CALL TO ORDER Mayor Napoleone called the meeting to order at 4:00 pm. Council Members in Attendance: Mayor Michael J. Napoleone, Vice Mayor John T. McGovern, Councilwoman Tanya Siskind, Councilwoman Maria Antuña, and Councilwoman Amanda Silvestri. Mayor Napoleone led the Pledge of Allegiance. 2. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the October 8, 2024 Regular Council Meeting for review. A. 24-6763 FISCAL YEAR 2025 KEELY SPINELLI GRANT AWARDS Mr. Barnes introduced the item. He stated that this was the Fiscal Year 2025 Keely Spinelli Grant Awards. He said that members of the School Board and district staff will be present to receive their awards. B. 24-6779 PURCHASING DEPARTMENT RECOGNITION Mr. Barnes introduced the item. He stated that this was the Purchasing Department Recognition. Mr. De La Vega explained the item. He noted that Wellington is one (1) of the one hundred and ninety-eight (198) agencies in the United States and Canada, and one (1) of seventy-two (72) cities to receive the award. He said that the Village is very excited to honor the Purchasing Department. C. 24-6771 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF SEPTEMBER 19, 2024 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meeting of September 19, 2024. He asked Council to provide comments, if any, to the Clerk's Office. D. 24-6773 AUTHORIZATION TO 1) UTILIZE EXISTING CONTRACTS AND AWARD SOLE SOURCE CONTRACTS, AND 2) APPROVE VARIOUS FY 2025 SURFACE WATER AND ROAD PROJECTS Mr. Barnes introduced the item. He said that this was the Authorization to 1) Utilize Existing Contracts and Award Sole Source Contracts, and 2) Approve Various FY 2025 Surface Water and Road Projects. Mr. De La Vega explained the item. Mayor Napoleone commented on the products planned. Mr. De La Vega responded to Mayor Napoleone's comment. E. 24-6777 AUTHORIZATION TO AWARD CONTRACTS TO MULTIPLE FIRMS FOR CIVIL ENGINEERING AND RELATED CONSULTING SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Award Contracts to Multiple Firms For Civil Engineering and Related Consulting Services. Mr. De La Vega explained the item. He noted the Request for Qualifications (RFQ) issued on June 16, 2024, thirteen (13) proposals received on July 17, 2024; and the presentations and interviews that were held on August 14, 2024 with the short listed firms. Vice Mayor McGovern asked if this is authorization to let staff negotiate the contracts or have they been done. Mr. De La Vega answered a question from Mayor McGovern. Mayor Napoleone asked how this is done. Mr. De La Vega answered a question from Mayor Napoleone. Mayor Napoleone asked if the Village had worked with the top five (5) firms before. Mr. Barnes noted that modifications had been made this round that allows the Village to utilize these contracts on any federally funded project and remove local preference. Councilwoman Antuña asked about the rankings listed on page 60 of the agenda. Mr. De La Vega answered a question from Councilwoman Antuña. R2024-53 (EMPLOYEE HEALTH INSURANCE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE MANAGER TO (1) AWARD A CONSUMER DRIVEN HEALTH PLAN (CDHP) AGREEMENT WITH CIGNA HEALTHCARE TO PROVIDE HEALTH INSURANCE TO ELIGIBLE EMPLOYEES, DEPENDENTS, AND RETIREES, AND APPROVE HRA FUNDING FOR EACH ELIGIBLE EMPLOYEE TO COVER ALL COSTS ASSOCIATED WITH ANNUAL DEDUCTIBLES; (2) RENEW A CONTRACT WITH CIGNA TO PROVIDE DENTAL INSURANCE TO ELIGIBLE EMPLOYEES, DEPENDENTS, AND RETIREES; (3) RENEW A CONTRACT WITH EYEMED TO PROVIDE VISION INSURANCE TO ELIGIBLE EMPLOYEES, DEPENDENTS AND RETIREES; (4) RENEW A CONTRACT WITH NEW YORK LIFE TO PROVIDE LIFE/AD&D AND DISABILITY INSURANCE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution No. R2024-53 (Employee Health Insurance). Mr. De La Vega explained the item. He discussed the cost of Employee Health Insurance, HRA Funding, Cigna Dental, EyeMed and New York Life to provide Life/AD&D insurance. He said that the current monthly contributions and the proposed contributions are located on page 76 of the agenda. Mayor Napoleone commented on the coverage for out-of-network services. Barbara Houghtaling, Associate Benefits Consultant at Gehring Group, responded to Mayor Napoleone's comment. Vice Mayor McGovern commented on the out-of-network coverage. Ms. Houghtaling responded to Vice Mayor McGovern's comment. There was discussion regarding the cost savings and benefits. Mr. Barnes noted that the Village is covering the health reimbursement accounts for employees. G. 24-6767 RESOLUTION NO. He stated that this was Ordinance No. 2024-14 (Authorizing the Placement, Installation and Operation of A Speed Detection System within Wellington School Zones and Providing for Traffic Enforcement Procedures). He said that this would be discussed in conjunction with the next item Resolution No. R2024-52. Mr. De La Vega explained the item. He noted that the Florida Legislature passed House Bill 657 to permit the use of speed detection systems to enforce speeding within school zones; this law became effective July 1, 2023. He discussed the requirements per the State Statutes and noted the cost listed on page 145 of the agenda. Mayor Napoleone asked had this been tested anywhere. Mr. De La Vega and Ms. Cohen answered a question from Mayor Napoleone. Mayor Napoleone commented about the complaints regarding speeding on the roads. He asked if there would be points issued on the license since this is a citation. Ms. Cohen responded to Mayor Napoleone's comment and question. Vice Mayor McGovern asked what does the Village have to do to make this happen and maintain it operationally. Ms. Cohen and Ms. Barnes answered questions from Vice Mayor McGovern. Neil M. Schiller, Esq., Government Law Group, spoke regarding the uniform traffic citation (UTC) process. Mayor Napoleone asked where is RedSpeed being operated in Florida now. Mr. Schiller answered a question from Mayor Napoleone. Councilwoman Antuña asked if the Palm Beach County Sheriff's Office (PBSO) would be involved. Mr. Schiller answered a question from Councilwoman Antuña. There was discussion regarding the citation issuance process. Vice Mayor McGovern asked Ms. Cohen to circulate the Florida Statute regarding the issuance of a citation. Councilwoman Antuña asked if PBSO would have a presence to a certain extent. Mr. Barnes answered a question from Councilwoman Antuña. Councilwoman Silvestri asked about the money that would go the School District regarding the hardening and walking conditions. She asked about the need for Wellington High School and Palm Beach Central High School being included in the school zones. Mr. Schiller and Mr. Barnes answered questions from Councilwoman Silvestri. Councilwoman Silvestri commented on fines for speeding. Mr. Barnes responded to Councilwoman Silvestri's comment. There were comments and discussion regarding RedSpeed and PBSO enforcement at the same time. Mayor Napoleone asked how many readings does this take to pass. She said that every time the Budget is adopted we are required to update the Capital Improvement Element of the Comprehensive Plan and reference the Palm Beach County School District 10-year Capital Improvement Schedule. O. 24-6753 ORDINANCE NO. 2024-13 (CODE OF ORDINANCES AMENDMENT TO CHAPTER 21- BUSINESS TAX RECEIPTS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON CODE OF ORDINANCES, MORE SPECIFICALLY, TO MODIFY AND CLARIFY CERTAIN PROVISIONS IN CHAPTER 21 (TAXATION) RELATED TO BUSINESS TAX RECEIPTS (BTR), AS CONTAINED HEREIN; TO ESTABLISH THE FINDINGS AND IMPLEMENTATION OF BTR; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AND EFFECTIVE DATE. She noted the discussion with the Legal Department regarding clarifying the different type of rentals that require a Business Tax Receipt (BTR). She mentioned that this does not change the procedures or anything with the Village's current practices and fees. Mayor Napoleone asked did the Village not have any definition before or are new ones being added. Ms. Cramer answered questions from Mayor Napoleone. R2024-41 (COUNCIL PROCEDURES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL REVISING THE RULES OF PROCEDURES FOR COUNCIL MEETINGS; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Resolution No. R2024-41 (Council Procedures). Ms. Cohen explained the item. She said that these are the proposed new Council Procedures that were discussed at length during the workshop. She said that all of the requested changes by Council have been made. She noted that the procedures were included as part of the record at the last meeting. Mayor Napoleone commented on the Council Procedures. There were comments and discussion regarding the procedures and changes. 3. WORKSHOP None. 4. ATTORNEY'S COMMENTS Ms. Cohen said that Legal is prepared to engage with a law firm; in event that the Council provides direction at tomorrow night's meeting to move forward with negotiating the purchase and sale agreement with the Related Group. She noted that the firm has represented another Related entity in the past and they have asked Related and the Village for a conflict wavier as part the agreement. Legal would be executing a conflict waiver. Mayor Napoleone asked did the firm last represent Related. Vice Mayor McGovern commented that he thought that the Council gave the instruction to hire the lawyer at the last meeting. There was discussion regarding the different offers and hiring a lawyer. 5. MANAGER COMMENTS Mr. Barnes provided an update on the Village preparation for Hurricane Milton. There were comments and discussion regarding the regular planning meetings during Hurricane Milton. Ms. Cohen and Mr. Barnes responded to comments and questions from Council. Mr. Barnes spoke about the Village programs and school closures. Vice Mayor McGovern asked about the five o'clock update. Ms. Coates answered a question from Vice Mayor McGovern. Councilwoman Antuña asked if there was an emergency number for residents. Mr. Barnes answered a question from Councilwoman Antuña. Mayor Napoleone asked if the information is available on the Village website. Ms. Quickel answered a question from Mayor Napoleone. Ms. Coates spoke about the County declaring a State of Emergency.
