CALL TO ORDER Mayor Margolis called the meeting to order at 3:00 pm. 2. REVIEW OF COUNCIL AGENDA Mr. Schofield presented the Agenda for the January 14th Council Meeting for discussion and review. A. 13-0458 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF NOVEMBER 12, 2013 AND NOVEMBER 26, 2013 Mr. Schofield presented the item. No changes. B. 13-0007 AUTHORIZATION TO CONTINUE UTILIZING CONTRACTS FOR THE LEASE, PURCHASE, MAINTENANCE, AND SERVICE OF OFFICE MULTIFUNCTIONAL COPYING EQUIPMENT Mr. Schofield presented the item. No changes. C. 13-0328 AUTHORIZATION OF DISPOSITION OF SURPLUS TANGIBLE PERSONAL PROPERTY Mr. Schofield presented the item. Councilwoman Gerwig asked if the Village would be able to donate their surplus laptops and Dell computers to Binks Forest. Mr. Schofield stated as part of their surplus policy they could look to the 501(c)(3)’s or other public entities to donate the equipment. He did not believe any of it had any serviceable life, but he would have Mr. Silliman look into it. Councilwoman Gerwig requested that staff contact the schools because their computers were aged and had not been replaced. Vice Mayor Coates asked where the proceeds came back into the budget and if it was found money. Mr. Schofield stated it was part of the budget process and was really never found money. He said when they acquire an asset there is a cost when they sell it, there is a number reported in the budget and staff could show that to him. Vice Mayor Coates said he was curious to know what they historically have been able to realize from these liquidations. Councilman Willhite thought with the number of surplus items and vehicles, they needed to come up with a practice or policy. He wanted something that better showed if they directed it all to the County or had an auction as well as showed the value of the surplus. He stated the transparency aspect needed to show it was being done through a process. Mr. Schofield indicated they had a disposal process, which was a policy that was adopted by Council, and staff would provide a copy of the policy to Council. D. 13-0411 RESOLUTION NO. R2014-03 (APPROVAL OF SERVICE OF PROCESS ACCEPTANCE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL Village of Wellington Page 1 Village Council Workshop Action Summary - Final January 13, 2014 AUTHORIZING THE VILLAGE ATTORNEY AND/OR ASSISTANT VILLAGE ATTORNEY TO ACCEPT SERVICE OF PROCESS ON BEHALF OF THE VILLAGE OF WELLINGTON; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Cohen explained the service process. No changes. E. 13-0440 RESOLUTION NO. R2014-05 (INVESTMENT POLICY) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING A REVISED INVESTMENT POLICY FOR THE VILLAGE OF WELLINGTON AND ACME IMPROVEMENT DISTRICT; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Quickel indicated Steve Alexander, their investment advisor from PFM Asset Management, was there to review the policy with Council. No changes. F. 13-0406 RESOLUTION NO. R2014-01 (THE RIDGE AT WELLINGTON EQUESTRIAN SPECIAL PERMIT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AN EQUESTRIAN SPECIAL PERMIT FOR THE RIDGE AT WELLINGTON AT 14415 AND 14535 PALM BEACH POINT BOULEVARD FOR EQUESTRIAN SHOWS FROM JANUARY 15, 2014 TO APRIL 30, 2014; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Mr. Stillings and Mr. Riebe reviewed the permit with Council. Councilwoman Gerwig questioned the two foot wide apron in condition #16. Mr. Riebe stated he would have an answer or explanation for Council by tomorrow. G. 13-0412 RESOLUTION NO. R2014-04 (GRAND PRIX FARMS - LOT 8 SPECIAL USE PERMIT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A SPECIAL USE PERMIT FOR TWO (2) TEMPORARY ACCESS POINTS ON GENE MISCHE WAY LOCATED AT 3256 GRAND PRIX FARMS DRIVE TO BE USED FROM JANUARY 15, 2014 TO APRIL 30, 2014; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Councilman Willhite said it did not make sense as to why they would allow someone to cross access in PUDs. Secondly, they were denying the access from the PUD it was currently in. He thought that should not be allowed, even if it was temporary. Mr. Schofield stated Councilman Willhite was correct. He said the applicant could come in and amend the master plans for both, but this special permit should not contain condition #7. He thought this could be made whole by simply removing condition #7. Village of Wellington Page 2 Village Council Workshop Action Summary - Final January 13, 2014 Councilman Greene thought submitting an application and getting Council approval were two different things. He wanted the permit to state it had to be returned to its original or better condition by May 14th, as that language appeared in a couple of different places. Mr. Schofield suggested in condition #6, the comma after May 2014 be replaced with a period, and then the rest of it be stricken. He said realistically they would not be able to process the application for approval by April 30th if it were there today. Councilman Greene stated the language appeared on the front page as well. Mr. Schofield thought that explanation was fine and they probably would not need to change it, but they would need to change the condition. Mayor Margolis stated if Ms. Cohen received confirmation indicating the signatures were from the applicant, he would like copies made and submitted to the rest of Council as well as have it made part of the record. He stated he could not make out the different signatures on page 277. Ms. Cohen indicated she spoke to Mr. Sexton and asked him to confirm that it was the applicant’s signature or the applicant authorized someone else to sign and he was agreeing to be bound by the conditions. She stated she received an e-mail from him on January 9th, which was forwarded by Mr. Bellissimo to him, and it said he did in fact sign the application. Mayor Margolis asked Ms. Cohen to make that part of their agenda packet for tomorrow night. Vice Mayor Coates indicated in looking at the drawing on page 288 and the access on Grand Prix Farms Drive, it stated access is restricted to employees and it is an emergency access only. He asked if that was contemplated, because when he reads the conditions it sounds like it is a complete preclusion of any access at all. He questioned if it was going to be limited/restricted access or no access at all. Mr. Stillings believed it should be limited and restricted, but in terms of the permit itself it was the use of the property. He said it should not be for employees, it should be an emergency access only. So the roadway is not physically being removed, it is just being restricted or otherwise eliminated for the use of the site. H. 13-0442 ORDINANCE NO. 2014-02 (RETAIL SALE OF DOGS AND CATS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING CHAPTER 14 OF THE CODE OF ORDINANCES BY CREATING A NEW SECTION 14-2, ENTITLED “RETAIL SALE OF DOGS AND CATS”; PROVIDING FOR CONFLICT; PROVIDING FOR CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Cohen explained the ordinance. No changes. I. 13-0410 ORDINANCE NO. 2014-01 (UPDATED TRAVEL AND TRAINING REIMBURSEMENT POLICY) AN ORDINANCE OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA AMENDING CHAPTER 2 “ADMINISTRATION” DIVISION 3 “REIMBURSEMENT FOR TRAVEL AND TRAINING” OF THE CODE OF ORDINANCES OF THE VILLAGE OF WELLINGTON; Village of Wellington Page 3 Village Council Workshop Action Summary - Final January 13, 2014 PROVIDING A REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Mr. Poag reviewed the policy with Council. No changes. J. 13-0363 PALM BEACH HORSE PARK OF WELLINGTON Mr. Schofield indicated this item was withdrawn. K. 13-0385 AUTHORIZATION TO NEGOTIATE A CONTRACT FOR THE DESIGN BUILD OF THE WELLINGTON COMMUNITY CENTER AND TENNIS FACILITY Mr. Schofield presented the item and indicated Mr. Barnes would be presenting this item to Council. Councilwoman Gerwig recused herself from the discussion. Mayor Margolis mentioned he had asked Mr. Barnes today about the subcontractors working with Pirtle Construction. Mr. Barnes stated they were pulling that information. Mayor Margolis said he was asking because Wally Sanger had done almost $1 million worth of work in the Village of Wellington over the last number of years, under Royal Builders or Royal Construction, and he wanted to make sure it was not a conflict of interest for him to be working on this project. Ms. Cohen did not think there was a conflict. She said Pirtle Construction would be the primary, in charge of overseeing the work, making sure it is done properly and processing all the payment applications. Councilman Willhite thought they could reroute or change Town Center Drive to make it more of an entrance. He stated he previously mentioned eliminating a few of the parking spaces, just to the south of the amphitheater, for safety due to the close proximity. He said he was not trying to relocate the tennis facility to repave it all and liked the idea of the open green space. However, just south of the Village Hall parking lot, he thought maybe a few extra spaces could go there. Mr. Barnes indicated any and all items were feasible to be discussed and would be looked at subject to getting under contract, and they certainly would be somewhat looked at during negotiations. 3. WORKSHOP A. Mr. Schofield - Staff requesting memorial for Rose Taliau. Conference Room 1C. MW - support. Make a policy plaque be retrofitted. PS - bring back as an Agenda item. 28th. Walk it on. Needs to be done in a more timely manner. Regular Agenda - Mr. Schofield presented the item. Steve Koch indicated staff was requesting Council approval for a memorial for Rose Taliau, a staff member who passed away unexpectedly in June. Councilman Willhite said it could be a reminder or a dedication, but he did not like the date of birth and death on the sign. He would rather celebrate and remember someone by having a saying she said engraved on the plaque. Mr. Koch stated they would get with the sign company. Village of Wellington Page 4 Village Council Workshop Action Summary - Final January 13, 2014 Councilman Willhite stated if they approved this, he would like to make a policy. He said if they were going to keep the existing one they have, he thought the plaque should be retrofitted on the current one they have so it matches and they are consistent throughout the building. Mr. Schofield stated they could do that. Councilwoman Gerwig liked the idea of just dedicating the conference room in Rose's name, as she thought that would be sufficient. She suggested they ask the family for their input. Mr. Schofield indicated staff would bring this back to Council with a policy. 4. ATTORNEY'S COMMENTS 5. MANAGER COMMENTS Mr. Schofield stated he had an item for Council to consider as a walk-on to the agenda. Mr. Stillings explained it was a gala event at the Grand Prix Farms just south of Pierson. He stated in the past they have had disc jockeys, quartets and different entertainment for the charitable event. He said it was being brought in front of Council because of the amplified music. Council preferred they walk this item on the agenda to make sure the event is done legitimately, properly and safely. 6. COUNCIL COMMENTS Village of Wellington Page 5
