CALL TO ORDER Mayor Margolis called the meeting to order at 3:00 pm. 2. REVIEW OF COUNCIL AGENDA Mr. Schofield presented the Agenda for the January 28th Council Meeting for discussion and review. A. 13-0441 PRESENTATION BY REPRESENTATIVE MARK PAFFORD OF THE UPCOMING LEGISLATIVE SESSION Mr. Schofield presented the item. No changes. B. 14-32 PRESENTATION BY THE SCHOOL BOARD OF PALM BEACH COUNTY AND WELLINGTON PUBLIC SCHOOL PRINCIPALS HONORING COUNCIL AND THE EDUCATION COMMITTEE FOR THEIR COMMITMENT TO EDUCATION Mr. Schofield presented the item. No changes. C. 13-0450 PALM BEACH COUNTY SHERIFF’S OFFICE DISTRICT 8 FY13 ANNUAL REPORT PRESENTATION Mr. Schofield presented the item. Mayor Margolis believed the group from the Soap Box Derby would be in attendance to present the challenge. H. 14-73 ORDINANCE NO. 2014-02 (RETAIL SALE OF DOGS AND CATS/PROHIBITION OF PUPPY AND KITTEN MILLS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES BY CREATING A NEW SECTION 14-2, ENTITLED “RETAIL SALE OF DOGS AND CATS/PROHIBITION OF PUPPY AND KITTEN MILLS”; PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE. Mr. Schofield presented the item and stated it was the second reading for adoption. Ms. Cohen explained the changes to the ordinance. Councilwoman Gerwig was concerned about allowing 20 puppies or kittens when the size of the property was not defined. Ms. Cohen stated Council could change the number. Councilman Greene also thought 20 was a lot of puppies or kittens. Councilman Willhite asked to change 8 animals to a cage, kennel or carrier to 2. Councilman Greene questioned if they could search the Business Tax Returns for any registered private breeders. Ms. Cohen stated they could do that. Councilman Greene suggested they discuss the number of animals and define the size of the cage, kennel or carrier. I. 13-0437 ORDINANCE NO. 2013-12 (VILLAGE HALL COMPREHENSIVE PLAN AMENDMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, AMENDING THE FUTURE LAND USE MAP IN THE VILLAGE OF WELLINGTON COMPREHENSIVE PLAN CHANGING THE FUTURE LAND USE DESIGNATION OF CERTAIN PARCEL KNOWN AS VILLAGE HALL, TOTALING 5.11 ACRES, MORE OR LESS, LOCATED ON THE NORTHWEST CORNER OF FOREST HILL BOULEVARD AND WELLINGTON TRACE, AS MORE SPECIFICALLY DESCRIBED HEREIN, FROM RESIDENTIAL E (5.01 DU/AC – 8.0 DU/AC) TO INSTITUTIONAL/PUBLIC FACILITIES/UTILITIES; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Cohen clarified this was not quasi-judicial but legislative. Mr. Stillings stated he did not believe so, ould look to see if Council approved this ordinance already. J. 14-56 ORDINANCE NO. 2014-01 (UPDATED TRAVEL AND TRAINING REIMBURSEMENT POLICY AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 2 “ADMINISTRATION” DIVISION 3 “REIMBURSEMENT FOR TRAVEL AND TRAINING” OF THE CODE OF ORDINANCES OF THE VILLAGE OF WELLINGTON; PROVIDING A REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item and stated it was the second reading for adoption. No changes. K. 14-48 RESOLUTION NO. R2014-09 ELIMINATING FLUORIDATION OF WELLINGTON’S PUBLIC DRINKING WATER SUPPLY AND REMOVING EXISTING FLUORIDATION FACILITIES A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ELIMINATING FLUORIDATION OF WELLINGTON’S PUBLIC DRINKING WATER SUPPLY AND REMOVING FLUORIDATION FACILTIES; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Mr. Riebe was there to discuss the item. Mayor Margolis asked Council how much time they should give the expert/scientist from Tallahassee to speak. Council discussed the issue, and they decided they would be flexible in allotting time for speaking. L. 13-0443 AUTHORIZATION TO AWARD A CONTRACT FOR LOBBYING SERVICES Mr. Schofield presented the item. Ms. Cohen explained the contract for Mr. Ramba or David Ramba Consulting Group included the requirement for general liability insurance coverage, but he was asking for it to be waived. Councilman Willhite asked if milestones could be included in the contract to measure the return on investment in dollars, hours or work. Ms. Cohen indicated Council could include that if they wanted to, but they were not locked into the contract and could terminate it at any time. Councilman Willhite questioned the amount and length of the contract for 2014. Ms. Cohen stated they would include the prorated amount in the contract. Councilwoman Gerwig asked if the other or previous lobbyists carried general liability insurance. Ms. Cohen said she could check that. Mayor Margolis stated in the written reports submitted by the lobbyists, he would like to see who the lobbyists met with, what legislation was reviewed Village of Wellington Page 3 Village Council Workshop Action Summary - Final January 27, 2014 and the number of legislative contacts made specific to the Village. Councilman Willhite thought during the legislative session they should produce weekly reports instead of monthly. Mayor Margolis asked, if Council decided these clauses should be added to the contract, if a representative from the Ramba Group would be present tomorrow to discuss them. Ms. Cohen stated she would check with the Ramba Group to see if someone would be attending. Councilwoman Gerwig asked Ms. Cohen about the different ethics rules regulating lobbyists versus other professionals such as attorneys or elected officials. Ms. Cohen stated she would get that information. M. 14-29 REQUEST FOR PAYMENT OF LEGAL EXPENSES INCURRED BY MAYOR BOB MARGOLIS RELATING TO ETHICS COMPLAINTS Mr. Schofield presented the item. Mayor Margolis recused himself from the discussion. Ms. Cohen explained the history of the agenda item. No changes. MANAGER COMMENTS Mr. Schofield indicated Council would have to convene as the Acme Board of Supervisors for the Annual Landowners meeting.
