PUBLIC HEARINGS 1. O-2003-0062 Ordinance amending Section 12.37(1)(b) of the Revised Municipal Code relative to changing the bulk requirements for multi-family residential properties in the RC-1 Residence District. Explanation of the proposed ordinance by John Stibal, Director of Development. Appearances: None. 2. O-2003-0063 An ordinance to amend the official West Allis Zoning Map by rezoning certain lands located at 33** S. 113 St. from RA-1 Residence District to RC-1 Residence District (Tax Key No. 523-9960-004). Mayor Bell announced this hearing is rescheduled for an October meeting date. 3. 2003-0506 Special use application submitted by the Nextel West Corporation d/b/a Nextel Communications to attach/collocate 3 sets of wireless telecommunication antennas and an equipment shelter at the City water tower site located at 11515 W. Rogers St. Explanation of the proposed special use by John Stibal, Director of Development. Appearances: None. 4. 2003-0524 Special Use Application submitted by Keller Structures on behalf of Richard Fabinski, d/b/a Southtown Amoco, to demolish the existing gas station and contruct a new gas station, convenience store and car wash at 10731 W. Appearances: City of West Allis Page 1 Printed on 12/21/2018 Common Council Meeting Minutes September 2, 2003 The Clerk's Office received a letter from seven neighbors concerned about the noise level of the car wash and the hours of operations. Stephen Chernof, 780 N. Water St., Milwaukee, Attorney representing owner of building described as Martha's Vineyard, said this area needs a traffic study. Mr. Chernof was concerned about car wash traffic, traffic congestion, safety and noise. He indicated two of the five criteria have been met for a special use. He requests delay in judgment until completion of traffic study. He further commented on the aesthetics of the buildings. 5. 2003-0200 Special Use Application submitted by Stan McIntyre of the Southside Baptist Church to establish a Christian School within the existing building located at 1501 S. 73 St. Explanation of the proposed special use by John Stibal, Director of Development. Appearances: The Clerk's Office received a letter from two neighbors concerned about the noise and safety of the children playing in the alley. Mike Dean, 20975 Swenson Dr., Suite 125, Waukesha, Attorney for Southside Baptist Church spoke. Pastor McIntyre being present. He began with stating the reservation of constitutional issues and issues arising under the Religious Land Use and Institutionalized Persons Act, and indicated they will make every effort to comply with the special use process and zoning code. Mr. Dean said the church has leased facilities in Milwaukee for schooling until code requirements are met. In good faith, the church has used the property for a school during the last year. He also mentioned program adjustments. He said no complaints were known, except children at recess. He further stated the architect has submitted renovation plans and plans to meet code compliance. Pastor Stan McIntyre, 1501 S. 73 St., indicated there is a small yard and building, and realized concerns of the alley being used for activities. They have staggered groups for recess, and he believes the yard is adequate. Sharon Wirth, 1509 S. 73 St., stated that the courtyard is right next door. She said during recess the house has been hit with balls. She further indicated that the house has recently been re-sided and does not want children in the yard. Attorney Mike Dean, 20975 Swenson Dr., Suite 125, Waukesha, is open to options for blocking off portion of the street or alley. E. CITIZEN PARTICIPATION Appearances: Robert Braun, 2160 S. 86 St., appeared on behalf of Christian Civil Liberties Union and Save Our Children from Sexual Perverts. Mr. Braun indicated that approximately a four (4) block area was notified of Family Video possibly moving in at S. 76 St. and W. National Ave. A portion of the store will be reserved for adult videos. Mr. Braun does not want to stop the business from opening, but he does not want the business to sell x-rated videos. The business location is close to the West Allis Public Library and Lincoln School. He requests additional notification to the public and additional meetings. Sister Mary Ellen Paulson, 2367 S. 84 St., President of the West Allis Public Library Trustees, stated the importance of hiring a new Library Director and requested an exception to the City of West Allis Page 2 Printed on 12/21/2018 Common Council Meeting Minutes September 2, 2003 hiring freeze based on their justification of the immediate need. Laurie Queen-Graebert, 1561 S. 83 St., commented on a petition submitted by neighbors of S. 83 St. in which twelve (12) families signed. She indicated there is a nuisance tenant on the street. She remarked that vandalism and beatings have occurred. She has contacted the police. She further inquired about a nuisance tenant law. Mike Ciganek, 1533 S. 83 St., stated the people moved in approximately one-and-a-half (1½) years ago. He indicated the vandalism to property, and has videotaped the crime. He questioned the issuance of citations. Mike Flood, 1574 S. 83 St., said the nuisance problem is getting worse. He mentioned that at one time, there might be fifteen (15) to twenty (20) people in the street, and every night there are people outside. He questioned the issuance of citations. He stated that mediation is not working, nothing has been solved, and the harassment continues leaving the residents to stay indoors. He said that their activity has to stop. Mike Clark, 1518 S. 83 St., indicated that he has been personally threatened. He stated that there is no respect being shown and that there is garbage around the area. Carl Knight, 2867 S. 96 St., explained his picketing of Super Video for over a three (3) year period. He described the customers that are attracted by adult video stores. James Mejchar, 7149 W. Greenfield Ave., representing the State Fair Park and the Board of Directors for the State Fair Park, thanked the City of West Allis and its leaders for putting up with the recent noise and traffic. He personally took and responded to various complaints. He indicated that a future recommendation will be made to not have helicopter rides for next year's fair. Even though the recent noise has been high, the area gained an international reputation for its hospitality and friendliness. Mr. Mejchar commented on the economic benefit received. Joel Paplham, 1215 S. 76 St., stated that President Bush and Governor Doyle have or will be announcing September 19th as POW/MIA Recognition Day. He described his progress for the raising of the POW/MIA flag. He thanked Ald. Reinke for her leadership and efforts in regards to the Freedom Celebration Breakfast. Michael Murphy, 349 Joris Ave., Waukesha, described his concern over the Family Video Store. He is concerned that a product consumed at home may cause problems in the home. He requested that people be notified of the potential new business, and asked that the portion of the store that sells the adult videos be denied. Bob Donegan, 2001 S. 97 St., commented on the accomplishments of fourteen (14) year old Chellsie Memmel who brought international publicity to the City of West Allis for her gymnastic accomplishments. Chellsie won two (2) gold medals in the World Gymnastics Championships which has never been done before by a gymnast in West Allis or the State of Wisconsin, and her outstanding achievement should be recognized. Richard Siebenaller, 8719 W. Orchard St., expressed his concern over cuts in services. He went over a number of questions relating to the idea of consolidating and reducing the number of polling places as a cost savings measure which included concerns regarding transportation, parking, apathy, processing of absentee ballots, favoring of political parties, and contact with other county, state and federal officials. G. MISCELLANEOUS BUSINESS Ald. Kopplin announced that a meeting is scheduled for September 16, 2003, at 6:00 p.m., in Room 128 at City Hall, regarding Family Video. He said it would be cost prohibitive to notify everyone of the meeting. Ald. Weigel and Kopplin took the initiative to notify people. The representative from Family Video will be present at the meeting. Ald. Weigel stated that a notice would be published in the Milwaukee Journal Sentinel. Ald. Sengstock referenced Bob Donegan's comments regarding Chellsie Memmel's accomplishments, and that her parents, Andy and Jeanell, and the City of West Allis are very proud of her. Ald. Sengstock announced Mayor Bell's Proclamation for Chellsie. He further encouraged Andy and Jeanell to bring Chellsie to a future Council meeting for proper recognition of her accomplishments as a young gymnast. Agenda Approval that the agenda as submitted be accepted A motion was made by Ald. Sengstock, seconded by Ald. Reinke, that the agenda as submitted be accepted. The motion carried. Kopplin, to approve the minutes of the regular meeting of August 5, 2003. The motion carried. H. ITEMS NOT REFERRED TO COMMITTEE 6. 2003-0528 Report of the Municipal Judge for the month of July, 2003, consisting of all fines, costs and fees collected by the City of West Allis in the sum of $86,479.05, all fines, costs and fees in the sum of $85,999.45 collected in the Municipal Court, $479.60 collected by the City Clerk/Treasurer's office thru credit card, and $81,285.00 in payment of parking violations sent directly to the City Clerk/Treasurer's office.
