CALL TO ORDER Mayor Gerwig called the meeting to order at 4:00p.m. Council Members in Attendance: Anne Gerwig, Mayor; Michael Napoleone, Vice Mayor; John McGovern, Councilman; Michael Drahos, Councilman; and Tanya Siskind, Councilwoman. 2. PLEDGE OF ALLEGIANCE Mayor Gerwig led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes introduced the agenda for the September 20, 2023 Regular Council Meeting for review. A. 23-6073 FISCAL YEAR 2024 KEELY SPINELLI GRANT AWARDS Mr. Barnes introduced the item. He stated that this was the Fiscal Year 2024 Keely Spinelli Grant Awards. He mentioned that principals and representatives from the Palm Beach County School District would be present. B. 23-6083 A PROCLAMATION OF WELLINGTON, FLORIDA’S COUNCIL RECOGNIZING THE WELLINGTON WIZARDS RUGBY U12 TEAM ON WINNING THE STATE CHAMPIONSHIP Mr. Barnes introduced the item. He stated that this was the Proclamation of Wellington, Florida's Council Recognizing the Wellington Wizards Rugby U12 Team on Winning the State Championship. He mentioned that the team and representatives from the Wizards Rugby Club will be present. Mayor Gerwig inquired about the team. Mr. Barnes responded to Mayor Gerwig's inquiry. C. 23-6115 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETING OF SEPTEMBER 5, 2023 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meeting of September 5, 2023. He asked Council to provide comments, if any, to the Clerk's Office. D. 23-5949 AUTHORIZATION TO ENTER INTO A SOLE SOURCE MASTER SERVICES AND HOSTING AGREEMENT FOR BUILDING SELECTXT PROJECT Village of Wellington Page 1 Village Council Workshop Action Summary - Final September 18, 2023 Mr. Barnes introduced the item. He stated that this was the Authorization to Enter into a Sole Source Master Services and Hosting Agreement for Building Selectxt Project. Ms. Quickel explained the item. Mr. Silliman and Mr. Tomasik further explained the item. Mayor Gerwig asked if other cities have good responses using the service. Mr. Tomasik answered a question from Mayor Gerwig. Mayor Gerwig commented about the lengthy messages. She asked if customers will be notified to contact the Village. Mr. Tomasik responded to Mayor Gerwig's comment and question. Vice Mayor Napoleone commented that this will be easier and faster. Mayor Gerwig asked about the cost. Mr. De La Vega and Mr. Tomasik answered a question from Mayor Gerwig. Mayor Gerwig asked Mr. Silliman if he had checked the vendor out. Mr. Silliman answered a question from Mayor Gerwig. E. 23-6011 AUTHORIZATION TO AWARD A CONTRACT FOR LOBBYING SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Award a Contract for Lobbying Services. Mr. De La Vega explained the item. Mayor Gerwig asked if this is the last year for the contract. Mr. De La Vega answered a question from Mayor Gerwig. Vice Mayor Napoleone commented about the contract. F. 23-6107 AUTHORIZATION TO UTILIZE CONTRACTS FOR THE PURCHASE AND DELIVERY OF VEHICLES AND EQUIPMENT; AND AUTHORIZATION TO DISPOSE OF EXISTING SURPLUS EQUIPMENT Village of Wellington Page 2 Village Council Workshop Action Summary - Final September 18, 2023 Mr. Barnes introduced the item. He stated that this was the Authorization to Utilize Contracts for the Purchase and Delivery of Vehicles and Equipment; and Authorization to Dispose of Existing Surplus Equipment. Mr. De La Vega explained the item. Mayor Gerwig asked if staff had checked to see if there were better deals. Mr. De La Vega answered a question for Mayor Gerwig. Vice Mayor Napoleone inquired about the Tradewind Generator. Mr. Barnes responded to Vice Mayor Napoleone's inquiry. Mayor Gerwig asked if the generator is being replaced. Mr. Barnes answered a question from Mayor Gerwig. G. 23-6111 AUTHORIZATION TO AMEND AN EXISTING PURCHASE ORDER FOR THE BIG BLUE TRACE LANDSCAPE AND IRRIGATION DESIGN AND BID PHASE SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Amend an Existing Purchase Order for the Big Blue Trace Landscape and Irrigation Design and Bid Phase Services. Mr. Reinsvold explained the item. Vice Mayor Napoleone asked if this is for additional plantings or changing the configuration. Mr. Reinsvold answered a question from Vice Mayor Napoleone. Vice Mayor Napoleone commented that there is no map or picture. Mr. Barnes responded to Vice Mayor Napoleone's comment. Councilman Drahos asked who wanted the update of landscape on the West side of the road. Mr. Barnes answered a question from Councilman Drahos. Councilman Drahos commented about the scope of the work and quality. Mr. Barnes responded to Councilman Drahos's comment. Village of Wellington Page 3 Village Council Workshop Action Summary - Final September 18, 2023 Vice Mayor Napoleone inquired if Council will see an illustration after the design phase. Mr. Barnes responded to Vice Mayor Napoleone's inquiry. Mayor Gerwig asked if this will help with drainage issue. Mr. Reinsvold answered a question from Mayor Gerwig. Mayor Gerwig commented about the damage. Mr. Reinsvold responded to Mayor Gerwig's comment. H. 23-6114 AUTHORIZATION TO NEGOTIATE A COMPREHENSIVE AGREEMENT FOR THE CONSTRUCTION, OPERATION AND MAINTENANCE OF PADEL COURTS Mr. Barnes introduced the item. He stated that this was the Authorization to Negotiate a Comprehensive Agreement for the Construction, Operation and Maintenance of Padel Courts. Mr. De La Vega explained the item. He noted the unsolicited proposal received from 10BY20, LLC on July 5, 2023. He said that Council authorized staff to advertise a 21 day notice at the August 8, 2023 meeting. He said that one proposal was received on September 6, 2023 from Inversiones Big Alexander. Councilwoman Siskind asked if there is room for additional tennis courts in addition to the seven (7) Padel courts. Mr. De La Vega answered a question from Councilwoman Siskind. Mayor Gerwig asked if the other proposal proposed a bathroom and cafe. Mr. De La Vega answered a question from Mayor Gerwig. Councilman Drahos asked how in-depth did staff get when comparing the quality of courts of the two entities. Mr. De La Vega answered a question from Councilman Drahos. Councilman Drahos inquired if the VIllage would have full indemnity on the courts that are designed. Ms. Bausch and Mr. De La Vega responded to Councilman Drahos's inquiry. Mr. Barnes introduced the item. He stated that this was A. Resolution No. R2023-12 (Acceptance of Amendment No.1 to State of Florida District Four (4) Department of Transportation Landscape Maintenance Memorandum of Agreement to Install Landscaping In Median of State Road 7 (US 441 Between Forest Hill Boulevard and Medical Park Boulevard), B. Resolution No,. R2023-48 (Acceptance of Agreement with Wellington Regional Medical Center, LLC., to Install Landscape in the Median of State Road 7 Between Forest Hill Boulevard and Medical Park Boulevard). Councilman Drahos asked about the condition of approval. Mr. Barnes answered a question from Councilman Drahos. Mr. Barnes answered a question from Mayor Gerwig. Councilman Drahos inquired if the Florida Department of Transportation (FDOT) dictates what can be placed in the median. Mr. Reinsvold and Mr. Barnes responded to Councilman Drahos's inquiry. Councilman Drahos requested that staff keep him in the loop. Mr. Barnes responded to Councilman Drahos's request. There was comment and discussion regarding design standards. Mr. Stillings mentioned a preliminary drawing from Cotleur & Hearing. Mr. Barnes said that staff can send the drawing to Council. J. 23-6100 RESOLUTION NO. R2023-31 (CODE COMPLIANCE LIEN REDUCTION FOR 10726 VERSAILLES BLVD) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL COMPROMISING A LIEN ASSOCIATED WITH CODE COMPLIANCE ACTIONS NOH-9-2387 AND NOH-11-2102 FOR 10726 VERSAILLES BLVD, PURSUANT TO SECTION 2-199 OF THE CODE OF ORDINANCES; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2023-31 (Code Compliance Lien Reduction for 10726 Versailles Blvd). Mr. Stillings explained the item. He noted the policy Council approved establishing the threshold approval. Mayor Gerwig asked what was the amount of the lien. Mr. Stillings said that the full amount was over $100,000 but it was reduced $3,500. Mayor Gerwig inquired about the Magistrate meeting date. Mr. Stillings responded to Mayor Gerwig's inquiry. Mayor Gerwig asked was this on Consent. Mr. Stillings answered a question from Mayor Gerwig. Village of Wellington Page 6 Village Council Workshop Action Summary - Final September 18, 2023 Councilman Drahos inquired about the lien amount. Mr. Stillings responded to Councilman Drahos's inquiry. Councilman Drahos asked about the nature of the violations and what is the explanation. He asked why it lingered for so long. Mr. Stillings answered questions from Councilman Drahos. There was discussion about lien compliance explanations. Ms. Bausch said that she recalls that this property owner was placed on a payment plan and it was recently paid off. There were comments by Council regarding the magistrate hearing. Mr. Stillings stated that there was no specific discussion as this item was on the Consent Agenda. Vice Mayor Napoleone commented that Council would be looking to undo a lien that was done three years ago and paid off. Mr. Stillings responded to Vice Mayor Napoleone's comment. Councilman McGovern commented about the payment and the ordinance. Mr. Stillings responded to Councilman McGovern's comment. Councilman McGovern asked if this is out of an abundance of caution. Ms. Bausch answered a question from Councilman McGovern. There were comments and discussion about the case and the Magistrate's authority. K. 23-5881 SECOND PUBLIC HEARING TO ADOPT THE FY 2023/2024 MILLAGE RATE AND ANNUAL BUDGET FOR WELLINGTON I. RESOLUTION NO. R2023-58 (MILLAGE RATE) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING THE TAX LEVY AND MILLAGE RATE FOR WELLINGTON FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2023 AND ENDING SEPTEMBER 30, 2024; AND PROVIDING AN Village of Wellington Page 7 Village Council Workshop Action Summary - Final September 18, 2023 EFFECTIVE DATE. II. RESOLUTION NO. R2023-59 (WELLINGTON BUDGET) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL ADOPTING A BUDGET FOR THE VILLAGE OF WELLINGTON FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2023 AND ENDING SEPTEMBER 30, 2024; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was the Second Public Hearing to Adopt the FY 2023/2024 Millage and Annual Budget for Wellington. Ms. Quickel said that there will be a full presentation at the meeting. Councilman Drahos asked if there had been any changes since the last presentation. Ms. Quickel answered a question from Councilman Drahos. Mayor Gerwig commented about this being part of the budget process. Ms. Quickel responded to Mayor Gerwig's comment. Mayor Gerwig asked why does the Village hold two meetings in September. Ms. Quickel answered a question from Mayor Gerwig. 4. WORKSHOP None. 5. ATTORNEY'S COMMENTS None. 6. MANAGER COMMENTS None. 7. COUNCIL COMMENTS Mayor Gerwig said that she meant to make an appointment at the last meeting for the Construction Board of Adjustments & Appeals. She commented that she will need someone to remind her at the meeting.
