CALL TO ORDER The meeting was called to order by Chair Czaplewski at 6:00 p.m. B. ROLL CALL Present 4- Ald. Czaplewski, Ald. Roadt, Ald. Barczak, and Ald. Haass Excused 1- Ald. APPROVAL OF MINUTES 1. 2016-0179 Minutes (draft) of the License & Health meeting of February 23, 2016, recess meeting of February 16, 2016, and March 1, 2016. The motion carried unanimously. D. NEW AND PREVIOUS MATTERS 2. 2016-0137 2015-2016 Operator’s License (bartender/sales clerk) application no. 16-386 of Christina F. Nowak. Appearance by Christina F. Nowak. Discussion ensued regarding Ms. Nowak's police report. The Committee cautioned Ms. Nowak that receiving a third OWI could result in revocation of her bartender's license. A motion was made by Ald. Barczak, seconded by Ald. Czaplewski, that this matter was Recommended For Approval. The motion carried by the following vote: Aye: 4- Ald. Czaplewski, Ald. Roadt, Ald. Timber, Agent, of Lo N Slo, LLC, d/b/a Lo N Slo LLC, premises located at 7420 W. Greenfield Avenue). Appearance by Mark S. Timber. Discussion ensued regarding the alcohol compliance check report. The Committee reminded Mr. Timber to advise his staff to check for identification. A motion was made by Ald. Barczak, seconded by Ald. Roadt, that this matter was Recommended to be Placed on File. The motion carried by the following vote: Aye: 4- Ald. Czaplewski, Ald. Roadt, Ald. Barczak, and Ald. Haass No: 0 E. MATTERS FOR DISCUSSION/ACTION 4. 2016-0181 Discussion regarding 2015-2016 Class B Tavern Licenses not yet issued. Nonappearance of Ronald L. Mellantine and Clement R. Vaia. They both contacted the Clerk's Office. The Committee requested they be ordered to appear at the next scheduled License & Health meeting Appearance by Charles Hastings. Discussion ensued regarding the work that has been done and still needs to be done before Mr. Hastings opens the establishment by June 1, 2016. The committee directed Mr. Hastings to contact the Clerk's Office if they are not going to be open by June 1, 2016. This matter was Held. 5. 2016-0182 Discussion regarding going over municipal quota for a Combination Class A Liquor License. Appearance by John Stibal, Director of Development and Patrick Schloss, Manager of Community Development. Discussion ensued relative to a request for an existing specialty foods establishment to open a second location with a Class A Combination Liquor License and the development of the property. A motion was made that this matter be Discussed. The motion carried unanimously. Appearance by John Stibal, Director of Development and Patrick Schloss, Manager of Community Development. Discussion ensued regarding the Development Department requesting to be able to offer new businesses a liquor license for economic growth and development opportunities. The Committee directed the Department of Development to bring new proposals to the Committee's attention. A motion was made that this matter be Discussed. The motion carried unanimously. F. CLOSED SESSION 7. 2016-0156 Summons and Complaint in the matter of the complaint against J.K. Lau Investments, LLC, Jeffrey K. Lau, Agent, for the premises located at 5632 W. Burnham St., d/b/a 57 Bar (2015-2016 Class B Tavern License no. 2071, and Food Related Permit). (Dated: 3-14-16). Attachments: Summons 57 Bar 3-22-16 Complaint 57 Bar 3-22-16 Nonappearance of Jeffrey K. Lau. Attorney Merten informed the Committee that the Summons and Complaint was not served. The Committee requested Mr. Lau be summoned to appear at the next scheduled License & Health meeting. This matter was Held. 8. 2016-0011 Communication from Assistant City Attorney regarding failure to follow the terms of the payment agreement for delinquent 2014 personal property taxes signed on February 24, 2015, for 5632 W. Burnham St., 57 Bar, Jeffrey K. Lau, Agent, dated December 14, 2015. Attachments: Atty. comm. re:delq ppt See legislative file no. 2016-0156. This matter was Held 9. 2015-0622 Communication from Assistant City Attorney regarding failure to follow the terms of the payment agreement for delinquent 2014 personal property taxes signed on February 24, 2015, for 5632 W. Burnham St., 57 Bar, Jeffrey K. Lau, Agent, dated August 14, 2015. Attachments: Atty. comm. 57 Bar nonpayment of PPTs See legislative file no. 2016-0156. Greenfield Ave., d/b/a Vani’s Kitchen (2015-2016 Class B Beer License renewal application no. 1984, Class C Wine License renewal application no. 1985, and Restaurant Permit). Attachments: Summons Vani's Kitchen 3-22-16 Complaint Vani's Kitchen 3-22-16 Nonappearance of Vigneshwar Bhadharla. Mr. Bhadharla did not contact the Clerk's Office. The Committee directed the City Attorney's Office to prepare Findings of Fact for revocation of the licenses. A motion was made by Ald. Barczak, seconded by Ald. Roadt, that this matter was Recommended To Issue a Findings and Recommendation. The motion carried by the following vote: Aye: 4- Ald. Czaplewski, Ald. Roadt, Ald. Barczak, and Ald. Haass No: 0 G. CLOSED SESSION PLEASE TAKE NOTICE That the License & Health Committee of the City of West Allis will meet in open session Tuesday, March 22, 2016, at approximately 6:00 P.M., or as soon thereafter as time permits, in Room 128 of West Allis City Hall, 7525 W. Greenfield Ave., West Allis, Wisconsin, to vote on a motion to convene in closed session at said time in Room 113 to deliberate and confer with the City Attorney on the Summons and Complaints regarding the following matters: 1. J.K. Lau Investments, LLC, Jeffrey K. Lau, Agent, (2015-2016 Class B Tavern License no. 2071, and Food Related Permit, d/b/a 57 Bar, for the premises located at 5632 W. Burnham St.). 2. Vani's Kitchen, Inc., Vigneshwar Bhadharla, Agent, (2015-2016 Class B Beer License renewal application no. 1984, Class C Wine License renewal application no. 1985, and Restaurant Permit, d/b/a Vani's Kitchen, for the premises located at 10535 W. Greenfield Ave.) A closed session for the above purpose is authorized pursuant to the provisions of Wis. Stats. Section 19.85(1)(a) and (g), which authorizes a governmental body, upon motion duly made and carried, to meet in closed session to deliberate concerning a case which was the subject of any judicial or quasi-judicial trial or hearing before that governmental body; and to confer with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved. Upon conclusion of the closed session, the License & Health Committee will reconvene in open session at said time in Room 128 to consider its public agenda, including motions to recommend approval or rejection of above-listed deliberations or any of the public agenda items that have not been acted upon. 7. 2016-0156 Summons and Complaint in the matter of the complaint against J.K. ADJOURNMENT City of West Allis Common Council members may attend the above License & Health Committee meeting for information gathering purposes. Should a quorum of Common Council members appear at this Committee meeting, a regular Common Council meeting may take place for the purposes of gathering information on an item listed on the Committee agenda. Should such a meeting occur, the date, time and location of the Common Council meeting will be that of the License & Health Committee as listed on the License & Health Committee agenda. All meetings of the License & Health Committee are public meetings. In order for the general public to make comments at the committee meetings, the individual(s) must be scheduled (as an appearance) with the chair of the committee or the appropriate staff contact; otherwise, the meeting of the committee is a working session for the committee itself, and discussion by those in attendance is limited to committee members, the mayor, other alderpersons, staff and others that may be a party to the matter being discussed.
