CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; John McGovern, Vice Mayor; Michael Drahos, Councilman; Michael Napoleone, Councilman; and Tanya Siskind, Councilwoman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the May 11, 2021, Regular Council Meeting for review. He said that there was nothing for the Presentations and Proclamations. A. 21-4436 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF APRIL 27, 2021 Mr. Barnes introduced the item. He said that this is the Council Approval of the Minutes of the Regular Wellington Council Meeting of April 27, 2021. He told the Council that if they have any recommended changes or additions to get those to the Clerk to make those changes accordingly. B. 21-4438 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA PROCLAIMING MAY 2021 AS "ASIAN AMERICAN AND PACIFIC ISLANDER HERITAGE MONTH" IN THE VILLAGE OF WELLINGTON Mr. Barnes introduced the item. He said that this is the Proclamation Proclaiming May 2021 as "Asian American and Pacific Islander Heritage Month" in the Village of Wellington. He explained it was not in the previous rotation and this will get it on the annual proclamation list. He recommended leaving on the Consent Agenda as there is no specific group to present the proclamation to and it will be on the annual list going forward. C. 21-4439 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA PROCLAIMING MAY 20, 2021 AS "FLORIDA EMANCIPATION DAY" IN THE VILLAGE OF WELLINGTON Village of Wellington Page 1 Village Council Workshop Action Summary - Final May 10, 2021 Mr. Barnes introduced the item. He said that this item is the Proclamation Proclaiming May 20, 2021 as "Florida Emancipation Day" in the Village of Wellington. He said that this will not be presented to anyone in particular, but will be included on our annual list. D. 20-4149 AUTHORIZATION TO AWARD CONTRACTS FOR ANNUAL PATHWAY AND MINOR CONSTRUCTION Mr. Barnes introduced the item. He said that this is the Authorization to Award Contracts for Annual Pathway and Minor Construction for Public Works, Engineering, and Utility Projects. Mr. De La Vega explained the item. He said that they were seeking authorization to award all four contractors on a project by project basis. E. 20-4251 AUTHORIZATION TO AWARD A CONTINUING CONTRACT FOR CONSTRUCTION MANAGER AT RISK SERVICES TO WHARTON-SMITH, INC. Mr. Barnes introduced the item. He said that this is the Authorization to Award a Continuing Contract for Construction Manager at Risk (CMAR) Services to Wharton-Smith, Inc. Ms. LaRocque explained the item. She said that this will be done on a project by project basis for anything under $4 million that may need to be done with the water treatment plant, water reclamation facility, improvements at water storage facility, booster pump stations, water supply facilities, and anything else needing to be done at the utilities central operations facility. This will include structural, mechanical, underground utilities, electrical and process controls. She mentioned the ribbon cutting at the water reclamation plant on June 4th. Vice Mayor McGovern asked how long this would be in place. Ms. LaRocque said it is initially for three years with two, one year extensions. F. 21-4397 RESOLUTION NO. R2021-23 (CODE COMPLIANCE FINE REDUCTION FOR 2740 DANFORTH TERRACE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL COMPROMISING LIENS ASSOCIATED WITH CODE COMPLIANCE ACTIONS NOH-17-0586 and NOH-17-3668, 2740 DANFORTH TERRACE, PURSUANT TO SECTION 2-199 OF THE CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE Mr. Barnes introduced the item. He said that this is the Request for reduction of liens submitted by Florida Financial Holdings, Inc. to settle Village of Wellington Page 2 Village Council Workshop Action Summary - Final May 10, 2021 liens associated with Code Compliance Actions NOH-17-0586 and NOH-17-3668, 2740 Danforth Terrace, for a total amount of $1,500.00. Ms. Cohen requested that this item be pulled from the agenda as there was an issue with the title. The applicant will be correcting the title so they can bring it back to Council at a later time. Mr. Barnes stated that they will pull that at the Council meeting the next night and have them vote on the revised agenda. G. 20-4246 RESOLUTION NO. R2021-25 (FRANCHISE AGREEMENT BETWEEN WELLINGTON AND FCC ENVIRONMENTAL SERVICES FLORIDA, LLC. FOR SOLID WASTE AND RECYCLABLE MATERIALS COLLECTION SERVICES) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A FRANCHISE AGREEMENT BETWEEN WELLINGTON AND FCC ENVIRONMENTAL SERVICES FLORIDA, LLC, FOR THE PROVISION OF SOLID WASTE AND RECYCLABLE MATERIALS COLLECTION SERVICES AND AUTHORIZING THE MAYOR AND CLERK TO EXECUTE THE AGREEMENT; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Authorization to execute an Exclusive Franchise Agreement (Agreement) between Wellington and FCC Environmental Services Florida LLC. (FCC) for the collection of the solid waste and recyclable materials generated by the Village's residents and businesses, in an amount of approximately $7,236,000 annually. Mr. De La Vega explained the item. He said that the selection committee made a recommendation to award the contract to FCC Environmental Services Florida, LLC. He mentioned that this is a ten year agreement with one, five year renewal option. Mr. Brazil, Mr. Merkley and Mr. Sandora of FCC gave a powerpoint presentation to the Council. They discussed the history of the company, the company locations, operations, experience, customer service, the new fleet, and their references. Councilman Napoleone asked what changes will the residents notice. Mr. Sandora explained that there may be a change in some of the pickup dates and times for some areas of Wellington. Councilman Drahos asked if they will still be receiving garbage pickup twice a week. Garbage will be twice a week and yard waste pickup will be on one of those days and recycling on the other day. It will be the same as it is now. Mr. Barnes explained that the pickups will not change, but the actual pick up days could change due to being more efficient on their routes. Vice Mayor McGovern asked how many new trucks will they be purchasing. Mr. Merkley stated that it would be 16. There was discussion regarding the transition from the old contract to the new contract and how it would be as seamless as possible. Councilman Napoleone asked about limitations on bulk pickup. Mr. De La Vega stated that it will be unlimited as it currently is. Service level will remain the same as it currently is. He also mentioned that the customer service/point of contact will still be handled by Wellington. There was discussion regarding the annual increases and termination of contract provisions. Vice Mayor McGovern suggested that this item be taken off the Consent Agenda and placed under the Regular Agenda. Mayor Gerwig asked the representatives from FCC to present at the meeting the following evening. H. 21-4399 ORDINANCE NO. 2021-01 (REPEALING THE EQUESTRIAN PRESERVATION ELEMENT AND REPLACING WITH THE EQUESTRIAN PRESERVE ELEMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON COMPREHENSIVE PLAN, MORE SPECIFICALLY, TO REPEAL THE EQUESTRIAN PRESERVATION ELEMENT AND REPLACE WITH THE EQUESTRIAN PRESERVE ELEMENT, INCLUDING MAPS, IN ITS ENTIRETY, AS CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. He said that this is the Approval of Ordinance No. 2021-01, a Comprehensive Plan Text Amendment (CPTA) to repeal the Equestrian Preservation Element and replace with the Equestrian Preserve Element of Wellington's Comprehensive Plan. He mentioned that there would be a full presentation on this item and the next item at the tomorrow night's meeting. I. 21-4398 ORDINANCE NO. 2021-03 (REPEALING THE TRANSPORTATION ELEMENT AND REPLACING WITH THE MOBILITY ELEMENT) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON COMPREHENSIVE PLAN, MORE SPECIFICALLY, TO REPEAL THE TRANSPORTATION ELEMENT AND REPLACE WITH THE MOBILITY ELEMENT, IN ITS ENTIRETY, AS CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. Mr. Stillings introduced the item, which is the Approval of Ordinance No. 2021-03, a Comprehensive Plan Text Amendment (CPTA) to Repeal the Transportation Element and Replace with the Mobility Element of Wellington's Comprehensive Plan, along with the previous item. J. 21-4425 RESOLUTION NO. R2021-26 (PRELIMINARY TRIM RATES FOR WELLINGTON SOLID WASTE COLLECTION AND RECYCLING ASSESSMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING THE PRELIMINARY NON-AD VALOREM ASSESSMENT RATES FOR SOLID WASTE COLLECTION AND RECYCLING SERVICE FOR TRUTH-IN-MILLAGE (“TRIM”) PURPOSES WITHIN THE JURISDICTIONAL BOUNDARIES OF WELLINGTON; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of Resolution No. R2021-26 Setting the Preliminary FY 2022 TRIM Rates for Solid Waste Collection and Recycling Proposed at $171/unit for Curbside Service and $121/unit for Containerized Service. Ms. Quickel explained the item. 4. WORKSHOP None. 5. ATTORNEY'S COMMENTS Ms. Cohen informed Council about the hearing and the Motion to Dismiss involving the Montemayor v. Village of Wellington.
