REVIEW OF COUNCIL AGENDA Mr. Schofield presented the Agenda for the April 8th Council Meeting for discussion and review. A. 14-272 PROCLAMATION RECOGNIZING WELLINGTON BATON TWIRLERS FOR THEIR ACHIEVEMENTS AT TWIRL MANIA IN ORLANDO Mr. Schofield presented the item. There were no changes recommended. B. 14-279 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF FEBRUARY 25, 2014 AND MARCH 11, 2014 Mr. Schofield presented the item. There were no changes recommended. C. 13-0333 AUTHORIZATION TO UTILIZE A CITY OF FLORENCE, SOUTH CAROLINA CONTRACT FOR THE PURCHASE OF WHEELED TRASH CONTAINERS Mr. Schofield presented the item. There were no changes recommended. D. 14-282 AUTHORIZATION TO UTILIZE AN EXISTING STATE OF FLORIDA IT CONTRACT AS A BASIS FOR PRICING FOR THE LEASE OF IT NETWORK INFRASTRUCTURE EQUIPMENT Mr. Schofield presented the item. Mr. Silliman answered Council’s questions. There were no changes recommended. E. 14-273 RESOLUTION NO. R2014-23 (INTERLOCAL AGREEMENT WITH PALM BEACH COUNTY TO LEASE FUEL DISPENSING EQUIPMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING AND AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A FUEL CONTROL EQUIPMENT AGREEMENT WITH PALM BEACH COUNTY; AND PROVIDING AN EFFECTIVE DATE. F. 14-205 ORDINANCE NO. 2014-11 (CODE OF ORDINANCE CHAPTER 2) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL; AMENDING WELLINGTON CODE OF ORDINANCE CHAPTER 2, “ADMINISTRATION”, ARTICLE IV, “CODE ENFORCEMENT”, DIVISON 1 “GENERALLY” AND DIVISION 2, “SUPPLEMENTAL Village of Wellington Page 1 Village Council Workshop Action Summary - Final April 7, 2014 CODE THROUGH CITATIONS”, TO REFLECT REVISIONS OF VIOLATIONS; TO REINSTATE OMITTED CODE SECTIONS; PROVIDING A REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. Ms. Koch reviewed the updates to the ordinance and responded to Council’s questions. Councilman Greene asked if this ordinance addressed what Council had discussed in the past of having different fines for single family, multi-family and commercial. Mr. Schofield indicated the code officers based the fines on the type of violation, and they do not always apply a $100, $200 or $500 fine, as some were as low as $25. He thought that information was provided to Council, but he would get it for Council again so they could see which violations generated a recommended fine. Councilman Greene stated his biggest concern is that violations go uncorrected, are not addressed or repeated extensions are filed in front of the magistrate, and he wanted something done on the backside to stop the magistrate from reducing the fines so significantly. Mr. Koch indicated they sent out an AT with a proposed policy. He stated they would attach the AT to the fine matrix and send it to Council. Mayor Margolis stated on page 101 of 129, he was seeing the words “a reasonable amount of time” and asked what “reasonable” meant. He wanted the amount of time to be uniform for the code enforcement officers for the same violation. Mr. Koch stated they had suggested times the code officer’s used at their discretion. For example, the code officer could grant another 30 days for property maintenance, but anything beyond that would have to be approved. Mayor Margolis was concerned someone could argue the point of “a reasonable amount of time.” Councilwoman Gerwig asked how much it cost to file a lien. Mr. Koch indicated it was approximately $8.00 to file a lien electronically, but he would have the answer for them by tomorrow. G. 14-268 ORDINANCE NO. 2014-01 (UPDATED TRAVEL AND TRAINING REIMBURSEMENT POLICY) AN ORDINANCE OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA AMENDING CHAPTER 2 “ADMINISTRATION” DIVISION 3 “REIMBURSEMENT FOR TRAVEL AND TRAINING” OF THE CODE OF ORDINANCES OF THE VILLAGE OF WELLINGTON; PROVIDING A REPEALER CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. There were no changes recommended. 3. WORKSHOP 4. ATTORNEY'S COMMENTS Ms. Cohen informed Council of a shade session tomorrow, April 8th, at 6:00 p.m. regarding Polo Field One, LLC vs. Jacobs and the Village of Wellington. 5. MANAGER COMMENTS • Mr. Schofield indicated he would be asking for Council’s authority to make the Community Center available for county commission debates for the Council of Community Associations. • Mr. Schofield stated Palm Beach Dressage has asked Council to consider a Special Use Permit (SUP) on Equestrian Village for an event in October, as the compatibility determination did not allow tents in the month of October. He said Palm Beach Dressage needed to apply to the dressage sanctioning body within the next couple of days, so with Council’s pleasure he would like to put this on the agenda. Councilman Willhite did not want to discuss this item at the Council Meeting tomorrow without first receiving the application and information normally provided in the agenda packet. Mr. Stillings stated he would get that information to Council. Council agreed to consider this as an agenda item tomorrow. Mr. Schofield indicated the rest of the agenda packet would be on their desks within the next half hour. • Mr. Schofield said on Wednesday the Solid Waste Authority would be considering a proposal to accept waste from outside Palm Beach County at a tipping fee of $25 per ton and Palm Beach County residents pay a tipping fee of $42 per ton. He indicated Palm Beach County residents were also responsible for repayment of the bonds that went into refinancing it. He stated he would like permission from Council to go to the Solid Waste Authority, and he suggested Council also provide authorization for Mayor Margolis. • Mr. Schofield indicated he received an e-mail from Councilman Willhite and had a discussion with Mayor Margolis to talk about the minutes of the Development Review Committee (DRC) meetings. He thought most of them had read the Palm Beach Post article. He stated they have had an issue with the minutes for the DRC meetings dating back to 2004 and have not kept meeting minutes since 2006. He said it seemed to coincide with the department manager and staff manager at that time, as they both came from Palm Beach County. He noted Palm Beach County does not keep minutes of Village of Wellington Page 3 Village Council Workshop Action Summary - Final April 7, 2014 their DRC meetings, but they publish an agenda and the results. He explained the issue was brought to their attention in 2011 when there was a conversation between the attorney and the planning director, so they have been keeping minutes since March of 2011. Also, by Council direction, the DRC meetings have been videotaped since August of 2013. He thought staff should keep minutes of all DRC meetings moving forward. Councilman Willhite stated, as they discussed earlier, DRC was a decisive body, and he questioned how they would know who or what was decided on behalf of the DRC or Council and what was presented to the developer during the time no minutes were being kept. Mr. Schofield indicated he had ordered copies of the Village’s Land Development Regulations, Code of Ordinances, and the Comprehensive plan, and he would give each of them a copy. Mr. Schofield also explained how the DRC had to follow the Land Development Regulations. Vice Mayor Coates wanted to avoid the situation of having someone change a procedure without Council approval from happening in the future and thought they may need a Council level policy decision that minutes are to be kept. Ms. Cohen stated Council could include that in Article 5 and it would be a code requirement. Vice Mayor Coates stated he had no issue with that if Council wanted to go in that direction.
