CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; John McGovern, Vice Mayor; Michael Napoleone, Councilman; and Tanya Siskind, Councilwoman. Absent: Michael Drahos, Councilman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes stated that they were moving the workshop item before the agenda review for the October 12, 2021, Regular Council Meeting. A. 21-4602 FISCAL YEAR 2022 KEELY SPINELLI GRANT AWARDS Mr. Barnes introduced the item. He said that this is the Presentation of the FY 2022 Keely Spinelli Grant Awards and they will also be recognizing Principal's Month with all the principals at the same time. B. 21-4675 PRESENTATION BY AVA PARKER, PRESIDENT, PALM BEACH STATE COLLEGE Mr. Barnes introduced the item. He said that they are suggesting that Ms. Ava Parker, President of Palm Beach State College, make a presentation to the Village Council before the Keely Spinelli Grant Awards. Council wanted to know the topic of her presentation. Mr. Barnes stated that it was just regarding the opportunities that the College could provide by partnering with the communities that surround the College. C. 21-4724 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF SEPTEMBER 28, 2021 Mr. Barnes introduced the item. He said that this is the Council Approval of the Minutes of the Regular Wellington Council Meeting of September 28, 2021. He asked that Council contact the Clerk if there are any comments on the minutes. He said that this is the Authorization to Utilize a Hillsborough County Contract with Xylem Water Solutions USA, Inc., as a Basis for Pricing, for the Purchase, Delivery, and Service of Flygt Pumps, not to exceed $225,000 Annually. Ms. LaRocque explained the item. E. 21-4501 AUTHORIZATION TO AWARD A TASK ORDER TO PROVIDE ENGINEERING CONSULTING SERVICES FOR THE VILLAGE OF WELLINGTON'S SURFACE WATER MANAGEMENT SYSTEM ICPR4 COMPUTER MODEL AND WATER CONTROL PLAN UPDATE Mr. Barnes introduced the item. He said that this is the Authorization to Award a Task Order to Mock, Roos & Associates, Inc. to Provide Engineering Consulting Services for the Village of Wellington's Surface Water Management System ICPR4 Computer Model and Water Control Plan Update for a cost of $223,490. Mr. Reinsvold explained the item. He answered questions from Council regarding costs and update version of the software. F. 21-4583 AUTHORIZATION TO AWARD A TASK ORDER TO MOCK, ROOS & ASSOCIATES, INC. TO PROVIDE LIMITED CONSTRUCTION PHASE ENGINEERING SERVICES FOR THE WATER TREATMENT PLANT (WTP) WELL VARIABLE FREQUENCY DRIVE (VFD) RETROFIT PROJECT Mr. Barnes introduced the item. He said that this is the Authorization to Award a Task Order to Mock, Roos & Associates, Inc. to Provide Limited Construction Phase Engineering Services for the Water Treatment Plant (WTP) Well Variable Frequency Drive (VFD) Retrofit Project, in the Amount of $80,000.00. Ms. LaRocque explained the item. G. 21-4625 AUTHORIZATION TO DISPOSE OF SURPLUS TANGIBLE PERSONAL PROPERTY Mr. Barnes introduced the item. He mentioned that this is the Authorization to Dispose of FY 21 Surplus Tangible Property. Mr. De La Vega explained the item. He answered questions from Council regarding how much we have brought in using Govdeals.com. Village of Wellington Page 2 Village Council Workshop Action Summary - Final October 7, 2021 H. 21-4637 AUTHORIZATION TO UTILIZE EXISTING CONTRACTS AND AWARD SOLE SOURCE CONTRACTS FOR VARIOUS FY 2022 PUBLIC WORKS PROJECTS Mr. Barnes introduced the item. He said that this is the Authorization to Utilize Existing Contracts and Award Sole Source Contracts for Various FY 2022 Public Works Projects with a Budgeted Total Amount of $3,390,000.00. He explained that this is normally what is brought to Council every year to approve to cover many different projects. Mr. Barnes answered questions from Council regarding what types of contracts this would include. I. 21-4639 AUTHORIZATION TO CONTINUE UTILIZING A U.S. COMMUNITIES CONTRACT, AS A BASIS FOR PRICING, FOR THE PURCHASE AND DELIVERY OF REFUSE CARTS Mr. Barnes introduced the item. He stated that this is the Authorization to Continue Utilizing a U.S. Communities Contract with Rehrig Pacific Company, as a Basis for Pricing, for the Purchase and Delivery of Refuse Carts, in the Amount of Approximately $100,000 Annually. He explained that this is the carts for regular household waste and also vegetation containers. He explained the new provisions in the newest contract as well as the other details of the item. Vice Mayor McGovern asked about the update with the transition with the new garbage company. Mr. De La Vega gave the update. J. 21-4653 AUTHORIZATION TO AWARD A TASK ORDER TO PROVIDE ENGINEERING SERVICES FOR THE WATER TREATMENT PLANT (WTP) EMERGENCY DIESEL GENERATOR 3 REPLACEMENT PROJECT Mr. Barnes introduced the item. He said that this is the Authorization to Approve a Task Order to Hillers Electrical Engineering, Inc. to Provide Engineering Design Services for the Water Treatment Plant (WTP) Emergency Diesel Generator 3 Replacement Design and Bidding Phase Services Project, in the amount of $130,665.00. Ms. LaRocque explained the item. She answered the Council's questions, which included topics such as the contractors and whether this was a budgeted item. R2021-52 (CODE COMPLIANCE LIEN REDUCTION FOR 1141-1143-1145-1147 GOLDENROD RD) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL COMPROMISING LIENS ASSOCIATED WITH A CODE COMPLIANCE ACTIONS NOH-09-3646, NOH-14-2046, NOH-15-226, AND NOH-19-1369 FOR 1141-1143-1145-1147 GOLDENROD ROAD, PURSUANT TO SECTION 2-199 OF THE CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE Mr. Barnes introduced the item. He stated that this is the Request for Reduction of Liens Associated with Code Compliance Actions NOH-09-3646, NOH-14-2046, NOH-15-226, and NOH-19-1369 for 1141, 1143, 1145, and 1147 Goldenrod Rd (Resolution R2021-52). Council Consideration of Mr. Scott Epstein's Settlement Offer in the Amount of $3,500.00. Mr. Stillings explained the item. He presented a powerpoint and discussed the properties, the violations, hearing dates, compliance dates and total lien amounts. He answered various questions from Council, including why the item was brought before Council and what the basis was for the counteroffer amount. There was a consensus to move the item from the Consent Agenda to the Regular Agenda. L. 21-4670 AUTHORIZATION TO UTILIZE A CITY OF BOYNTON BEACH ANNUAL CONTRACT FOR WATER SERVICE INSTALLATION AND RESTORATION SERVICES Mr. Barnes introduced the item. He said that this is the Authorization to Utilize a City of Boynton Beach Annual Contract with Line-Tec, Inc. for Water Service Installations and Restoration Services in the amount of approximately $100,000.00 Annually. Ms. LaRocque explained the item. M. 21-4713 AUTHORIZATION TO UTILIZE A PALM BEACH COUNTY CONTRACT WITH SULLIVAN ELECTRIC & PUMP, INC., FOR REPAIRS TO VARIOUS PUMPS AND MOTORS Mr. Barnes introduced the item. He said that this is the Authorization to Utilize a Palm Beach County Contract with Sullivan Electric & Pump, Inc., as a Basis for Pricing, for Pump and Motor Repairs at Sanitary Lift Stations, the Water Plant, the Water Reclamation Facility, Raw Water Supply Wells, and Remote Booster Stations in an amount not to exceed $100,000. N. 21-4717 1) RATIFICATION OF AN EMERGENCY GRAVITY LINE REPLACEMENT AT THE COURTYARD SHOPS; 2) APPROVAL LIFT STATION 16 GRAVITY INFLUENT LINE REPLACEMENT; AND 3) APPROVAL OF RESOLUTION NO. R2021-61 AMENDING THE UTILITY FUND BUDGET FOR FISCAL YEAR 2020-2021 BY ALLOCATING FUND BALANCE FOR THE EMERGENCY REPAIRS TO GRAVITY LINE AT COURTYARD SHOPS AND LIFT STATION NO. 16; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this is the 1) Ratification of an Emergency Purchase Order for the Gravity Line Replacement at the Courtyard Shops, with Johnson-Davis, Inc., in the Amount of $170,621.00; 2) Approval of a Purchase Order for Lift Station 16 Gravity Influent Line Replacement, with Johnson-Davis, Inc. in the amount of $557,986.00; and 3) Approval of Resolution No. R2021-61 Amending the Utility Fund Budget for Fiscal Year 2020-2021 by Allocating Fund Balance for the Emergency Repairs to Gravity Line at Courtyard Shops and Lift Station No. 16; and Providing an Effective Date. Ms. LaRocque explained the item. She presented a powerpoint which covered the emergency repair of the sewer, pictures of the damage, the LS 16 Influent Sewer Replacement and an aerial picture of where the work is to be done. Ms. LaRocque answered various questions from Council including environmental damage and operational impacts. O. 21-4673 ORDINANCE NO. 2021-18 (ZONING TEXT AMENDMENT TO SECTION 6.4.1.A.5. OF WELLINGTON’S LAND DEVELOPMENT REGULATIONS FENCES, WALLS, AND HEDGES) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, AMENDING THE WELLINGTON LAND DEVELOPMENT REGULATIONS, MORE SPECIFICALLY, A ZONING TEXT AMENDMENT TO MODIFY SECTION 6.4.1.A.5 OF ARTICLE 6 TO ESTABLISH A CONSISTENT APPEARANCE OF HEDGES AND FENCES, AS CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this is the Approval of Ordinance No. 2021-18 to Amend Section 6.4.1.A.5 of Wellington's LDR to Modify the Regulations Related to Fences, Walls, and Hedges Along Thoroughfares and Throughout Wellington. He answered a few questions from Council including which part of the yard this was applying to and the planned outreach to residents. P. 21-4681 ORDINANCE NO. 2021-21 (FY 2021/2022 ANNUAL CAPITAL IMPROVEMENT ELEMENT UPDATE OF WELLINGTON’S COMPREHENSIVE PLAN) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL, UPDATING THE WELLINGTON COMPREHENSIVE PLAN BY INCORPORATING THE ANNUAL REVIEW AND REVISIONS TO THE CAPITAL IMPROVEMENTS ELEMENT TO REFLECT THE 2021/2022 THROUGH 2026/2027 FIVE-YEAR CAPITAL IMPROVEMENT PLAN FOR LEVEL OF SERVICE PROJECTS; UPDATING POLICY CI 1.2.5 TO ADOPT THE SCHOOL DISTRICT OF PALM BEACH COUNTY’S FISCAL YEAR 2021/2022 10-YEAR CAPITAL IMPROVEMENTS SCHEDULE BY REFERENCE; PROVIDING FOR CONFLICT AND SEVERABILITY; AUTHORIZING THE MANAGER TO UPDATE THE COMPREHENSIVE PLAN; AND PROVIDING FOR AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this is the Approval of Ordinance No. 2021-21 Updating Table CI-1, Wellington Capital Improvement Plan 5 Years Level of Service Projects, and Policy CI 1.2.5 Which Adopts the School District of Palm Beach County's 10-Year Capital Improvements Schedule by Reference, of the Capital Improvement (CI) Element of Wellington's Comprehensive Plan. Mr. Stillings explained the item. Q. 21-4684 ORDINANCE NO. 2021-13 (OFFICIAL ZONING MAP) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON OFFICIAL ZONING MAP, AS CONTAINED HEREIN; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He mentioned that this is the Approval of Ordinance No. 2021-13 to Adopt an Updated Official Zoning Map for Wellington. Mr. Stillings explained the item. He mentioned that there would be a presentation at the next meeting. Village of Wellington Page 6 Village Council Workshop Action Summary - Final October 7, 2021 Mr. Barnes mentioned that there is an update to the Moncada Property. Ms. Quickel gave the update on the Moncada Property and their intent to sell. She explained the process that needed to be done. 4. WORKSHOP 21-4740 IMPAIRED WATERS UPDATE Mr. Barnes introduced the item. He said that this is was the Presentation Regarding Impaired Waters that will be provided to the Village Council. He mentioned that Mr. Wertepny would be giving the update and Mr. Reinsvold would be starting it off. Mr. Reinsvold explained how this situation came about. Mr. Wertepny informed the Council on the process of what needs to be done to try to stop this. He also responded to questions that the Council had regarding the issue. Mr. Wertepny presented the Council with a powerpoint presentation. He discussed the Wellington WMS/MS4 in which he focused in on Wellington's WMS area and outfall, the listing of facilities, MS4 Permit, the DEAR agency and their assessment process, map that DEAR produced, an overlying map of all information and monitoring locations. 5. ATTORNEY'S COMMENTS Ms. Cohen informed Council she sent them an email about the Wellington Residential Code Enforcement Appeal. She explained what the next steps would be. 6.
