CALL TO ORDER Vice Mayor Napoleone called the meeting to order at 4:00 p.m. Council Members in Attendance: Michael Napoleone, Vice Mayor, John McGovern, Councilman, Michael Drahos, Councilman, and Tanya Siskind, Councilwoman Council Members Absent: Anne Gerwig, Mayor. 2. PLEDGE OF ALLEGIANCE Vice Mayor Napoleone led the Pledge of Allegiance. 3. REVIEW OF COUNCIL AGENDA Mr. Barnes said that the Regular Agenda Item for the Aquatics Facility would be moved to be heard first during Agenda Review. He introduced the agenda for the March 12, 2024 Regular Council Meeting for review. A. 24-6373 PRESENTATION OF AUDIT RESULTS FOR THE FISCAL YEAR ENDED SEPTEMBER 30, 2023 Mr. Barnes introduced the item. He stated that this was the Presentation of Audit Results for the Fiscal Year ended September 30, 2023. He said that the auditors and staff would be present to discuss the results. B. 24-6408 MINUTES OF THE REGULAR WELLINGTON COUNCIL MEETINGS OF JANUARY 23, 2024, JANUARY 24, 2024, JANUARY 25, 2024, FEBRUARY 7, 2024, FEBRUARY 13, 2024 AND MARCH 5, 2024 Mr. Barnes introduced the item. He stated that this was the Council approval of the Minutes of the Regular Wellington Council Meetings of January 23, 2024, January 24, 2024, January 25, 2024, February 7, 2024, February 13, 2024 and March 5, 2024. He asked Council to provide comments, if any, to the Clerk's Office. C. 23-6169 AUTHORIZATION TO: 1) AWARD A TASK ORDER TO PROVIDE HYDROGEOLOGIC CONSULTING SERVICES FOR PHASE V OF THE WELLFIELD REHABILITATION PROJECT; 2) RENEW AN EXISTING CONTRACT FOR WELLFIELD REHABILITATION AND MAINTENANCE; AND 3) APPROVAL OF RESOLUTION NO. R2024-13 AMENDING THE UTILITY FUND BUDGET FOR FISCAL YEAR 2023-2024 BY REASSIGNING CAPITAL PROJECT BUDGETS TO THE WELLFIELD REHABILITATION PHASE V PROJECT Mr. Barnes introduced the item. Ms. Panse explained the item. She noted the increase in price. Vice Mayor Napoleone asked how old are the wells. Ms. Panse answered a question from Vice Mayor Napoleone. D. 23-6180 AUTHORIZATION TO CONTINUE UTILIZING A CITY OF BAYTOWN, TEXAS CONTRACT, AS A BASIS FOR PRICING, FOR UTILITY BILL PRINTING AND MAILING SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Continue Utilizing A City of Baytown, Texas Contract, As a Basis for Pricing, For Utility Bill Printing and Mailing Services. Mr. De La Vega explained the item. Vice Mayor Napoleone asked if the number of people receiving mail is decreasing. Mr. De La Vega answered a question from Vice Mayor Napoleone. Mr. De La Vega answered a question from Vice Mayor Napoleone. E. 23-6190 AUTHORIZATION TO AWARD MULTIPLE CONTRACTS FOR UTILITY INSTRUMENT CALIBRATION SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Award Multiple Contracts for Utility Instrument Calibration Services. Ms. Panse explained the item. She said that P.C. Controls, Inc. is the current vendor and Trinova is a new vendor with lower pricing. Vice Mayor Napoleone asked if the Village knows of anyone else that uses Trinova. He asked if the Village is happy with them. Ms. Panse answered questions from Vice Mayor Napoleone. F. 24-6379 AUTHORIZATION TO 1) AWARD A SOLE SOURCE CONTRACT TO BADGER METER, INC. FOR THE PURCHASE OF METERS AND COMPONENTS AND 2) AWARD A SOLE SOURCE CONTRACT TO BADGER METER, INC. FOR THE LARGE METER EQUIPMENT REPLACEMENT PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to 1) Award a Sole Source Contract to Badger Meter, Inc. for the Purchase of Meters and Components and 2) Award a Sole Source Contract to Badger Meter, Inc. for the Large Meter Equipment Replacement Project. R2024-07 ADOPTING THE VILLAGE OF WELLINGTON’S UTILITY WATER FACILITY PLAN FOR THE IMPLEMENTATION OF THE ADVANCED METERING INFORMATION SYSTEM PROJECT AS RELATED TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP) STATE REVOLVING FUND (SRF). A RESOLUTION OF THE VILLAGE COUNCIL OF THE VILLAGE OF WELLINGTON, FLORIDA, RELATING TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION (FDEP) STATE REVOLVING FUND (SRF), ADOPTION OF THE WATER FACILITY PLAN FOR THE IMPLEMENTATION OF THE ADVANCED METERING INFORMATION SYSTEM PROJECT, EFFECTIVE THIS DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2024-07 Adopting the Village of Wellington's Utility Water Facility Plan for the Implementation of the Advanced Metering Information System Project as Related to the Florida Department of Environmental Protection (FDEP) State Revolving Fund (SRF). She mentioned the application is being submitted for funding in the amount of $10,630,960. Councilman McGovern asked what does that mean when the application is submitted. H. 24-6322 AUTHORIZATION TO EXECUTE A GUARANTEED MAXIMUM PRICE (GMP) AMENDMENT FOR PUBLIC WORKS FACILITY STORAGE BUILDING AND SITE IMPROVEMENTS Mr. Barnes introduced the item. He stated that this was the Authorization to Execute a Guaranteed Maximum Price (GMP) Amendment for Public Works Facility Storage Building Site Improvements. Mr. Reinsvold explained the item. Councilman McGovern commented on the space. Vice Mayor Napoleone asked if the space is being used for anything right now. Mr. Reinsvold answered a question from Vice Mayor Napoleone. Mr. Barnes said that the facility would meet all of the requirements. Councilman McGovern inquired about the requirements. Mr. Barnes and Mr. Reinsvold responded to Councilman McGovern's inquiry. Councilman McGovern asked why do we need this. Mr. Barnes answered a question from Councilman McGovern. Vice Mayor Napoleone asked about the paper records. Vice Mayor Napoleone asked if this is a need for right now or next year. Mr. Barnes answered a question from Vice Mayor Napoleone. There was further discussion regarding the storage. Councilman Drahos commented on the property. Mr. Barnes responded to Councilman Drahos' comment. There were comments and discussion regarding the property. Councilwoman Siskind asked the timeframe of the construction. Mr. Reinsvold answered a question from Councilwoman Siskind. I. 24-6324 AUTHORIZATION TO AWARD A CONTRACT FOR THE GREENBRIAR PARK OFFSITE FORCE MAIN EXTENSION PROJECT Mr. Barnes introduced the item. He stated that this was the Authorization to Award a Contract for the GreenBriar Park Offsite Force Main Extension Project. Mr. Reinsvold explained the item. He noted that the project was sent out for bid. He said that three bids were received. Councilman McGovern commented that the Village has experience with Foster Marine. Mr. De La Vega responded to Councilman McGovern's comment. Mr. Reinsvold noted the project would begin in May 2024 and be completed in September 2024. He discussed the park plans. Vice Mayor Napoleone asked if the existing restroom is on septic. Mr. Reinvold answered a question from Vice Mayor Napoleone. He continued to present the proposed plans for Greenbriar Park. Mr. De La Vega said that the pickleball contract would be brought before Council in April; the cost for six courts would be approximately between $350,000 to $400,000 for the six courts. Councilman McGovern asked if this is for outside pickleball courts. Mr. Barnes provided a brief overview of the entire site. Vice Mayor Napoleone asked if there are grants available to get rid of the septic. Ms. Quickel answered a question from Vice Mayor Napoleone. Councilman McGovern asked what is the status of South Shore Park. Mr. Barnes answered a question from Councilman McGovern. There were comments and discussion regarding South Shore Park, private sector commitment and the Resolution. Mr. Barnes said that an update would be provided to Council tomorrow evening. J. 24-6371 AUTHORIZATION TO RENEW EXISTING CONTRACT FOR ROADWAY STRIPING AND PAVEMENT MARKING SERVICES Mr. Barnes introduced the item. He stated that this was the Authorization to Renew Existing Contract for Roadway Striping and Pavement Marking Services. Mr. De La Vega explained the item. He noted that this is the second and final renewal. He mentioned the 4% price increase. K. 24-6344 AUTHORIZATION TO UTILIZE A SOURCEWELL CONTRACT AS A BASIS FOR PRICING FOR THE PURCHASE OF MICROSOFT SOFTWARE, LICENSES AND MAINTENANCE Mr. Barnes introduced the item. He stated that this was the Authorization to Utilize A Sourcewell Contract as a Basis for Pricing for the Purchase of Microsoft Software, Licenses and Maintenance. Mr. De La Vega explained the item. Village of Wellington Page 6 Village Council Workshop Action Summary - Final March 11, 2024 Mr. Silliman further explained the item. He discussed the increase of cost, licensing and upgrades. He noted the overall cost savings of $60,000 over the next three years. Mr. De La Vega said that the increase went from $127,000 to $176,000 annually; however the $127,000 cost was locked in for 3-years and the new cost $176,000 is locked in for an additional 3 years. Mr. Silliman mentioned that Microsoft had increased about 10%-15% each year on their annual cost. L. 24-6375 RESOLUTION NO. R2024-12 (WELLINGTON GREEN MUPD B ABANDONMENT) A RESOLUTION OF WELLINGTON’S COUNCIL ABANDONING A PORTION OF THE 12-FOOT WIDE WATER AND SEWER EASEMENT, TOTALING APPROXIMATELY 1,943 SQUARE FEET, LOCATED WITHIN WELLINGTON GREEN MUPD B, MORE SPECIFICALLY DESCRIBED HEREIN; AND PROVIDING AN EFFECTIVE DATE. Mr. Barnes introduced the item. He stated that this was Resolution No. R2024-12 (Wellington Green MUPD B Abandonment). Mr. Stillings explained the item. M. 24-6380 STATE HOUSING INITIATIVES PARTNERSHIP (SHIP) PROGRAM: 13469 FOUNTAIN VIEW BOULEVARD Mr. Barnes introduced the item. He stated that this was the State Housing Initiatives Partnership (SHIP) Program: 13469 Fountain View Boulevard. Mr. Stillings explained the item. He stated that this was the Approval of Agreement Amending Quitclaim Deed Use Restrictions for Section 24. Mr. Stillings explained the item. He mentioned the Master Marketing Agreement with Arcadia to install cell towers. Ms. Cohen said that the language had been negotiated with the South Florida Water Management District attorney to allow the installation of the cell tower. Vice Mayor Napoleone asked what providers would go on the towers. Mr. Stillings answered a question from Vice Mayor Napoleone. Vice Mayor Napoleone asked if this is eliminating the restriction. Mr. Stillings answered a question from Vice Mayor Napoleone. Councilman McGovern commented on the cell tower sites. Vice Mayor Napoleone asked if eight sites are coming from Arcadia. R2024-15 (STATEWIDE MUTUAL AID AGREEMENT) A RESOLUTION OF WELLINGTON, FLORIDA’S COUNCIL AUTHORIZING THE MAYOR AND VILLAGE CLERK TO EXECUTE A STATEWIDE MUTUAL AID AGREEMENT BETWEEN THE STATE OF FLORIDA DIVISION OF EMERGENCY MANAGEMENT AND THE VILLAGE OF WELLINGTON FOR CATASTROPHIC DISASTER RESPONSE AND RECOVERY; UPDATING THE PREVIOUS AGREEMENT DATED MAY 22, 2018; AND PROVIDING AN EFFECTIVE DATE. She noted that the agreement is updated every five years; the last agreement was updated in 2018. Ms. Cohen explained the item. She noted that this was the Second Reading. R. 24-6323 AUTHORIZATION TO 1) EXECUTE A GUARANTEED MAXIMUM PRICE (GMP) AMENDMENT WITH WHARTON-SMITH, INC. FOR CONSTRUCTION OF THE AQUATICS FACILITY; 2) AMEND AN EXISTING AGREEMENT WITH OHLSON LAVOIE CORPORATION, TO PROVIDE CONSTRUCTION PHASE SERVICES FOR THE AQUATICS FACILITY; AND 3) AWARD A SOLE SOURCE CONTRACT TO WJN, LLC., FOR THE PURCHASE AND INSTALLATION OF A NINJA CROSS SYSTEM AND 4) APPROVE RESOLUTION NO. R2024-14 AMENDING THE GENERAL FUND AND SALES SURTAX CAPITAL FUNDS FOR FISCAL YEAR 2023-2024 BY ASSIGNING FUND BALANCES AND RESERVES, AND REASSIGNING CAPITAL PROJECT BUDGETS TO THE AQUATICS CENTER CONSTRUCTION PROJECT. Mr. Barnes introduced the item. He stated that this was the Authorization to 1) Execute A Guaranteed Maximum Price (GMP) Amendment with Wharton-Smith, Inc. For Construction of the Aquatics Facility; 2) Amend an Existing Agreement with Ohlson Lavoie Corporation to Provide Construction Phase Services for The Aquatics Facility; and 3) Award a Sole Source Contract to WJN, LLC., For the Purchase and Installation of A Ninja Cross System; and 4) Approve Resolution No. R2024-14 Amending the General Fund and Sales Surtax Capital Funds for Fiscal Year 2023-2024 By Assigning Fund Balances and Reserves, and Reassigning Capital Project Budgets to the Aquatics Center Construction Project. Mr. De La Vega explained the item. He said, if approved, the Ninja Cross System would be the first in the State of Florida with a 3-year exclusive in Palm Beach County. He said that Sam Elsheikh, Senior Principal, OLC, LLC., would show a quick video. Mr. Elsheikh showed a video rendering of the Aquatics Facility. He mentioned the feedback from everyone and noted the changes based on the feedback. He presented a PowerPoint Presentation on the Wellington Aquatics Facility. Vice Mayor Napoleone asked Mr. Elsheikh to highlight anything that was changed from the last presentation. Mr. Elsheikh answered a question from Vice Mayor Napoleone. Mr. De La Vega noted the addition of some kitchen equipment that was not included as part of the original design. Councilman Drahos asked what was added. Mr. De La Vega answered a question from Councilman Drahos. He said that it is about $81,000 worth of equipment. There were comments regarding the concession area. Mr. Elsheikh continued presenting the Building Design. Councilman Drahos asked about the utilization of the kitchen. Mr. Juckett answered a question from Councilman Drahos. Mr. Elsheikh discussed the multipurpose room. Councilman Drahos commented regarding making the multipurpose room as versatile as possible. Councilwoman Siskind asked Councilman Drahos if he wanted the multipurpose room connected to the concessions. There were comments and discussion regarding the multipurpose room and concessions. Mr. Elsheikh continued presenting the Building Design. Councilman Drahos asked about the storage square footage. Mr. Elsheikh and Mr. Juckett responded to Councilman Drahos' inquiry. Mr. De La Vega commented on the storage use. Mr. Elsheikh noted the changes made to the facility entry. Vice Mayor Napoleone asked if there is a reason why the pool is 25-yards wide instead of 25-meters wide. Mr. Elsheikh answered a question from Vice Mayor Napoleone. Councilwoman Siskind asked if the meter and 3-meter diving for competition is what the high school students need. Mr. Juckett answered a question from Councilwoman Siskind. Councilman McGovern asked if anything else is needed other than the meter and 3-meter diving. Mr. Elsheikh and Mr. Juckett answered a question from Councilman McGovern. Councilman Drahos asked if there is anything about the design that would limit the ability to host a high school event. Mr. Juckett and Mr. Barnes answered a question from Councilman Drahos. There were comments regarding this being an attractive destination for college teams. Mr. Elsheik discussed the Multi Purpose Recreational Pool. Councilman Drahos commented on the Ninja Cross cost of $1 million and the Village getting its money worth. He asked where did the idea for a Ninja Cross verses the water slide come from. Mr. Juckett answered questions from Councilman Drahos. Vice Mayor Napoleone noted the talks about Ninja Cross. He asked how did staff get to the point to do it now verses putting in the infrastructure for it if Village wanted to add it later. Mr. Barnes answered a question from Vice Mayor Napoleone. He asked what does the Village get in exchange. Mr. Barnes and Mr. De La Vega answered questions from Councilman Drahos. Vice Mayor Napoleone asked how much equipment comes with the Ninja Cross. Mr. Juckett answered a question from Vice Mayor Napoleone. Mr. Barnes commented on Councilman McGovern's question regarding the price; what the Village wants to look at and reserve the opportunity to come back to and add a slide. Vice Mayor Napoleone asked where would a slide be added. Councilman McGovern answered a question from Vice Mayor Napoleone. There were comments and discussions regarding slides, current programming and cost. Mr. Elsheikh said that the bigger play structure could be added by adding $350K to the budget. Councilman Drahos commented on the cost. Councilman McGovern and Mr. Barnes responded to Councilman Drahos' comment. Mr. Elsheikh mentioned that there are bigger systems but it would be more expensive. There were comments regarding catering to ages along the way to the Ninja Cross and kitchen equipment. Councilman Drahos asked if announcements could be made from the administrative office to the pool. Councilman Drahos inquired if music is played at the pool. Mr. Barnes and Mr. Elsheikh responded to Councilman Drahos' inquiry. Mr. Elsheikh discussed and presented the Other Amenities. Councilman Drahos asked about the turf grass. Mr. Elsheikh answered a question from Councilman Drahos. He showed the 3D-View and discussed the Schedule. He mentioned the Summer 2024 start date and the Fall 2025 completion date. Councilman McGovern asked about the actual construction start date. Mr. Fulks said that we are aiming for June; with an open day on Labor Day. He said that it would be about 15-months. Councilman Drahos asked about the June start date. Mr. Fulks answered a question from Councilman Drahos. There were comments and questions regarding the opening date and permitting. Councilman McGovern asked about the next phase. Mr. Elsheikh answered a question from Councilman McGovern. Councilman McGovern said that he would like the exclusivity to be five years. Councilman McGovern asked who was presiding over the case. Ms. Cohen answered a question from Councilman McGovern. There were comments and questions by Council regarding the docket and the 130 Violations case. 6. MANAGER COMMENTS Mr. Barnes said that the Celebration of Service for the departing Council members would take place tomorrow in the Village Hall Lobby at 6:00 p.m. prior to the start of the Regular Council meeting .
