REVIEW OF COUNCIL AGENDA Mr. Schofield presented the Agenda for the March 25th Council Meeting for discussion and review. A. 14-246 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF JANUARY 28, 2014 AND FEBRUARY 11, 2014 AND THE MINUTES OF THE JANUARY 28, 2014 ANNUAL LANDOWNERS MEETING OF THE ACME IMPROVEMENT DISTRICT Mr. Schofield presented the item. There were no changes recommended. B. 13-0403 AUTHORIZATION TO AWARD A CONTRACT FOR THE SUPPLY AND DELIVERY OF LED LIGHTING FIXTURES Mr. Schofield presented the item. There were no changes recommended. C. 14-143 AUTHORIZATION TO UTILIZE A CITY OF BOCA RATON CONTRACT AS A BASIS FOR PRICING FOR BANKING SERVICES TO THE VILLAGE OF WELLINGTON Mr. Schofield presented the item. Mr. De La Vega responded to Council’s questions. Councilwoman Gerwig thought staff should review the contract annually to determine if it is still the best value, even though pricing in the contract through the City of Boca Raton is guaranteed through September 30, 2018. Vice Mayor Coates believed the Village should receive the loyalty credit each year, not just the first year. D. 14-223 RESOLUTION NO. R2014-18 (AMENDMENT #1 TO THE AGREEMENT WITH THE FLORIDA DEPARTMENT OF CORRECTIONS FOR THE PROVISION OF INMATE LABOR FOR MAINTENANCE OF THE WELLINGTON ENVIRONMENTAL PRESERVE AT THE MARJORY STONEMAN DOUGLAS EVERGLADES HABITAT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE AMENDMENT #1 TO THE CONTRACT WITH THE FLORIDA DEPARTMENT OF CORRECTIONS TO PROVIDE FOR THE USE OF INMATE LABOR IN WORK PROGRAMS WITHIN THE WELLINGTON ENVIRONMENTAL PRESERVE AT THE MARJORY STONEMAN DOUGLAS EVERGLADES HABITAT; AND PROVIDING AN EFFECTIVE DATE. There were no changes recommended. E. 14-229 RESOLUTION NO. R2014-19 AND BUDGET AMENDMENT #2014-022 (CDBG ADA COMPLIANCE RETROFIT PROGRAM) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE BUDGET FOR FISCAL YEAR 2014 BY INCREASING REVENUE AND EXPENSE IN THE CAPITAL FUND TO COVER APPROVED CDBG PROJECT EXPENSES THROUGH SEPTEMBER 30, 2013; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Evangelista further explained the purpose of the item. Councilman Willhite asked Mr. Schofield to do a Public Service Announcement (PSA), as residents have called asking him why the Village was using tax dollars to put in new sidewalks. He thought staff could provide some information or explain to the residents the Village was using federal tax dollars funded through grants and not allocating local taxes to do this work. Mr. Schofield asked Councilman Willhite if he would like to do the PSA. Councilman Willhite said he would do it. Mr. Schofield mentioned staff compiled a list of PSA’s and would be asking each Council member to do some of them. F. 14-239 RESOLUTION NO. R2014-21 (NEIGHBORHOOD STABILIZATION GRANT PROGRAM AMENDMENT NO. 007) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AMENDMENT NO. 007 TO THE AGREEMENT WITH PALM BEACH COUNTY FOR THE PURPOSE OF RECEIVING A GRANT UNDER THE PROVISIONS OF THE NEIGHBORHOOD STABILIZATION GRANT PROGRAM; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Evangelista explained the resolution and responded to Council’s questions. There were no changes recommended. G. 13-0398 ORDINANCE NO. 2014-04 (TRAFFIC PERFORMANCE STANDARDS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE LAND DEVELOPMENT REGULATIONS, ARTICLE 15, TRAFFIC PERFORMANCE STANDARDS, A ZONING TEXT AMENDMENT TO UPDATE THE ARTICLE TO THE LATEST INDUSTRY STANDARDS AND PRACTICES, REMOVE REFERENCES TO PALM BEACH COUNTY AND UNINCORPORATED LANDS REGULATIONS NOT APPLICABLE TO WELLINGTON, AND ESTABLISH WELLINGTON SPECIFIC Village of Wellington Page 2 Village Council Workshop Action Summary - Final March 24, 2014 STANDARDS; AMENDING ARTICLE 3, CHAPTER 2 DEFINITIONS, A ZONING TEXT AMENDMENT TO RELOCATE TRAFFIC PERFORMANCE DEFINITIONS FROM ARTICLE 15; PROVIDING FOR PURPOSE AND INTENT; PROVIDING CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Mr. Stillings and Ms. Troutman, Wellington's Traffic Engineer Consultant, reviewed the proposed updates and changes regarding this ordinance and responded to Council’s questions. Councilman Willhite was concerned with the congestion on South Shore Blvd and wondered if they could lower the truck threshold percentage to avoid additional or reduce road maintenance. Mayor Margolis asked for the definition of a truck. Ms. Troutman explained pickup trucks with trailers were counted as a truck or heavy vehicle. She suggested they change the wording from truck percentage to heavy vehicle percentage. Mr. Stillings stated they could add a definition. Mr. Schofield encouraged Council members to look at the legislative summary, because many of the bills have a real impact on Wellington. For the Council meeting, Vice Mayor Coates asked if there was anything raised at PZAB that Council had not discussed at the meeting. Mr. Stillings stated most of the changes making the ordinance more restrictive came from PZAB, as staff was much more conservative in their approach. He said reducing five years to three years for redevelopment was one they felt should come back as a new project. Vice Mayor Coates asked what the County’s rule was on that. Ms. Troutman stated as long as it has not been vacant for more than five years, they would still get credit for that traffic use. Vice Mayor Coates questioned the reason for the Village being two years more restrictive than the County. Mr. Stillings indicated PZAB felt that the property owner should do something quicker rather than holding onto these vested trips. Vice Mayor Coates thought if they could not sell the property in three years with the approvals, the property would be even less valuable after the approvals expired and they would now have an eyesore there for the next decade. Mr. Schofield explained, under the rule, if the property sits vacant for three years, it would have to be reanalyzed as a new property. It would not lose, because it has a vested number of trips with it. But at three years, they would look at it again to see how those trips impacted what was on the roadway today. He stated it would not just be a blanket, the Village would not tell them they could not do it or take away all the trips, but the Village would make them look at it based on traffic patterns existing today. Vice Mayor Coates wanted to know the answer for tomorrow night. Mr. Schofield said he would sit with Ms. Troutman to discuss the Wellington PUD, because the PUD does not lose its approval and individual parcels have to be looked at separately. He stated the bulk of the development occurs within the Wellington PUD, which is 7,500 acres. He indicated it was an existing valid Village of Wellington Page 3 Village Council Workshop Action Summary - Final March 24, 2014 development and it would be problematic to take a right away from someone who had an existing valid development order, so he wanted to make sure he and Ms. Troutman were on the same page. Vice Mayor Coates needed to know the answer, because he does a lot of property law and those approvals are a huge piece of the property value. Mr. Schofield stated it could happen if they had an approval that was not related to anything else, but something that is sitting within one of the PUD’s, there are rights that run with those that the Village cannot take away. Councilwoman Gerwig thought they were discussing the PUD’s for today, but in ten years there could be other areas of concern, so they needed to have it clearly laid out. H. 14-182 RESOLUTION NO. R2014-14 (SPECIAL USE PERMIT FOR THE 5TH ANNUAL GPL POLO EVENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A SPECIAL USE PERMIT FOR THE 5TH ANNUAL GPL POLO EVENT UTILIZING OUTDOOR AMPLIFIED MUSIC TO BE HELD AT 13444 SOUTHFIELDS ROAD; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Stillings and Mr. Riebe answered Council’s questions. There were no changes recommended. I. 14-191 PRESENTATION OF AUDIT RESULTS FOR THE FISCAL YEAR ENDED SEPTEMBER 30, 2013 Mr. Schofield presented the item. Mr. Tony Grau with Grau & Associates provided a quick overview of the audit process. Council decided they would save the audit presentation for tomorrow night. J. 14-248 A. AUTHORIZATION TO AWARD A CONTRACT TO PIRTLE CONSTRUCTION, INC. FOR THE PLANNING, DESIGN AND CONSTRUCTION OF THE WELLINGTON COMMUNITY CENTER AND TENNIS FACILITY AND APPROVAL OF RESOLUTION NO. R2014-17 AND BUDGET AMENDMENT #2014-020 A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE BUDGET FOR FISCAL YEAR 2014 BY TRANSFERRING MONIES FROM THE GENERAL FUND RESERVES TO GOVERNMENTAL CAPITAL PROJECTS EXPENSE AND INSURANCE RESERVES FOR THE CONSTRUCTION OF THE WELLINGTON COMMUNITY CENTER LOCATED AT 12150 FOREST HILL BOULEVARD; AND PROVIDING AN EFFECTIVE DATE. B. APPROVAL OF AGREEMENT WITH ALEXIS KNIGHT ARCHITECTS, INC. (DESIGN CRITERIA PROFESSIONAL) FOR Village of Wellington Page 4 Village Council Workshop Action Summary - Final March 24, 2014 CONSTRUCTION ADMINISTRATION SERVICES FOR THE CONSTRUCTION OF THE WELLINGTON COMMUNITY CENTER AND TENNIS FACILITY Mr. Schofield presented the item. Councilwoman Gerwig wanted to participate in the budget discussion of this item, as she is unable to participate in the authorization of the award, and asked if the two items could be separated. Ms. Cohen stated she would look into it and let her know if she would be able to participate. Councilwoman Gerwig recused herself at this time. K. 14-254 DR. MARCIA RADOSEVICH - 15 MINUTES Mr. Schofield presented the item. Vice Mayor Coates wanted to discuss the prospects of a Board member being subject to removal by their appointing Council member and replaced. He thought this was a different circumstance than having an at-large Council decision, as each of the appointments of the advisory body members were based on individual Council members, so to some extent whatever happens could reflect on the appointing Council member. Ms. Cohen stated that was a policy decision and part of the Council procedure updates staff will be bringing forward. She said Council could add it to their procedures if they so desired. Vice Mayor Coates asked when the updates would be completed, because he would like to have this discussion before the new appointments are made in April. Ms. Cohen stated it would require them to amend the resolution or adopt a new resolution with their updated Council procedures. She said they could move it up on their project list and bring it forward sooner. Mayor Margolis asked if Council could have an update on the appointees. Mr. Schofield stated there would be a schedule in their weekly issues. 4. ATTORNEY'S COMMENTS Ms. Cohen mentioned Council received a copy of the draft complaint filed by Dan Rosenbaum on the Jacobs’ appeal. 5. MANAGER COMMENTS 6.
