CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; John McGovern, Vice Mayor; Michael Drahos, Councilman; Michael Napoleone, Councilman; and Tanya Siskind, Councilwoman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the April 12, 2022, Regular Council Meeting for review. He mentioned that there would not be a workshop due to a cancellation. A. 22-4985 APPOINTMENT OF VICE MAYOR Mr. Barnes introduced the item. He stated that this was the Appointment of Vice Mayor of the Village of Wellington. B. 22-5013 A PROCLAMATION OF THE VILLAGE COUNCIL OF WELLINGTON, FLORIDA RECOGNIZING AND CONGRATULATING THE LOCAL WINNERS OF THE AMERICAN WATERWORKS ASSOCIATION’S 2022 “DROP SAVERS” WATER CONSERVATION POSTER CONTEST Mr. Barnes introduced the item. He stated that this was the Presentation of Proclamations to the Local Winners of the American Waterworks Association's "Drop Savers" Water Conservation Poster Contest. He said that the winners would be there to be recognized. C. 22-4944 PROCLAMATION RECOGNIZING 95TH ANNIVERSARY OF LESSER, LESSER, LANDY AND SMITH, ATTORNEYS AT LAW Mr. Barnes introduced the item. He stated that this was the A Proclamation Recognizing the 95th Anniversary of the Firm of Lesser, Lesser, Landy and Smith, Attorneys at Law. He said that Mickey Smith would be there to receive the proclamation. D. 22-4984 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF FEBRUARY 22, 2022 AND MARCH 22, 2022 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meetings of February 22, 2022 and March 22, 2022. E. 22-4937 PALM BEACH CENTRAL HIGH SCHOOL AND WELLINGTON COMMUNITY HIGH SCHOOL PROJECT GRADUATION SPONSORSHIP 2022 Mr. Barnes introduced the item. He stated that this was the Approval of Palm Beach Central High School and Wellington Community High School 2022 Project Graduation Sponsorship. Mr. Barnes answered Mayor Gerwig’s questions. F. 21-4836 AUTHORIZATION TO CONTINUE UTILIZING A SOUTHEAST FLORIDA COOPERATIVE CONTRACT WITH MULTIPLE VENDORS, AS A BASIS FOR PRICING, FOR THE PURCHASE AND DELIVERY OF WATER METER FITTINGS AND WATER LINE ACCESSORIES Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing a Southeast Florida Cooperative Contract, with Multiple Vendors, as a Basis for Pricing, for the Purchase and Delivery of Water Meter Fittings and Water Line Accessories, in the Amount of Approximately $150,000 Annually. Ms. LaRocque explained the item. G. 21-4838 AUTHORIZATION TO CONTINUE UTILIZING A SOUTHEAST FLORIDA COOPERATIVE CONTRACT WITH ALLIED UNIVERSAL CORPORATION, AS A BASIS FOR PRICING, FOR THE PURCHASE AND DELIVERY OF SODIUM HYDROXIDE Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing a Southeast Florida Cooperative Contract with Allied Universal Corporation, as a Basis for Pricing, for the Purchase and Delivery of Sodium Hydroxide in the Amount of Approximately $120,000 Annually. Ms. LaRocque explained the item. She answered questions from Mayor Gerwig. H. 21-4840 AUTHORIZATION TO RENEW AN EXISTING CONTRACT FOR BUS RENTAL AND DRIVER SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Renew an Existing Contract with Bus One, LLC for Bus Rental and Driver Services in the Amount of Approximately, $60,000 Annually. Mr. De La Vega explained the item. He answered questions from Council. He stated that this was the Authorization to Award an Annual Contract to Steffen and Sons Striping, LLC and Authorization to Approve Fiscal Year 2022, Roadway Striping and Pavement Marking Service Projects, in the Amount of Approximately $148,000. Mr. De La Vega explained the item. Mr. Wagner answered questions from Council. J. 22-4989 AUTHORIZATION TO EXECUTE A GUARANTEED MAXIMUM PRICE (GMP) AMENDMENT WITH WHARTON-SMITH, INC. FOR THE WATER TREATMENT PLANT RENEWAL AND REHABILITATION COMPLETION PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Execute a Guaranteed Maximum Price (GMP) Amendment with Wharton-Smith, Inc. for the Water Treatment Plant Renewal and Rehabilitation Completion Project at a Cost of $1,694,316.00. Ms. LaRocque explained the item. She answered questions from Council. K. 22-5024 UTILITY SERVICES AGREEMENT WITH BLAKE G. HODESS AND CAROL F. COHEN-HODESS FOR PROPERTY LOCATED IN PALM BEACH COUNTY, FLORIDA Mr. Barnes introduced the item. He stated that this was the Approval of a Developer Agreement Reserving Potable Water, Wastewater and Fire Capacity for the Property Owned/Controlled by Blake G. Hodess and Carol F. Cohen-Hodess in Palm Beach County, Florida. Ms. LaRocque explained the item. She answered questions from Council. L. 22-5027 UTILITY SERVICES AGREEMENT WITH LOTIS WELLINGTON, LLC FOR PROPERTY LOCATED IN PALM BEACH COUNTY, FLORIDA Mr. Barnes introduced the item. He stated that this was the Approval of a developer agreement reserving potable water, wastewater and fire capacity for the property owned/controlled by Lotis Wellington, LLC in Palm Beach County, Florida. He stated that this was the Approval of Ordinance No. 2022-15 Proposing Referendum Question No. 1 to Amend Section 6(B) of Wellington's Municipal Charter Relating to Term of Office for Mayor and Councilmembers and Removing Unnecessary Language Relating to Filling of Vacancies. Ms. Cohen explained the item. She answered questions from Council. Mayor Gerwig expressed how she felt about this question and gave suggestions of other Charter items that should be addressed. There was discussion regarding Council salary changes in the Charter. Ms. Cohen answered questions from Council regarding the wording of the referendum question. O. 22-5005 ORDINANCE NO. 2022-13 (SIGN CODE - ZONING TEXT AMENDMENT TO WELLINGTON’S LAND DEVELOPMENT REGULATIONS) AN ORDINANCE OF WELLINGTON, FLORIDA’S COUNCIL AMENDING THE WELLINGTON LAND DEVELOPMENT REGULATIONS BY REPEALING AND REPLACING ARTICLE 7, “SITE DEVELOPMENT STANDARDS,” CHAPTER 9, "SIGN REGULATIONS” TO ADDRESS CURRENT CASE LAW REQUIREMENTS AND TO ESTABLISH SPECIFIC STANDARDS AND REGULATIONS RELATED TO SIGNS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. He stated that this was the Approval of Resolution No. R2022-01, a Master Plan Amendment (MPA) to Amend the Wellington Planned Unit Development (PUD) Master Plan by Modifying Pod 65B, Also Known as Blue Cypress of Palm Beach Polo and Country Club, to Change the Unit Type from Zero Lot Line (ZLL) to Single Family (SF)/ZLL, to Reduce the Dwelling Units (du) Assigned to Pod 65B from 140 Units to 136 Units, to Modify the Density of Pod 65B from 4.99 to 4.82 du/ac, and to Transfer the Remaining 56 Dwelling Units from Tract B to Tract G-1 of Blue Cypress of Palm Beach Polo and Country Club. Mr. Stillings mentioned that he would have a full presentation at the next meeting. Q. 21-4789 AUTHORIZATION TO NEGOTIATE A CONTRACT FOR ARCHITECTURAL AND ENGINEERING SERVICES FOR THE CONSTRUCTION OF A NEW PALM BEACH SHERIFF’S OFFICE (PBSO) SUBSTATION Mr. Barnes introduced the item. He stated that this was the Authorization to Negotiate a Contract with Leo A. Daly Company for Architectural and Engineering Services for the Construction of a New PBSO Substation. Mayor Gerwig recused herself from the discussion. She mentioned that she would be submitting the appropriate documents. Mr. De La Vega explained the item. He stated that this was the Discussion of Code Compliance Special Magistrates. Mr. Barnes explained the item. Mr. Stillings and Ms. Cohen answered questions from Council. Ms. Cohen stated that they could draft an internal policy to address the magistrate renewal notification. S. 22-5039 APPROVAL OF VILLAGE ATTORNEY CONTRACT Mr. Barnes introduced the item. He stated that this was the Approval of Village Attorney Contract. Councilman Napoleone discussed his meeting with Ms. Cohen and the proposed contract.
