CALL TO ORDER Mayor Margolis called the meeting to order at 7:00 p.m. 2. PLEDGE OF ALLEGIANCE Mayor Margolis led the Pledge of Allegiance. 3. INVOCATION 4. APPROVAL OF AGENDA Mr. Schofield presented the Agenda recommending approval with the following amendments: (1) Regular Agenda item 8A: Palm Beach Horse Park of Wellington was withdrawn; and (2) add to Regular Agenda as item 8C: Resolution No. R2014-08 (Special Use Permit for the Just World Fundraising Event). A motion was made by Councilwoman Gerwig, seconded by Vice Mayor Coates, and unanimously passed (5-0) approving the Agenda as amended. 5. PRESENTATIONS AND PROCLAMATIONS 6. CONSENT AGENDA Council opened the floor up for public comments on the Consent Agenda. There were no public comments. Mr. Schofield presented the Consent Agenda recommending approval as presented. A motion was made by Vice Mayor Coates, seconded by Councilwoman Gerwig, and unanimously passed (5-0) approving the Consent Agenda as presented. R2014-03 (APPROVAL OF SERVICE OF PROCESS ACCEPTANCE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE VILLAGE ATTORNEY AND/OR ASSISTANT VILLAGE ATTORNEY TO ACCEPT SERVICE OF PROCESS ON BEHALF OF THE VILLAGE OF WELLINGTON; AND PROVIDING AN EFFECTIVE DATE. R2014-01 (THE RIDGE AT WELLINGTON EQUESTRIAN SPECIAL PERMIT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AN EQUESTRIAN SPECIAL PERMIT FOR THE RIDGE AT WELLINGTON AT 14415 AND 14535 PALM BEACH POINT BOULEVARD FOR EQUESTRIAN SHOWS FROM JANUARY 15, 2014 TO APRIL 30, 2014; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the Agenda item. Ms. Rodriguez read the resolution by title. Ms. Cohen announced that this was a quasi-judicial hearing. She administered the oath to those people who indicated they would be speaking on this item. Council disclosed their ex-parte communications. A motion was made by Vice Mayor Coates, seconded by Councilwoman Gerwig, and unaimously passed (5-0) approving Resolution No. R2014-01 as amended. B. 13-0412 RESOLUTION NO. R2014-04 (GRAND PRIX FARMS - LOT 8 SPECIAL USE PERMIT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A SPECIAL USE PERMIT FOR TWO (2) TEMPORARY ACCESS POINTS ON GENE MISCHE WAY LOCATED AT 3256 GRAND PRIX FARMS DRIVE TO BE USED FROM JANUARY 15, 2014 TO APRIL 30, 2014; AND PROVIDING AN EFFECTIVE DATE. A motion was made by Councilwoman Gerwig, seconded by Vice Mayor Coates, and passed (4-1) with Councilman Willhite dissenting, approving Resolution No. R2014-04. C. 13-0442 ORDINANCE NO. 2014-02 (RETAIL SALE OF DOGS AND CATS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES BY CREATING A NEW SECTION 14-2, ENTITLED “RETAIL SALE OF DOGS AND CATS”; PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Schofield introduced the Agenda item. Ms. Rodriguez read the ordinance by title. Ms. Cohen explained the item. Council expressed concern about there being the opportunity for puppy mills on the larger property. They requested that Council look at the County's ordinance in terms of breeding; and also to look at the City of Parkland's ordinance prior to Second Reading. A motion was made by Vice Mayor Coates, seconded by Vice Mayor Coates, seconded by Councilman Greene, and unanimously passed (5-0) approving Ordinnce No. 2014-02 on First Reading. D. 13-0410 ORDINANCE NO. 2014-01 (UPDATED TRAVEL AND TRAINING REIMBURSEMENT POLICY) AN ORDINANCE OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA AMENDING CHAPTER 2 “ADMINISTRATION” DIVISION 3 “REIMBURSEMENT FOR TRAVEL AND TRAINING” OF THE CODE OF ORDINANCES OF THE VILLAGE OF WELLINGTON; PROVIDING A REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes presented the staff report. Councilwoman Gerwig recused herself from this item. A motion was made by Councilman Willhite, seconded by Councilman Greene, and passed (3-1) with Vice Mayor Coates dissenting, directing staff to negotiate a contract price for the design of a new Wellingotn Communtiy Center and Tennis Facility with the companies as they were ranked by the Selection Committee. Councilwoman Gerwig recused herself from this item. C. 14-37 RESOLUTION NO. R2014-08 (SPECIAL USE PERMIT FOR THE JUST WORLD FUNDRAISING EVENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A SPECIAL USE PERMIT FOR THE JUST WORLD INTERNATIONAL FUNDRAISING EVENT UTILIZING OUTDOOR AMPLIFIED MUSIC TO BE HELD AT 3206 AND 3224 OLDE HAMPTON DRIVE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield introduced the Agenda item. Ms. Rodriguez read the resolution by title. Mr. Stillings presented the staff report. A motion was made by Councilwoman Gerwig, seconded by Councilman Greene,, and unaimously passed (5-0) approving Resolution No. R2014-08. 9. PUBLIC FORUM 10. ATTORNEY'S REPORT Ms. Cohen: No report 11. MANAGER'S REPORT Mr. Schofield presented the following report: 1. Next Regular Council meeting was scheduled for January 28, 2014 at 7:00 p.m. The Annual Landowners Meeting of the Acme Improvement District will immediately follow the conclusion of the Council Meeting. 2. Village Offices would be closed on Monday, January 20th for the Martin Luther King Holiday. 12. COUNCIL REPORTS Councilwoman Gerwig presented the following report: 1. Requested that next year the Village hold a National Day of Service Day as they had done in the past. 2. Requested that the Village look at different applications (apps), i.e., recreational events, that would provide the residents with more updated information. Vice Mayor Coates presented the following report: 1. With regard to fluoridation, Vice Mayor Coates said that he would take ownership of this and requested that Council conduct a Workshop to discuss Village of Wellington Page 4 Village Council Action Summary - Final January 14, 2014 this item. Mr. Schofield indicated they would presenting it on January 28. Councilman Greene presented the following report: 1. He thought it was unfortunate that the Horse Park had been withdrawn. He thanked Mr. VanDell and his group for their efforts on this item. He also thanked staff for their work on this. 2. He was happy to see the people from Wellington Christian at the meeting. He mentioned the extensive conversations he has had with people in the community. He thought others could reach out to their networks to seek assistnace for this so that the school doesn't have to close. 3. He noted that he had spoken to Mr. Schofield about issues he wanted to discuss over the coming months: Equestrian Preserve Element of the Comprehensive Plan; and opportunities to acquire land; Multifamily housing; hours of operating for business; code enforcement fine policy, K-Park and crime areas. Councilman Willhite presented the following report: 1. He thought that it was tragic Wellington Christian would be closing its high school. He understood the separation between Church and State, but asked Mr. Schofield if there was anything that the Village could do to assist them. Mr. Schofield noted that staff had met with the school and the Village would be providing the use of its stage. He said staff would stream the event information on the website and Channel 18. 2. He noted that the Village was still experiencing so many technical problems which he couldn't understand because the Village has given so much money to these efforts. 3. He spoke on fluoridation. He noted that he did not support fluoridation, and supported having a workshop. 4. He wanted to discuss a policy that would allow Council to delay hearing applications that have pending open cases until those cases are resolved. 5. Councilman Willhite asked for Council support to hold a workshop to see if they had any common goals for 2014 and to clear their pending list of issues. Mayor Margolis presented the following report: 1. He raised his concerns about the responsibilities of the Canvassing Board and what they can and cannot do. He noted that at the last election Canvassing Board members were actively campaigning for candidates, and he thought that according to the State Statute they should have recused themselves from serving on the Board. He indicated that he has requested a formal opinion from the state regarding this. 13. ADJOURNMENT NOTICE Village of Wellington Page 5
