McGovern, Councilman Michael Napoleone, Councilman Tanya Siskind, Councilwoman Village Council Workshop Action Summary - Final August 23, 2021 1. CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; John McGovern, Vice Mayor; Michael Napoleone, Councilman and Tanya Siskind, Councilwoman. Councilmembers Absent: Michael Drahos, Councilman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. WORKSHOP Mr. Barnes explained that there were three items for workshop discussion. A. 21-4564 UPDATE-DRAFT BUILDING SAFETY INSPECTION PROGRAM Mr. Barnes introduced the item. He said that this is the Presentation of the Proposed (draft) of the Building Safety Inspection and Recertification Program with to date results of Collaboration by Palm Beach County Building Officials and Technical Subcommittee organized by Florida League of Cities. Mr. Tomasik explained the item. Mayor Gerwig asked what stage we were in at the time and had this already been accepted by the County. Mr. Tomasik explained that he will go through all of it step by step, but he said that it originated with the tragedy at Surfside. He displayed a powerpoint presentation for the Council in which he discussed how the program came about and described the Palm Beach County League of Cities Model of the program, the recap of activities, features of the Palm Beach County League of Cities Model and forms. Vice Mayor McGovern asked about specific wording on the form. Mr. Tomasik explained what it meant. There was discussion on eliminating the "building is safe" part of the form. Mr. Tomasik continued on with the presentation in discussing the Palm Village of Wellington Page 1 Village Council Workshop Action Summary - Final August 23, 2021 Beach County League of Cities Model. He discussed the structure and electrical portions. Mayor Gerwig asked if the buildings were required to have the standby generators. Mr. Tomasik stated that some types of buildings were required and some were not; the plan would identify those and the requirements. He continued on with the presentation in discussing the Life Safety Systems and the current suggestions on inspection dates. Councilman Napoleone asked if they estimate the date from the Certificate of Occupancy. Mr. Tomasik stated that was correct. He discussed the waterproofing inspections, the committee members involved in the program, the next steps in the process, the topics of consideration for the Wellington Model, the ICC/BOAF Panel Discussion and what the topics were at that discussion. Mayor Gerwig asked up until the Surfside Tower incident, how had deterioration issues been addressed when a condo noticed issues. Mr. Tomasik explained that Miami-Dade already had this program in effect when this happened. Palm Beach County does not. Mayor Gerwig asked if currently a building is suspected to be unsafe, would Mr. Tomasik be the one that should be notified. Mr. Tomasik said that if someone feels a building is unsafe, they will go investigate. He spoke on the timing of inspections and recertification, property maintenance and real estate industry, the applicable parts for Wellington - FBC 116.1, the location of aging buildings (with 3 or more floors) in PBC on presented map, location of aging buildings (multi-family with 3 or more floors) in PBC on presented map, map of Wellington buildings/condos that had 2 or more floors that were 25 years old or older, and a map of Wellington buildings/condos that had 2 or more floors that were 35 years old or older. Councilwoman Siskind asked how often the committee meets. Mr. Tomasik said that in July they met six times. There is a meeting set up for the next week. Councilwoman Siskind asked if there was an end date in sight. Village of Wellington Page 2 Village Council Workshop Action Summary - Final August 23, 2021 Mr. Tomasik stated that Palm Beach County is looking to have a final draft two months from this point. Vice Mayor McGovern asked if we were not waiting until the next legislative session that will occur next year. Mr. Tomasik said that the legislation session could happen parallel. He said that compared to the Code Council, this is the most advanced plan so far. He said that he can only imagine that the Florida legislation will be addressing this also. Mayor Gerwig asked how it will work when someone is told that the work needs to be done and they do it and who will certify the work has been done. Mr. Tomasik stated that the Village would rely on the licensed professionals (contractors/engineers) to take on that responsibility. B. 21-4606 LIEN REDUCTION POLICIES & PROCEDURES Mr. Barnes introduced the item. He said that this is the Discussion and Direction Regarding Procedures for Lien Reductions and Approval Authority. Mr. Stillings explained the item. He gave a powerpoint presentation that discussed the lien reduction policies and procedures with the goal, the explanation of what is involved, current policy, overview of code compliance historical data, settlement approval levels, the updates requested, reduction considerations and the current open lien data. Mayor Gerwig asked how the liens affect how a home is homesteaded? Does that mean the Village cannot collect the lien until the property is sold? Mr. Stillings stated that we cannot foreclose on the property. Otherwise, we have to wait until the property is sold. He said that rarely it could happen that a property slips through the foreclosure process and then the lien lies upon the new owner. Vice Mayor McGovern asked what the amount was for that last one. Village of Wellington Page 3 Village Council Workshop Action Summary - Final August 23, 2021 Mr. Stillings said that he believes it was around $60,000 total. Vice Mayor McGovern asked if that was after the reduction. Mr. Stillings said no and that with the reduction it was about $12,000. He continued on with the presentation discussing the open lien data and the proposed lien reduction policy. Vice Mayor McGovern asked what the current policy was. Mr. Stillings said that staff can approve up to 80% administratively and anymore than that has to come before Council on any dollar amount. Mayor Gerwig asked if this proposal is introducing a dollar amount. Mr. Stillings stated it is entering a dollar amount and the property type. Vice Mayor McGovern asked if another change is adding in the tiered phase where the Village Manager becomes the sole approver. Mr. Stillings answered this question and the other questions that were asked by Council. He explained the lien reduction tiered proposed policy changes more. Councilman Napoleone suggested a new tiered amount and there was discussion on that. There was a consensus on the change and Mr. Stillings stated he would bring it back with that change. C. 21-4616 SOLID WASTE COLLECTION SERVICES UPDATE Mr. Barnes introduced the item. He said that this is the Update on Transition from Waste Management, Inc. to FCC Environmental Services to Provide Solid Waste and Recyclable Material Services Village-wide. Ms. Coates explained the item. She presented a powerpoint for the Council and discussed the re-cap of where they were several months ago and the timeline with the details for the transition. Ms. Coates, with the assistance of a representative from FCC, responded to the questions that the Council had regarding service dates and garbage bins. Ms. Coates presented the timeline of the transition, the Solid Waste Village of Wellington Page 4 Village Council Workshop Action Summary - Final August 23, 2021 Education Program, PSA's, notices for non-compliance, FCC Transition Public Awareness Strategy, route map, collection schedule change, and the communication plan. Ms. Coates, Mr. Stillings and the FCC representative answered the questions from Council regarding billing, code issues and other items. Mr. Barnes mentioned that Mr. Reinsvold and PBSO Lt. Shavitz were there to update the Council on their observations on the school drop off/pick up and general issues/solutions. Mr. Reinsvold gave his observations on the school drop off/pick up situations. Mr. Barnes replied to the questions that Council had regarding the traffic issue and if the school was being pro-active. Lt. Shavitz expressed his observations on the school traffic situations. Mr. Barnes and Lt. Shavitz answered questions from Council regarding the drop off/pick up processes as well as other questions. Mr. Barnes said that they will keep monitoring the situation. Mayor Gerwig described a situation that happened where she had to call 911 and another situation of a gas station that she was upset with for selling paraphernalia. Lt. Shavitz mentioned that PBSO will follow up with those situations. Mayor Gerwig also mentioned pan handlers and not giving them money. 4. ATTORNEY'S COMMENTS Ms. Bausch reminded Council of the upcoming Shade Session the next evening at 6:00 pm regarding the Pine Tree Assessment. 5. MANAGER COMMENTS None. 6. COUNCIL COMMENTS Vice Mayor McGovern mentioned that he has appointed Susan Weinstein on the Senior Advisory Committee.
