McGovern, Councilman Village Council Workshop Action Summary - Final March 23, 2015 1. CALL TO ORDER Mayor Margolis called the meeting to order. 2. REVIEW OF COUNCIL AGENDA Mr. Schofield presented the agenda for March 24, 2015 for review. A. 15-214 PROCLAMATION RECOGNIZING THE WELLINGTON HIGH SCHOOL BOYS BASKETBALL TEAM FOR A RECORD-BREAKING SEASON AND FOR WINNING THE 2014-2015 CONFERENCE; DISTRICT TITLE; REGIONAL TITLE AND BECOMING CLASS 8A STATE CHAMPIONS Mr. Schofield presented the item. He indicated that the team will be in attendance at the Council meeting. There were no changes recommended. B. 15-213 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF FEBRUARY 10, 2015, FEBRUARY 24, 2015 AND MARCH 10, 2015 Mr. Schofield presented the item. Mayor Margolis asked Council if there were any errors or corrections that needed to be made. He added that Ms. Rodriguez and Ms. Callovi would be able to make the necessary corrections. There were no changes recommended C. 14-653 AUTHORIZATION TO CONTINUE UTILIZING A CITY OF FLORENCE, SOUTH CAROLINA CONTRACT FOR THE PURCHASE OF WHEELED TRASH CONTAINERS Mr. Schofield presented the item. He stated that the Village of Wellington owned the trash containers. The Village had found that it was cheaper to buy the trash containers and replace them then to allow the Waste Management contractor to do the same because there is an upcharge. Mr. Schofield stated that this was the best price available. Vice Mayor Greene stated that he had looked at the Florence contract at $52.53 per unit including tax. Mr. Barnes said that the Village did not pay tax so the price would be $48.64. Vice Mayor Greene asked if roughly 1,000 containers would be purchased. Mr. Barnes confirmed and said that as of October 1, 2015 the Village would enter into a new contract for solid waste collection services, that contract includes the vendor providing the containers. He stated that at the time of the change of contract the Village would no longer be incurring the cost for waste collection containers. Mr. Barnes believed that the containers would be as close to identical as possible. There were no changes recommended. D. 14-853 AUTHORIZATION TO UTILIZE A U.S. COMMUNITIES’ CONTRACT, AS A BASIS FOR PRICING, WITH CINTAS CORPORATION FOR THE RENTAL AND SERVICE OF EMPLOYEE UNIFORMS, MATS, MOPS, TOWELS AND OTHER RELATED PRODUCTS AND SOLUTIONS Mr. Schofield presented the item. There were no changes recommended. E. 15-182 AUTHORIZATION FOR PROPOSED BIRKDALE DRAINAGE SWALE RECONSTRUCTION PROJECT Mr. Schofield presented the item. He stated that there were 2 parts to this item and the project will not be started until the second part is brought before Council. This item is to go through and redo the Birkdale swales from one end to the other. Mr. Schofield stated that there would be a landscape project coming that would be the second part to this item. There was a plan for the landscape project but there has yet to be a final cost. Mr. Schofield told Council that the landscape project would probably be brought to Council within the next month. Mayor Margolis asked for an estimate as to the cost of the landscape project. Mr. Barnes stated that the cost probably wouldn’t exceed $200,000 but would be over $100,000 based on what the projected cost of the irrigation. Vice Mayor Greene asked what the Village paid annually for sod as there seemed to be something arising with sod and it was always with Odum. Mr. Barnes explained that Odum had an annual contract as they were the low bidder. He was unsure of the exact amount but could get the number to Council the following night. There were no changes recommended. F. 14-854 AUTHORIZATION TO CONTINUE UTILIZING A SOUTHEAST FLORIDA COOPERATIVE CONTRACT AS A BASIS FOR PRICING FOR THE SUPPLY AND DELIVERY OF SODIUM HYDROXIDE Mr. Schofield presented the item. He said that Sodium Hydroxide was used in the water treatment and water reclamation facilities to control odor. Councilwoman Gerwig stated that she had received a call from a resident saying that they had noticed a significant odor from the Wastewater Facility. Mr. Schofield said that the Village had a far worse problem prior to having an enclosed drying system. He stated that with a wastewater plant it is hard to make the odor completely go away. Councilwoman Gerwig asked what the residents should do if they notice an Village of Wellington Page 2 Village Council Workshop Action Summary - Final March 23, 2015 increase in the odor. Mr. Schofield stated that the resident should contact the Village as there is usually a reason and it can on occasion be corrected. Mayor Margolis added that he had seen trucks leaving the facility and upon following the truck noticed that there was an odor permeating from it. Mr. Riebe explained that there was one truck a week with dried sludge that did not particularly have an odor. He said that the Village was in the process of designing additional improvements to the wastewater plant which will address the smell. Councilwoman Gerwig asked if this was the best deal the Village could get on sodium hydroxide. Mr. Riebe responded affirmatively. There were no changes recommended. G. 15-108 AUTHORIZATION OF DISPOSITION OF SURPLUS TANGIBLE PERSONAL PROPERTY LOCATED AT THE EXISTING WELLINGTON COMMUNITY CENTER/TENNIS FACILITY Mr. Schofield presented the item. He indicated that as the building is being demolished some of the material can be reused. Mr. Barnes explained that in the past the Village had asset tagged capital expense projects. He stated that before the building is demolished, staff wanted to go through and asset tag the reusable items, but Council approval was needed to do that. Councilwoman Gerwig said that there may be residents who have had special events at the Community Center that might want a memento and asked if that would be possible. Mr. Barnes stated that the Village could work with the contractor to come up with something. H. 15-91 ORDINANCE NO. 2015-02 (ZONING TEXT AMENDMENT OF WELLINGTON’S LDRS ELIMINATING THE OUTDOOR ACTIVITY AREA REQUIREMENT FOR ADULT DAY CARES IN SECTION 6.4.4.34) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING SECTION 6.4.4.34.e.iii OF THE WELLINGTON LAND DEVELOPMENT REGULATIONS RELATED TO THE OUTDOOR ACTIVITY AREA REQUIREMENTS FOR ADULT DAY CARE FACILITIES; PROVIDING A CONFLICTS CLAUSE; PROVIDING FOR CODIFICATION; PROVIDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Mr. Schofield presented the item. He stated that this topic came up during the approval of the most recent Alzheimer’s facility that was approved by Council. He explained that County code did not have any outside requirement and by adding this ordinance the Village of Wellington would be consistent with the county’s regulations. Mr. Stillings indicated that code requires 100 square feet per person for both child and adult daycares. He said that when the Alzheimer’s care came through, they pointed out that this was different than what they had Village of Wellington Page 3 Village Council Workshop Action Summary - Final March 23, 2015 experienced in the county. When the county removed it in 2003, their Director of Senior Services took the position, which the Village agreed with, that the marketplace should dictate how much space is provided as each facility would have their own distinct needs relative to their patients. He said that having a minimum standard might negatively affect their ability to provide the service and meet their costs. In addition, children generally go outside in a group whereas adults will go out in fewer numbers. Staff’s recommendation was to eliminate the minimum requirement all together and leave it up to the marketplace in terms of what they provide. Vice Mayor Greene stated that he supported the service that is being provided, but he was concerned with the process. He said this was a cure for what they had already done in terms of building out a facility that was not clearly identified as an adult daycare facility. Mr. Stillings explained that the adult daycare facility had chosen to complete the project in phases so they are limited to 25 individuals at the moment. In order to increase the capacity to 45 individuals the facility would need to provide an additional 2000 square feet of space. If the zoning text were to change the facility would not be required to add the extra space. Vice Mayor Greene asked how this zoning text would affect the Village of Wellington on a broader scale. Mr. Stillings explained that any future facilities would not have the same square footage standard apply. Vice Mayor Greene asked why the state and county made the changes to space requirements. Mr. Stillings said that the county and state felt that it was better left to the market place as facilities generally know the amount of space needed to run an adult daycare. Councilman McGovern asked if the adult daycare facilities were regulated by AHCA and the Palm Beach County Health Department and if so, do they have a requirement for outside space. Mr. Stilling explained that neither organization had a specific requirement for outdoor space, rather a specific requirement for a service provider per person ratio that had to be met as well as the amount of indoor space per person. Councilwoman Gerwig asked if Council had the flexibility to require outside space for recreation. Mr. Stillings confirmed that with a conditional use permit Council would have the ability to ask for certain requirements. Mr. Schofield indicated that the only limitation would be a rational reason to apply a requirement such as an Alzheimer patient cannot be left outside and needs constant supervision. There were no changes recommended. I. 15-116 ORDINANCE NO. 2015-01 (HEDGE HEIGHT ZONING TEXT AMENDMENT [ZTA]) AN ORDINANCE OF WELLINGTON, FLORIDA'S COUNCIL AMENDING SECTION 6.6.4.E HEIGHT OF FENCES, WALLS AND HEDGES OF THE WELLINGTON LAND DEVELOPMENT REGULATIONS; TO MODIFY THE HEDGE HEIGHTS BASED ON SIZE OF PROPERTY; PROVIDING A CONFLICTS CLAUSE; Village of Wellington Page 4 Village Council Workshop Action Summary - Final March 23, 2015 PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. He indicated that this was the second reading and adoption of the ordinance. When this item was previously introduced to Council there were inquiries as to why this did not go before the Tree Board. He said the review process was outlined very clearly in the Land Development Regulations which did not include that. Mr. Schofield indicated that the Planning Department was looking into what types of applications should go up for reviews. He said that previous changes by Council included hedge heights for duplexes and multi-family were 6 feet and everything else was at 10 feet. Mr. Stillings explained that the Tree Board’s recommendation was to reduce the proposed 10 feet to 8 feet. He stated that the Planning, Zoning and Adjustment Board recommendation was to remain at 10 feet. The discussion among the Tree Board was geared more toward maintenance than height, and the lower height would be easier to maintain. Mr. Stillings added that initially the recommendation by the Planning, Zoning and Adjustment Board was for the hedge heights for the zero lot line properties be limited to 6 foot hedges. The Board expanded it to include duplexes, villas and multi-family because it was found that there was still a variety of lot sizes. The purpose of the change was to avoid a situation where a 6 foot hedge was placed next to a 10 foot hedge. Vice Mayor Greene asked how Council could disseminate these changes to HOAs. Mr. Schofield explained that the Village would engage the HOAs by having informational distributions to the HOA master list on a quarterly basis, if not more often. Vice Mayor Greene did not think that this was an efficient way to reach out to HOA communities. Mr. Schofield explained that this amendment would not affect HOAs to the extent that some may have thought because there are communities with their own master landscape plans. He said that staff was looking more towards a contact and email list that includes both the president of the HOA and their management company. Vice Mayor Greene indicated that he met with a group that represented some of the larger HOAs. He thought that he would reach out to them and ask them how the HOAs would like to be kept in informed of the changes to Village ordinances. There were no changes recommended. J. 15-68 PRESENTATION OF AUDIT RESULTS FOR THE FISCAL YEAR ENDED SEPTEMBER 30, 2014 Mr. Schofield introduced the item. Ms. Quickel presented the item. She stated that the auditors would be in attendance at the Council meeting. In addition, the auditors would be meeting individually with Council at noon prior to the Council meeting. She said that Grau had provided an unqualified opinion. They did; however, have two findings. The first finding involved the escrow accounts and most have been reconciled. The second finding included fully depreciated fixed assets. She explained that different programs were being looked into to address the problem. The items were in inventory for quite some time, many of them dating Village of Wellington Page 5 Village Council Workshop Action Summary - Final March 23, 2015 back to 2000 and 2001. The problem had to do with procedures for not tagging things such as furniture. Ms. Quickel stated that the Village was very happy with the audit. There were no changes recommended. K. 15-157 RESOLUTION NO. R2015-21 (SPECIAL USE PERMIT FOR THE 4TH FOOD AND BUSINESS SHOWCASE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A SPECIAL USE PERMIT FOR VICTORI EVENTS, LLC, TO HOST THE 4TH FOOD AND BUSINESS SHOWCASE UTILIZING AMPLIFIED MUSIC LOCATED AT 2175 WELLINGTON GREEN DRIVE; AND PROVIDING AN EFFECTIVE DATE. Mr. Schofield presented the item. He indicated that the showcase would be held at Village Green Park which is being rented from the Village. He noted that this item was before Council because there would be amplified music at the event which required Council approval. Mr. Stillings explained that the original intention was for the proceeds to benefit the anti-bullying campaign Adventures of Moosey; however, they may now be partnering with the Little Smiles Children’s charity. Mayor Margolis asked for clarification that that the proceeds from this event would go to a charity. Mr. Stillings confirmed that the proceeds would go to a charity once one is officially chosen. Councilwoman Gerwig asked what portion of the proceeds would go to the charity. Mr. Stillings did not know. Mr. Barnes stated that the special use permit did not address the aspect of the donations. He said that they were renting the facility and amplified music necessitates a special use permit. Ms. Cohen stated that she had a problem with the applicant being listed as Moosey's Adventure. Mr. Barnes explained that the rental is to Victori, LLC. Ms. Cohen stated that the renter may need to resubmit the page indicating Moosey’s Adventure. 5. MANAGER COMMENTS Mr. Schofield stated that the Village had received two requests for uses of Village signs and marquees. One was from the Wellington Chamber of Commerce to promote the Flavors of Wellington. The other request for use of signs was from PBSO, who would like to use the signs to remind residents to lock their car doors. Vice Mayor Greene asked for clarification as to what was actually being requested. Mr. Schofield explained that they were requesting advertising for the event. Councilwoman Gerwig thought that it was good to promote local business and restaurants. Mayor Margolis understood that the Chamber of Commerce was asking for advertising on the Village website as well. Mr. Schofield stated that he had less Village of Wellington Page 6 Village Council Workshop Action Summary - Final March 23, 2015 of an issue using the marquee signs than using the Village website and Channel 18. Councilwoman Gerwig thought that Channel 18 would be good. Mr. Schofield said that if Council consensus was for the marquee and Channel 18 that would be fine. Vice Mayor Greene asked that Council be consistent with allowing or not allowing advertising on the website. He said he did not have a problem with the signs or Channel 18. Council consensus was to allow the Chamber to advertise the event on the Village’s marquee and Channel 18, but did not support the use of the Village’s website. Council was fine with PBSO using signs as well. 3. WORKSHOP A. 15-211 COUNCIL DISCUSSION REGARDING APPOINTMENT OF SPECIAL MAGISTRATES Mr. Schofield introduced the item. Mr. Koch stated that 2 of the 4 magistrate’s terms were set to expire on June 1, 2015. He said that Mr. Doney had expressed that he would not be seeking reappointment and Mr. Suarez-Rivas was seeking reappointment. Staff’s recommendation was to reappoint Mr. Suarez-Rivas and go to the original Selection Committee candidates to fill Mr. Doney’s position. Councilwoman Gerwig asked if that would keep the Village from advertising for the position. Mr. Koch confirmed and said that the original Selection Committee candidates had already been vetted. He explained that if staff had Council direction, they would start reaching out to the previous candidates. Mayor Margolis asked if they knew who the candidates were. Mr. Koch said that staff would go back to the original top five and reach out to them to see if they were still interested in being candidates. Councilman McGovern asked when the candidate pool was done. Ms. Cohen stated that it had been done about a year or two ago. She explained this type of selection is exempt under the Village’s Purchasing Manual. Initially, when the Village requested letters of interest it was not going to be a competitive type of solicitation; however, Council then asked to utilize a Selection Committee for the appointment process. The Village then formulated the evaluation criteria after the Village had put out for the letters of interest. Ms. Cohen said that it was an unusual process but technically this was something that did not require competitive solicitation or advertising. Vice Mayor Greene asked if it was possible to look at the cases that the magistrates had handled, what they had heard, and what the findings had been. Mr. Koch said that he could compile that information. To clarify, Mr. Koch asked Vice Mayor Greene if he wanted the cases heard, decisions made and the fines. Vice Mayor Greene said it was to understand what they had heard, time for compliance and end result. Mr. Koch said he would have his staff start working on it. Mayor Margolis asked to clarify that there were 4 special magistrates that work Village of Wellington Page 7 Village Council Workshop Action Summary - Final March 23, 2015 quarterly and three of them have to be Wellington residents. Mr. Koch responded affirmatively explaining that according to Village policy traditionally, Wellington had only 1 external magistrate. Councilman McGovern asked who the external magistrate was. Mr. Koch stated that Mr. Suarez-Rivas from Broward County was the external magistrate. Ms. Cohen was unsure if the policy was a written policy. Mr. Schofield stated that the policy was Council direction. Councilwoman Gerwig asked why Mr. Doney was not interested in continuing with the Village. Ms. Cohen explained that he was with the same firm that Mr. Ken Edwards was with and the Village had been using that firm for a number of different matters. She explained that Mr. Doney felt that it might give the appearance that there was a bias if he continued as a special magistrate. Ms. Cohen didn’t believe that there was anything that would preclude him from serving but he felt that the public perception might be that there was some sort of bias. Councilwoman Gerwig asked if there was any type of peer review or performance review that is done on the magistrates. Ms. Cohen responded that there was no peer review or performance review. Councilwoman Gerwig asked if there were other communities that did anything like that. Ms. Cohen did not believe so. Mr. Koch said he was unaware of any such reviews being done by other communities; however, he offered to contact other communities to confirm that. Councilwoman Gerwig explained that she had asked about it because she wondered how the Village knew that the special magistrates were doing a good job or not. She wanted to know if there was a way for an outside board to look at it. Ms. Cohen said it was difficult because typically the magistrates become familiar with the code, the process and that was one of the reasons why they were selected and serve in that capacity. She said they have the experience not just with the Village of Wellington as a municipality but other municipalities. Using fine reduction as a measure would be difficult because the special magistrate is generally reducing fine based on what staff had recommended other than those that fall outside of the authority of Mr. Koch which would go to Council. She said that in order to gauge whether the special magistrates were doing a good job or not you would have to look at the experience that the special magistrate had with these types of cases, their demeanor and their years of practice. Councilwoman Gerwig asked if Council looked at the two magistrates and thought that they weren’t doing a good job, would this be the time to bring it out. Ms. Cohen said yes if Council felt that for some reason they shouldn’t be reappointed. She thought that her recollection was that Council placed a limit on the number of terms that they could serve. Mr. Schofield stated that the term limit was four 2 year terms. Ms. Cohen stated that code enforcement was comfortable with the level of performance seen by Mr. Suarez-Rivas and Mr. Doney. She explained that the Village had not asked Mr. Doney not to reapply. Ms. Cohen said that her opinion was that there was not any conflict and that he could continue to serve if he chose to. Councilman McGovern asked if Mr. Suarez-Rivas was chosen from the list previously mentioned. Ms. Cohen confirmed that he was chosen from that list. Village of Wellington Page 8 Village Council Workshop Action Summary - Final March 23, 2015 Vice Mayor Greene said he wanted to see the effectiveness in terms of how quickly the magistrates get cases resolved and if there are repeat offenders. He wanted to make sure that the Village gets through cases without seeing people again. Mr. Barnes pointed out that the list of special magistrates was created in August of 2013. Councilman Gerwig said that if the Village provided a new set of criteria after solicitation for the position, the Village may find a different response. She said that this was a small pool of attorney’s that do this type of work. They get paid hourly for 6 to 7 hours per month. Mr. Koch explained that they get paid for the actual hearing, the preparation, and post hearing work. Ms. Cohen said that the attorney’s only benefit once a quarter when they serve. Mr. Koch explained that Mr. Suarez-Rivas did not get paid travel time for the commute from Miami-Dade. Vice Mayor Greene said that it would be interesting to see the difference in how the cases are handled between magistrates who live within the community and those that live outside the municipality. He thought that sometimes it may be more difficult for a magistrate if they know someone in town to to assess a stronger penalty or take a harder line. Mayor Margolis asked if there were municipalities that use one special magistrate for every hearing. Mr. Schofield said that was more of the norm. He indicated that larger municipalities may have more magistrates because they have a higher case load but, most municipalities are sized with one to hear cases per month. Mayor Margolis was concerned when a case goes before one magistrate, then it goes to another magistrate who may make the final decision if it is pushed back to another magistrate meeting. Ms. Cohen stated that this had not traditionally been an issue but the Village did have an issue with respect to a scriveners error in a final order. She explained that in order to correct the error, the Village had to get the order back in front of the same magistrate so it was delayed for several months. Mayor Margolis said many times people go to special magistrate hearings for a continuance. He asked if the special magistrate takes the time and effort to prepare if the continuance is not granted, as in they would be spending the same time to prepare for that issue to have it postponed. Mr. Koch stated if the item was not on consent it would be called as a regular case. Ms. Cohen asked what items were sent to the magistrate prior to the hearings. Mr. Koch said that the magistrate was sent an agenda packet. Ms. Cohen indicated that she wasn’t sure that there was any preparation time prior to the hearing, rather the magistrate spent more time post hearing. Mayor Margolis said that the magistrates were spending quarterly hours in preparation. Ms. Cohen thought that the miscommunication was that it was believed that there was not time spent preparing for a hearing, it is after the hearing. Mr. Koch stated that he was sure the special magistrates reviewed the agenda prior to the hearing but the agenda is only given to them a day or two in advance. Vice Mayor Greene asked if there were no case files for the cases being heard. Ms. Cohen stated that there were case files but they were not provided to the special magistrates prior to the hearing because it is the obligation of the Village of Wellington Page 9 Village Council Workshop Action Summary - Final March 23, 2015 Village who bears the burden of proving the violation. She said it was much like going to court. Vice Mayor Greene asked if compliance occurred shortly before a magistrate hearing, would those cases still be heard. Ms. Cohen said that those cases would be dismissed. Mr. Koch said it depended on the time frame because the statute permits the Village, if the party does not comply by their compliance date, they can bring them forward for cost. He said it was basically his discretion as to whether to take that individual to the hearing or not. Mr. Koch stated that if the correction is made within a week of the compliance date, they would probably dismiss it. But, anything outside a week or two weeks the staff will bring it before the magistrate. Vice Mayor Greene asked what Mr. Koch’s cutoff was. Mr. Koch said it was usually about 2 weeks as every case is different, as some have extenuating circumstances. Mayor Margolis asked Mr. Koch if he had a principle for a continuance because those items are on the consent agenda that don’t even go to the magistrate. Mr. Koch explained that the item was still within the agenda but it would be placed on the consent agenda. Ms. Cohen said absent someone withstanding being there to object, she could not envision a scenario in which the magistrate would not approve the consent. Mayor Margolis asked if there was a policy that limited the number of times a case would be put on continuance. Mr. Koch said that the time frame is generally 4 months. Mr. Schofield said that based on Council direction in the past, once something makes the agenda the Village would not continue it at that point. The other thing that happens is, if it is a home owner or a first time violation and they had corrected the violation a week before the hearing, then the recommendation would be to dismiss. However, for repeat violators or properties that have had historic problems, the Village will take them through and get a finding of fact. Vice Mayor Greene thought otherwise because he said there was a recent case that did not go through the magistrate. Mr. Schofield said he would talk to Vice Mayor Greene about that. Vice Mayor Greene asked if there were costs that the Village could recoup on consent items as the Village spends a large amount of time and resources to gain compliance. Mr. Koch said that generally the cost would be about $200 at the point of seeing the special magistrate, but if the case is continued, the Village did not recover those costs. If it is a reoccurring violation, which means that they had corrected before they went to hearing and did the violation again, then the individual would go straight to hearing. If it is a repeat violator, there are excuses, it goes. Ms. Cohen recommended that Council not take away the discretion that Mr. Koch had. Vice Mayor Greene stated that he was not advocating that, he just wanted to see consistency, who had discretion and what the process was. Mr. Koch said that if Council wishes he would reach out to the candidates and will get to work on each report. Mayor Margolis thought that Mr. Koch had consensus to do so.
