CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00 p.m. Council Members in Attendance: Anne Gerwig, Mayor; Michael Drahos, Vice Mayor; John McGovern, Councilman; Michael Napoleone, Councilman and Tanya Siskind, Councilwoman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the October 11, 2022 Regular Council Meeting for review. A. 22-5420 FISCAL YEAR 2023 KEELY SPINELLI GRANT AWARDS Mr. Barnes introduced the item. He stated that this was the Fiscal Year 2023 Keely Spinelli Grant Awards. He noted that the school principals and representatives from Palm Beach County School District (PBCSD) will be in attendance. B. 22-5461 PRESENTATION OF A MARKET STUDY BY CLANCY SPORTS PROPERTIES, LLC. FOR THE WELLINGTON ATHLETICS PROJECT Mr. Barnes introduced the item. He stated that this was the Presentation of A Market Study By Clancy Sports Properties, LLC for The Wellington Athletics Project. He noted that Item U and Item V will be discussed with the presentation as it relates to the financing portion. He advised that there will be a presentation added to the agenda by the Housing Trust regarding the County Housing Bond. He noted that the agenda would be re-arranged to make the presentation first. He advised that there will be an Information Only meeting for the community that will be held on October 18, 2022 at the Wellington Community Center. Mayor Gerwig disclosed that she serves on the Housing Leadership Council which was involved in the process at the very front side; and said there is no conflict. C. 22-5478 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF SEPTEMBER 21, 2022 Mr. Barnes introduced the item. He stated that this was the Council Approval of the Minutes of the Regular Wellington Council Meeting of September 21, 2022. D. 22-5395 AUTHORIZATION TO UTILIZE EXISTING CONTRACTS AND AWARD SOLE SOURCE CONTRACTS FOR VARIOUS FY 2023 PUBLIC WORKS PROJECTS Mr. Barnes introduced the item. He stated that this was the Authorization To Utilize Existing Contracts and Award Sole Source Contracts for Various FY 2023 Public Works Projects. Mr. De La Vega explained the item. Mayor Gerwig inquired if there is anything unusual. Mr. Barnes responded to Mayor Gerwig's inquiry. E. 22-5438 AUTHORIZATION TO UTILIZE AN EXISTING PUBLIC WORKS CONTRACT, AS A BASIS FOR PRICING, FOR THE POLO CLUB ROAD / C-7 CANAL CULVERT REPAIR Mr. Barnes introduced the item. He stated that this was the Authorization To Utilize An Existing Public Works Contract, As a Basis for Pricing, For The Polo Club Road/C-7 Canal Culvert Repair. Mr. Reinsvold explained the item. He presented a PowerPoint Presentation and discussed the Location Map and Project Plan. He noted that the culvert is located within the Polo Club Subdivision. Mayor Gerwig asked about the timeline. Mr. Reinsvold answered questions from Mayor Gerwig. He noted that the Village has been in contact with Jim Taccone's Group. Mayor Gerwig commented on the Right-of-Way (ROW) and the Village's obligation to provide drainage. Mr. Reinsvold continued with the presentation. There was discussion on the headwalls. Vice Mayor Drahos asked what was the catalyst for the project. Mr. Reinsvold responded to Vice Mayor Drahos's questions. Mayor Gerwig inquired if the community was asked about the aesthetics. Mr. Reinsvold answered a question from Mayor Gerwig. Mr. Barnes noted the completed project on Wellington Trace for Council to view the similar aesthetics. F. 22-5439 AUTHORIZATION TO EXECUTE A GUARANTEED MAXIMUM PRICE (GMP) AMENDMENT WITH WHARTON-SMITH, INC. FOR THE WATER TREATMENT PLANT RAW WATERMAIN-DRAINAGE (RWD) CONFLICT REPLACEMENT PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Execute A Guaranteed Maximum Price (GMP) Amendment With Wharton-Smith, Inc. For The Water Treatment Plant Raw Watermain-Drainage (RWD) Conflict Replacement. Ms. Panse explained the item. Mr. Barnes commented on the various departments working together on this project. Ms. Panse and Mr. Reinsvold responded to Council questions. Councilman McGovern inquired about recourse against the contractor. Ms. Bausch said that this is her first time hearing about this and mentioned she can work with staff to look into this. Mr. Barnes said that staff can look into this. There was discussion on liability provisions. Mr. Reinsvold noted that this is not the first issue. G. 22-5441 AUTHORIZATION TO AWARD A TASK ORDER, TO PROVIDE ENGINEERING CONSULTING SERVICES FOR BOOSTER PUMP STATION NO. 1 Mr. Barnes introduced the item. He stated that this was Authorization to Award A Task Order, To Provide Engineering Consulting Services for Booster Pump Station No. 1. Ms. Panse explained the item. Mayor Gerwig inquired if this will help determine the cost of work. Ms. Panse responded to Mayor Gerwig's inquiry. H. 22-5466 AN AMENDMENT TO THE RESTRICTIVE COVENANT BETWEEN W&W EQUESTRIAN CLUB, LLC AND WELLINGTON FOR WINDING TRAILS Mr. Barnes introduced this item. He stated that this was An Amendment to The Restrictive Covenant Between W&W Equestrian Club, LLC and Wellington For Winding Trails. He noted that there are a total of three items; two which are on the Consent Agenda and one on Public Hearing. He said that the two items on the Consent Agenda will move to the Public Hearing Agenda to be heard concurrently at the Village Council October 11, 2022 meeting along with Item 7F Resolution No. R2022-47 The Landings At Wellington PUD Amendment - Lot 6 of Winding Trails Access Point and Item I. Ms. Ferraiolo explained the item. Mayor Gerwig asked Ms. Ferraiolo if this is similar to the pervious restrictive covenant. Ms. Ferraiolo answered Mayor Gerwig's question. There was discussion on the reason for another entry way and bus stop location. Ms. Feraiolo and Mr. Stillings answered questions from Council. Mayor Gerwig passed the gavel to Vice Mayor Drahos and left the meeting at 4:37 p.m. Vice Mayor Drahos presided over the remainder of the meeting. Vice Mayor Drahos asked about the total number of barns and whether traffic studies were completed. Ms. Feraiolo answered Vice Mayor Drahos's questions. Councilman Napoleone asked about the Planning, Zoning and Adjustment Board and Equestrian Preserve Committee votes. Ms. Ferraiolo answered Councilman Napoleone's question. R2022-48 (WELLINGTON SENIORS CLUB AGREEMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING A CONTRACT FOR SENIOR CITIZENS SERVICES BETWEEN WELLINGTON AND THE WELLINGTON SENIORS CLUB, INC.; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2022-48 Wellington Seniors Club Agreement. Mr. De La Vega explained the item. Councilman McGovern asked about the Village Senior Services Program and what is the reason for the amount justification. Mr. De La Vega answered Councilman McGovern's questions. Mr. Barnes stated the goal for changing the structure. J. 22-5409 RESOLUTION NO. R2022-56 (ALCOHOL POLICY) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING A REVISED ALCOHOL RISK MANAGEMENT POLICY; REPEALING PRIOR RESOLUTIONS RELATING TO THE ALCOHOL RISK MANAGEMENT POLICY; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He said that this was Resolution No. 2022-56 Alcohol Policy. He noted that this item will be moved to the Public Hearing Agenda, given that the Code provisions are being modified and need to be adopted first before the Council adopts the new Alcohol Policy. He thanked Ms. Coates for providing the bus stop location for the prior items. Councilman McGovern inquired where the item will be placed on the agenda. Mr. Barnes noted that the it would be Item 7D. Ms. Coates explained the item. Councilman McGovern asked whether this is based on the number of attendees and duration of time; and asked who is making these calls. He stated that this was the Advisory Board and Committee Enabling Resolutions. Ms. Bausch explained the item and noted the changes. Vice Mayor Drahos asked about the procedure to remove a board member. Ms. Bausch answered Vice Mayor Drahos's questions. There was discussion regarding the procedures to remove At-Large appointees. R. 22-5453 RESOLUTION NO. R2022-30 (PUBLIC ASSEMBLIES POLICY AND APPLICATION FEE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL APPROVING THE PUBLIC ASSEMBLIES ADMINISTRATIVE POLICY TO PROVIDE FOR WAIVER OF CERTAIN REQUIREMENTS, FEES, INSURANCE, APPLICATION REVIEW, AND FAST-BREAKING ASSEMBLY LOCATIONS; ADOPTING A FEE FOR PUBLIC ASSEMBLY APPLICATIONS; AND PROVIDING AN EFFECTIVE DATE. R2022-51 (WELLINGTON PUD MASTER PLAN) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL, FOR A MASTER PLAN AMENDMENT REPEALING AND REPLACING THE WELLINGTON PLANNED UNIT OF DEVELOPMENT (PUD) MASTER PLAN IN ITS ENTIRETY TO PROVIDE AN UPDATED MASTER PLAN WITH ALL CURRENT APPROVALS AND SITE CONDITIONS; PROVIDING A CONFLICTS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. U. 22-5472 AUTHORIZATION TO APPROVE THE FINANCING TEAM UNDERWRITER SELECTION FOR THE WELLINGTON COMMUNITY PARK IMPROVEMENT PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Approve the Financing Team Underwriter Selection for the Wellington Community Park Improvement Project. Mr. Barnes explained the item. He noted that this item would tie in with the full presentation by the Market Study Consultant and mentioned the companion item; the Amendment to the Comprehensive Agreement for Design, Development, Construction, and Operation of the Wellington Community Park between Wellington Athletics to Develop the Traction Operation of Wellington Community Park, which is the Wellington's Athletics Project. He noted that George Linley of the Palm Beach County Sports Commission would be present along with representatives from Village of Wellington Page 10 Village Council Workshop Action Summary - Final October 6, 2022 Wellington Athletics, and staff. Councilman Napoleone asked what would be the order of the agenda. Mr. Barnes answered a question from Councilman Napoleone. Councilman Napoleone inquired about the Market Study. Mr. Barnes responded to Councilman Napoleone's inquiry. V. 22-5462 AMENDMENT TO A COMPREHENSIVE AGREEMENT FOR THE DESIGN, DEVELOPMENT, CONSTRUCTION, AND OPERATION OF WELLINGTON COMMUNITY PARK, BETWEEN WELLINGTON ATHLETICS, LLC., AND ACME IMPROVEMENT DISTRICT, A DEPENDENT DISTRICT OF THE VILLAGE OF WELLINGTON This item was discussed with the previous item. 4. WORKSHOP Mr. Barnes introduced the item. He stated that there would be a brief presentation; specifically, on grants from the Housing Department. Councilman McGovern inquired about the village manager's contract being added as a walk on item. Mr. Barnes responded to Councilman McGovern's inquiry. Councilman McGovern explained the item. He mentioned meeting with Mr. Barnes, Ms. Quickel, and Ms. Gibbons to work on an employment agreement. He provided highlights and noted the changes made in the agreement. Vice Mayor Drahos asked Mr. Barnes if he is okay with the agreement. Mr. Barnes responded to Vice Mayor Drahos's question. Councilman McGovern asked Council if there were any questions and direction. If any, Council should provide them to be addressed prior to Village Council October 11, 2022 meeting. Vice Mayor Drahos commented on the agreement; and said that it is a good contract. A. 22-5475 HOUSING GRANT UPDATE Mr.Barnes introduced the item. He stated that this was the Housing Grant Village of Wellington Page 11 Village Council Workshop Action Summary - Final October 6, 2022 Update previously mentioned in meetings. Mr. O'Dell explained the item. Ms. Kelly further explained the item. She presented a PowerPoint presentation Wellington Housing Grant Programs and discussed the programs. Ms.Kelly answered Council questions. There was discussion on program requirements and adding a Homestead Exemption requirement. Mr. O'Dell and Ms. Bausch answered Council questions. Ms. Bausch made a comment on the Homestead Exemption discussion. She advised that she would look into the requirements for the Community Development Block Grant (CDBG) and State Housing Initiatives Partnership Program (SHIP) and advise whether the Homestead Exemption restrictions can be applied to these programs. Mr. O'Dell and Ms. Kelly answered questions from Vice Mayor Drahos. Ms. Bausch noted that the SHIP status can change and explained how it is assessed.
