The motion carried unanimously. D. NEW AND PREVIOUS MATTERS City of West Allis Page 1 Printed on 6/15/2016 License & Health Committee Meeting Minutes May 3, 2016 74. 2016-0228 Communication from Donald Henry relative to removing himself from the partnership with Fred D. Bell, d/b/a Just for Today, Entertainment Club License for the premises at 1900 S. 60 St. Attachments: D. Henry Just For Today Letter Appearance of Donald Henry and Fred D. Bell. Discussion ensued regarding Mr. Henry's reasons for requesting himself to be removed from the application and to not be held accountable for activities associated with the premises. The question was asked if Mr. Bell could hold the license as an individual if he has a pending criminal case. Attorney Merten said she could monitor the case and watch for the decision. Mr. Bell was informed that the license expires on June 30, 2016. A motion was made by Ald. May, seconded by Ald. Roadt, that this matter was Recommended to be Placed on File. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 75. 2016-0226 Police Department Report involving Stallis Palace, 8812 W. Greenfield Ave. of Stallis Palace, LLC, Rachel L. Wesenberg, Agent, Incident Date: March 14, 2016. Appearance by Rachel and Tom Daniels. Discussion ensued regarding the incident on March 14, 2016. The Committee questioned whether the patron was overserved, and who contacted the police. Mr. Daniels stated he called the police when he observed the patron getting in their car. The Committee said they applauded Mr. Daniels actions for that evening. A motion was made by Ald. Weigel, seconded by Ald. Haass, that this matter was Recommended to be Placed on File. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 76. 2016-0227 Police Department Report involving The Drunken Duck, 5906 W. Burnham St. of DeRosia Enterprises, LLC, Dawn M. Clark, Agent, Incident Date: March 20, 2016. Appearance by Dawn M. Clark and Steve DeRosia. Discussion ensued regarding the reason for the requested appearance and how it could have been avoided. The Committee stated they felt confident the whole incident could have been avoided if Ms. Clark or one of her employees would have called the police when trouble started in the tavern instead of asking everyone to leave and having the problems escalate outside. A motion was made by Ald. Roadt, seconded by Ald. May, that this matter was Recommended to be Placed on File. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Gilbert. Appearance by Cari R. Gilbert. Discussion ensued regarding Ms. Gilbert's background report. Ms. Gilbert was reminded to call the police for any problems and to obey the laws associated with a bartender's license. A motion was made by Ald. Roadt, seconded by Ald. Haass, that this matter was Recommended For Approval. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 78. 2016-0222 2016-2017 Operator’s License (bartender/sales clerk) application no. 17-441 of Charles F. Malak. Appearance by Charles F. Malak. Discussion ensued regarding Mr. Malak's police report. A motion was made by Ald. Weigel, seconded by Ald. May, that this matter was Recommended for Denial based on the police report. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 79. 2016-0223 2015-2017 Operator’s License (bartender/sales clerk) application no. 17-442 of Christianne M. Kiepert. Appearance by Christianne M. Kiepert and Christopher Paul. Discussion ensued regarding Ms. Kiepert's police report. Mr. Paul spoke very highly of Ms. Kiepert's employment history with him and her quality of work. Mr. Paul said he was aware of Ms. Kiepert's background. A motion was made by Ald. Weigel, seconded by Ald. Haass, that this matter was Recommended for Denial based on the Police Report. The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 80. 2016-0230 2016-2017 Operator’s License (bartender/sales clerk) application no. 17-436 of Renee E. Lippitt. Nonappearance of Renee E. Lippitt. Ms. Lippitt did not contact the Clerk’s Office. The Committee requested she be ordered to appear at the next scheduled License & Health meeting. This matter was Held. Nonappearance of Christine Ann Stampfel. Ms. Stampfel did not contact the Clerk’s Office. The Committee requested she be ordered to appear at the next scheduled License & Health meeting. This matter was Held. 82. 2016-0221 2015-2016 Class B Tavern License application no. 2309 of Retro, LLC, Brian R. Teclaw, Agent, d/b/a Retro, for the premises at 6827 W. National Ave. (new-existing). Appearance of Brian R. Teclaw. Discussion ensued regarding Mr. Teclaw's experience, the type of establishment he plans to operate and the type of clientele he wants to attract. A motion was made by Ald. Weigel, seconded by Ald. Haass, that this matter was Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 83. 2016-0218 2015-2016 Combination Class A Liquor License application no. 2306 of Grays Estate, LLC, Deshawn Gray, Agent, d/b/a State Fair Liquor, for the premises at 1568 S. 81 St. (new-existing). Appearance by Deshawn Gray. Discussion ensued regarding Mr. Gray's experience with operating a liquor store. The Committee directed Mr. Gray to correct item #8 on his Plan of Operation. Mr. Gray was informed of the City's Compliance Check Program and reminded to check identification. A motion was made by Ald. Weigel, seconded by Ald. Haass, that this matter was Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. Weigel No: 0 84. 2016-0220 Application of Transfer of License from Premises to Premises of 2015-2016 Class A Beer License no. 1680 of Lucki Mini Mart, Inc., Sharif Ali Corp., Ljiljana Lucic, Agent, d/b/a Lucki Mini Mart, 1480 S. 84 St. to 1512 S. 84 St. Nonappearance of Ljiljana Lucic. Ms. Lucic contacted the Clerk's Office. Ms. Lucic sent an email stating she is transferring her Class A Beer License and surrendering it. A motion was made by Ald. Weigel, seconded by Ald. Haass, that this matter was Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Patel, Agent, d/b/a Cigarette Depot, for premises at 1512 S. 84 St. (new-nonexisting). Appearance by Dineshkumar P. Patel. Mr. Patel was reminded of the rules for having a Beer License, of the City's Compliance Check Programs for beer and cigarettes, and to check identification. A motion was made by Ald. Weigel, seconded by Ald. Roadt, that this matter was Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 86. 2016-0217 2016-2017 Class B Tavern License application no. 2307 of 88 Keys, LLC, Gregory S. Barczak, Agent, d/b/a 88 Keys Piano Martini Lounge, for the premises at 7211 W. Greenfield Ave. (new-existing). Appearance by Gregory S. Barczak. Discussion ensued regarding Mr. Barczak's remodeling of the premises and future plans for leasing it. A motion was made by Ald. Weigel, seconded by Ald. May, that this matter was Recommended for Approval subject to the necessary requirement(s). The motion carried by the following vote: Aye: 5- Ald. Czaplewski, Ald. Roadt, Ald. Haass, Ald. May, and Ald. Weigel No: 0 87. 2016-0207 2015-2016 Special Class B Beer and Wine License application no. 32 of Corvina Wine Company as a Trade Organization, for an event at West Allis Farmer’s Market, 6501 W. National Ave. on Wednesday, June 1, 2016 (first date of Music at the Market). Appearance by Frank LaSusa. Attorney Merten stated that Corvina Wine Company did not qualify for a Picnic License. The Committee told Mr. LaSusa they would like to see the Farmer's Market location used for more events. The Committee said that the City Attorney and Health Department would need to be contacted to see what could be allowed. This matter was Held. E. MATTERS FOR DISCUSSION/ACTION City of West Allis Page 5 Printed on 6/15/2016 License & Health Committee Meeting Minutes May 3, 2016 87a. 2016-0212 Discussion relative to the City designating the Farmer’s Market as a Park and to enact an Ordinance allowing City Employees to sell there. Discussion ensued regarding additional community activies and functions to be held at the West Allis Farmer's Market. It was asked whether a usage form could be created, if there could be enforcement fees, what extra expenses would be incurred and how they would be covered, the seasonal helper's hours being expanded, how alcohol could be served, how age limitations would be enforced, and whatever else would be involved. Ald. Reinke, Board of Health, and Sally Nusslock, Health Commissioner, expressed concerns. John Stibal, Director of Community Development, asked the Committee to come up with a plan so that the Farmer's Market could be utilized more. This matter was Discussed and Consensus Given. F. ADJOURNMENT A motion was made by Ald. Roadt, seconded by Ald. Weigel, to adjourn at 7:00 p.m. The motion carried unanimously.
