APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as amended. 1) Postpone Presentation Item 5A, Fiscal Year 2025 Keely Spinelli Grant Awards, to the November 12, 2024 Village Council Meeting. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0), to approve the Agenda as amended. 5. The Village Council disclosed any Ex-parte Communications . Kelly Ferraiolo entered the file into record and presented this item. Don Hearing, Cotleur & Hearing, referenced the history of the site and discussed the project. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Silvestri, and unanimously passed (5-0) to open the public hearing. Public Comment: 1. Douglas Henry expressed his concerns regarding the access point. There being no further public comments, a motion was made by Councilwoman Silvestri, seconded by Vice Mayor McGovern, and unanimously passed (5-0) to close the public hearing. B. 24-6668 ORDINANCE NO. 2024-14 (AUTHORIZING THE PLACEMENT, INSTALLATION AND OPERATION OF A SPEED DETECTION SYSTEM WITHIN WELLINGTON SCHOOL ZONES AND PROVIDING FOR TRAFFIC ENFORCEMENT PROCEDURES) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL CREATING ARTICLE VI OF CHAPTER 22 OF THE VILLAGE’S CODE OF ORDINANCES TO AUTHORIZE THE PLACEMENT, INSTALLATION, AND OPERATION OF SPEED DETECTION SYSTEMS ON ROADWAYS MAINTAINED AS SCHOOL ZONES, ESTABLISHING TRAFFIC ENFORCEMENT PROCEDURES WHEN SPEED DETECTION SYSTEMS ARE UTILIZED FOR SCHOOL ZONE SPEED LIMIT VIOLATIONS, AND CREATINGE HEARING PROCEDURES RELATING TO SUCH SCHOOL ZONE SPEED LIMIT VIOLATIONS; PROVIDING FOR IMPLEMENTATION; PROVIDING FOR CODIFICATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes recommended that there be one concurrent staff presentation since the items (Ordinance No. 2024-14 and Resolution No. R2024-52) are related; with a separate motion for each item. Ms. Hall read the Ordinance and Resolution by title. Mr. De La Vega presented this item. Mr. Barnes provided background information regarding the Village speaking with RedSpeed Florida LLC. There was discussion regarding the rankings, the vendors the Village had spoken or met with and how the citation process would work. David De La Espriella, Vice President Client Relations & Sales/RedSpeed Florida, explained the citation process. Neil M. Schiller, Esq., Government Law Group, spoke regarding other clients that have contracts with RedSpeed Florida. Mr. Barnes, Mr. De La Vega, Mr. De La Espriella and Mr. Schiller responded to the Village Council's questions regarding RedSpeed Florida, Contract, Cameras, Florida Statutes, Data, Citations and costs. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to approve Ordinance No. 2024-14 (Authorizing The Placement, Installation And Operation Of A Speed Detection System Within Wellington School Zones And Providing For Traffic Enforcement Procedures) as presented on first reading. C. 24-6675 RESOLUTION NO. R2024-52 (SPEED DETECTION CAMERA SYSTEM FOR SCHOOLS) A RESOLUTION OF WELLINGTON, FLORIDA'S COUNCIL AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AN AGREEMENT BETWEEN WELLINGTON AND REDSPEED FLORIDA LLC TO PROVIDE THE TRAFFIC REPORT SERVICES FOR THE VILLAGE'S SCHOOL ZONES, AND TO INSTALL AND OPERATE THE SDS SYSTEMS ON BEHALF OF THE VILLAGE TO ENFORCE SCHOOL ZONING SPEEDING VIOLATIONS; AND PROVIDING AN EFFECTIVE DATE This Item was discussed in conjunction with Item 7B. Vice Mayor McGovern discussed further information he would like to have for the next meeting. D. 24-6768 ORDINANCE NO. 2024-15 (NOISE STANDARDS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, Village of Wellington Page 5 Village Council Action Summary - Final October 8, 2024 AMENDING THE WELLINGTON CODE OF ORDINANCES CHAPTER 13, ARTICLE II (NOISE STANDARDS), SECTIONS 13-4 TO 13-8, TO PROVIDE DEFINITIONS AND CLARIFY PERMISSIBLE SOUND LEVELS AS MORE SPECIFICALLY CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced this item. Ms. Hall read the Ordinance by title. Mr. Stillings presented this item. Ms. Cohen stated Mr. Stillings has proposed additional language as mentioned by Councilwoman Silvestri and explained the language in regards to the Palm Beach County code. Mr. Stillings and Ms. Cohen answered the Village Council's questions. There was further discussion regarding the addition of language for animal noise to the ordinance prior to second reading. Public Hearing A motion was made by Vice Mayor McGovern, seconded by Councilwoman Silvestri, and unanimously passed (5-0) to open the public hearing. There being no public comments, a motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to close the public hearing. Vice Mayor McGovern commented about an email received by Council. Mr. Stillings stated they spoke with a group of residents in August and last week sent them drafts of the ordinances for this meeting and the draft of the proposed vacation rental ordinance changes going before the Planning, Zoning and Adjustment Board next week. There was discussion regarding providing copies of the ordinances passed on first reading tonight to the residents that staff met with previously and to make them aware of the date for second reading. Mr. Barnes discussed staff efforts pertaining to state law and the Village’s enforcement of laws. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to approve Ordinance No. 2024-13 (Code Of Ordinances Amendment To Chapter 21- Business Tax Receipts) as presented on first reading. 8. REGULAR AGENDA A. 24-6762 RESOLUTION NO. R2024-41 (COUNCIL PROCEDURES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL REVISING THE RULES OF PROCEDURES FOR COUNCIL MEETINGS; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. Ms. Cohen discussed the proposed Council Procedures. Public Comment: 1. Dr. Kristy Lund spoke regarding the proposed time limits for interested parties, public and the combination of applications. 2. Maureen Brennan spoke regarding the proposed time limits for interested parties and the reason for the change. 3. Jill Townsend spoke regarding the proposed time limits for the public and the number of days for interested parties to sign up. There was discussion between the Village Council, Ms. Cohen and Mr. Stillings regarding the sign up for interested parties, time limit for interested parties and the “no stacking” of time. Ms. Cohen stated that she would bring the redline and clean version of the Council Procedures with the changes discussed back to Council at the October 22, 2024 Council Meeting. 9. PUBLIC FORUM Village of Wellington Page 11 Village Council Action Summary - Final October 8, 2024 Mr. Barnes indicated there were no comment cards submitted for Public Forum. 10. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen referenced letters of interest for K-Park and asked for authorization to retain outside counsel. A motion was made by Vice Mayor McGovern, seconded by Councilwoman Siskind, and unanimously passed (5-0) to authorize Ms. Cohen to retain outside counsel to negotiate the terms of a contract, so as to protect the Village, with Related. Ms. Cohen spoke regarding the letters to property owners in Little Ranches. She stated eleven letters were sent out and four responses have come back. Ms. Cohen referenced an email from Ms. Edwards-Walpole regarding Mr. Knopp’s two properties. There was brief discussion regarding this issue. 11. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The Next Council Meeting will be held on October 22, 2024. Mr. Barnes provided a brief hurricane update. 12. COUNCIL REPORTS COUNCILWOMAN SILVESTRI: Councilwoman Silvestri presented the following report: Councilwoman Silvestri stated today is her son’s 10th birthday. Councilwoman Silvestri encouraged everyone to stay safe in the storm. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind said for everyone to stay safe in the storm. COUNCILWOMAN ANTUÑA: Councilwoman Antuña presented the following report: Village of Wellington Page 12 Village Council Action Summary - Final October 8, 2024 Councilwoman Antuña thanked everyone for wearing Pink in honor of Breast Cancer Awareness Month. She stated her sister and cousin are survivors of breast cancer. Councilwoman Antuña commented that the Public Safety Night event was great and thanked PBSO for the awesome job that they do. Councilwoman Antuña stated the 40th Anniversary event for Palm Beach County Fire-Rescue was also awesome.
