A Budget Amendment to Allocate the Grant). Ms. Quickel explained the item. She said that this grant is for $200,000 with a required match of $200,000 that has been included in the Fiscal Year 2025 Budget. Mayor Napoleone asked for the cost of the whole project. Ms. Quickel answered a question from Mayor Napoleone. She said that $1.2 million was budgeted for six (6) tennis courts. Mr. Basehart provided a brief overview of the ordinances. He noted that the Council passed all four ordinances on First Reading at the September 3, 2024 meeting. He noted that the two (2) Comprehensive Plans had been transmitted to the State. He mentioned that the Florida Department of Transportation (FDOT) has recommendations; nothing that is binding. Vice Mayor McGovern asked if the recommendations are in regards to roads. Mr. Basehart answered a question from Vice Mayor McGovern. Mayor Napoleone commented on placing a note in file. L. 24-6797 ORDINANCE NO. 2024-23 (FLOOD DAMAGE PREVENTION) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON CODE OF ORDINANCES CHAPTER 5 BUILDINGS AND BUILDING REGULATIONS, TO REVISE THE FLOOD INSURANCE STUDY DATE; SPECIFY ELEVATION OF MANUFACTURED HOMES IN FLOOD HAZARD AREAS; REFORMATTING AMENDMENTS TO THE FLORIDA BUILDING CODE, PROVIDING FOR APPLICABILITY AND SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Ordinance No. 2024-23 (Flood Damage Prevention). Mr. Mills explained the item. He noted that this is the First Reading. M. 24-6825 DISCUSSION AND DIRECTION ON THE TERMS OF THE PURCHASE AND SALE AGREEMENT(S) FOR K PARK Mr. Barnes introduced the item. He stated that this was the Discussion and Direction on the Terms of the Purchase and Sale Agreement(s) for K Park. He said that this is an opportunity for the Related Ross Team to provide an update on their efforts including engagement with different Village of Wellington Page 8 Village Council Workshop Action Summary - Final October 21, 2024 community groups and the community at large on their plan. Mayor Napoleone asked Mr. Barnes to explain what is the Council being asked to do and give direction on. Mr. Barnes answered a question from Mayor Napoleone. Ms. Cohen said that the Legal Department had made revisions to the Purchase and Sale Agreement (PSA) and transmitted it to Related's attorney; they are reviewing it and staff is awaiting their comments. She said that they expect the comments from them some time this week. Mayor Napoleone asked if there is one or two agreements. Ms. Cohen answered a question from Mayor Napoleone. Vice Mayor McGovern asked if the Village is getting both agreements in November if all goes according to the timeline. Mr. Barnes and Ms. Cohen answered a question from Vice Mayor McGovern. There was discussion regarding the agreements. Vice Mayor McGovern expressed his concerns that these projects be completed simultaneously and the legal components that are essential. There were comments and discussion regarding the PSA. Councilwoman Silvestri asked if a workshop could be scheduled with the attorney. Ms. Cohen answered a question from Councilwoman Silvestri. Vice Mayor McGovern asked where is the Village with Mast and Portman. Mr. Barnes answered a question from Vice Mayor McGovern. Councilwoman Silvestri commented on the process. Mr. Barnes responded to Councilwoman Silvestri's comment. Councilwoman Antuña asked what is the purpose of this for tomorrow night. Mayor Napoleone commented about the closing and comprehensive plan of the Lotis sale to Lennar. Mr. Barnes responded to Mayor Napoleone's comment. Vice Mayor McGovern asked if Mast and Portman had been made aware of the acreage, number of units and purchase price at Lotis II by Lennar. Mr. Barnes answered a question from Vice Mayor McGovern. Councilwoman Antuña asked can a set date be made. Mr. Barnes and Ms. Cohen answered a question from Councilwoman Antuña. Councilwoman Silvestri asked had anyone told the other firms that they need to come back before a certain date. Mr. Barnes answered a question from Councilwoman Silvestri. There were comments and discussion regarding other firms, Council's direction and botanical gardens. N. 24-6820 RESOLUTION NO. R2024-41 (ADOPTING NEW COUNCIL PROCEDURES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL REVISING THE RULES OF PROCEDURE FOR COUNCIL MEETINGS; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution Village of Wellington Page 10 Village Council Workshop Action Summary - Final October 21, 2024 No. R2024-41 (Adopting New Council Procedures). Ms. Cohen explained the item. She said that the changes had been made to the procedures as directed by the Council at the last meeting. She discussed the changes requested. There was discussion regarding interested parties and the time allotted. Ms. Cohen said that the procedures would be updated based on the comments at this meeting. She said that the redline version would provided to the Council before tomorrow's meeting. 3. WORKSHOP A. 24-6821 BINKS FOREST DRIVE AND BENT CREEK ROAD TRAFFIC SIGNAL DISCUSSION Mr. Barnes introduced the item. He said that this was the Binks Forest Drive and Bent Creek Road Traffic Signal Discussion. He said that Motasem Al-Turk. Ph.D., P.E. Division Director Engineering and Public Works - Traffic with Palm Beach County and Mr. Reinsvold have been working on this. Mr. Reinsvold provided a brief overview of the traffic signal. He said that the residents had been emailing requests for a full-time signal. He said that the Village asked Palm Beach County to do traffic studies of the area to see if the signal would be warranted. He said that the studies had come back that a signal is not warranted for full-time use but it is warranted for school time use. Mr. Reinsvold mentioned the golf cart ordinance and said that Dr. Al-Turk's team added a function on the lights where you can use the lights for pedestrians 24/7. Mr. Al-Turk spoke regarding traffic signals, interlocal agreement for municipal roads and the study. Mayor Napoleone asked for a copy of the study. Mr. Reinsvold answered a question from Mayor Napoleone. Mr. Al-Turk continued and discussed the study, resident requests and the Wellington Community High School signal. Mr. Al-Turk answered a question from Mayor Napoleone. There were comments and discussion regarding the school signals and signal times. 4. ATTORNEY'S COMMENTS Ms. Cohen said that a workshop had been scheduled for November 7, 2024 with the Little Ranches residents who own lots one (1) through twelve (12). She noted that only four (4) responses had been received from property owners indicating that they would be willing to accept a quit-claim deed that reserves an easement to Acme. She discussed the next steps. There were comments and discussion regarding the workshop. Ms. Cohen and Mr. Barnes responded to comments from Council. 5. MANAGER COMMENTS Mr. Barnes provided an update on the debris collection and post storm recovery efforts. He thanked Ms. Coates and Mr. Wagner for spear heading the effort to get this done. He said that there world be a walk-on agenda item for Coastal Waste & Recycling, Inc. for disposal of material in the amount around $50,000. Vice Mayor McGovern asked if the Village is able to utilize the site in Loxahatchee Groves. Mr. Barnes answered a question from Vice Mayor McGovern. Ms. Cohen said Coastal had already accepted all of the Village's changes. Mr. Barnes said that the Village is making good process. Mayor Napoleone commented on the fantastic job Public Works had done making sure that the streets are clean. Vice Mayor McGovern commented that it has been exceptional and by large, residents have been telling Council this. Mr. De La Vega said that the Village would be seeking reimbursement for the items. Vice Mayor McGovern asked if the 50th and 120th debris locations are being used.
