CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; Michael Drahos, Vice Mayor; John McGovern, Councilman; Michael Napoleone, Councilman; and Tanya Siskind, Councilwoman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the April 26, 2022, Regular Council Meeting for review. A. 22-5041 PACK 125 ANNUAL PINEWOOD DERBY TROPHY PRESENTATION Mr. Barnes introduced the item. He stated that this was the Request From Pack 125 to Address the Mayor and Council for a Trophy Presentation. B. 22-5043 RECOGNITION OF POLO PARK MIDDLE SCHOOL ROBOTICS TEAMS Mr. Barnes introduced the item. He stated that this was the Recognition of Polo Park Middle School Robotics Teams for Their 2022 First LEGO League Regional Championship Wins. C. 21-4720 AUTHORIZATION TO UTILIZE A FLORIDA SHERIFFS ASSOCIATION (FSA) CONTRACT, AS A BASIS FOR PRICING, FOR THE PURCHASE AND DELIVERY OF TIRES AND RELATED SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Utilize the Florida Sheriffs Association (FSA) Contract, as a Basis for Pricing for the Purchase and Delivery of Tires and Related services, in the Amount of Approximately $68,000.00 Annually. Mr. De La Vega explained the item. D. 21-4887 AUTHORIZATION TO AWARD A CONTRACT FOR THE EXTERIOR PAINTING OF THE WELLINGTON COMMUNITY CENTER AND VILLAGE PARK GYMNASIUM Mr. Barnes introduced the item. He stated that this was the Authorization Village of Wellington Page 1 Village Council Workshop Action Summary - Final April 25, 2022 to Award a Contract for the Exterior Painting of the Wellington Community Center and Village Park Gymnasium, to All Counties Painting LLC dba People's Choice Pressure Cleaning and Painting, in the Amount of $98,042.50. Mr. De La Vega explained the item. Mr. Wagner and Mr. Barnes answered questions from Council. E. 22-4981 AUTHORIZATION TO DISPOSE OF SURPLUS TANGIBLE PERSONAL PROPERTY Mr. Barnes introduced the item. He stated that this was the Authorization to Dispose of FY 2022 Surplus Tangible Property. Mr. De La Vega explained the item. Mr. De La Vega and Mr. Barnes answered questions from Council. F. 22-5017 AUTHORIZATION TO RENEW AN ANNUAL AUDITING SERVICES CONTRACT WITH GRAU AND ASSOCIATES Mr. Barnes introduced the item. He stated that this was the Authorization to Renew an Annual Auditing Services Contract with Grau and Associates, for One Year, in the Amount Not to Exceed $95,000. Ms. Quickel explained the item. Ms. Quickel and Mr. De La Vega answered questions from Council. G. 22-5018 AUTHORIZATION TO CONTINUE UTILIZING INDEPENDENT CONTRACTOR AGREEMENTS WITH TENNIS PROFESSIONALS TO PROVIDE TENNIS INSTRUCTION Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing Independent Contractor Agreements with Tennis Professionals to Provide Tennis Instruction. Mr. De La Vega explained the item. H. 22-5078 ORDINANCE NO. 2022-15 (PROPOSING REFERENDUM QUESTION NO. 1 TO AMEND SECTION 6(B) OF WELLINGTON’S MUNICIPAL CHARTER RELATING TO TERM OF OFFICE FOR MAYOR AND COUNCILMEMBERS AND REMOVING UNNECESSARY LANAGUGE RELATING TO FILLING OF VACANCIES) AN ORDINANCE OF WELLINGTON’S COUNCIL PROPOSING REFERENDUM QUESITON NO. 1 TO AMEND SECTION 6(B) OF WELLINGTON’S MUNICIPAL CHARTER TO CLARIFY THAT A COUNCILMEMBER WHO HAS SERVED PART OR ALL OF THEIR TERM(S) MAY SERVE AS MAYOR, BUT NO MAYOR MAY THEREAFTER SERVE A CONSECUTIVE TERM AS A COUNCILMEMBER UNTIL AT LEAST ONE YEAR FOLLOWING THE DATE UPON WHICH THEY VACATE THEIR OFFICE, COUNTING TIME SERVED AS MAYOR PRIOR TO THE AUGUST 23, 2022 ELECTION TOWARD SUCH TERM LIMITS, ELIMINATING LANGUAGE MADE UNNECESSARY BY THE AMENDMENT AND REVISING SECTION (B) (1) TO REMOVE LANGUAGE RELATING TO APPOINTMENT TO FILL A VACANCY, PROVIDING FOR THE SUBMISSION OF THE PROPOSED CHARTER AMENDMENT TO THE ELECTORS OF WELLINGTON AT THE PRIMARY ELECTION TO BE HELD ON AUGUST 23, 2022; PROVIDING FOR FILING WITH THE FLORIDA DEPARTMENT OF STATE; PROVIDING FOR PUBLICATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. He stated that this was the Approval of Ordinance No. 2022-15 Proposing Referendum Question No. 1 to Amend Section 6(B) of Wellington's Charter to Clarify Term of Office for Mayor and Councilmembers and to Remove Language Relating to Appointments to Fill Vacancies. Ms. Cohen explained the item. Councilman Napoleone had a wording suggestion. I. 22-5077 ORDINANCE NO. 2022-14 (PROPOSING REFERENDUM QUESTION NO. 2 TO AMEND SECTION 9(G) OF WELLINGTON’S MUNICIPAL CHARTER RELATING TO WELLINGTON’S CANVASSING BOARD) AN ORDINANCE OF WELLINGTON’S COUNCIL PROPOSING AN AMENDMENT TO SECTION 9(G) OF WELLINGTON’S MUNICIPAL Village of Wellington Page 3 Village Council Workshop Action Summary - Final April 25, 2022 CHARTER TO PERMIT WELLINGTON TO DESIGNATE THE PALM BEACH COUNTY CANVASSING BOARD TO SERVE AS WELLINGTON’S CANVASSING BOARD DURING UNIFORM MUNICIPAL ELECTIONS, PROVIDING FOR THE SUBMISSION OF THE PROPOSED CHARTER AMENDMENT TO THE ELECTORS OF WELLINGTON AT THE PRIMARY ELECTION TO BE HELD ON AUGUST 23, 2022; PROVIDING FOR FILING WITH THE FLORIDA DEPARTMENT OF STATE; PROVIDING FOR PUBLICATION; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item and stated that this was the Approval of Ordinance No. 2022-14 Proposing Referendum Question No. 2 to Amend Section 9(G) of Wellington's Municipal Charter Relating to Wellington's Canvassing Board. Ms. Cohen explained the item. She answered questions from the Council. There was a discussion from Council regarding options for the canvassing board. Ms. Cohen answered a few more questions from Council. J. 22-5082 ORDINANCE NO. 2022-13 (SIGN CODE - ZONING TEXT AMENDMENT TO WELLINGTON’S LAND DEVELOPMENT REGULATIONS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON LAND DEVELOPMENT REGULATIONS BY REPEALING AND REPLACING ARTICLE 7, “SITE DEVELOPMENT STANDARDS,” CHAPTER 9, "SIGN REGULATIONS” TO ADDRESS CURRENT CASE LAW REQUIREMENTS AND TO ESTABLISH SPECIFIC STANDARDS AND REGULATIONS RELATED TO SIGNS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Approval of Ordinance No. 2022-13 to Amend Chapter 9, Sign Regulations, of Article 7, Site Development Standards, of Wellington's LDR to Establish Specific Standards and Regulations Related to Signs Within Wellington. He presented a PowerPoint and discussed the changes from second reading. He discussed examples of window signs. He answered Council’s questions. There was a discussion by Council regarding the Architectural Review Board's (ARB) responsibility for deciding this item. Mr. Stillings mentioned that he would have a full presentation at the next meeting. 4. WORKSHOP Mr. Barnes introduced the item. He stated that this was a Presentation by the US Polo Association to Address the Polo World Championship. He stated that the second item for the workshop would be a Presentation Regarding an Update on the Impaired Waters. Representatives from the USPA addressed the Council regarding the FIP World Polo Championship and presented a PowerPoint. They discussed what the XII FIP World Polo Championship was, the qualification rounds, the match schedules, and promotions. They answered questions from Council. Mr. Barnes introduced Mr. Varn. Mr. Varn addressed the Council and gave them an update on the status of the Impaired Waters situation. He answered questions from Council. Ms. Cohen and the rest of Council thanked Mr. Varn for his work on this issue. 5. ATTORNEY'S COMMENTS Ms. Cohen informed Council that they received a ruling on the fine reduction appeals. She explained the ruling and what it meant for the Village. Council asked questions regarding the ruling. Ms. Cohen answered Council’s questions.
