SEPARATION FROM AGENDA 27. 2021-0758 Signed Findings & Recommendations, Summons and Complaint in the matter of complaint against E. Bomback and L. Bald, Partners, d/b/a The Spot, 6424 W. Greenfield Ave. Agent: Edward Bomback. Mayor Devine stated if there are no objections, he would like to take agenda item #27 out of order and discuss it now. Attorney Decker stated the licensee filed a conditional surrender with a surrender date of November 28, and upon acquisition by the City's Community Development Authority. Because of that he asked the Common Council to table this matter until then. If any significant incidents occur prior to November 28, the Common Council could revoke the license sooner. The Council is not obligated to accept his recommendation but there has been much work done behind the scenes to get to this point to avoid going to court. Ald. Lajsic moved to table the license revocation for The Spot contingent to voluntarily surrendering the Liquor License on November 28, 2021, Ald. Stefanski seconded, motion carried. Finance Director/Comptroller Jason Kazmarek and Administrator/Clerk Rebecca Grill presented the 2022 City Budget. R-2021-0718 Resolution to approve amending certain activities of the FY2019 annual plan of the Community Development Block Grant (CDBG) program relative to the reallocation of CDBG-CV (COVID) funding in the amount of $131,285. Sponsors: Administration and Finance Committee Steve Schaer, Planning and Zoning Manager, presented the changes being made to the CDBG program. E. ANNOUNCEMENT OF RECESS MEETINGS OF STANDING COMMITTEES G. MAYOR'S REPORT Saturday November 20 WACIF hosting a Food Drive at the Farmer's Market. Asking to donate non-perishable food items, more information on website and social media, 1130am to 230pm. Market, food trucks will be there. First 100 people to donate 5 items or more will be entered into a drawing for new city logo wear. H. ALDERPERSON'S REPORT Grisham grateful for the community that came out and shone a great light on our Trick-or-Treat. She saw families and a sense of normalcy that we haven't seen in a while. A special thank you to Mariah Nord for working with her and Ald. Kuehn on the Halloween house decorating contest. The top three winners received gift cards to Half Nuts. R-2021-0673 Resolution accepting work of MJ Construction, Inc. for the private lead water service line replacements, sump pump installations, storm lateral installations and sanitary sewer lateral rehabilitations at various locations throughout the City of West Allis and authorizing and directing settlement of said contract in accordance with contract terms of 2019 Project No. 12 for final payment in the amount of $5,000. Sponsors: Public Works Committee Adopted. 5. R-2021-0674 Resolution accepting work of Azarian Wrecking, LLC for the building repair at the former Crawdaddy’s Restaurant located at 6414 W. R-2021-0675 Resolution accepting work of Mid City Corporation for replacement of private lead service lines (LSL) at locations where the City of West Allis has previously replaced the utility-owned portion of the service line and authorizing final payment in the amount of $500 for 2018 Project No. 7. Sponsors: Public Works Committee Adopted. 7. R-2021-0676 Resolution accepting work of LaLonde Contractors, Inc. for street construction in S. 80th St. from W. Greenfield Ave. to W. Approved. L. COMMON COUNCIL RECESS Ald. Lajsic moved that the Council recess until completion of the Standing Committee meetings, Ald. Reinke seconded, motion carried. Council Action: Approved recommendation. 20. 2021-1220 2021-2023 Renewal Operator’s License (Bartender/Sales Clerk) application for Luke Kolancheck. Committee Action: Ald. Stefanski moved to approve, Ald. Reinke seconded, motion carried. Council Action: Approved. 21. 2021-0625 New Class B Tavern License Application for DHV Enterprises, LLC, d/b/a The G Spot, 7534 W. Beloit Road. Agent: Glenn Schrubbe. Committee Action: Ald. Stefanski moved deny for the reasons which included the neighborhood residents objecting to the issuance of an alcohol license to that property and that the location is not suitable for a bar, Ald. Roadt seconded, motion carried with one nay by Ald. Grisham. Council Action: Approved recommendation by roll call vote. Committee Discussion: Attorney Decker and Administrator/clerk Grill discussed the license issuing process and agreed upon a process. The License & Health Committee would approve the application and send it to Council. Council will then hold the item until all other permits and inspections are completed. Ald.
