CALL TO ORDER Mayor Gerwig called the meeting to order at 7:00 p.m. Council Members present: Anne Gerwig, Mayor; John T. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. INVOCATION Pastor Peter Bartuska, Christ Community Church, delivered the invocation. 4. 22-4985 APPOINTMENT OF VICE MAYOR Mr. Barnes introduced the item. He indicated that Council, per Charter, needed to appoint a Vice Mayor for the Village of Wellington. A motion was made by Councilman Napoleone, seconded by Vice Mayor McGovern, and unanimously passed (5-0), to approve the appointment of Councilman Drahos as Vice Mayor of the Village of Wellington. Council congratulated Vice Mayor Drahos. 5. APPROVAL OF AGENDA Mr. Barnes indicated staff recommended approval of the Agenda as amended. Move Public Hearing Item 8D, Resolution No. R2022-01 (Wellington PUD Master Plan Amendment - Blue Cypress POD 65B), to Item 8A and the other Public Hearing items will move accordingly (Item 8A becomes Item 8B, Item 8B becomes Item 8C and Item 8C becomes Item 8D). PRESENTATIONS AND PROCLAMATIONS A. 22-5013 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING AND CONGRATULATING THE LOCAL WINNERS OF THE AMERICAN WATERWORKS ASSOCIATION’S 2022 “DROP SAVERS” WATER CONSERVATION POSTER CONTEST Mr. Barnes introduced the item. Ms. Addie read the proclamation. Ms. LaRocque stated this is the sixth year of the contest and recognized Milena Meehan and Marlene Cheney from her department who coordinate the contest. She acknowledged the first, second and third place winners in attendance from Binks Forest Elementary, Panther Run Elementary, Wellington Elementary and Wellington Landings Middle schools. Ms. LaRocque thanked the principals, parents, students and teachers. She presented the winners with certificates and backpacks from the Village of Wellington. She thanked Council for allowing the Utilities Department to participate in the contest. Council thanked Ms. LaRocque, the schools, teachers and parents for their participation and involvement. B. 22-4944 PROCLAMATION RECOGNIZING 95TH ANNIVERSARY OF LESSER, LESSER, LANDY AND SMITH, ATTORNEYS AT LAW Mr. Barnes introduced the item. Ms. Addie read the proclamation. Mr. Smith thanked Council for the proclamation and for all that the Village Council does each day. He stated they look forward to working with Council in the future on community projects and serving their Wellington clients. Council commended and congratulated the firm on their 95th Anniversary and gave various comments regarding their commitment to community involvement. 7. Mr. Stillings informed Council who the Applicant, Owner and Agent were for the item. He discussed the request and presented an analysis. Councilman McGovern asked what happens if Council does not approve the transfer of units. It is a reassignment to this tract. The overall POD is assigned 136 units. He stated it is a common practice to bank units. Mayor Gerwig asked if this is ministerial. Ms. Cohen stated it is not ministerial and this item is Quasi-Judicial. She offered a brief explanation. Then, Ms. Cohen swore in the individuals who were going to speak on this item. Council disclosed any ex parte communications. Mr. Stillings resumed his presentation and responded to Council's questions. Mr. Liam Sargent, Agent on behalf of Kimley Horn, conducted a PowerPoint presentation and explained the request to the PUD Master Plan Amendment. Public Hearing A motion was made by Councilman Napoleone, seconded Vice Mayor Drahos, and unanimously passed (5-0) to open the public hearing. There being no public comments, a motion was made by Councilman Napoleone seconded by Councilwoman Siskind, and unanimously passed (5-0) to close the public hearing. There was further discussion regarding the number of units and the proposed breakdown. REGULAR AGENDA A. 21-4789 AUTHORIZATION TO NEGOTIATE A CONTRACT FOR ARCHITECTURAL AND ENGINEERING SERVICES FOR THE CONSTRUCTION OF A NEW PALM BEACH SHERIFF’S OFFICE (PBSO) SUBSTATION Village of Wellington Page 8 Village Council Action Summary - Final April 12, 2022 Mr. Barnes introduced the item. Mayor Gerwig declared a conflict of interest, passed the gavel to Vice Mayor Drahos and left the dais. Mr. De La Vega presented the item. He stated any negotiated contract will be brought back to Council for award and execution. A motion was made by Councilman McGovern, seconded by Councilwoman Siskind, and unanimously passed (4-0; Mayor Gerwig recused) for Authorization to negotiate a Contract for Architectural and Engineering Services for the Construction of a New Palm Beach Sheriff’s Office (PBSO) Substation. After the vote, Mayor Gerwig returned to the dais. B. 22-5025 DISCUSSION OF CODE COMPLIANCE SPECIAL MAGISTRATES Mr. Barnes introduced the item. Mr. Stillings presented the item. Vice Mayor Drahos stated he would like to see a third magistrate added and feels that Council should be informed when Special Magistrates are up for renewal and it should be voted on publicly. Mr. Stillings stated staff would bring forth language to Council for their consideration at second reading regarding a change to the Code of Ordinances. Mayor Gerwig stated Council is in consensus to add a third magistrate to the bench and renewing Mr. Posner. Councilman McGovern inquired about Mr. Posner's and Mr. Zangen's terms. Mayor Gerwig inquired about the advertising process. Ms. Cohen stated they would adhere to the advertising process. C. 22-5039 APPROVAL OF VILLAGE ATTORNEY CONTRACT Mr. Barnes introduced the item. Councilman Napoleone stated he led the negotiations with Ms. Cohen to discuss her contract. He said she originally wanted a five-year contract, Village of Wellington Page 9 Village Council Action Summary - Final April 12, 2022 but they agreed on a three-year term, and he commented regarding severance pay. The compensation amount (salary) remains unchanged. Councilman McGovern inquired about the severance pay section of the contract and the merit increase. He suggested language regarding the merit increase. Vice Mayor Drahos commented regarding the merit increase. Mayor Gerwig suggested that Councilman Napoleone meet with Ms. Cohen again regarding the merit increase. Public Comment: 1. Mr. Bart Novak spoke regarding the proposed contract. There was further discussion of the contract. Councilman Napoleone indicated Ms. Cohen asked that the Village increase her deferred compensation from three percent to the max. He said they agreed to five percent. Councilman McGovern inquired about insurance. A motion was made by Councilman Napoleone, seconded by Councilman McGovern, and unanimously passed (5-0) to approve the Attorney’s contract as amended. Ms. Cohen thanked Council. 10. PUBLIC FORUM Mr. Barnes indicated one comment card was received. Public Comment: 1. Mr. Bart Novak spoke regarding his trailer at his house. He stated he feels there is selective enforcement. 11. ATTORNEY'S REPORT MS. COHEN: Ms. Cohen presented the following report: Ms. Cohen stated she sent a memo to Council today regarding the Opioid settlement litigation. Village of Wellington Page 10 Village Council Action Summary - Final April 12, 2022 Ms. Cohen stated for the record, the Village does not engage in selective enforcement. Mr. Novak has had code violations and has reported others. She stated the department is acting on those within its discretion. 12. MANAGER'S REPORT MR. BARNES: Mr. Barnes presented the following report: The Next Regular Council Meeting will be held on Tuesday, April 26, 2022 at 7:00 p.m. Village Offices will be closed on Friday, April 15, 2022 in observance of Good Friday. April is Distracted Driving Awareness Month, and we invite all residents to join staff and Sgt. DeJoy to discuss Distracted Driving at this week's Neighborhood Watch meeting. Sgt. DeJoy is leading efforts on two traffic enforcement operations in the Village: 1) Operation Bent Metal and 2) Operation Broken Bottle. The virtual meeting will be held on Wednesday, April 13, 2022 and will begin at 5:30 p.m. Persons can register on the Village’s Neighborhood Watch webpage at wellingtonfl.gov. Residents are invited to attend the “Pizza with PBSO” Event at Piatto Cucina on State Road 7 near Trader Joe's on Wednesday, May 4, 2022 from 5:00 p.m. to 9:00 p.m. Residents can engage with District 8 Deputies and discuss issues that matter to the community. Enforcement of the Golf Cart Ordinance is under way and residents are encouraged to go to wellingtonfl.gov/golfcarts to review the ordinance and rules. The primary complaints received so far by residents pertains to the Elementary schools and golf carts going beyond the 'No golf cart beyond this point' signs. Golf cart signs have been fully installed. Minor field modifications are in progress on a case-by-case basis. In addition to PBSO enforcement, staff is evaluating the performance of the ordinance and signage and is working on providing an update soon. The Public Safety Committee and Education Committee will be holding a joint meeting on Wednesday, April 27, 2022 at 6:30 p.m. at the Wellington Community Center Grande Ballroom. Wellington COVID-19 Testing is available to all, including those uninsured, for a fee, at the Wellington Green Park (10-acre) Drive-Thru site, Monday through Friday from 8:00 a.m. until 5:00 p.m.; and at the Village Hall parking lot, Monday through Saturday from 8:30 a.m. until 8:00 p.m. Fees for the uninsured range from $99 to $150 depending on Village of Wellington Page 11 Village Council Action Summary - Final April 12, 2022 the type of test requested. The Curative testing site on South Shore & Greenview Shores is working on accepting uninsured for a fee in the near future. The South Shore site is open 7 days a week from 8:00 a.m. until 5:30 p.m. Both Curative testing sites at Village Hall and South Shore & Greenview Shores are replacing the NAAT testing and are switching back to offering Rapid PCR tests effective this Wednesday, April 13, 2022. Most residents preferred the Rapid PCR test and Curative was able to secure an agreement with the Rapid PCR supplier to ensure adequate supply to the sites. Town Center Phase 2 construction is in progress. Consequently, Town Center Drive has been closed between the community center and Village Hall. Construction is projected to be completed in May 2023. Staff has scheduled the Aero Club Drive Shoulder Widening/Landscaping Construction Project to begin on May 1, 2022. The project will take approximately 90-120 days to complete. Councilman McGovern asked if staff is monitoring along with Congresswoman Frankel’s office regarding allocation of funding for testing. He stated as soon as federal or state funding becomes available again, the Village will resume free testing. Mayor Gerwig inquired about an accident that happened on Sunday on Greenview Shores and Wellington Trace. Mr. Barnes briefly spoke regarding the accident. Mayor Gerwig stated she continues to receive complaints regarding the flashing yellow lights. She asked that staff track this intersection. Mr. Barnes stated staff will track the intersection. 13. COUNCIL REPORTS VICE MAYOR DRAHOS: Vice Mayor Drahos presented the following report: Vice Mayor Drahos waived comment. COUNCILMAN NAPOLEONE: Councilman Napoleone presented the following report: Village of Wellington Page 12 Village Council Action Summary - Final April 12, 2022 Councilman Napoleone reminded everyone that the Annual Egg Hunt is this Saturday (April 16, 2022) at 10:00 a.m. at Village Park Councilman Napoleone stated that the Earth and Arbor Day Celebration will be held on April 23, 2022 at the Promenade. Councilman Napoleone stated the GoWellington App is now live. Councilman Napoleone wished everyone a Happy Easter and a Happy Passover. COUNCILMAN MCGOVERN: Councilman McGovern presented the following report: Councilman McGovern stated he hopes that many people will attend the Annual Egg Hunt at Village Park on April 16, 2022 at 10:00 a.m. Councilman McGovern stated the last Lakeside Green Market will be held on April 22, 2022 and the Health and Wellness Fair will take place at the same time. He said he wanted to give credit to the Village's staff for the coordination of the events. Mr. Barnes commended the Parks and Recreation staff for the events. Councilman McGovern stated that they would like for everyone to join them for the Earth/Arbor Day celebration and the Great American Clean-Up. Councilman McGovern congratulated Mr. Drahos on his appointment to Vice Mayor. Councilman McGovern congratulated Ms. Cohen on her contract extension. COUNCILWOMAN SISKIND: Councilwoman Siskind presented the following report: Councilwoman Siskind stated there were two successful events this past weekend. She congratulated the Crowned Pearls on their event at Wellington International (the show grounds) and stated it was sold out and a packed house. Village of Wellington Page 13 Village Council Action Summary - Final April 12, 2022 Councilwoman Siskind commented regarding the John Scollo Memorial Softball Tournament and said the opening ceremony was very touching. Councilwoman Siskind stated she attended the Community Roundtable meeting today with all of the community partners and it was fantastic. Councilman McGovern congratulated the friends at Gay Polo on Field 1. MAYOR GERWIG: Mayor Gerwig presented the following report: Mayor Gerwig stated Wellington won the "Let’s Move" Campaign. She stated it was a community effort and staff did a phenomenal job. Mayor Gerwig commented regarding garbage being strewn around. She commented regarding A-Frame signs about illegal dumping. Mr. Barnes stated Mr. Stillings and his team have been coordinating with Public Works. Mayor Gerwig asked if there were difficulties with the broadcast on Channel 18. Mr. Barnes spoke regarding Channel 18. Mayor Gerwig commented that Mr. Gangnes had been emailing regarding horse safety. Mr. Barnes stated he advised Mr. Gangnes to provide the information to him and he has provided it. Mayor Gerwig commented regarding golf carts and yielding. She feels it is not getting through to the drivers. Mr. Barnes stated PBSO is continuing to provide information to residents via written and verbally. 14.
